In corporate networks (both small and large), this is usually a behind-the-scenes process. However, if you have a home-based business or just a personal computer or laptop, you’re probably your own IT staff (unless something really bad happens and you’re forced to call a service professional). That means the responsibility for back-ing up your data rests firmly in your hands.

OK. Take a deep breath — no hyperventilation required. There are a host of solutions that can keep your data safe in the event of a major disaster (i.e., fire, flood, child with a propensity for spilling juice on the laptop, etc.).

The growth in digital photography, home video record-ing and digital music storage (e.g., iPod) means that users are filling their computer’s hard drive space faster than ever, with increasingly large files. Most of us would be exceptionally unhappy to lose those keepsakes. Here are some ideas for backing up the data on your computer:

In 1925, Charles Bucci established a small dairy operation on Bald Hill Road in Warwick, which he expanded several years later into an ice cream business in order to provide job oppor-tunities for his three sons, all of whom were disabled.

Eighty-four years after that modest venture took place, the Bucci family business – now in its fourth generation – is booming, thanks to an increased offering of products and the acquisi-tion, last year, of Creative Creamery. This subsidiary, once operating in Massachusetts, is now headquartered in Warwick and specializes in gourmet ice cream cakes like cappuccino hazel-nut, Mississippi mudd and chocolate

raspberry temptation, and “function” ice cream cakes like spumoni, mudd pie and cookies and cream.

The company also consists of a man-ufacturing division, co-packing busi-ness and a wholesale distributorship for companies like Good Humor, Uni-lever, Hood and Ben & Jerry’s. With a reported annual output of at least 600,000 ga!llons of ice cream, the com-pany is one of the most successful of its kind in the region, and estimates its production has increased by roughly 20 percent annually in recent years.

With its growth came a need for more space – and a need for more em-ployees, a rarity in today’s economy. In addition to their Bald Hill Road

facility, Warwick Ice Cream recently announced its lease of an additional 15,000 square feet of storage space in the former Leviton site. Their em-ployee roster currently stands at 28, with an eye to hire at least several more people in the near future.

The company doesn’t anticipate a slowdown in business anytime soon, and should they need a larger facil-ity in the future, our Department of Tourism, Culture and Development stands ready to assist them in their search. In the meantime, Warwick Ice Cream’s continued growth is good news for the company, the local business economy, and ice cream aficionados near and far.

Kent HeartSafe Foundation trains 300 in CPR & AEDThe Kent Heart Safe Foundation recently teamed up with Kent Hospital, the city of

Warwick, the American Heart Association and the Central Rhode Island Chamber of Commerce to offer free CPR and AED training, “Save A Heart Day.” These free cardio-pulmonary resuscitation classes (CPR) trained more than 300 individuals and were held over the course of six weeks. Instructors from the City of Warwick, the Warwick Fire De-partment and Kent Hospital taught participants CPR techniques that could save the life of a person suffering from cardiac arrest. CPR has the power to restore blood flow to an individual, keeping him or her alive until they can be transported to a hospital. Each participant received a free, take-home kit to allow practice and training of friends and family members.

For cardiologist Dr. Joseph Spinale, every day is a “save a heart” kind of day. As head of the Kent HeartSafe Foundation, he works year-round to make Warwick a “heart safe” community.

According to Dr. Spinale, there are, on average, nine cardiac arrests in Warwick each month. Sudden cardiac arrest is often misidentified as a heart attack, but a heart attack, which is caused by a blockage of blood flow to the heart, is simply one cause of sudden cardiac arrest. Other causes include stroke, electric shock, allergic reaction, asthma or a blow to the chest.

During cardiac arrest, the heart stops beating and needs a shock in order for it to start again, either through cardio-pulmonary resuscitation (CPR) or the use of an automatic external defibrillator (AED). An AED is a portable medical device that analyzes a heart’s rhythm and then delivers an electric shock, if necessary.

If the heart is shocked within one minute of stopping, the afflicted have a 90 percent chance of survival. Every minute delay decreases the chance of survival by10 percent.

The Foundation has a listing of public buildings with AEDs, but not which private establishments have them. So the Foundation created a registry for AEDs on its Web site, www.Ken-tHeartSafe.org/reg_aed.html as a way for citizens to be able to register the location of their AEDs.

“It would be a shame for some-one to collapse in the mall parking lot and no one knows that there is an AED 50 feet away, inside,” said Dr. Spinale.

Survivinga financial crisis

Over the past few months, the news has been almost incomprehensible. It’s hard for many of us to make sense of the failure of major Wall Street firms and large banks, and of the $700 billion bailout of the financial sec-tor. It’s also hard for investors to be calm when stocks have fallen more than 40 percent between October, 2007, and Inauguration Day in 2009. What can you do to cope?

