SCOPE OF WORK & SPECIAL CONDITIONS:

The work should be carried out at Utran Gas Based Power Station. The work consists of painting by

• Cleaning of all surfaces to be painted thoroughly manually and subsequently with supply and

application of paint remover agent / wire brush, emery paper and preparing surface for primer

application.

• Supply and application of one coat of ASIAN / Berger make metal primer i.e. Red Oxide / Zinc

Chromate and subsequently supply and application of two coats of ASIAN Apcolite / Berger

Premium make, ISI approved smoke grey Synthetic Enamel Paint on inter connecting Transformer

1,2,3 & its related accessories, of 220KV Switchyard at UGBPS, Utran.

1. All the accessories, radiators bank and other part are to be painted at its installed position only.

2. Old paints should be removed thoroughly by paint remover and wire brush and it should be shown

to our Engineer as surface preparation is most important before application of paint.

3. If any rusted part is found which will be shown to you by our engineer then before painting rust

should be removed &. Red Oxide / Zinc Chromate should be applied and it should be shown to our

Engineer & there after two coats of enamel paints of approval make should be applied. Before

applying 2nd coat of paint, it should be shown to our engineer, then only 2nd

coat should be applied.

4. All painting should be done with spray painting & work should be look as good as original.

5. All dust, oil & grease should be cleaned & scraped and it should be shown to our engineer before

applying the paint.

6. All stain of colour should be removed from the insulators, glass or any other parts of the equipment

from where painting is not required to be done.

7. The name plate / identification of all equipments, boxes and panels should be rewritten with

original description with required colour paint as directed by engineer in charge.

8. Wherever original colour difference is observed by engineer in charge, same should be repainted as

per instruction of our engineer in-charge.

9. The electric supply required for running air-compressor will be arranged by GSECL at one place free

of cost or wherever air point is available, air will be supplied free of cost.

10.Air compressor & other equipment & materials, tools & tackles required for painting work should

be arranged by the contractor.

11. No men & materials will be given by GSECL for this work. Necessary scaffolding material, paint

remover , cloth emery paper, wire brush scrapper, painting brush/spray gun, air hose etc. and other

tools will be arranged by the contractor for carrying out the above job.

12. The paint should be got approved first from S.E. (Elect), GBPS, Utran before its use.

13. If GSECL’s any equipment, materials are damaged due to bad workmanship; the cost of same will

be recovered from the contractor.

14. If any loss or damage occurred to your men & materials, GSECL will not be responsible for the

same.

15. If spray painting of equipment is not possible which will be observed by engineer in charge then

contractor has to carry out the painting with the help of brush that too with the prior permission of

engineer in-charge of the work.

16. If any stains are found on wall floor or other place due to painting of other equipment. It should be

cleaned by the contractor without any extra cost to GSECL.

17. No accommodation will be provided by the GSECL for carrying out this work.

18. Contractor will raise first and final single bill after satisfactory completion of the job work.

19. The payment will be made as per actual work done and certified by the Engineer-In-Charge.

20. Measurement will be taken jointly and for any dispute, the decision of Engineer-In-Charge will be

final.

21. You will make safe scaffolding looking to the safety of your working persons.

22. The contractor should give guarantee at least for six months for satisfactory performance for

the painting work carried out and no corrosion/ rusting phenomenon take place, for which

10% of order amount will be withheld till the guarantee period is over.

23. . The paint should be of ASIAN Apcolite / Berger Premium make only having ISI

24. The contractor should ensure that there is no deviation in shade & correct shade should be

maintained.

25. The drum of the paint should be opened in the present of GSECL’s Engineer-in-charge.

26. The progress of the work is to be maintained as per our requirement.

27. Any labour laws in force from time to time will be applicable.

Time Note :

1.As per availability of shutdown Transformer will be spared and will be intimated in advance work

should be started immediately should be completed within four days.

2.The contract will be valid for 12 months from the date of placement of order without any

additional cost / rise in order value.

