In continuation to Government Order No. 131-F of 2011dated 28-04-20 I I, it is hereby ordered that the State GovernmentPensioners/Family Pensioners shall be allowed Dearness Allowance onPension/Family Pension as under :-

(iii) Other provisions governing the grant of Dearness Allowance onPension/Family Pension such as the regulation of DearnessAllowance during employment/re-employment, where more thanone pension is drawn etc. and other provisions of the existing rules/orders (as are not in contlict with the provisions of this order),shall continue to remain in force.

In supersession to Government Order No. 08-F of 2011 dated18-01-2011 and G. O. No. 123-F of2011 dated 25-04-2011, it is herebyordered that :-

1. The entire amount of pension revision arrears payable, shall bepaid to State Pensioners/Family Pensioners in five equal annualinstallments spread over a period of five years from 2011-2012onwards.

2. Pension revision arrears payable in favour of such of the StatePensioners/Family Pensioners whose age is 90 years or aboveshall be paid in two equal annual installments during 2011-12and 2012-13.

3. The residual portion of commuted value of pension and that ofDCRG in favour of State Pensioners/Family Pensioners who haveretired between 01-01-2006 to 30--06-2009 shall be paid in twoequal annual installments during 2011-12 and 2012-13.

4. 50% of the residual portion of cash in lieu of leave salary shallbe paid in 2011-12 in one go and remaining 50% thereof, shallbe paid in four equal annual installments spread over 1\ periodor four years from 2012 1J,

While releasing initial installment of pension revision arrearsresidual portion of gratuity, commuted value of pension and cash inlieu of leave salary, Treasury Officers and Drawing and DisbursingOfficers shall ensure adjustment of amounts, if any paid, under G. O.No. 08-F of 20 II dated 18-01-20 II and G. O. No. 123-F of 20 11 dated25-04-2011.

SRO-35.-ln exercise of the powers conferred by proviso to section124 of the Constitution of Jammu and Kashmir, the Governor is pleasedto direct that the General Provident Fund Rules, Samvat, 1981, beamended as under :-

I. In rule 8 C. (1).-

after the existing proviso to clause (i ii), the following proviso shallbe added :-

"provided further that subsequent non-refundable withdrawal fromthe fund can be granted only after the expiry of six months from thedate of the previous withdrawal ; and

In rule 11.-

for the figure and word "48 installments", wherever occurring, thefigure and word "36 installments" shall be substituted with effect from()1-04-20 12".

Whereas the retired employees ofPDD/PDC/lrrigation/Mechanicalind Civil Engineering Departments who have partly worked in capacityof work charge, whole time contingent paid or DRWs before theirregularization, represented to the Finance Department for counting oftheir entire un-regularised service for grant of pensionary benefits onthe retirement. .

Whereas the demand put forth, was examined in the FinanceDepartment and found that rules are amply clear on the subject whichinter alia provide that work charged, whole time contingent paidemployee including daily rated workers followed by regular service, 50%period of such service is to be counted as qualifying service forpensionary benefits on retirement. Such service is regulated under Art.177-A of J&K CSR Vol (I) which reads as under :-

"Notwithstanding anything contained in Art. 177, a work chargedemployee/wholetime contingent paid staff including daily ratedworker(s) [excluding casual/seasonal worker(s)] who is/arebrought on regular establishment and retires/retire without havingh, ~n declared substantive or quasi-permanent, shall be allowedto count 50% of his/her work charged/contingent paid serviceas qualifying fOI pension together with the period of servicerendered in regular establishment. If the total of two spells is20 years or more, he will be eligible for pension under thepreceding proviso."

Whereas the Finance Department disposed off the representationvide OM No. /\/36(94)-347 dated 16-9-2008. terming the demand asirrclcvnnt nnd unjustified as it might cucourugc othl'l' incumbents from

different corners to put forth the similar demands for counting ofunregularized service for pensionary benefits on the analogy basis.

Whereas these retired employees of PDD/PDC/lrrigation/Mechanical and Civil Engineering Departments filed the petition beforethe Hon'ble High Court and challenged the view of the FinanceDepartment as conveyed vide OM No. A/36(94 )-34 7 dated 16-9-2008to Principal Secretary, Social Welfare Department.

Whereas the Hon'ble Court disposed off the petition vide judgmentdated 24.10.2011 and quashed impugned OM No. A/36(94)-347 dated16-9-2008, the operative part of the judgment is as under :-

"For the reasons discussed above, the writ petition is allowedand Office Memo No. A/36(94)-347 dated 16-9-2008 quashed.The respondents are directed to give fresh look to the mnucrhaving regard to the above observations and pass an order inaccordance with Rules within 30 days from the date the copof the judgment is served on the respondents."

Now, therefore, in compliance to above referred orders, therepresentation has been re-examined and found that there is 110

justification in the representation for counting of remaining 50% of DailyWage/Work Charge services towards pensionary benefits even in suchcases which have been, subsequently, declared substantive orquasi permanent.

