What work requires a BUILDING PERMIT

Building Permits are required for the following:

All new construction

All new residential accessory structures/storage buildings over 130sq.ft

All new commercial accessory structures/storage buildings of any size

Any and all new plumbing—not including changing out fixtures

All renovations related to the following:

1. Changing bedroom window

2. Upgrading insulation and vapour barrier

3. Changing or upgrading heating equipment

4. Upgrading, changing or adding plumbing

5. Any and all structural changes or upgrades

6. Changing exits or stairs

7. Installation of barrier-free ramps and washrooms

8. Installation of sprinkler or fire alarm systems

9. Creating multiple living units

New or changing woodstoves, pellet stoves, oil fired space heaters and any other type of

fuel-fired equipment.

Installation of fuel tanks

Changing or relocating of chimneys

Any and all decks that require Guards and/or Handrails

Moving of, and placement of mobile homes

Demolition or moving of existing buildings

Change of use

Building Permit

Application requirements:

When making application for a building permit, the following information and documents are required and

must be provided at time of application:

A. Proof of a Development Permit. See page 4 for the Development Permit Application Checklist.

B. Building Permit Application checklist which must be completed.

C. A copy of the Certificate of Title or a copy of the agreement for sale and if the applicant is the not

the owner then additionally we would need a letter from the owner giving the applicant the right to

build on their land.

D. A complete sets of plans, drawn to scale, showing each structure to be constructed, plans must in-

clude the following:

1. A site plan showing distances from the proposed structure to the property boundaries, to

the well, to the sewage disposal system, to other existing buildings, watercourses and

lakes. (see figure 1)

2. A foundation plan; (see figure 2)

3. A plan view of each floor; (see figure 3)

4. A cross section of the structure; (see figure 4)

5. Drawings, specifications and calculation for Energy Performance Compliance as set out in

the Building Standards Act and the National Building Code.

E. Factory-built units require a site plan, a foundation plan as in (C. 2) above, and the name of the

manufacturer, year of manufacture, model and serial number of the unit. Modular and panelized

buildings must conform to CSA A277 and manufactured homes must conform to CSA Z-240.

F. Where a private sewage disposal system is to be installed, a permit from Environmental Health

Services will be required. They can be contacted at;

Re: Development, Building & Plumbing Permit Fees

The following is to be used to assess the Value of Construction, when determining Development, Building, Plumbing

Permit and Special Inspection Fees.

Development Permit Fee: $25.00 for a Development Permit for all buildings or structures that are proposed to be

constructed on a site, at that time, within a Development Area Regulation. This fee is in addition to any Building or

Plumbing Permit Fees. Within a Municipality a Development Permit must be issued by that Municipality before we can

issue a Building Permit.

Commercial: Estimated value shall be equal to the cur rent normal level as if placed for open contract bid.

Temporary Mobile Re-locatable Industrial Camps & Mobile Homes: $25.00 for each unit/trailer (if set-up for less

than 5 years) – if a unit also includes the installation of a secondary heating source then there is an additional fee of

$25.00 payable per each additional heating source. If units are to be set-up for more than five (5) years than the fee is

based on value of the cost of constructing the units plus the cost of setting the units up on site.

Residential: Cur rent normal level of construction costs per floor (per square foot):

Main/Floor /Crawlspace or Slab on Grade $80.00

Main floor/ Basement $100.00

Each Additional Finished Floor $50.00

Garage/Shop/Accessory Building $30.00

Cold Storage Shed/Deck/Carport $15.00

Building Permit fee is the Construction value multiplied by .005 (0.5%), with a minimum fee of $ 25.00

(Includes up to a value of $5,000.00)

Plumbing Permit Fee: use $6.00 per trap, minimum fee of $ 25.00 (includes 4 traps)

Development Permit Application Checklist

Checklist for a Complete Application:

I have, and read the Area Development Regulations for the proposed location of my project. (It can be found here: http://www.gov.yk.ca/legislation/legislation/page_a.html) An explanation of the proposed development, the applicable Area Development Regulation and Zoning of the property and assurance of positive site drainage away from all buildings without affecting adjacent properties. Copy of Certificate of Title or copy of the Agreement of Sale, if the applicant is not the owner then we need a letter from the owner giving the applicant the right to develop on their lot. A complete site plan, drawn to scale showing the dimensions of the property and the distances from the proposed building to all property lines, the location of the sewage disposal system, wells, all existing buildings and structures.