NAME OF CONTRACTOR : LABOUR LAWS :

01 Persons below the age of 18 years shall not be employed for the work. 02 No female workers shall be employed in the night shift between 7.00 PM to 6.00 AM. 03 Contractor/ Agency shall have to maintain valid Labour License under the Contract

Labour (Regulation & Abolition) Act 1970 and Rules 1972 for employing necessary manpower to be required by him and in the absence of such license the contract shall be liable to be terminated without assigning any reasons thereof.

04 The contractor / Agency shall at his own expense have to comply with all the Labour

Laws and keep the Corporation indemnified in respect thereof. Some of the major liabilities under various Labour and Industrial Laws which the contractor / Agency shall have to comply with are as under.

05 Payment of contribution of employees (Contractor’s Labour / Agency ‘s Labour) as well

as employer’s (Contractor / Agency) contribution towards Provident Fund, Family Pension Scheme, Employees Deposit Linked Insurance Scheme, Administrative charges, inspection charges etc. at the rates made applicable from time to time by Government of Gujarat / Government of India or other statutory authorities shall be made.

06 Labourers engaged by Contractor/Agency shall be entitled for Earn leave as per the

provision laid down in factories Act-1948. Contractor / Agency shall have to extend the facility of E.L. as per the provision laid down in Factories Act and shall also have to maintain leave records in prescribed form under Factories Act.

07 No labourers are allowed to enter in power station premises that do not have Identity

Card prescribed under Factories Act.

08 Contractor / Agency shall have to comply with the Maternity benefit if they happen to engage female labours as per Maternity benefit Act.

09 Contractor / Agency shall have to obtain Insurance of the laborers engaged by him to carry out contractual work before commencement of work under workmen’s compensation Act.

10 \P.F. CODE UNDER :

It should be ensured that no tender is issued to any Contractor who has no separate PF Code number as well as not considered for acceptance of tender and without PF code number tender is likely to be disqualified.

11 PROVIDENT FUND AND FAMILY PENSION SCHEME : : The contractor / Agency shall have to submit along with his bill ( Month wise ) a

statement regarding deductions at the rate of 12% of the wages against employee’s Provident Fund & Family Pension Scheme in respect of each concerned employees ( or at the rates made applicable by the Government from time to time ) of the wages. The Contractor’s / Agency’s contribution and his worker’s contribution along with Admn. charges, Insp. charges, EDLI Insp. Charges, Group Ins. Scheme Premium etc at the rates applicable from time to time towards Provident Fund and Family Pension Scheme shall be deposited by the contractor with Regional Provident Fund Commissioner Ahmedabad / Vadodara/ Surat or to the authority prescribed under the Act along with the other charges applicable.

12 If any workman engaged by Contractor / Agency, meets with fatal or non- fatal

accident while on duty then Contractor/ Agency shall be liable to pay compensation to the legal hair or to the Workman as the case may be as per Workman’s compensation Act.

13 EMPLOYEES DEPOSIT LINKED INSURANCE SCHEME : :

The Contractor / Agency shall have to deposit ½% of the rate applicable form time to time of the wages. In respect of employees who are a member of the Provident Fund against the contribution towards Deposit linked insurance scheme with r Regional Provident Fund Commissioner, Ahmedabad.

14 The Contractor / Agency should pay prevailing minimum wages to the labours

engaged by him as per the minimum wages Act in presence of the Representative of principal employer.

15 The Contractor / Agency shall deposit fifteen days salary for every completed year of

service in case of each worker towards the liability of gratuity.

16 ADMINISTRATIVE CHARGES : : Administrative charges for maintaining Provident Fund Account shall be deposited by the Contractor / Agency with Regional Provident Fund Commissioner Ahmedabad / Baroda/ Surat at the rates applicable.

17 LABOUR LICENSE FOR LABOUR CONTRACT : :

The Contractor / Agency shall have to obtain the copy of Labour Contract License under contract Labour (Regulation & Abolition) Act from the appropriate authorities before commencement of work.

18 Payment of minimum rates of wages under Minimum wages Act – 1948. The Contractor / Agency shall have to pay to every contract labour/ employees

engaged under him, wages at a rate not less than the minimum rate of wages fixed by such notification / Commissioner of Labour for that class of employment in that employment without any deductions except as may be authorized within such time and subject to such conditions as may be prescribed time to time.

