Amazement. That’s what Jessica Guerrero felt upon receiving news that she’d been accepted into the Model Senate program – the fi rst time. That was a few years ago. Now she’s back, as a seasoned veteran, working as a facilitator. “I always come back, because this is what I enjoy. I see myself improving the laws and improving my district.” The Ecuadorian student is interested in working in criminal justice, possibly at the FBI. She is busy outside the classroom too, juggling two jobs – one at a mental health center helping teens struggling with thoughts of suicide. “We’re trying to help people because of bullying. We’re doing meetings and talking to parents.” Not surprisingly, the Forensic Science major is keen on gathering and analyzing all the data and deconstructing the bill, line by line. “I have had to learn a lot of new vocabulary. I need to be prepared.” She has some ideas. “This reform needs more regulations. There should be an investigation, background checks, and a review of criminal records to make a fi nal decision.”

One mistake. That’s all it might take to undo a lifetime of eff ort. Carmelo Quiñones Jr. has seen the lives of some around him unravel. “You have people that are hard workers, and something can aff ect their life in an instant.” The Puerto Rican sophomore, who is pursuing studies in Education and English, has always had an affi nity for politics. Quiñones recalls relishing debates in middle school. “We had to understand both perspectives. We always knew that from whichever side we were on, we had to fi nd balance.” So it is with bail reform. However charged the discussion, Quiñones believes that “you should be able to have a respectful understanding of the opposition to be able to debate on the subject.” It is his duty as a Model Senator – and as a future educator – to engage fully and openly with others when there is disagreement. The work of his Model Senate mentors in constructing real dialogue has deeply impressed him. “I’ve seen this here more than I’ve seen it anywhere else.”

Founded over two decades ago, the Model New York State Senate (Model Senate) is fi rmly ensconced as a CUNY institution. Students from all walks of life have taken on the role of Senator, resulting in over 1,000 individual stories of learning, debate and policy.

Administered annually by CUNY’s Edward T. Rogowsky Internship (ETR) Program with the Puerto Rican and Hispanic Task Force of the New York State Legislature and the State University of New York (SUNY), the program hosts more than 60 CUNY and SUNY students for experiential learning.

Prior to the debate in Albany, students are convened for a series of sessions in which they learn about the functions and processes of legislative democracy and the realities associated with law-making in a diverse urban setting like New York. They also learn more general skills such as critical thinking, public speaking, and argumentation.

For many, it is their fi rst introduction to the policy-making process in New York State.

It is often not their last.

This political science major doesn’t believe in backing down from her convictions— but neither does she believe in tearing anyone down. “I have faced discrimination many times,” says the Puerto Rican student, “but those experiences can benefi t someone else that doesn’t have that voice right now.” Her decision to join Model Senate was spurred by her desire to better understand how opposing viewpoints can be forged into real compromise. “I want to refi ne my knowledge of politics and use it for the greater good.” The critical thinking Model Senate has provided are valuable assets. “Anyone can use the tools gained here. We would be a better society overall if everyone could apply them.” She is committed to a narrative in which more, rather than less, voices are heard. “You must consider the other perspective. This is the perfect setting to do that.”

Thanks to Model Senate, this aspiring guidance counselor is discovering new talents – within herself. “Before this, I probably wouldn’t have even thought about tapping into my potential with these skills.” The Liberal Arts major sought out the program to learn how to have positive impact on the young people she will work with in the future. “I want to infl uence them to make change in their neighborhoods as well.” Smith, who is also a dancer and artist, has found similarities in the diff erent spheres she occupies. “There’s a political dance, with a lot of steps. Through this learning experience, I feel like we’re creating a piece.” She appreciates the complexities of the debate ahead. “There is more to policy than a simple ‘yes’ or ‘no.’ Everyone should be able to learn for the sake of their communities.”

When Monsita Colón was six years old, she relied on classmates to translate the world around her. Now, she is majoring in Early Childhood Education to help others understand. “Having a child see someone like them in a classroom, they know there is a chance for them to do something better and bigger.” The wife and mother of three is proud of her Puerto Rican heritage and counts Justice Sonia Sotomayor as a role model. The Model Senate’s deliberative approach has sparked questions. “Who is going to stand up and make a diff erence? It’s not all black and white. Sitting in the Senator’s seat, you actually get to see the process.” The sophomore will represent Senate Majority Leader Andrea Stewart-Cousins, the fi rst woman to lead a conference in New York State – and a former educator. “She’s been in her Senate seat for 13 years,” marvels Colón of the pioneering legislator. “She has opened the door for all women.” She is looking forward to the bail reform debate. “Criminalizing poverty has been such a big issue. It’s holding us back in so many ways.” Colón is honing her debate skills, and fi nding her voice. “I am going to push through. What better platform than the New York Senate?”

