The scheme will be implemented duringRabi 2016-17 season on the followingconditions:

1. Implementing Agency.— The district-wiseimplementing agency is given in Annexure–I.

2. Risks covered and exclusion.— Followingstages of the crop and risks leading to croploss are covered under the scheme:

(a) Prevented Sowing/Planting Risk:Insured area is prevented from sowing//planting due to deficit rainfall or adverseseasonal conditions

(b) Standing Crop (Sowing to Harvesting):Comprehensive risk insurance is providedto cover yield losses due to non--preventable risks, viz. Drought, Dry spells,Flood, Inundation, Pests and Diseases,Landslides, Natural Fire and Lightening,Storm, Hailstorm, Cyclone, Typhoon,Tempest, Hurricane and Tornado etc.

(c) Post-Harvest Losses: Coverage isavailable only up to a maximum period oftwo weeks from harvesting for those cropswhich are allowed to dry in cut and spreadcondition in the field after harvestingagainst specific perils of cyclone andcyclonic rains and unseasonal rains.

(d) Localized Calamities: Loss/damageresulting from occurrence of identifiedlocalized risks of hailstorm, landslide andInundation affecting isolated farms in thenotified area.

(e) General Exclusions: Losses arising outof war and nuclear risks, malicious damageand other preventable risks shall be excluded.

Important Conditions/Clauses applicable forCoverage of Risks:

(1) Insurance companies should havereceived the premium for coverage eitherfrom bank, channel partner, insurance

intermediary or directly. Any loss in transitdue to negligence by these agencies or non--remittance of premium by these agencies,the concerned bank/intermediaries shall beliable for payment of claims.

(2) In case of any substantial mis--reporting by nodal bank/branch in case ofcompulsory farmers coverage, the concernedbank only shall be liable for such mis--reporting.

(3) Mere sanctioning/disbursement of croploans and submission of proposals//declarations and remittance of premium byfarmer/bank, without explicit intent to raisethe crop, does not constitute acceptance ofrisk by insurance company.

(4) Acreage Discrepancy: Some areas in thepast have reported excess insurance coveragevis-à-vis planted acreage, leading to over-insurance.

For the time-being, it is to be addressed asfollows:

(a) Wherever the ‘acreage discrepancy’is likely, the acreage insured at IU levelshall be compared with average plantedacreage of past three years, and thedifference is treated as ‘excess’ insurancecoverage after taking into account sownarea data of the Revenue authority.

(b) Sum insured is scaled down in theproportionate ratio the average of threeyears’ actual planted acreage bears to theinsured acreage for the given crop.

(c) Claims shall be calculated on thescaled down sum insured.

(d) Premium (farmer share and Centraland State Government Subsidy) shall berefunded back to Government of India forthe portion of sum insured scaled downand the amount may be utilised forimprovement of technology/research/Impactassessment etc.

Once the individual farms (plots/surveynumbers) are digitized and available on a GISplatform, it is quite possible to overlay the

crop cover as derived using satellite imageryon the GIS platform to identify the crop andestimate the cropped area on each farm. Thisshould lead to identifying the acreagediscrepancy at individual farm level.

3. Crops & Areas covered.— The schemewould cover notified crop in the defined areas(Cluster of Village Panchayats) as unit ofinsurance i.e. each defined area will beconsidered as one unit for the purpose of CropCutting Experiments (CCEs).

The crop wise areas to be covered underthe scheme for Rabi 2016-17 season are givenin Annexure-II.

4. Farmers Covered.— (a) All farmersincluding sharecroppers and tenant farmersgrowing the notified crops in the notifiedareas are eligible for coverage. However,farmers should have insurable interest for thenotified/insured crops.

(b) Compulsory Component— All farmershaving been sanctioned Seasonal AgriculturalOperations (SAO) loans from FinancialInstitutions (i.e. loanee farmers) for the notifiedcrop(s) would be covered compulsorily.

Any loan eligible for compulsory coverageunder PMFBY, if not covered will be deemedto be self-insured by the concerned financialinstitute and claim, in the event of loss shallbe borne by the financial institute.

(c) Voluntary Component— The schemewould be optional for the non-loanee farmers.

The non-loanee farmers are required tosubmit necessary documentary evidence ofland records prevailing in the State [Recordsof Right (RoR), Land possession Certificate(LPC) etc.] and/or applicable contract//agreement details/other documents notified//permitted by concerned State Government(in case of sharecroppers/tenant farmers).

