The Friends of Alex Gromack, Account # C19500, is for Mr. Gromack’s campaign for Town Supervisor in Clarkstown, NY. On Jan. 11 2006, in the January 2006 Periodic Report on Schedule G, Transfers In, there is a transfer of $661,892.03 from the Friends of Alex Gromack, Account # A01272 (see attached). Account # A01272 is for Mr. Gromack’s campaign for NYS Assembly. Mr. Gromack was a NYS Assemblyman prior to running for the position of Town Supervisor in Clarkstown, NY. It should be noted that the maximum contribution for the position of NYS Assembly is greater than the maximum contribution for the position of Town Supervisor in Clarkstown, NY. Therefore, the transfer from Mr Gromack’s Assembly campaign account in the amount of $661,892.03 to his Town Supervisor campaign account is an over contribution and he must return the full amount immediately. In addition, Mr. Gromack’s filing for his Assembly campaign account (Account # A01272) improperly recorded the transfer out. On Schedule H for the 2005 Off Cycle Report for Account # A01272 there is a Transfer Out recorded in the amount of $549,857.43 on Jan. 18, 2005. The following problems arise upon reviewing these transactions: - The Transfer Out from the Assembly Account occurred a year prior to the Transfer In on the Town Supervisor Account; - The dollar amount for the Transfer Out from the Assembly Account does not match the dollar amount for the Transfer In recorded on the Town Supervisor Account; - The Assembly Account still shows a closing balance of $66,365.64 in the last filing for that account which was the July 2006 Periodic Report.

Dear Ms. Sugarman,

I am writing to file a complaint against the Friends of Alex Gromack, Account # C19500. The Friends of Alex Gromack, Account # C19500, is for Mr. Gromack’s campaign for Town Supervisor in Clarkstown, NY. Account # A01272 is for Mr. Gromack’s campaign for NYS Assembly. Mr. Gromack was a NYS Assemblyman prior to running for the position of Town Supervisor in Clarkstown, NY.

It should be noted that the maximum contribution for the position of NYS Assembly is greater than the maximum contribution for the position of Town Supervisor in Clarkstown, NY. Therefore, the transfer from Mr Gromack’s Assembly campaign account in the amount of $661,892.03 to his Town Supervisor campaign account is an over contribution and he must return the full amount immediately.

- The Transfer Out from the Assembly Account occurred a year prior to the Transfer In on the Town Supervisor Account;

- The dollar amount for the Transfer Out from the Assembly Account does not match the dollar amount for the Transfer In recorded on the Town Supervisor Account;

- The Assembly Account still shows a closing balance of $66,365.64 in the last filing for that account which was the July 2006 Periodic Report.

- And if my math is correct there was an additional $112,034.60 recorded as being transferred into Mr. Gromack’s Town Supervisor account than was transferred out of his Assembly account.

So in addition to making Mr. Gromack return the $661,892.03 from his Town Supervisor account to his Assembly account I would like to know why the dates of the transfers do not match and why the dollar amounts do not match. And where did the additional $112,034.60 come from and why isn’t it properly recorded?
