WHEREAS, a building permission has been granted in favour of Ghulam Mohammad Bhat S/o Abdul Qaffar Bhat for construction of double storied residential house in the year 2012 vide Building Permission No. 545 of 2012, dated:- 03-10-2012 on the specific terms and conditions as indicated in the sanctioned plan.

WHEREAS, you have constructed column structure in violation of the sanctioned plan for which the BOCA has already initiated action under section 7 of COBA.

WHEREAS, you have assailed the demolition notice under section 7 (3) bearing No. SMC/Enf 1874-77, dated: - 31-08-2013, by way of appeal before the Appellate Authority J&K Special Tribunal.

WHEREAS, the Hon’ble Special Tribunal passed status-quo order on 03-09-2014 to be maintained on spot by the parties with a specific direction to you that no further construction of any nature shall be carried out by you on spot, for which you have submitted an undertaking before Appellate Authority.

WHEREAS, despite of submitting the bond/undertaking before the Appellate Authority, you have violated the Court Orders and carried the further construction at site as reported by the Ward Officer, Ward No. 29 vide his No. SMC/W-29/363-66, dated: - 22-03-2014 and SMC/W-29/367-71, dated: - 22-03-2014.

WHEREAS, the Appellate Authority J&K Special Tribunal has dismissed your appeal on merits on 18-02-2014.

WHEREAS, the structure was under construction and the work was going on after enact of Civil Law (Special Provision), 2014, i.e. on 05-03-2014.

Now you are hereby called upon to Show cause as to why the structure raised in violation of master plan, sanctioned plan and Court Order shall not be sealed within 10 days from the date of publication of this notice in the newspaper, failing which an order under section 8 of J&K Controlling Operations Building Act, 1988, shall be passed for sealing of your aforesaid structure.