Subject :-Conversion of Cost of Living Allowance (COLA) intoDearness Allowance.

Sir,

The erstwhile Government Lumber Undertaking (GLU) employeesworking in the State Forest Corporation (SF'C) are entitled to thepensionary benefits under the State after the retirement. But it has cometo the notice of Finance Department that while issuing LPCs in favourof these (GLU) employees, the SFC has not mentioned the componentof COLA in their LPCs as the Corporation has not been in a positionto release all the notified COLA installments to the employees due totheir limited resource position, thus, the DCRG of these employees hasbeen authorized by the Accountant General taking into account theirbasic pay only, excluding the COLA.

In this connection, the undersigned is directed to request thePrincipal Accountant General, J&K to take into account the COLAequivalent to the admissible rate of DA while authorizing DCRG inrespect eligible GLU Employees irrespective of the fact that any of the

OLA installment might have yet to be released by-the SFC in theirfuvou~ ~

The PSUs shall bear additional burden on account of COLAfrom their internal accruals/own resources and only after liquidatingthe financial liabilities accrued due to loans raised from thefinancial institutions, State Government or other statutory authoritiesand after making depreciation on buildings, plant & machinery, officeequipments and other allied items and keeping sufficient resources forworking capital, purchase of raw materials and other operationalrequirements; and

CIRCULAR

Subject :-Implementation of VR/GH Schemes in favour of surplustaff/un-viable units in State PSUs.

In order to rejuvenate the State Public sector undertakings, a.ornmittee was constituted vide Government order No. 1355-GAD of006 dated 07-11-2006 to make recommendations for the rationalization

of surplus staff in sick un its, having some prospects of becoming viablemd the closure of unviable units in the Public Sector undertakings byoffering a Golden Handshake or Voluntary Retirement Scheme to such·mployees. The recommendations of the said committee wereimplemented in favour of the employees of the State. PSUs videGovernment Order No. 2IS-F of2007 dated 16-7-2007. The PSUs werehound to implement the GHSIVRS in the true spirit to shed the surplus••taff and place the units on the road to recovery within a couple of

ears. But, unfortunately, this has not happened and the process is stillpersisting.

It has come to the notice of the Finance Department that the PSUsIre retaining surplus staff as close to their date of retirement as possible.On the other hand, instances have also been noticed, wherein thexnployees brought under GHS, have sought judicial intervention,because of which the PSUs are having to pay idle wages and the GHSpackage, which is higher in comparison to normal retiral outgo, is beingiven to such petitioners at the eleventh hour just before their retirement.

Therefore, in order to arrest such tendencies, the ManagingDirectors of all State PSUs are advised to withhold the implementationor the Golden Handshake Scheme in favour of such employees, whohave challenged the GHS till the final outcome of the cases in court.When any such employee reaches the age of superannuation during theinterim, he shall be treated as retired in the normal course.

It is also enjoined upon the competent authorities in the StateI'SlJs and the respective administrative departments of the PSUs to holdprior consultations with the Finance Department before sanctioning the

benefits under the Golden Handshake Scheme to ensure that all theparameters, put in place while sanctioning the scheme are being observed.

"Provided that, if any super time pay scale has been awardedto District Judges, equal to 10% of the cadre strength, insteadof 10% of theselection grade strength, in contravention of theabove rule, the same shall be allowed to continue in theirpersonal capacities.

The future strength shall be maintained strictly @ 10% of theSelection Gra:de strength of District Judges and the relevant,recruitment rules be modified accordingly."

by various Government Departments in Kashmir Valley in contravention

to Government Order No. 11O-IND of 2011 dated 24-06-2011. It is

hereby enjoined upon all the Government Departments to comply with

the provisions of Government Order No. 11O-IND of 2011 dated

24-06-2011. issued by the Industries and Commerce Department.

Violation of these orders by any Government Department/office will

be viewed seriously.

In continuation to Government Order No. 149-F of 20 II dated27-04-2012, it is hereby ordered that the State Government Pensioners/Family Pensioners shall be allowed Dearness Allowance on pension/family pension asunder :-

(ii) The payment of Dearness Allowance involving a fraction of 50paisa and above, shall be rounded to the next higher rupee andthe fraction of less than 50 paisa shall be ignored.

(iii) Provisions governing the grant of Dearness Allowance onpension/family pension, such as the regulation of DearnessAllowance during employment/re-employment, where morethan one pension is drawn etc. and other provisions of the

Subject :-Payment of arrears of pay revision on accountof implementation of J&K Civil Services Revised PayRules, 2009.