Six months after becoming principal at P.S. 132, Wendy

Poveda noticed something unusual.

Members of the staff at the elementary school were bringing home and washing the clothes of students.

Approximately 25 percent of P.S. 132 Juan Pablo Duarte’s students suffer from housing insecurity, either residing in shelters or apartments that are overcrowded.

Some students would fail to come to school because they did not have clean clothes to wear, Poveda said.

“It impacts attendance, it impacts self-esteem,” she remarked.

A solution came in the form of suds.The school, located at 185 Wadsworth

Avenue, has installed an on-site washer and dryer to ensure that students have clean clothes.

The laundry room is the debut project of a new program – dubbed JPD Cares – designed to offer services and programming to aid families in need.

The machines were installed by Catholic Charities Community Services, Alianza Division (CCCS/Alianza), and will be free for families to use.

“Many of us take for granted that we can get

our clothes washed, but that was not something that could happen for many of the families here,” said Beatriz Díaz Taveras, Executive Director of Catholic Charities Community Services New York. “That does impact the students. It affects how they’re able to learn and how comfortable [they are at] school.”

Soraya Rodríguez, who has two children at P.S. 132, said parents have long been expressing how difficult it is to do laundry.

“We’re going to feel comfortable to come to school with the uniforms clean,” she said, thanking Poveda for bringing in the washer and dryer.

“This principal always thinks about the community,” Rodríguez said.

Poveda reached out to CCCS/Alianza to see if laundry machines could be provided, she said.

Your chance for justice should not be determined by the

change in your jeans.

In New York, especially in the Bronx, Washington Heights, Brooklyn, Harlem and Southeast Queens, bail had developed into a mechanism for keeping poor people locked away, even when they are still innocent under the law.

In 2020, New York State undertook an ambitious bail reform program that eliminated bail for most non-violent offenses and attempted to right some of the wrongs of decades of misguided criminal justice policy.

But a few groups have loudly expressed concerns about public safety in the wake of this new law, arguing that it allows dangerous criminals to simply “walk free” and threaten society with more criminal activity.

This is simply not true.Consider this for a moment: If an accused

person pleads guilty to the accusation, then, she or he will likely be released without a custodial sentence.

Essentially, this debate is not about safety. If it were, we would not let people who acknowledge criminal guilt and who are subsequently convicted walk out free.

The concept of using money as a condition for freedom is the complete opposite of who we are as a people—especially when data clearly indicates that low-income defendants consistently show up to court, even when their own money is not on the line.

According to the U.S. Census Bureau, Latinos only own about 9.1% of the housing stock in the Bronx. If you do not own a home, you do not qualify for collateral bond and are thereby subject to cash bail. On average, the lowest set cash bail is $5,000 The average Bronx household earns about $38,000 annually. That family would need to have more than four net biweekly paychecks saved in order to be able to bail out a loved one in need. Keep at the math, and you will quickly realize that the system is rooted in valuing your bank account instead of your life.

We will not go back.It is worth repeating some key facts.New York law has not allowed for

preventive detention based on a prediction of future “dangerousness” since 1971—a term which inevitably is weaponized against poor and minority defendants. Under the previous system, defendants with means could simply pay their bail and go home – regardless of how “dangerous” they had been deemed. In fact, long before the new bail reform took effect, it was an established practice that prosecutors and judges could consider only whether a person was likely to return to court as the basis for detention. Moreover, our state had already begun utilizing other, more just options besides bail to encourage people to return for their court dates.

We must also keep in mind that the prosecution retains complete control over charging decisions, and if a person is accused of committing an offense that is truly serious in nature, the charging decision would (and should) reflect that and therefore make the individual ineligible for bail and pretrial release.

We all agree that hate crimes must be handled with particular care and sensitivity. Anti-Semitism, homophobia, and other destructive prejudices have deep roots,

Estelle Gold Wing will present “On the Town: Past and Present,” an art exhibit by Washington Heights resident Kathryn Ruby. Owl wants a bold statement about art.

But the other animals have different things to say about love, life and loss.

A Barn Play by Lizzie Donahue is UP Theater Company’s latest offering. All of the characters are animals, mounting a theatrical production (costumes by Hunter Dowell). But everything changes when the lamb and the calf will be taken away in what the company describes as a “darkly comic fable” performed by a cast of farm animals.

Director Melissa Moschitto said working with seven actors authentically portraying animals on stage is both exciting and challenging.

“The actors are invested in making their animal characters fully three-dimensional,” she said. “No one has approached it like, ‘Oh, I’m just the cat.’”

The actors (who play a dog, sheep, cow, pig and a chicken) pay close attention to movement and vocal patterns. “It speaks to the notion of seeing the animals for

who they really are, and you realize that they are very individual creatures.”