19 Contractor / Agency shall have to issue the contractual appointment letter for a specific

period to their Labour engaged during the contract period each and every instance & should narrated clear out terms & conditions for the liabilities of the concerned employees.

20 After completion of the contract work, the work completion certificate is required to be

produced before the I.R.O. / H.R. Head for the purpose of issuance of NOC for labour laws compliance and cancellation of the gate passes issued to the Contractor’s / Agency workman at the time of execution of the contract work.

21 The Contractor / Agency shall have to maintain all the relevant records under various

Labour Laws as mentioned here in above and keep ready for verification by the Company authority as well as the authority of the Government Officials as and when asked for the checking.

22 RESPONSIBILITY FOR PAYMENT OF WAGES :

It shall be the duty of the Contractor / Agency to ensure the disbursement of wages in the presence of the authorized representative of the principal employer to certify the amounts paid as wages to each worker employed by him in such manner as may be prescribed. The Contractor / Agency shall have to produce / submit the copy of wage Register / Muster Roll / P.F. Deposition Challan / PF Schedule and relevant records under various Labour Laws for the contract work to Head of the H.R. Department for the purpose of issuing the NOC for Labour Laws compliance. SCHEDULE -C1

GENERAL TERMS AND CONDITION

(1) AGREEMENT: The contractor will have to execute agreement on Rs.100/- non judicial stamp paper

& Indemnity Bond on Rs100/-non- judicial stamp paper before starting the work at his cost. Incase of

non-execution of the same, payment will be with held.

(2) Income tax as applicable will be deducted from the bill as per I.T. act.

(3) Security deposit: The contractor will pay security deposit 10% of total value of contract before

starting work.

(4) The contractor will be responsible for his working personnel for any injuries or mishap

Caused/occurred to them during the execution of above work. The GSECL will not pay any

compensation in such cases to the contractor’s persons.

(5) The contractor will also be responsible for any damages caused to the GSECL property by his

Personnel during the execution of above work. In such cases, the contractor will arrange to

repair/rectify or will pay such amount to GSECL as may be decided by the competent authority of

GSECL.

(6) The contractor will have to carry out the work as per the instruction of Engineer -in – charge.

(7) If any dispute arise during the execution of work, the decision of the under signed (Addl. Chief Eng.)

will be final and binding to contractor.

(8) The contractor’s personnel will also co-operate to the engineer –in-charge for execution and

satisfactory completion of work.

(9) The contractor shall bring his own special tools and tackles as may be required for carry out the above

work.

(10) The contractor has to re clean the required portion of above work free of cost.

(11) If engineer–in-charge feels that work done by the contractor is not done in satisfactory

manner no extra charge will be payable by the GSECL for such work if carried out again.

(12) The contractor will issue Identity –cards with photographs to his working personnel.

(13) If contractor fails to start the work in time specified or his work is found dissatisfactory and he

defaults In proper execution of work and he fails to improve his working in spite of instruction given

to him, GSECL reserves the right to terminate the contract by serving 7(seven) days notice. The

security deposit Paid by the contractor in such case shall be forfeited. GSECL also reserves the right

to award the contract to any other party or may carry out the work departmentally at the risk and

cost of the contractor.

(14) The contractor will have to submit labour license and documentary proof of payment of provident

fund of concerned employees to their account, with RPFC commissioner after which the necessary

payment will be released.

(15) The party will provide well- experienced and skilled personnel as agreed in main contract form.

(16) The contractor will govern his personnel as per the Government Labor Law, minimum wages act and

other Laws prevailing in Gujarat state. GSECL will not be responsible for any compensation for

such cases.

(17) The party will observe all safety measures for his working personnel.

(18) The contractor shall have to quote his EPF/CPF code no.and have to give the documentory evidence

of EPF/CPF deductced of his employees to PFC commissioner. if the contractor fails to submitt the

evidence of the same, bill will not be proceed for the payment.

(19) The contractor will have to furnish the details of such works executed satisfactory in GSECL or any

other organisation alongwith documentary proof of the same i.e. work orders,exprience certificate

e.t.c.