The site plan shall include a north arrow, legal description of the property and if available the civic address, lot dimensions, driveway access, parking spaces with dimensions and for commercial projects the parking lot configuration and location of large fuel and propane tanks. The use and square footage of all the existing buildings and structures must be provided: If they are used as dwelling units we need to know the existing total number of dwelling units. A complete floor plan, of all floors in the proposed building, drawn to scale showing the square footage of each floor and what each room will be used for. An elevation drawing of the proposed building, drawn to scale showing the maximum height of the building, from the average finished grade level to the peak of the roof. I am aware that without an Approved Development Permit Environment Health Services cannot process a Sewage Disposal System Permit. I hereby declare that all the information provided in this application for development and contained in the supporting documents are to the best of my belief true and correct in all respects. I hereby acknowledge any change to the plans outlined within this application will result in the issuance of a Development Permit based on the information provided in this application to be null and void. I hereby confirm that the proposed development, as outlined in the application for Development Permit, complies with any easements, caveats or contracts which affect development of the site. Pursuant to the Building Standards Act and Regulations, this permit is issued subject to the following conditions.

RESPONSIBILITY OF THE OWNER4. (2) During construction of a building the owner of the property shall give

at least 72 hours notice of a time for inspection of the construction and shall obtain inspection and acceptance of the construction by an inspector at the following stages:

(i) foundations—when damp-proofing is in place and prior to any construction above the subfloor and prior to backfilling;

(ii) framing and insulation—after vapour barrier, windows, roofing, exterior doors, heating, plumbing, and wiring have been installed;

(iii) occupancy—after the building is completed, although a conditional occupancy permit may be issued prior to completion;

(iv) at any stage stipulated by an inspector and necessary to ensure standards are met.

PERMITS5. (3) Every permit to authorize construction or plumbing is issued upon

the following conditions:

(a) the work shall be started within six months from the date the permit is issued;

(b) the work is not discontinued or suspended for a period of more than one year;

(c) that special instructions or conditions set out in writing at the time of issuing of the permit are complied with;

(d) the permit lapses if any condition above is not met;

(e) an additional fee shall be paid if the permit is renewed.

CONDITIONS3. (8) No person shall occupy or allow the occupancy of any building or

part of a building contrary to the terms of a permit, notice, or order.

3. (3) No person shall alter, cover, or remove a notice, permit, or order posted at a job site or building pursuant to a provision of the Building Standards Act or this Regulation unless authorized by an inspector.

4. (8) Neither the acceptance of drawings and specifications by an inspector, nor the granting of a permit, nor the completion of an inspection, nor the approval of the construction by an inspector relieves the owner of a building from responsibility for carrying out the work or having the work carried out in accordance with the requirements of the building code, the Building Standards Act and this Regulation, or any other applicable bylaws, or Federal or Territorial Act or regulation, or any covenant, easement, or right-of-way registered against the property.

4. (10) When required by an inspector, the owner shall uncover and replace at their own expense any work that has been covered contrary to a notice or order or prior to the completion of an inspection required by this Regulation.

4. (11) During construction, the owner to whom a permit is issued shall

(a) keep the permit posted in a conspicuous place on the property for which the permit is issued, and

(b) keep on the property a copy of the drawing and specifications for the construction for which the permit was issued.

(iii) début de l’usage – après la fin des travaux, même si un permis d’usage conditionnel peut être délivré avant la fin;

(iv) à toute autre étape prescrite par l’inspecteur et nécessaire pour assurer le respect des normes.

PERMIS5(3) Le permis autorisant la construction ou la plomberie est délivré aux

conditions suivantes :

a) les travaux doivent commencer dans les six mois suivant la date de délivrance du permis;

b) les travaux ne sont pas interrompus ou suspendus pour une période de plus d’une année;

c) les instructions ou conditions spéciales énoncées par écrit au moment de la délivrance du permis sont respectées;

d) le permis devient nul si l’une des conditions ci‑dessus n’est pas respectée;

e) un droit supplémentaire doit être acquitté si le permis est renouvelé.

CONDITIONS3(8) Nul ne peut faire usage d’un bâtiment ou d’une partie d’un bâtiment,

ou permettre qu’il soit utilisé, contrairement aux dispositions d’un permis, d’un avis ou d’une ordonnance.

3(3) Nul ne peut modifier, couvrir ou enlever un avis, un permis ou une ordonnance affiché sur un chantier ou sur un bâtiment conformément à une disposition de la Loi sur les normes de construction ou du présent règlement, à moins d’autorisation d’un inspecteur.

4(8) Du simple fait que les dessins et le cahier des charges soient acceptés par un inspecteur, qu’un permis soit délivré, qu’une inspection ait été faite ou qu’un inspecteur ait approuvé les travaux, le propriétaire d’un bâtiment n’est pas dégagé de son obligation de réaliser les travaux ou de les faire réaliser conformément aux exigences du code du bâtiment, de la Loi sur les normes de construction ou du présent règlement, ou de tout autre règlement administratif, ou de tout autre loi ou règlement, fédéral ou territorial, ou compte tenu de tout autre engagement, servi‑tude ou droit de passage enregistré à l’égard du terrain.