Here are some tips to help you survive a financial crisis:

• Close your ears — but open your eyes. These days, you may hear some so-called “experts” talking about end-of-capitalism scenarios. Try not to listen to these doom-sayers. We still have the most powerful economy in the history of the world and we will recover from these setbacks. However, even if you close your ears, you should keep your eyes wide open. Specifically, look for opportunities. Stock prices are down now, but they won’t always be — and, all else be-ing equal, investors who buy into the stock market at lower prices are likely to earn higher returns than those who buy stocks when prices are higher.

• Focus on things you can control. During a financial crisis, your success at weathering the storm depends on your ability to stay calm and concentrate on the things you can control. For example, you can control your emotions so that you aren’t panicked into making unwise short-term decisions, such as putting all your money under your mattress. And, to a certain extent, you can even control your portfolio’s ability to withstand volatility. How? By diver-sifying your holdings as broadly as possible. The wider your range of investments, the less you’ll be hurt by downturns that primarily affect one asset class. (Keep in mind, though, that diversification, by itself, cannot guarantee profits or protect against loss.)

• Review and rebalance your portfolio. During this market decline, some of your holdings have probably fallen more than others. As a result, you may now own a lower percentage of a specific asset class than you had originally intended when you built your portfolio. Conse-quently, you may want to meet with your financial advisor to determine if you should rebal-ance your portfolio by adding more money to those asset classes that have fallen the most. You may also want to rebalance if your risk tolerance or long-term goals have changed.

• Look for quality investments. In this economic environment, it’s more important than ever to focus on quality investments. When you buy stocks, look for those companies with strong balance sheets. If you’re purchasing bonds, stick with those that receive high credit ratings. If we are entering a prolonged economic downturn, these types of investments will, in all likelihood, fare better than lower-quality stocks and bonds.

• Be patient. No one can predict when a bear market will end, but history has shown that turnarounds can happen quickly and unexpectedly. So be patient. The most successful investors have the courage to stay the course and take advantage of opportunities while oth-ers are “bailing out” of the financial markets.

We may still have some rough roads ahead of us. But if you can check off every item on this list, you can smooth out some of the bumps you’ll encounter on your journey toward achieving your long-term goals. Revisiting thejoint employer issue

Can an employer eliminate its liability under the various civil rights laws and other worker protections by hiring temporary employees or by outsourcing the hiring responsibility for a portion of the workforce to a temporary services firm?

The short answer? Not usually. However, employers sometimes misunder-stand this when entering into an arrangement with a temporary firm or when entering into an outsourcing agreement.

The joint employer issue often arises when a temporary or leased employee is utilized for short-term labor needs, such as a job assignment for a week, month or some other fixed interval. The temporary services firm pays the worker, maintains employment records, provides workers compensation insurance and some ben-efits, and performs payroll-withholding functions.

The general rule is that in order for a joint employer relationship to exist, each “employer” must exercise control over the working conditions of the employee in question. If the contract employer exercises too much control over the tem-porary employee, the contract employer may be deemed a “joint” employer of the individual and equally subject to employment laws. The Equal Employment Opportunity Commission (EEOC) often considers the contract employer to be a joint employer for determining liability for unlawful discrimination. Temporary workers have sometimes been found eligible for participation in 401(k) plans, employer-sponsored insurance plans and other forms of non-cash compensation when the lines between regular and temporary workers become blurred.

Does it matter that the worker is placed by the temporary agency? Generally, no. In reality, it is the company utilizing the temporary services that assigns the work, supervises the worker’s day-to-day activities, issues the appropriate work rules and instructions, and makes the routine work assignments made by all employers.

We would recommend that members review all temporary employment relationships to determine whether a joint employer relationship may exist. If it appears that such a relationship may exist, members must be comfortable with the business practices of the temporary firms with which they contract. If not, or if the temporary firm is unwilling to provide credible answers to your questions, insist upon open dialogue and clear understanding as a condition of continued busi-ness.

FISCAL YEAR 2010 STATE BUDGET PROPOSED

The governor has released the following proposed FY 2010 budget for the state of Rhode Island.

Fiscal Year (FY) 2010 Budget: total state spending$3.079 billion

***Revised FY 2009 Supplemental Budget: Total state spending$3.064 billion

***The revised number for FY 2009 was submitted as part of the proposed FY 2010 budget and represents a $204 million reduction in total state spending from the enacted FY 2008 state budget.

