The purpose of this letter is to request approval to create a multi-way stop signintersection on Paul Minnie Avenue at Bostwick Lane. My office has received severalcomplaints regarding traffic operations at this three-legged intersection which iscurrently stop sign controlled on the Bostwick Lane approach only. Bostwick Lane isthe main access road into Green Acres Elementary School and serves some residentialhomes but is not a County maintained road. Parents, school employees, and residentswho utilize this private street have requested a safer environment for students to crossPaul Minnie Avenue using the existing crosswalk and for motorists to enter Paul MinnieAvenue from the schooL. A petition (attached) has been submitted signed by at least 50residents requesting the stop signs be installed to help address speeding problems atthe intersection.

The Department of Public Works has reviewed the intersection and has indicated itdoes not meet State warrants for a multi-way stop and therefore they cannotrecommend it to the Board of Supervisors at this time. However, it is important toprovide safe access for schools and livable streets to residents within the communityand the multi-way stop signs would help meet that goal. A map with the proposed multi-way stop intersection plan is attached for your review.

Accordingly, i recommend that the Board take the following actions:

1. Adopt in concept the attached ordinance creating the multi-way stop

The Board of Supervisors of the County of Santa Cruz does ordain as follows:

SECTION I

The provisions of Section 9.28.030 of the Santa Cruz County Code related toStop Intersections are hereby amended to read as follows:

Paul Minnie Avenue and Bostwick Lane (three-way);

SECTION II

This ordinance shall take effect on the 31 st day after the date of final passage.

Comments:In the petition for a multi way stop at the intersection of Paul Minnie and Bostwick while using the currentcrosswalk to make it safer for students to cross Paul Minnie to Bostwick is a false statement. The crosswalk thattraverses Paul Minnie to Bostwick traveling from west to east leads directly into a large set of hedges. Alsothere is no sidewalk on the east side of the street, which would force students and adults to walk in the streetwithout the added protection of a sidewalk.Plus, the petition states that it has at least 50 signatures of residents who live on Paul Minnie and Bostwick. Thisstatement is also false. Two people whose signature appears on the petition deny signing the petition or areaware of its existence, 2 other signatures live over 1?4 mile away and the third "resident" lives in Capitola Ca.I'm not saying that there isn't a speeding issue on Paul Minnie, because there is. I'm saying that maybe somemore time should be invested to make sure stop signs are the best and most appropriate action.

Comments:My name is Soren Coats and I am a home owner on Paul Minnie. My home is located on the Northwest comerof Paul Minnie and Bostwick making me one of the most affected homes with the installation of this proposedstop sign.

I believe the item before you is simply a knee jerk reaction without due process or adequate investigation to acomplaint by another resident on our street to a long st anding issue that all neighborhoods in Santa CruzCounty experience, which of course is speeding. I can't stand here and unequivocally say that there are notspeeders on our street but I can tell you that the problem here is no more than any other neighborhood in thearea.

The issue that I have is that by installing a stop sign without the requisite traffic study associated with such aninstallation would simply be trading one problem for another. The traffic on Paul Minnie would come to avirtual standstil during school hours making it near impossible for ANY resident in the area to get in or out oftheir driveway.

Thank you Supervisor Leopold for attempting to tackle this problem, however in your letter regarding this issuethere are a few statements that I would like to correct that would help you make a more informed decision onthis important matter.

Item 1. It states Bostwick lane is the main access to the school, this in not completely factual. There is equalaccess from the other side of Bostwick which is not a residential street and is a larger street with less vehicles.

Item 2. It states this would make it a safer environment for students to cross Paul Minnie using the existingcrosswalk. Again, not completely factual, the existing crosswalk goes right into a large hedge. Additionally, theopposite side of the street does not have any sidewalks the entire length of Paul Minnie, this would forcestudents to walk in the street itself which I think we could all agree is completely unsafe.

Item 3. The petition is signed by 50 residents. While on the surface this appears accurate however a largenumber of those signatures are not homeowners but renters in a neighborhood with a high turnover rentalcommunity. Additional, only 28 of the signatures are from residents of Paul Minnie and Bostwick, the rest arefrom 2 dead end streets at the opposite side of Paul Minnie, over 200 plus yard away as well a s few fromstreets not even in the area. 1 person who appears on this petition denies ever even signing it.

0780Lastly, The state of California Department of Transportation 'Manual on Uniform Traffic Control Devices forstreets and highways' states "A traffc control device should not be installed unless a engineering study indicatesthat installing a traffc control device will improve the overall safety and/or operation of the intersection" ....

Have we completed a traffic study for the area?Have we completed a radar study for the speed of the street?Have we discussed the impact to the response times for the fire dept for the area?Have we discussed this issue with the school board to ascertain whether they are in support of such a drasticchange to the flow of traffc?