4(10) À la demande de l’inspecteur, le propriétaire doit défaire et replacer à ses propres frais tout ouvrage qui a été recouvert contrairement à un avis ou à une ordonnance, ou avant qu’ait lieu une inspection prescrite par le présent règlement.

4(11) Pendant les travaux, le propriétaire à qui un permis est délivré :

a) doit afficher le permis à un endroit visible sur le terrain pour lequel le permis est délivré;

b) doit garder sur le terrain une copie des dessins et du cahier des charges pour les travaux pour lesquels le permis a été délivré.

Proof of an Approved Development Permit if the property is within one of over 20 Area Development Regulations in Yukon. Or Proof of an Approved Development Permit from the applicable Municipality if the property is in one of the following Municipalities;

Carmacks, Dawson City, Mayo, Faro, Teslin, Watson Lake or Haines Junction I have a current copy of the National Plumbing Code of Canada, or I have a copy readily available. A complete isometric drawing of the existing and proposed drainage and venting system. I have a current copy of the National Building Code of Canada, or I have a copy readily available.

An explanation of the proposed construction, assurance of adequate soil bearing capacity for the building and positive site drainage away from all buildings without affecting adjacent properties.

I am aware that if any construction has begun prior to the application and issuance of a Building Permit that any construction that has been undertaken will need to be analyzed and inspected by a Structural Engineer (registered to practice in Yukon) & a letter of approval from that Structural Engineer is to be submitted together with all the documentation required when applying for a Building Permit.

I am aware that if any load bearing 2 X 4 wall exceeding 10 feet in height or any load bearing 2 X 6 wall exceeding 12 feet in height; the plans shall be stamped by a Structural Engineer (registered in Yukon) and is to be submitted together with all the documentation required when applying for a Building Permit.

Copy of Certificate of Title or copy of the Agreement of Sale, if the applicant is not the owner then the owner is to provide a letter giving the applicant the right to build on their lot.

The proposed building meets the requirements of 9.36 “Energy Efficiency” and have provided documentation to show compliance.

A complete site plan, drawn to scale showing the dimensions of the property and the distances from the proposed building to all property lines, the location of the sewage disposal system, water wells, all existing buildings and structures. The site plan shall include a north arrow, legal description of the property and if available the civic address, lot dimensions, driveway access with dimensions.

The use and square footage of all the existing buildings and structures must be provided: If they are used as dwelling units, provide the existing total number of dwelling units and the existing total

number of bedrooms in each dwelling unit. A complete foundation plan, drawn to scale, showing all dimensions, the provisions incorporated to provide protection from soil gas ingress and the location of the rough-in for the subfloor radon mitigation system, the effective thermal resistance values of all above and below ground wall & floor assemblies. If there is a drainage sump, a rock pit or dry well this is also to be shown on the plans. A complete floor plan, of all floors in the proposed building, drawn to scale showing the square footage of each floor and what each room will be used for: If the building will be used as a dwelling unit or several dwelling units, we need to know the maximum number of proposed bedrooms in each dwelling unit. If there are any required fire separations the plans are to indicate the location of all the required fire separations and the fire resistance ratings that are applicable to each of these fire separation. A complete cross section of the building, drawn to scale, the drawings need to indicate the materials being used to construct all the components of floors, walls, ceilings and roof. An elevation drawing of the proposed building, drawn to scale showing the maximum height of the building, from the average finished grade level to the peak of the roof. In addition to meeting all the requirements above a factory-built mobile home unit shall conform to CSA- Z240 and a factory-constructed building shall conform to CSA-A277. I am aware that mechanical ventilation is required and will be installed. The applicable Building Permit fee. I am aware that if a Development Permit is not required Environment Health Services cannot process a Sewage Disposal System Permit without an Approved Building Permit. I am aware that in addition to an Approved Building Permit I may also need some additional permits and approval such as; plumbing permits, wood stove permits, oil heating and fuel storage system permits propane and electrical permits, boiler approvals and elevator approvals, driveway access permits etc. I hereby declare that all the information provided in this application for a Building Permit and contained in the supporting documents are to the best of my belief true and correct in all respects. I hereby acknowledge that any changes to the plans outlined within this application will be submitted for review or this Building Permit will be deemed to be null and void. I hereby acknowledge that if work has not started and no inspections have been requested within six months from the date the permit was issued the Building Permit will be deemed to be null and void and will be automatically cancelled. I hereby acknowledge that if work is discontinued or suspended and not inspected for a period of twelve months from the last inspection the Building Permit will be deemed to be null and void and will be automatically cancelled. INSPECTION REQUIREMENTS

Building Safety—Yukon Government

Please be advised that it is the owners’ responsibility to call for all the required inspections, and to provide at

lease seventy-two hours(72) notice, at the following stages:

1. Foundation - (Siting, Footing, Drainage Tile, Foundation Damp-proofing, Plumbing Rough-in Under

Slab).