Moschitto is also the Artistic Director of another uptown theater group, The Anthropologists. Its latest production, Artemisia’s Intent, will be performed downtown later this month. The play focuses on the life, work and words of 17th-century painter Artemisia Gentileschi, who worked in the style of Baroque painter Caravaggio, and who would become the first female member of the Accademia in Florence, one

of Europe’s first drawing schools.“This is a rare moment for

me to step away from my own company,” said Moschitto.

But Barn Play’s fable-like quality captivated her because its many themes are reflections of the political landscape and power structures.

Many on the play’s artistic team, including Moschitto, have

children. The idea of babies taken from their mothers brought up everything from animal rights to children separated from parents at the border.

“It is kind of devastating, thinking what it would look like if we lived in a world where humans and animals existed in a way where we didn’t rely on them as a food source, and

we respected them,” she said. “I think that extends to how humans treat each other.”

Reading the play, she couldn’t shake images of crying children in cages and separated families. “If we are willing to treat animals that way, we are willing to treat you that way,” she said.

The family separation is presented in a subversive way, said UP’s Artistic Director James Bosley. “And then there’s hope, and love.”

During the run of the play, the Thursday evening performances will have Spanish language translation available for audience members. “We were very fortunate that the Miranda Family gave us funding to do with as we wish,” Bosley said, referencing support provided by the Miranda Family Fund. “We are using that money to broaden our audience.”

Maritza Martínez isn’t giving up. The Liberal Arts major earned her nomination to the Model Senate program by working hard. “I’m an advocate and like to fight for people’s rights. I want to take advantage of opportunities like this.” Learning the finer points of argumentation fascinate her. “I’ve learned that people can be quick to judge instead of getting to know more about ‘why’ or ‘how’. It is not as simple as most people believe.” The Latina sophomore credits her parents for setting an example of tenacity for her and her siblings. “They never had the chance to go to college, so I’m going to show them that I will keep going. They have been through a lot and want the best for us.” There are, admittedly, difficulties. “I have dyslexia, so just grasping all of the information is a challenge.” But she is not deterred. “I have a system of keeping my own notes. I have my strategies.”

Getting involved in the Model Senate program was a “no-brainer” for Karen Báez, who is pursuing Jewish Studies and History. “It’s important to contextualize the past, the present and the future,” explains the Bronx resident. Báez, who is of Dominican and Nicaraguan heritage, actively pursues social justice reforms when not tackling the texts of Hillman and Freud in class. The Model Senate program’s analytical approach has refocused her thinking. “Getting into the statistics has helped me. If you don’t have the numbers, you are going to miss out on facts.” As she assumes the mantle of Model Senator, Báez says she is inspired by another young woman from the Bronx whose career she emulates: State Senator Alessandra Biaggi. “She is one of my major role models. I have been following her journey.” The immersion in policy-making has proven eye-opening. “Before, I thought it was all very abstract. But what we’re tackling here affects our communities and will determine the future.” And her own future is undeniably rooted in civic life. “Even if it’s being part of a community board, this is going to be a part of my life.”

“It’s important because our families are going to have a space where they can wash their clothes and also a place where they can gather,” said Eddie Silverio, Director of Catholic Charities Alianza Youth Services.

A case worker will soon be brought in to assess additional needs of families in need.

School leaders say that approximately 47 of the school community’s 195 families – nearly one-quarter – reside in shelters or overcrowded homes shared with extended family members.

“It goes beyond just the washing machines and we know that. It’s an opportunity to engage the families and talk to them,” Silverio said.

On February 27, the school and CCCS/Alianza hosted a ribbon-cutting ceremony for the laundry room.

“What we’re doing today is celebrating the dignity of every child, the dignity of every family in this school, acknowledging that in order to have a just city, a just education system, we need to take care of the basic needs of our students,” said Chris Caruso, Senior Executive Director of the Office of Community Schools. The machines will allow students in need to get their clothes washed more easily.

Poveda explained that P.S. 132 children will be able to bring their dirty laundry into school, where a school aide will wash the clothes and then send them back home with the kids.

“The students will have a little backpack with their name on it. Eventually we want to open it up to the families to come in to

get their clothes washed, which will also give them a reason to come into the school,” said Poveda.

The school is seeking donations of detergent and other laundry supplies, she said.

“It’s not just what happens at the school, but also what happens in the home,” added Díaz Taveras said. “That’s where bringing the case managers here, and being one with the teachers, with the guidance counselors... is so important.”

Manhattan Borough President Gale Brewer called P.S. 132 “ahead of the curve” for adding the laundry machines, and said it

was high time for more public schools to do the same.