AMERICAN RECOVERY AND REINVESTMENT ACT

American Recovery and Reinvestment Act (federal stimulus plan) dollars to be delivered to RI for FY 2009 (ending June 30, 2009): $252 million

American Recovery and Reinvestment Act (federal stimulus plan) dollars to be delivered to RI for FY 2010 (ending June 30, 2010): $529 million

Rhode Island is in line for more than $137 million in enhanced Medicaid match funds as part of the ARRA. In the proposed FY 2010 budget, these funds are directed for cost savings associated with pension reform, delayed implementation of the Medicaid Waiver, restoration of reductions in the Mental Health Retardation & Hospitals developmentally disabled programs, partial restoration of the Depart-ment of Human Services nursing homes and hospitals reimbursements, and a limited and restricted restoration of local aid.

RHODE ISLAND STATE/MUNICIPAL EMPLOYEE PENSION REFORM

As part of the proposed FY 2010 budget, Article 32 of the FY 09 Supplemental Bud-get is revised. This revision will grandfather employees who are eligible to retire as of July 1, 2009. As submitted in the proposed FY 2010 budget, the cost savings total $42.1 million in FY 2009 and $76.4 million in FY 2010.

LOCAL AID, ETC.

The FY 2010 budget proposes the restoration of $31 million in local aid, offset by a reduction of the same figure — $31 million — in aid to education. (The budget rec-

ognizes the availability of $38.3 million in federal stimulus aid, which will be directed to make up the lost state aid.) Amendments to the FY 2009 supplemental budget will also require municipalities to dedicate $12.6 million of the restored $31 million in general revenue sharing back to school districts. (This figure will be based entirely on a municipality’s past support of its schools.)

TAX POLICY CHANGES

The FY 2010 budget proposes reducing the corporate income tax rate from 9.0 percent to 7.5 percent as of January 1, 2010. The corporate income tax rate will then be phased out in successive years, with the complete elimination of the tax by January 1, 2014. The proposed decrease in the rate is as follows:

Six percent as of January 1, 2011Four percent as of January 1, 2012Two percent as of January 1, 2013Zero percent as of January 1, 2014

The FY 2010 budget proposal contains no combined reporting requirement.

The FY 2010 budget proposes to increase the exemption amount for the Rhode Island estate tax from $675,000 to $1,000,000, effective January 1, 2010.

The FY 2010 budget proposes personal income tax [rate] changes, creating four new tax [rates] brackets for individual taxpayers. The proposed [rates] brackets would take effect on January 1, 2011, and would range from 3.5 percent to 5.5 percent.

Also proposed in the FY 2010 budget is an increase of approximately 363 full-time [state employee] positions above the FY 2009 supplemental budget plan. These em-ployment figures are proposed to properly administer the state’s share of the federal stimulus package, (136 employees) and implement the Global Medicaid Waiver (57 employees). The figure also reflects 170 additional positions, proposed to restore adequate levels in social services and public safety. SEED secures $1 million for small business micro loansand refinancing business credit card debt with high interest rates. The term on the loans is up to six years and the current rate is 6.5 percent fixed.

According to Gooch-Smith, small busi-ness owners need to have at least a 600 credit score and be able to explain delin-quencies. She added that SEED will be re-viewing the small business owner’s entire household income to see if there is enough income to repay the loan.

“SEED can be flexible with repayment terms and collateral, but we expect small businesses to stand behind their loans and will take all available collateral, including a second or third position on the small business owner’s home, whether there is equity available or not,” she said.

The application process includes fill-ing out SEED’s application form and

providing federal income tax returns for three years for the small business and the owner. The application and list of items needed is available on SEED’s Web site at www.seedcorp.com.

SEED has administered a SBA micro loan program in Massachusetts for the past 10 years, with minimal charge-offs. So far, SEED has made 300 micro loans totaling $6.6 million, and assisted in the creation of 865 new jobs.

“SEED’s micro lending experience has proven that micro loans, often ‘character’ loans, do get paid back,” said Gooch-Smith.

SEED is a non-profit economic devel-opment corporation that was established and certified by SBA in 1982 to assist small businesses in the region. Under various loan programs, SEED makes loans from

$1,000 to $4 million to assist small businesses in growing and creating jobs.

SEED also provides technical as-sistance to small businesses, and works with other economic develop-ment organizations and financing in-stitutions in the region to ensure that individuals who are committed to owning and operating a small busi-ness are able to obtain the assistance they need to be successful.

The South Eastern Economic Develop-ment (SEED) Corporation has secured $1 million from the U.S. Small Business Ad-ministration (SBA) for micro loans up to $35,000 for small businesses in Massachu-setts and Rhode Island.

“We are very pleased to have SBA funds available to assist small businesses in both states in these difficult economic times. The need for micro loans has grown exponentially. SEED will have up to $3.5 million available from SBA to meet de-mand,” said Maria Gooch-Smith, SEED’s executive director.

