    A. ALLEGATIONSCOMMONTOALLPLAINTIFFS34. DefendantHolderwasaspecialeducationteacherinspecialdayclassesinthe

    BUSDfrom1996to2012. ShetaughtatLomaVistaElementarySchooluntilMay2010andthen

    wastransferredtoKreySchoolbeginninginthe2010-2011schoolyear. Sheresignedfromthe

    BUSDaspartofthesettlementofalawsuitfiledinthiscourt,KevinPhelan,et.al.v.DinaHolder,

    et.al.,casenumberC12-00465LB.

    35. DefendantHoldersubjectedthestudentsinherclassroomtoongoingverbalandphysicalabuse.Thestudentswerealldisabledandsomewerenonverbal. Theyrangedinagefrom

    threetosix.

    36. Atleastasearlyas2008,employeesofBUSD,includingJames,Olson,Anthony,KruseandGrantobservedorhadknowledgeofinformationthatstudentsinHoldersclassroom

    werebeingsubjectedtoverbalandphysicalabuse. Theseemployeeshadtheabilitytodiscipline

    Holderorterminateheremployment,buttheydidnothing. Instead,theemployeesconcealedthe

    abusefromlawenforcementofficialsandparents.

    37. TheemployeesreferredtointhepreviousparagraphobservedorhadknowledgeofinformationgivingrisetoareasonablesuspicionthatHolderhadcommittedactsofchildabuseor

    neglectasdefinedbyPenalCode11165.3againststudentsinherclassroom.Theseemployees

    weremandatedreportersasdefinedbyPenalCode1165.7,butdidnotreporttheabuseorneglect

    toanagencydefinedinPenalCode11165.9.

    38.

    OnMarch4,2011,PAIGELARKbroughthersontovisitHoldersclass.Ms.Lark

    momentarilysteppedoutoftheclass.Whenshereturnedafewminuteslater,sheobservedHolder

    andhersonfromafewfeetawaythroughawindowintheclassroomdoor.SheobservedHolder

    shakinghersoonviolentlybytheshoulderssothathisheadwasmovinglikeabobblehead.

    39. PAIGELARKthenquicklyopenedthedoorandranintotheclassroom.SheconfrontedHolder,whoclaimednottoknowwhatthemotherwastalkingabout.Holderalsosaid,

    40. Holdertestifiedatadepositionthatshewassittingbehindthestudentwithherarmsateithersideofthestudent.Holderclaimsshedidnottouchthestudentandthatthestudentshead

    wasmovingbecausehewasshakinghisheadno.Holderclaimedthatherversionofeventswas

    supportedbyheraide,JaniceLopez,whowassittingacrossthetablefromher.

    41. Atherdeposition,Ms.LopeztestifiedthatshesawHoldershandsonthestudentsshoulders,butonlytocomfortthestudent.

    42. Ms.LarkcomplainedtoMs.JamesandMs.AnthonyabouttheabuseofL.L.Ms.Anthony,onbehalfofBUSD,wroteL.L.smother,statingthattheirinvestigationfoundno

    violationofpolicyorwrongdoingonthepartofdistrictemployees.Infact,neitherAnthony,

    James,noranyotheremployeeofBUSDconductedanyinvestigationandnoneofthem

    interviewedLopez.

    43. L.L.smothercontactedthepolice,whodidnotconductanindependentinvestigationafterlearningofBUSDsinvestigation.

    44. Duringaportionofthe2008to2009schoolyear,K.G.wasapre-kindergartenstudentatLomaVistaElementarySchoolinHoldersSpecialDayClass. Throughoutthisperiod,

    hewassubjecttoregularactsofchildabuseorneglectandobservedactsofchildabuseorneglect

    beinginflictedonotherspecialneedschildreninhisclassroom,including,butnotlimitedto,

    yelling,swearingandinappropriatelyaggressivephysicalcontact.HewasstruckbyHolderandhe

    observedHolderhittingotherchildren.

    45. OnMay19,2008,K.G.camehomeveryupsetandbegancrying. Hecomplainedtohisgrandmotherthathehadbeenslappedtwiceatschoolbyanadultandthathehadaredwelton

    hischeek.ThegrandmothercontactedK.G.smother,SYLVIAGALLEGOS,whoimmediately

    wenttotheschoolwhereshedeterminedthattheadultwhohadslappedhersonwasHolder.