Even our own Dept. of Public Works has reviewed this intersection and are NOT recommending an installationof a stop sign as this intersection does not meet State Warrants for a multi way stop sign. One of which is anusually large amount of accidents at said intersections, in my 12 years at this location there have been only 2accidents both extremely minor in nature involving property damage only. There are some p'ublished studiesfrom other jurisdictions which can easily be googled on the Internet surmising that the installation of stop signcan increase the danger to an intersection rather than the intended effect of reducing it.

I simply ask that we don't rush to a decision today and do our due diligence by completing all the necessarystudy's associated with this decision.

Speeding is a problem, stop signs are not the solution.

Comments:I am a resident of Paul Minnie A venue and I directly oppose the adoption of an ordinance amending Section9.28.030 of the Santa Cruz County Code relating to the proposed multi-way stop intersection at Paul MinnieA venue and Bostwick Lane.

I reside at 2441 Paul Minnie A venue. I was neither informed about/asked to sign the petition nor informed ofthe proposed ordinance. Other residents of Paul Minnie Avenue were not infonued about/asked to sign thepetition and were never made aware of the proposal for the multi-way stop intersection.

While I agree that speed is an issue, I disagree that safety is an issue. There is no record online listed under thepolice, the city, or the county for any accident involving a pedestrian. In the eight years that I have resided here,I have neither seen, heard about, or been informed of any accident.

If the proposed multi-stop intersection is passed, I will be unable to enter or leave my driveway. This willdirectly affect my ability to go to work, earn an income, and provide for my family. Additionally, it creates asafety issue if an emergency were to arise. Other families will be similarly impacted. Unlike the letter from JohnLeopold stated, this will tum a liveable street into an unliveable street.

The person who began the petition (Carolyn Tyler) stays at home all day and walks or rides her bike w hen sheleaves. Even though traffic wil be blocking her driveway due to the proposed multi-stop intersection, she wilnot be impacted due to her lifestyle, and thus cannot be an accurate measurement for impact.

I believe the proposed multi-stop intersection will fail to impact speed because people will stil drive quickly toand from the proposed stop. There wil be an increased risk of accidents as an increase in stopping wil lead toan increased chance for rear-end collisions due to drivers failing to break at an appropriate time, failed breaks,and similar issues. There will also be increased noise at all hours and a decrease in property values.

The proposed multi-stop intersection is flawed because the crosswalk leads to a 10' hedge belonging to aresident of Paul Minnie A venue. No sidewalk exists. The proposed intersection creates a safety issue because itwould encourage students to cross the street and walk in the street because there is no sidewalk f or them towalk on.

There is a health care and rehab facility located on Paul Minnie Avenue that will be directly affected by backedup traffic that will occur due to the proposed multi-stop intersection. This creates a health and safety issue.

0788As residents and renters can park on both sides of the street, this leaves a narrow corridor for two-way traffic.Emergency vehicles, and therefore safety, will be impacted as traffic back-ups at the proposed stop sign willimpede emergency response.

I also have several concerns about the signatures collected on the petition, including:

* Many of the people who signed the petition are renters. The person who collected the signatures (CarolynTyler) has mentioned to me previously that she owns rental property. i believe the signatures should beinspected to see if any of them belong to her tenants and to see if she exerted undue influence or other means ofcoercion to acquire the signatures. Additionally, bec ause the signatures are from renters, they are transients andare less likely to be impacted by a multi-stop intersection and, due to their transient nature, it is quite likely thatpeople who signed the petition no longer live in the area. For example, this past week, renters near where thisproposed stop sign is to be placed just moved out.

* Twenty-one of the signatures collected for the petition are from people who do not live on Paul MinnieA venue, and will not be impacted by the proposed multi-stop intersection.

* Three times, there appear two signatures from people who reside at the same address (Signatures #2 and 4belong to J iI Yamashita and Zachary Yamashita at 2460 Paul Minnie A venue, Signatures #23 and 24 belong topeople who reside at 2280 Paul Minnie Court (signatures illegible) and Signatures #28 and 29 belong to KenRockas and Kurt Anderle at 2350 Paul Minnie A venue). This overinflates the actual number of concernedfamilies by making it appear there are more families listed than there actually are.

* The names of two people are listed who did not sign the petition (Paul Cogswell and Rick Rice, Signatures # 1and 3 respectively). Their names were typed on the petition and it cannot be assumed that they support theproposed multi-stop intersection due to the lack of signatures. I question whether the entire petition is invalid asa result.

* One signature is from a person who lives half a mile away and thus is inaccurately described as a resident, andis not directly impacted by the proposed multi-stop intersection (Signature #50 belonging to Sherry Lee Bryanat 2345 17th Avenue).

Wouldn't it be simpler and more cost effective to have the police department do its job and enforce the speed onPaul Minnie Ave? This would bring needed revenue into the county and, unlike the proposed multi-stopintersection, would not negatively impact multiple families, the neighborhood, and the Santa Cruz Countybudget.