(d) Special efforts shall be made to ensuremaximum coverage of SC/ST/Women farmersunder the scheme.

5. Indemnity Level, Sum Insured Limits,Premium Rates.— District-wise/crop-wise

Level of Indemnity, Sum Insured Limits andPremium rates are given in Annexure–III.

6. Subsidy on premium.— The ActuarialPremium Rate (APR) would be charged underPMFBY by implementing agency (IA).However, farmers would be paying maximumof 1.5% ( Rabi) for food crops, oilseeds, cerealsand millets and 5% for Annual Commercial//Horticultural crops respectively.

The difference between actuarial premiumrate and the rate of insurance charges payableby farmers shall be treated as rate of normalpremium subsidy, which shall be shared equallyby the Centre and State.

7. Seasonality disclipline.— Loaning andacceptance of proposal by Branches/PACs andreceipt of Declarations by AIC as well assettlement of claims will be as per seasonalitydiscipline in Annexure-IV.

8. Change in crop.— Farmers covered, onvoluntary basis, can buy insurance beforeactual sowing/planting, based on advancecrop planning. However, for any reason if afarmer changes the crop planned earlier, heshould intimate the change to insurancecompany, at least 30 days before cut-off datefor buying insurance or sowing, throughfinancial institution/channel partner//insurance intermediary/directly; as thecase may be, along with difference inpremium payable, if any, accompaniedby sowing certificate issued by concernedvillage/sub-district level official of theState. In case the premium paid was higher,insurance company will refund the excesspremium.

Similarly, loanee farmers can also changethe name of insured crop from the originalcrops submitted in the loan applicationbut such changes should be submitted inwriting to the concerned bank branchwell in advance so that their proposed cropsshould be insured. However changes of non--notified crops to notified crops withoutsubmitting the sowing certificate is notpermissible.

Cut-off date for submission of yield data bythe State Government:

Cut-off date for submission of yield databased on minimum crop cutting experimentsfor Crop for Rabi 2016-17 season, from theDirectorate of Agriculture, Government of Goato Implementing Agency (AIC) is as mentionedin Annexure–IV.

9. Loss Assessment, Claim Settlement andClaim Sharing.—

Wide Spread Calamities (based on season--end yield):

Government Department overseeingconduct of CCEs, under GCES i.e. Single Serieswill submit crop-wise/notified area-wiseyield data to the respective insurancecompany within the prescribed cut-offdate along with results of individual CCEs.The certificate that CCEs data is beingsubmitted based on single series would befurnished alongwith yield data every season.

In order to maintain the sanctity andcredibility of CCEs as an objective method ofyield estimation, the modalities mentionedbelow will be followed:

(a) Digitizing the CCE process includinggeo-coding (providing the latitude andlongitude of the CCE location), date/timestamping and with photographs (of the CCEplot and CCE activity), is a must for allCCEs.

(b) Insurance company would havecomplete access to co-witness the CCEs,as also the digital images of the CCEs andrelevant data in the requisite form by theState Government. (As outlined in paraXXIV.2.m) A formal letter with the scheduleof CCEs would be given to the respectiveinsurance company sufficiently in advancewithout fail to help them mobilize themanpower if they so desire.

(c) Wherever the yield estimates reportedat IU level are abnormally low or highvis-à-vis the general crop condition, theinsurance company in consultation with

State Government can make use of variousproducts (e.g. Normalized DifferenceVegetation Index, etc.) derived from satelliteimage data or other technologies to confirmthe yield estimates. In case of significantdifferences between these two yieldestimates, the matter should be referred toTechnical Advisory Committee (TAG) atCentre and its decision shall be final.

(d) Use of Mobile Phone Technology toimprove Yield-data Quality and Timelinessto increase the reliability, accuracy andspeed of CCE data, it is mandatory to usesmart phones/hand held devices forcapturing images, location of the CCE andfor online transmission of data on centralizedserver (e.g. Bhuvan server) would be donefor faster compilation of data and quick claimsettlement. RST and Drones etc. may alsobe used for the purpose of increasingaccuracy and speed of yield estimationthrough CCEs.

Assessment of Claims (Widespread Calamities):

If ‘Actual Yield’ (AY) per hectare of insuredcrop for the insurance unit (calculated on basisof requisite number of CCEs) in insured season,falls short of specified ‘Threshold Yield’ (TY),all insured farmers growing that crop in thedefined area are deemed to have sufferedshortfall in yield of similar magnitude. PMFBYseeks to provide coverage against suchcontingency.