At the subfloor stage and after the drainage tile and damp-proofing has been completed but prior to back-fill

a Building Location Certificate may be required to be obtained. This Building Location Certificate, (if re-

quired) shall be submitted to confirm applicable zoning and building code set-back requirements have been

met. Then, prior to any backfilling a building inspection is required to confirm that the footings have been

placed on undisturbed soil, rock, or compacted granular fill, that the damp-proofing has been installed correct-

ly and when required, that the drainage tile has also been installed correctly.

Note: Unless it can be shown to be unnecessary, the bottom of every exterior foundation concrete wall

shall be drained by drainage tile.

Note: Siting approval and the requirement to submit a Building Location Certificate will be handled on

an individual basis, at the discretion of the Development Officer/Building Inspector.

Note: Siting or set-backs from all property lines will be determined by the Development Officer/

Building Inspector, based on Local Area Development Regulations or in the absence of such regula-

tions, it will be based on the most current National Building Code of Canada (NBC).

2. Framing and Insulation

When insulation and vapour barrier, doors, windows, roofing, and plumbing rough-in are completed.

3. Conditional Occupancy (optional)

May be granted when all health and safety items such as guards, handrails, smoke alarms, CO detectors, etc.,

are in place. Electrical approval, propane approval, and septic approval are required at this stage.

4. Occupancy

Will be given when all work has been completed.

Note: AN INSPECTION MUST BE CALLED FOR TO CERTIFY ACTIVITY WITHIN

6 MONTHS OF THE DATE OF PERMIT ISSUE AND WITHIN 12 MONTHS OF THE

“Occupancy Approval Check List”

Items to be completed for OCCUPANCY “only” : Fire, Safety and Health for Dwelling Units.

1. Ensure Electrical, Propane, Oil, and Health Dept. (septic) approvals have been “obtained” and submitted to the Building Inspector.

2. A functioning bathroom and a kitchen sink installed with a clean surface for handling food.

3. Plumbing system complete and complete with all the traps in place and any future pipes capped off

4. Heating and fuel storage system complete and functioning

5. Water-resistant floor finishes in place in bathrooms, kitchen, entrance halls and laundry areas.

6. Stairs, landings, guards and handrails to be in place.

7. A self-closer and weather-stripping in place on a door between the house and attached garage. (No duct openings from house to garage.)

8. “Openable” bedroom windows.

9. If there is a fuel– burning appliance, has it been approved and are the required Carbon Monoxide Alarms installed and functioning?

10. If future decks are not in place, ensure any access to them has been barricaded.

11. Electric smoke alarms are required on every floor level and in every bedroom and are required to be interconnected.

12. Has ventilation and heating systems been approved and are they operating.

13. Interior wall and ceiling coverings in place, with no exposed vapor barrier in occupied spaces.

14. Exterior doors in place and exterior “reasonably” clad to weather.

Important Notice regarding FEES pertaining to

Sewage Disposal Systems

As per the Sewage Disposal Systems Regulations, pursuant to the Public Health and Safety Act

Environmental Health Services

will now collect FEES for:

Issue of a Permit $50

A permit is required to construct, install, enlarge, rebuild, substantially repair a sewage disposal system, or

connect to an existing system. This includes septic systems with an in-ground field and sewage holding tanks.

A permit is not transferable, and is void within 3 years of the date of issuance.

This fee does not apply to: the construction and use of a privy (outhouse)

permits obtained prior to Jan. 1, 2001, provided the owner of the premises has not changed.

Documents Search and Copies $25

Owners are encouraged to keep documentation and photographs pertaining to the construction, installation and

approval of their sewage disposal system.

This will assist in any future sales of the property and in the processing of financial arrangements.

Documents should be passed on to the new property owners.

A single fee will be applied to each request for a document search (includes copies required) on a specified

property.

Issue of Letter of Permission

To Retain a Sewage Disposal System $50

Should a sewage disposal system have already been built or installed without having being issued a permit,

under certain circumstances, a letter of permission to retain the sewage disposal system may be issued.

Fee Collection

Fees are to be submitted with the application for a permit; application for permission to retain; or upon request

for a document search and copies, unless other arrangements have be pre-approved.

Fees may be paid by: cash; money order;

Debit card; Visa; Master Card; or cheque.

Cheques and money orders are to be made payable to; The Territorial Treasurer.
