For

Study on "Working and Reorganization of Central Public Work Department(CPWD) "

The Ministry of Urban Development, Government of India proposes to engage areputed agency for conducting a study on "Working and Reorganization of the CentralPublic Works Department (CPWD)".

Interested agencies should provide information demonstrating that they have the Technical& Financial required strength, past experience in carrying out similar activities and keypersonnel with the relevant experience.

The short listing process will be undertaken to identify a panel of 10 agencies to whomRequest For Proposal (RFP) will be issued.

The Ministry of Urban Development, Government of India proposes to engage a reputedagency for conducting a study on "Working and Reorganization of the Central PublicWork Department (CPWD)".

2. Background and Objectives

CPWD came into existence in 1854. It is functioning as an attached office of Ministry ofUrban Development, Government of India. It is the premier Public Works Organization ofthe Government of India and primarily undertakes construction of Government projects.CPWD provides comprehensive building construction management services includingplanning, designing, estimation, evaluation of bids, finalization of contracts, defendingarbitration and court cases. Its activities are spread throughout the length and breadth ofthe country. It also undertakes the projects of Autonomous Bodies and Public SectorUndertakings as Deposit Works. It also functions as Technical Advisor to the Governmentof India and has expertise in all fields of building construction namely Architecture, CivilEngineering, Structural Engineering, Electrical and Mechanical Engineering andHorticulture. It is proposed to carry out a study on "working and reorganization ofCPWD" with the aim to enhance the functional efficiencies and delivery capabilities ofCPWD in the contemporary context.

3. Scope of Work & TOR

The evaluation study would cover the following and any other issues incidentalthereto:-

i. Study in detail the working of CPWD keeping in view its mandate andfunctions.

ii. Carry out an analysis of the structure and organization of CPWDconsidering all the verticals viz. original works, deposit works,maintenance functions, technical advisory functions etc.

iii. Carry out a comparative analysis with similar / comparable CentralGovernment organizations in the Government such as MilitaryEngineering Service, Border Roads Organization etc. as well as PublicSector Undertakings in the field of civil/electrical construction.

iv. Examine recommendations made by various committees/bodies in thepast regarding working ofCPWD.

v. Recommend different options for enhancing efficiency andeffectiveness of the organization, including but not limited to thefollowing:

(a) Hive off the maintenance functions of CPWD to be vested in aSection 25 not-for-profit Company to be constituted as a whollyowned subsidiary of CPWD.

(b) Constitute CPWD as an autonomous Central Works Board on thelines Railway Board.

4. Criteria for Evaluation.

1. The agency should be a firm /company registered/incorporated in Indiaunder the Companies Act, 1956/autonomous institutions/centralgovernment institutions.

2. Experience of at least five years in conducting such evaluation! studies atvarious levels -national, state and district levels. The agency should havecarried out studies of at least two Government Departments / SemiGovernment / Autonomous Bodies / Public Sector Undertakings of Govt. ofIndia on the request!order of the concerned Ministries/Departments ofGovt. of India.

3. An annual turnoverlbudget (in case of institutions) of at least Rs. 5 crorefrom consultancy business /per annum during the last three years, to besupported by audited Balance Sheets, Profit & Loss Account, Receipt andPayment Account, etc.

4. Should have technically and managerially qualified and experienced in­house resource base.

5. The agency should not have been blacklisted by any Central/StategovernmentlPublic Sector Undertaking!Autonomous bodies under Centraland State Governments in India during last 5 years.

6. The Agency should have adequate number of personnel/resources tocomplete the task within stipulated time.

7. The agency should have or be able to depute its personnel in Delhi tofrequently interact with CPWDlMinistry officials to ensure timelypreparation of the study.

5. Evaluation of Applications:

(a) The applications will be evaluated on the basis of the parameters mentioned below:

b) The minimum score for short listing of the agencies is 50 marks out of 100.However, out of the agencies securing 50 marks or more, ten (10) top scoring agenciesshall be short listed and the RFP documents be issued to those short listed agencies.

c) The RFP will be issued to short listed firms for selection on Quality and Cost BasedSystem (QCBS).

6. Disqualifications

Ministry of Urban Development may at its sole discretion and at any time during theevaluation of Proposal, disqualify any respondent, under the following circumstances:

1. The agency has submitted the proposal documents after the responsedeadlines.

2. The agency has been involved in litigation that may have an impact ofaffecting or compromising the delivery of services as required under thisExpression of Interest.

3. The agency has made misleading or false representations in the forms,statements and attachments submitted in the Expression of Interest;

4. The agency has exhibited a record of poor performance such as abandoningworks, not completing the contractual obligations properly, inordinatelydelaying completion of projects or financial failures, etc. in any project inthe preceding three years;

5. The agency has submitted a proposal that is not accompanied by requireddocuments or is non-responsive;

6. The agency has failed to provide clarifications related thereto, wheneversought;

7. The agency has been blacklisted by any Central/State government/PublicSector Undertaking/Autonomous organisation under Central/StateGovernment.