    K.G.smotherreportedtheincidenttoJamesinpersonthatday.

    46. JamesspoketoK.G.andhismotherabouttheincident.K.G.hadlimitedspeakingability,buthemadedidmakeaslappingmotiontowardhisface. Inaddition,hewasableto

    accuratelydescribeHolderandtheclothesshewaswearing. Jamesdidnotcontactthepolice

    47. Therewerecrucialmisstatementsandomissionsintheinformationprovidedbyschoolpersonneltothepolice.Jamesdidnotdescribetheslappingmotionshesawandtheaides

    claimedthatHolderneverraiseshervoicewithchildren.Inaddition,Jamesconveyedtothepolice

    thatK.G.couldnotspeakandthereforecouldnotcorroboratethebattery. TheDistrictAttorney

    didnotpursuetheinvestigationgiventhattherewerenowitnessestothebattery.

    48. ThephysicalandverbalabusebyHoldercontinuedfollowingtheseincidents. TheconditionsinDinaHoldersclassroomwere,tousethewordsofoneofheraides,horrendous.

    49. Ms.Holderregularlyreferredtostudentsaslittleshits. Sheroutinelyyelledshutup!atstudentssoloudlythatshecouldbeheardinanadjoiningclassroom.Shewasoverheard

    yelling,getyourbutthere. Duringcircletime,whenthestudentsreadorplaygames,Ms.

    Holderyelledatorberatedchildrenwhodonotverbalizearesponse. Shewouldgetintheface

    ofchildrenwhowerestrugglingtospeakandyell,Youcansayitorotherwiseberatethem.

    50. Ms.Holderroutinelyforcedveryyoungchildrenintochairsandmovedthembygrabbingtheirarms. OneparentobservedMs.Holderpullingachildbythearmanddragginghim

    acrosstheflooroftheclassroomonmanyoccasions. Thestaffpsychologistandspeechpathologist

    workedwithMs.Holdertoadoptappropriateclassroommanagementtechniques,butshenever

    adoptedthem. TheschoolpsychologistvisitedHoldersclassroomonceaweekandobserved

    physicallyaggressivebehaviorprettymucheveryweek.

    51. Eventually,Ms.Holderessentiallystoppedteaching. Sheroutinelyarrivedlateonlytositatherdeskplayingcomputersolitaireandpayingbills. Shehadnoclearinstructional

    programandwasunpreparedwhensheattendedstudentsIEPmeetings. Instructionalaides,with

    noformaltrainingineducation,tookoverlessonplanningandteachingduties. Theaides,rather

    thanMs.Holder,didtheinstruction. Theseconditionswereknowntoeveryoneonthepreschool

    staffand,accordingtooneaide,wascommonknowledgeintheschool.52. Theconditionsintheclassroomwereextremelydetrimentaltostudents. Oneaide

    describedtheatmosphereaschaoticandtense. Shealsostatedthatthechildrenwereworking

    outoffear. Speechandlanguagetherapistsandaidesobservedthatstudentsstoppedresponding

    wereinsteadregressingandstoppedtalking.

    53. Psychologists,speechtherapists,speechpathologyaides,instructionalaidesandotheremployeesreportedtoJames,Anthony,Olsen,KruseandGranttheirconcernsaboutverbal

    andphysicalabusetheyobservedinHoldersclassroom.James,Anthony,Olsen,KruseandGrant

    hadtheabilitytodisciplineHolderorterminateheremployment,butdidnothing.

    54. OnMay25,2010,Ms.Holder,threeinstructionalaideswerepreparingtheclassforcircletime. AstudentwascuttingoutpaperforaprojectanddidnotcomplywithMs.Holders

    requestthathejointherestoftheclass. Ms.Holdergrabbedthestudentbythearmandpulledhim

    outofthechair. Thestudentfelltothegroundandwaslyingproneonhisside. Ms.Holder

    forcefullykickedhiminthelowerbackorbuttockstomovehimtowardthecirclearea.

    55. Theattackwasobservedbytwooftheinstructionalaides,whodescribeherasyellingaggressivelyatthestudenttogetupandgotothecircle. Onestatedthatshekickedthe

    studentlikeyouwouldkickadogoutoftheway. OneoftheaidesyelledatMs.Holdertostop

    andpulledheroffofthestudent. Ms.Holderstoppedkickingthestudentandasshewalkedaway,

    shecalledhimastupidsonofabitch. Shesaidtheepithetloudlyenoughthatallofthe

    instructionalaidesandthestudentswereabletohearit.

