COTU (K) neither filed its reply statement norappeared Juring thc ùearing as afbrestated and no reasons were givenfor its failure to ûle its reply statemtnt and non-appearance or absence,The dispute was therefore, heard ex-parte on the said date, i.e. 17thJanuary. 2002.

Mcssrs. Joash Amukayia. Philip Abong'o, Bernard A. Ludeshi andPaul Irungu (who arc hereinafter called the grievants) were employedby COTU ( K) on diverse dates as accounts clerk. senior clericalofficer. clerical officer-registry and accounts clerk-wages,rcspectively. ()n 30th October, l 995. thc grievants were suspendedfrom duty without pay. allegedly for committing $4a serious grossmisconduct and insubordination'' and on 17th November, 1995. thcirscrviccs were terminated with effect from 16th November, 1995* onpaymen! of one month*s salary in lieu of noticc. The union, however,intercedcd for the grievants. but no amicable settlcment was reachedbetwcen the partics. Consequently. the union reported a formal tradedispute to thc Minister for Labour who aqcepted the same andappointed Wandeto to act as the investigator. The Ministtr released hisreport to the parties on 1 st April, l 996. wherein he found that thetcrmiaation of ttte grievaats amounted to victimization and unfairlabour practice. and for this reason he rccommended t'that all the fourcmployees affected be reinstated back to their respective positionsunconditionally with no loss of benefits or service''. The Ministerfinally appealed to the parties to acccpt tht recommendation as a basisof scttlillg this dispute'. and by his Ietter, dated 2nd May. 1996. theSecretary Gcncral of' COTU ( K). Joseph J.
