PUBLIC NOTICE

Applications are invited from practicing advocates, havin g experience in criminal matters, for engagement as Special Public Prosecutors (SPPs), to represent the Income Tax Department before the Courts of Sessions a nd its Subo rd inate Cou r ts in Chandigarh and Districts of Mohali and Ropar in Punjab in Prosecution ca ses. Advocates, who a re en rolled as members of the State Bar Council a n d have sufficient experience in dealing with crimi nal matters, a re invited to apply. Preference would be given to advocates h a ving experie nce in deali n g with Income Tax/ Direct Tax matters. The e ligibility terms a nd conditions are as per Instruction No. 6/2016 dated 07.09 .20 16 issued by the Government of India, Ministry of Finance (Department of Revenue). Centra l Board of Direct Taxes, New Delhi. The terms and Schedule of fees payable to Prosecution Counsels will be as per the Instruction No. 6/20 16, F. No. 279/Misc/ M-77/20 11-ITJ dated 07.09.2016.

2.3.1 I he performance of thc SPPs shalt he rev ic .... 2.3.2 The CCIT shall submit a proposal for renewal of period of engagement to the l::loarJ at least Ihrce monlhs before tbe e);piry "r the term, if the pertbrmant:e uf Iht.\ SPP is found to be satisfactory. The performance nppmi:::al should be sent along with the proposal in Profomla­P3. The L'eneW~11 or the lenn shal l normally be fo r t1 pcriod of 3 years.

2.4 Allocation of cast's tit Special Public Prosecuturs

The CCIT shal l be the overall in charge of entire proseculion work 011 behalf of the lncornel ax D~purtm~nt in his Region. Work allocation amongst the SPPs in aPr. CCIT Region :::ha!1 be done by the CCIT/DGiT. Howc,,·cr. a copy of the list of SP I)s and the cases assigned to thenl shall al,so be forwarded to the e fT (1)!Addl en (J)I Technical in the 0 /0 the Pl'. CelT fo r maintaining a cC'lltmiized database for prosecution ca'ies in the Region.

2.~ T~I'minatiou of eogag~mcnllresjgnlttion/e1piry of tent!

The engagemem of SPP can be tcnuinatoo through wriUrn intimation by either side wilhout assigning any reason. The celT is oUlhorized to act on behalf of the: depa rtme:nt for the purpose. On c.xpiry of the renn or lenninalioll or resignation, the SPP shal l immediately handovcr thc briefs and other related l)"dPCrs to the Pro CITlPr. DIT/CITIDIT concerned or the other SPPs nominated by the CelT for the purpose fi nd the pending bills of Ull: Sl'P should be $e(t!~d within three mouths of the end of the lenn.

2.6 Outies of tht' Special Public Prosecutors

Duties of the Special Public Prosecutors shaH include:

(i) To represent l~e. Deportment personally and effecti vely Ul conduct of trial for prosecution m;ltte~ in thl! Trial emu-tsl Courts of Session.

(iil To give opinion whe n it is sought about the feasibility of fil ing a prosecution case or an) other l)rOSeclition matter.
