Escalation of a tussle betweenjudiciary and Government overappointment of judges for highercourts and rumblings within theCollegium over its “opaque”working dominated high-voltageevents in 2016 in the SupremeCourt, where the ModiGovernment suffered huge embar-rassment over central rule inArunachal Pradesh andUttarakhand.

The Government was alsokept on tenterhooks after the tele-vised announcement by PrimeMinister Narendra Modi todeclare Rs 500 and Rs 1,000 notesas illegal tenders, with the apexcourt regularly expressing concernover its impact on the people andasking inconvenient questions.

Though it refused to tinkerwith demonetisation, a batch ofpetitions challenging the move hasbeen referred to a five- judge con-stitution bench for an authoritativepronouncement.

Besides getting the flak ondemonetisation, the BJP-led NDAgovernment also got a shock treat-ment from the apex court forimposing President’s Rule inArunachal Pradesh andUttarakhand, even as it wasengaged in a war of words withthe judiciary over appointment ofjudges for higher judiciary witheach accusing the other of cross-ing the ‘Lakshmanrekha’.

The turf war between themthat had begun last year after thequashing of the National JudicialAppointment Commission

(NJAC) Act escalated this year asthe court first threatened to take upthe issue of judges’appointment inthe judicial side but later took up aPIL and blamed the Centre forbringing the judiciary to a “grind-ing halt”.

Emotion and high drama werewitnessed over the issue asJustice T S Thakur, who willdemit office as Chief Justice ofIndia on January 3, broke down

at a function attended by thePrime Minister while complain-ing about huge vacancies in judi-ciary.

He made light of the constantplea of the Centre that it was thecollegium which was not finalis-ing the Memorandum ofProcedure (MoP) on appointmentof judges, saying non- finalisationof MoP was no ground for notappointing judges. (PTI)