Micro loans up to $35,000 are available for existing and start-up small businesses, including home-based businesses. Loan funds can be used for working capital, in-ventory, machinery and equipment, furni-ture and fixtures, leasehold improvements

Interview tips forjob seekers

Job interviews can be stressful, even for job seekers who’ve gone on many interviews. The

best way to reduce stress is to be prepared. Here are some tips to help you be best prepared for your next interview:

• Make a good first impression. A professional re-sume should be one page, free of errors, brief but to the point and should include descriptions of em-ployment, education, certifications and computer

skills. Briefly describe any notable achievements and community service. Make your resume stand

out from the thousands recruiters receive. Be aware of how your resume transmits electronically; certain fonts and spacing may not transmit as you intended.

• Contact information should be easy to locate on your resume. Highlight your name, phone number and email address in bold at the top of your resume.

• Be prepared when interviewing. Be knowledge-able about the company and the position. Select key points from the job posting to show a correlation with your experience and the skills that the com-pany seeks. Check the company Web site and fa-miliarize yourself with the history, mission state-ment and corporate culture. Employers expect job seekers to do their homework.

• Dress for success. Looking professional may set you apart from other candidates. Be sure to dress professionally; business attire always makes an excellent impression. Over-acces-

sorizing may be distracting; you want the recruiter to focus on you, not your nail polish, earrings, tattoos or perfume.

• Interviewing is a two-way street. Asking questions about the job and the com-pany shows that you are interested and inquisitive. Come prepared with three or four relevant questions about the company; other good questions include training and progression within the organization. Be sure to ask questions that relate spe-cifically to the position. Recruiters want to know that you are interested in that job with their company. Avoid questions about time-off, vacation and benefits until you progress further in the process.

• Use examples from successful work or school projects. They will show that you are organized, prepared, work well with deadlines and have had to communicate information to others. Never speak negatively of your former employer; simply relay difficult employment situations, supervisors or co-workers as challenges that you dealt with positively and successfully.

• Provide references. Having a list of references available at the interview demon-strates that you are organized and will save the recruiter an extra step. Make sure that you have contacted your references beforehand and have asked their permis-sion to be contacted.

• Follow up. Sending a thank you to the recruiter after an interview shows that you are interested in the position and are serious about the opportunity. A brief email or hand-written note thanking them for their time and restating your inter-est in the position will go a long way. Be sure to send one to the hiring manager and others who may have participated in the interview. You don’t want to over-look the decision maker.

• Show confidence, enthusiasm, interest and teamwork. These will be your key to successfully landing the job you want.

• Off-site/Internet-based storage solutions: Leveraging the Internet to copy your data off site is a great way to ensure that no data is lost in the event of, say, a building fire where all the equipment is destroyed. This way, you know that the data is stored in a secure, remote location. While the cost of these services is getting more affordable, large data amounts can become costly.

The first two examples (USB flash drive and USB external drive) are great back-up techniques, right up until a fire or catastrophic loss wipes out your office. Back-ups will not do you any good if the back-up device burns in the fire, along with the data. So just remember that you may want to mix and match the tech-nologies listed above to makes sure your back-up data is not at risk.

It’s also important to consider back-up data integrity. It’s great if you are backing up every night and making sure that the back-up is taken off site to protect against fire or flood. But what happens if you’ve backed up for five years consistently and when you finally need to restore something, the data is corrupt? You’d be surprised how many businesses (not clients) have called out of the blue, in a panic, stating that the back-up they’ve been performing religiously would not restore. The problem is that backing up the data is only one part of the solution. Test restoring that data is just as impor-tant. It can be as simple as checking the USB flash drive for the data, or using the software bundled with the USB external drive. No matter the technology you employ, there is documentation detailing how to verify your data. This needs to be done or you can’t be sure the back-up was really successful.

TECHNOLOGY TIP

If you are a Microsoft Outlook user, have you ever thought about what you would do if you lost all your emails, contacts or calendar information?

If you store your Microsoft Outlook data on your computer (laptop or workstation) and you are not connected to a corporate network, then I’m willing to bet you’ve never backed up your Outlook information. The data files are stored in a really strange place on the computer and are definitely not located in My Documents by default. Microsoft has developed an add-in for Outlook that will allow you to back up your data file. You can even tell it to back up to your nice, new USB flash drive.

You can download it at www.microsoft.com/downloads. One lit-tle caveat: in order to download the file, the site will look to make sure your version of Microsoft Office is legit. So if someone gave you a “free” copy of Microsoft Office, your validation may fail. No wor-ries, if you email me, I’d be happy to send it to you.