She noted that P.S. 149 also installed a washer and dryer about four years ago. “It was the first time I’d heard of it,” Brewer said. “It changed the dynamic in that school.”

“When the clothes are clean, there’s no bullying,” she added. “I think it’ll help the teachers a lot.”

The laundry room at P.S. 132 is located near the school cafeteria, in a room formerly used as an office by CCCS/Alianza, which also provides students with Metrocards for public transportation and debit cards to buy food.

The plan is to eventually open up the laundry room to kids at Dos Puentes Elementary School, which shares the building with P.S. 132, Silverio said. He noted that it is rare to have washers and dryers in New York City schools.

“I believe this is the first [school] in the district to do this,” he said. “We’re looking at doing it in other schools that we partner with. I’ve already got emails from other places asking, ‘Can we do this for our school?’”

Northern Manhattan theater companies have proven to be a supportive community. UP Theater, People’s Theater Project and The Anthropologists all started around the same time. “We all talked about how do we make theater happen uptown, and how there needs to be more space,” Moschitto said. “It’s interesting to revisit those conversations and see how they are both of their companies have really done a tremendous job in carving out space and building an audience.”

Jane Martin-Lavaud, a member of advocacy group Families for Safe Streets (FSS), came to City Hall clutching a photo of her daughter Leonora, who was killed at age 24 by a speeding driver in 2013.

“There’s a cloud hanging over us that’s never going to go away,” she said.

Martin-Lavaud said she routinely witnesses reckless and speeding drivers on New York City streets, making it hazardous for pedestrians as well as drivers.

“Every time we go out, we are fearful,” she said. “Cars are whizzing by with no regard for what havoc they are wreaking.”

The new bill will establish a pilot program that will launch in February 2021 and run for three years, after which lawmakers will decide whether to renew or modify the program. The program is expected to affect between 3,000 and 6,000 vehicles, city officials said – less than

1 percent of the nearly 2 million vehicles registered in the city.

City Councilmember Brad Lander, who introduced the legislation, recalled the deaths of children Abigail Blumenstein and Joshua Lew near his Brooklyn district office in 2013.

but there is no evidence that setting bail on defendants accused of committing hate crimes will somehow correct their views and keep society safer. Hate crimes involving serious violence are still bail-eligible, and we should expect that justice ultimately will be served regardless of whether bail was initially set.

While I am certainly open to legitimate changes and improvements, we should not let fear-mongering lead to irresponsible changes such as incorporating judicial discretion or dangerousness.

Judicial discretion sounds great in theory, and assessing “dangerousness” makes sense without any context when assessing a possible criminal. However, ask yourself, if your child, your loved one, your friend was at the wrong place at the wrong time, should he or she be considered “dangerous”? Would you want the decision about their release left to judicial discretion?

The fact is, race, class, gender and power lead to different sets of rules.

Harvey Weinstein, a man known to be a prolific sexual predator, was able to fight his case from the comfort of his own home because he could afford to pay his bail of $2 million – less than five percent of his 2018 salary.

But on any given night in New York, thousands of mostly black and brown men and women—even those accused of minor offenses—remained in jail because they could not afford their bail.

While waiting for trial, people would lose their jobs, their children, their homes, and their sanity. That’s why Kalief Browder, a former constituent of mine, has become a poster child for everything that was wrong with our system. Kalief took his own life at the age of 22 – after

he spent three years fighting the charges while waiting at Rikers Island for trial with bail set at $3,000.

The charges were ultimately dropped by the prosecutor.

Under the old system, bail had effectively become a kind of ransom.

That has changed.We – as legislators – changed the

law last year to give them a chance. In the words of the modern-day

prophet Bryan Stevenson, “The opposite of poverty is not wealth. The opposite of poverty is justice.”

We must give New York’s bail reform a real fighting chance at success.

Let’s give all our people a chance to realize their destiny and not bail on bail reform.

Model Senators will take to Senate Chambers to wrangle over one

of the most contentious bills to come to the capital in years: bail reform.

The group will debate and vote on a bill that would amend the bail reform law that went into eff ect January 1 in New York State.

The Bail Elimination Act of 2019 (BEA-2019), passed last year by the state legislature, allows people accused of misdemeanors and non-violent felonies to avoid jail while awaiting trial. Among the most prominent backers of the reforms was Assembly Speaker Carl Heastie.

This year's Model Senate Bill, Model Bail Reform Act of 2020 (known as MS 24), seeks to correct BEA-2019 and would refi ne the previous legislation by instituting strict limits on time an individual may be detained based upon severity of crime charged.

“I urge people to wait, to see the good these new laws will accomplish,” Williams said at a recent rally. “People are spreading myths and misinformation about these reforms in order to try to claw back the progress that was made.”

Now, Model Senators will decide.