8. The agency has submitted more than one Proposal (without withdrawingprevious proposals).

9. Any form of canvassing and attempt to influence.

7. Time-Frame

The draft of the report will be submitted to the MoUD within eight (8) weeks fromthe date of awarding the work. The final report, in thirty copies (hard as well as soft in theform of CD), will be submitted within twelve (12) weeks from the date of awarding thework. No extension of time for submission of report would be granted unless inexceptional circumstances as deemed fit by MoUD.

8. DeliverablesThe Consultant shall submit the Draft Report and Final Report along with ExecutiveSummary and Final Recommendations on the different options for enhancingefficiency and effectiveness of the organization, including but not limited to thefollowing:

(a) Hiving off the maintenance functions of CPWD to be vested in a Section 25not-for-profit company to be constituted as a wholly owned subsidiary ofCPWD.

(b) Constitute CPWD as an autonomous Central Works Board on the lines RailwayBoard.

9. Mode of Payment

The Consultant shall be paid for its services as per the Payment Schedule indicated below:(i) No advance payment shall be made.(ii) 40% of the contract value on submission of Draft Report & its acceptance by MoUD.(iii) 60% of the contract value on submission of Final Report and its acceptance byMoUD.

The MoUD shall cause the payment due to the Consultant to be made within 60 (sixty)days after the receipt by the MoUD of duly completed bills with necessary particulars.

All payments under this Agreement shall be made to the account of the Consultant as maybe notified to the MoUD by the Consultant. Disputes if any is to be referred to Secretary,MoUD.

Note: MoUD will not reimburse any expenses incurred by the applicant towardspreparation of the tender document, traveling cost, boarding and lodging incurred forattending any pre-bidlbid meeting or visiting MoUD's office for making the presentation.MoUD shall, in no case, be responsible or liable for any such costs whatsoever, regardlessof the outcome of the tender process.

10. Penalty

I. Delay on part of the Agency will invite a penalty @ I % of sanctioned cost perweek after stipulated period. However, this shall be limited to a maximum of 10% of thesanctioned cost and shall be deducted from IlIrd instalment of the Agency's bills.

2. In case of leaving work incomplete, or unacceptable level of slow progress, ifExpert Committee recommends so and Ministry accepts, the agency may be relieved of thejob and the task may be got carried out by the agency next in the line at the time of awardof work based on financial bids at the cost and risk of the first agency.

3. In unavoidable circumstances, considering the poor performance of agency,Ministry may initiate action to blacklist the agency for participating in tenders of Ministryor Central government for next 3 years.

11. Submission of application

Last date for submission of EOI is 12th December, 2016 by 15.00 Hrs, 1ST. Theapplication shall be uploaded on the web postal www.eprocure.gov.in duly digitallysigned. No physical submission of applications shall be accepted. The agencies areadvised to indicate their response in the same order as indicated below for easy scrutiny.

12.1 Heading: Application for Expression of Interest (EOI) for study on working andreorganisation ofCPWD, MoUD

12.2 Format for letter of application (Appendix I).

12.3 A Format for details of applicant including financial background (Appendix II).

12.4 A profile of the agency clearly delineating the domain specificexpertise/experience of the agency (Appendix III).

12.5 Profile of key persons (Core team), of organisations having relevant domainknowledge who would be assigned with the above mentioned task (Appendix IV).

12.6 Initial understanding of the nature and scope of the consultancy, and the resourceswhich they possess that, in their opinion, makes them particularly suited to execute theconsultancy (Appendix V).

12.7 Format for affidavit certifying that consultancy/organisation is not blacklisted(Appendix VI).

13. List of documents to be submitted

1. Copy of registration certificate of the company along with Memorandum ofUnderstanding.

2. Audited Balance Sheets for the last 3 financial years indicating Profit & LossStatement, details of service tax paid.

3. IT/Service Tax Return Statement for the previous 3 years.4. Work orders issued by public/private sector organizations supporting the claim of

overall continuous experience in the field of study.5. Work orders in respect of2 completed projects undertaken in the last 5 years in the

field of study6. CVs of the Core team of Experts to be deputed for the project along with certified

copies of testimonials and undertaking of their availability for entire period of theproject.

7. Proof of awards or other recognitions in the field of study given by government orother institutions.

8. Detailed list of full time staff of the agency indicating their position andresponsibilities.

9. Annual Report of the agency for the last three years.

10. Proof of office In Delhi or NCR or an undertaking to set up the same inDelhilNCR.

Other Terms and Conditions• The EOI shall remain valid for a period of not less than 120 days after the deadline

stipulated for submission. EOI, with a shorter validity period, is liable to berejected as non-responsive.

• The EOI should be submitted under the signature of the authorized signatory of theagency.
