George Hampel AM QC George Hampel is a Professor of Trial Practice and Advocacy at Monash University and is the founding chairman of the Australian Advocacy Institute and the International Institute of Forensic Studies at Monash, now known as the Monash Forensic Studies Program. He spent many years as a barrister prior to his appointment as a Justice of the Supreme Court of Victoria, a position he held from 1983 to 2000. Throughout his career, Professor Hampel has been chair of a number of legal education administrative boards. His advocacy and expert witness training experience extends over 30 years and across many international jurisdictions. “The GCFS built on my existing knowledge of the judicial system and provided me with a deeper understanding of all facets of the expert witness role. Completing the course has improved my confidence in appearing as an expert witness as well as enhanced my skills in the preparation of reports. Being partly online, it provided flexible study options with full access to the lecturers. Structure and deliveryThis part-time course runs over nine months and combines seven days of face-to-face sessions with online learning. The practical and interactive nature of the course encourages students to apply the knowledge and skills they have learned in the classroom to real-life problems. Students are given the opportunity to undertake trial practice and are able to review their performances and receive continuous feedback.

Course content

The expert witness in the adversary systemStudents explore the important and unique position of the expert witness in the adversary system. This includes analysis of legal and ethical issues in expert evidence, court rules and professional standards and obligations.

Pre-trial preparation and analysisParticipants examine and experience effective techniques for taking instructions, analysing materials and preparing reports which are compliant with the rules of evidence and up-to-date court practice. Students will also confer with lawyers and examine how to approach expert evidence most effectively.

The Graduate Certificate in Forensic Studies (Accounting) has been designed specifically for accounting practitioners who may be involved, or who wish to be involved in litigation.

This course is particularly relevant for professionals who interact with the legal profession and for those who are required to give expert evidence in court. It is also appropriate for those who wish to move into the forensic field or update their skills in this ever-growing area.

This postgraduate qualification was developed for accounting practitioners by Monash Law School’s Forensic Studies Program in conjunction with the Australian Advocacy Institute and the Institute of Chartered Accountants in Australia (ICAA).

The course was developed some years ago and is now a well-established qualification to enhance the skills of accounting professionals working within the expanding areas of litigation, dispute resolution, data analytics and fraud investigations.

Course objectivesParticipants in the Graduate Certificate in Forensic Studies (Accounting) will:

• Broaden their understanding of the forensic process

• Develop and enhance the skills required to present confidently and professionally in the courtroom

• Expand current techniques relating to analysis, preparation and report writing

• Engage in networking opportunities with other practitioners

• Gain a qualification which demonstrates a strong commitment to forensic practice

Loss, causation and damagesStudents examine issues of law relating to negligence, causation and damages, with particular reference to the problems facing expert witnesses in understanding and dealing with these issues.

The expert witness in the courtroom (assisted by the Australian Advocacy Institute)This practical workshop involves participation in mock trials and enables students to build on their existing strengths, increase courtroom confidence and learn strategies for coping with examination and cross-examination. Through this practical training, students learn how to effectively prepare and use materials to assist in the presentation of evidence.