    56. Thatafternoon,oneoftheaidescontactedConnieForrest,aSpecialDayClassteacherintheroomnextdoor. Ms.ForrestistheformerCoordinatorofSpecialEducationforthe

    District. Ms.ForresttoldtheaidetoresolvetheissuewithMs.Holderdirectly. Sheadvisedthe

    aidetocontacttheschoolprincipalandotherauthoritiesonlyifshecouldnotresolvetheissue

    withMs.Holder.

    57.

    Ms.ForrestthenspoketoMs.Holder. Ms.ForrestaskedMs.Holderifsheintended

    tospeaktotheprincipalorJ.P.parents;Ms.Holderrepliedthatshewouldthinkaboutit.

    58. Thenextday,oneoftheaidescontactedaschoolpsychologistwhoinformedJamesoftheincident.

    59. TheaidesandalloftheemployeeswholearnedofHoldersbatteryonthestudentweremandatedreportersasdefinedbyPenalCode1165.7,butnoneofthemreportedtheabuseor

    neglecttoanagencydefinedinPenalCode11165.9. Infact,theemployeesbelievedincorrectly

    thattheinstructionalaideswerenotlegallyobligatedtoreportabuse.

    60. KruseandJamesinterviewedemployeesregardingtheMay25batteryandconditionsinHoldersclassroom. Thatinvestigationdocumentedtheongoingverbalandphysical

    abusetowhichHoldersubjectedherstudents.

    61. BUSDissuedaLetterofUnprofessionalConducttoHolder,concludingthatherclassroomwasanunhealthyenvironmentforchildrenduetorepeatedincidentsofverbaland

    physicalabuse.Yetratherthanterminatingheremployment,BUSDtransferredHolderfromLoma

    VistaSchooltoKreyElementarySchool.

    62. JamesandKruseinformedtheparentsofthechildwhowasbatteredbyHolderonMay25,2010abouttheincident. TheydidnotinformtheparentsthatHolderhadswornattheir

    sonorthattheyhadconcludedthatHoldersclassroomwasanunhealthyenvironmentforher

    studentsbecauseofongoingverbalandphysicalabuse.

    63. Whentheparentsaskediftheschoolintendedtocontactthepolice,KrusestatedthatBUSDwouldnotcontactthepoliceandwouldinsteadtreattheincidentasaninternal,

    confidentialmatter. Dissatisfiedwiththisresponse,theparentscontactedtheBrentwoodPolice

    Department. ThepolicedepartmentconductedaninvestigationandcontactedKruse,Jamesand

    otherBUSDemployees.Noneoftheemployeesinformedthepoliceaboutthefindingsofthe

    BUSDinvestigationthatHolderhadsubjectedstudentstoverbalandphysicalabuse. Instead,the

    employeesconveyedtheimpressionthatHolderwasagoodteacherandthatthebatteryonMay

    25,2010wasanaberrantactonHolderspart.

    theparentsaboutHoldershistoryofabusingchildreninherclassroom.Thisexperiencecaused

    A.G.sparentssignificantemotionaldistress.

    74. A.G.wasnotabletounderstandtheconditionsinHoldersclassroomwerewrongfulnorwasheabletocommunicatethesourceofhisdistresstohisparents.BUSDwithheld

    A.G.andahostileenvironmentbasedonhisdisability.

    90. J.P.sufferedmanyunexplainedinjurieswhileastudentinHoldersclassroom.Shesustainedbruisesonherarmconsistentwithbeinggrabbedbythearmandonherkneesandback.

    Shealsosustaineddeepscratchesandaseriouscuttoherchinwhichleftapermanentscar.She

    becamemuchmoreaggressiveandengagedinself-injuriousbehaviorduringthetimeshewasa

    studentinHoldersclassroom.J.P.becamewithdrawnandnonverbalduringthetimeshewasa

    studentinHoldersclassroom.Shecontinuestosufferemotionalinjuriesasaresultofhertimein

    Holdersclassroom.

    TheunhealthyconditionsinHoldersclassroomcauseJ.P.tosufferphysicalinjury,