The entitlement of the revised pay on account of implementationof J&K Civil Services Revised Pay Rules 2009 in favour of the employeesappointed on Ad hoc basis on or after 1-1-2006 stands clarified by theFinance Department vide, O.M. No. A/72(09)-728 dated 9-9-2009.However, doubts have been expressed regarding the modus operandito the followed for the payment of arrears on account of theimplementation of J&K Civil Services revised Pay Rules 2009'. The casehas been examined in the Finance Department. It is clarified that theprocedure to be adopted for the payment of arrears for the employeesappointed on Ad hoc basis on or after 1-1-2006 shall be as under :-

(I) The entire amount of arrears due to such employees w.e.f.1-1-20Q6 to 30-6-2009 on account of the implementation ofJ&K Civil Services Revised Pay Rules 2009 i.e. SRO-93 dated15-4-2009 shall be paid in five equal annual instalments@ 20% each commencing from the current financial year.

(II) The pay revision arrears in respect of those State Governmentemployees appointed on ad hoc basis who have expired/mayexpire on or after 02-1-2006 shall be paid in instalements thatmay become due to them till their date death and balanceinstalemtns, if any remaining thereafter, shall be paid duringsubsequent years.

The Administrative Secretaries of all the departments are requestedto settle the cases of arrears of such employees' accordingly. However,

the provisions required for payment of such arrears for the current fiscalshall be projected in the revised estimates for 2012-13 giving fullparticulars of each employee.

Despite issuance of clarification/instructions vide this department'sO. M. No. A170 (09)-1070 dated 28-08-2012 further doubts have beenexpressed with regard to the payment of arrears on account ofpreponement of increment as on 01-01-2006 /" per SRO-222 dated10th July, 2012 in respect of those employees who have retired between01-07-2009 to 30-06-2012.

The case has been examined. It is clarified that the arrears onaccount of increment from 01/2006 to 06/2009 shall be regulated bythe Government Order No. 8-F of 2012 dated 05-01-20 12. However,the payment of such arrears to the retirees who have retired between01-07-2009 to 30-06-2012 shall be paid in cash. The payments shallbe made after these amounts are duly appropriated in the revisedestimates for the current financial year 2012-13.

SRO-395.-ln exercise of the powers conferred by proviso to section124 of the Constitution of Jammu and Kashmir, the Governor is pleased todirect that the following amendment shall be made in the Jammu andKashmir Civil Services Regulations, 1956 :-

Insertion of an Article, to be numbered as Article 240-A(VII), inthe J&K Civil Services Regulations, Vol. (I), as under :-

Notwithstanding anything contained in Article 240-A(VI), theState Judicial Officers, who have rendered qualifying service oftwenty years or more at the time of retirement on or after02-9-2008, shall be entitled to full pension and those havingless than ~wenty years, but ten years or more, shall get pensionon pro-rata basis:

Provided that, with effect from Ist October, 2012, the pensionersand family pensioners of the judicial officers shall get theadditional quantum of pension/family pension from the Ist ofthe month in which he/she attains the prescribed age, as under :-

Subject :-Date of next increment in cases where Government servantsare not able to join posts in particular grade pay onpromotion/appointment on I st January of a year due toSunday or Gazetted Holiday-clarification thereof.

As per Rule 10 of the J&K Civil Services (Revised Pay) Rules2009, there is a uniform date of increment for all the Govt. employees,i.e. I st of July every year. Government servants completing six monthsand above in the revised pay structure on Ist July are eligible to begranted the increment. From the above rules it flows that Governmentservants who have rendered less than six months of service on Ist ofJuly of a year will not be eligible to draw increment on that day andtheir date of increment will fall 12 months later on the next I st of July.Accordingly, all the Government servants who join posts in a particulargrade on account of promotion/appointment etc., on I st of January ofa year wi II be el igible to draw their annual increment on the Ist of Julyof that year. However, those who join the post between 2nd Januaryand 30th June wi II not be el igible for the same.

I. In the light of the above position, Government of India,Ministry of Finance, Department of expenditure vide O.M. No. F.No. 1/1/2008-IC dated 13th March, 2009 has clarified that in cases whereGovernment Servants are not able to join posts in a particular gradepay on promotion/appointment due to I st of January falling on a Sundayor a Gazetted Holiday andjoin the post on 1st working day of the yearwill be treated to have completed 6 months of service on Ist of Julyof that year for the purpose of grant of annual increment on I st of July.

2. As the State Pay Rules are broadly based on the pattern adoptedby the (lOWIIIIlH.'llt of India, therefore, it is clarified that in normal course,

It has been brought to the notice of the Finance Department thatdoubts are being felt in the field in fixation of pay at the time ofup-gradation of pay band+grade pay in favour of J r. Engineers who havebeen placed in PB2 of (9300-34800+Grade Pay of 4200 vide Govern-ment Order No. 296-F of20 IOdated 21-12-2010 with prospective effect.

The issue has been examined in the Finance Department. It isclarified that while placing a Jr. Engineer (Diploma or degree holder)in the upgraded Pay Band, the pay in pay band drawn prior to his place-ment in upgraded Pay Band shall not be disturbed. Grade pay attachedto the upgraded pay band shall only be allowed.