‘Claim’ shall be calculated as per thefollowing formula:–

(Threshold Yield – Actual Yield)—————————————— x Sum Insured Threshold Yield

Where,

Threshold yield for a crop in a notifiedinsurance unit is the moving average yield ofpast seven years (excluding a maximum oftwo calamity year(s) as notified by StateGovernment/UT) multiplied by applicableindemnity level for that crop.

On Account Payment of Claims due to Mid--Season Adversity:

(1) It is proposed to provide immediate reliefto insured farmers in case of adverse seasonalconditions during the crop season viz. floods,prolonged dry spells, severe drought etc.,wherein expected yield during the season islikely to be less than 50% of Threshold yield.

(a) Eligibility Criteria:

(i) All notified Insurance Units would beeligible for “ON ACCOUNT” payment onlyif the expected Yield of the affected cropduring the season is less than 50% ofthreshold yield.

(ii) The provision would be invoked for aspecific crop or group of crops by the StateGovernment through damage notificationbased on the proxy Indicators.

(iii) Insurance company may decide thequantum of likely losses and the amount of‘on-account’ payment based on the jointsurvey of Insurance Company and StateGovernment officials.

(iv) Only those farmers would be eligiblefor financial support under this cover whohas paid the premium/the premium has beendebited from their account before the dateof issuance of damage notification by theState Government.

(v) Maximum amount payable wouldbe 25% of the likely claims, subject toadjustment against final claims.

(vi) If adversity occurs within 15 daysbefore the normal harvest time, thisprovision will not be invoked.

(b) Proxy-Indicators:

Indicators to be used for loss intimationwould be rainfall data, temperature andrelative humidity data, satellite imagery andcrop condition reports by district level stategovernment officials, supported by mediareports.

(c) Loss assessment procedure:

(i) Joint Committee of State Governmentand the insurance company, for assessmentof crop damage, would be formed andnotified before start of the crop season foreach district.

(ii) This Joint Committee shall decide theeligibility for on-account payment based onthe weather data (available AWS notifiedby the Government)/long term averagerainfall data/satellite imagery supported byestimated yield losses at notified Insuranceunit level and the extent of loss.

(iii) Information/Services of MahalanobisNational Crop Forecast Centre (MNCFC)may also be utilized for determination ofextent of loss for on-account payout.

(iv) If the expected loss of the affectedcrop is more than 50% of the threshold yieldfor the Notified Insurance Unit, on-accountpayment would be payable.

(v) On-account payment would becalculated as per following formula:

(Threshold Yield–Estimated Yield)

x Sum Insured x 25% Threshold Yield

(d) Time frame for loss assessment andsubmission of report:

(i) An order will be issued by StateGovernment defining eligibility of on--account payment with details of damagedInsurance Units within 7 days from theoccurrence of adverse seasonal event.

(ii) Loss assessment report at the affectedinsurance unit level has to be completed bythe joint committee within 15 days fromoccurrence of the adverse seasonal event.

(e) Conditions:

(i) Mere disbursement/sanction of loanwithout receipt/debit of premium before thenotification of calamity would not make afarmer eligible for the claim.

(ii) These claims would be adjusted fromthe end season area approach yield basedclaims.

Prevented/Failed Sowing and PreventedPlanting/Germination Claims:

(1) It is proposed to provide insurance coverto farmers in case of widespread incidence ofeligible risks affecting crops in more than 75%of area sown in a notified unit at early stageleading to total loss of crop or if the farmersare not in a position to either sow ortransplant the crop. The district wise/cropwise cut-off-dates for invoking this provisionare given in Annexure.

(i) The Notified Insurance Unit and cropwise normal area sown would be provided tothe insurance companies by Directorate ofAgriculture, Government of Goa.

(a) Eligibility Criteria:

(i) Notified Insurance Units will be eligiblefor “Prevented Sowing/Planting” pay-outonly if more than 75% of Crop Sown Areafor notified crop remained unsown due tooccurrence of any of the above perils.

(ii) Only those farmers would be eligiblefor financial support under this cover whohave paid the premium/the premium hasbeen debited from their account by the dateof notification to this effect.

(b) Proxy-Indicators:

Indicators like rainfall data, other weatherdata, satellite imagery and crop conditionreports by district level agricultural officer,media reports and area sown data releasedby district level agricultural officer StateGovernment.

(c) Loss assessment procedure:

(i) State Government would declare aNotified Insurance Unit as having sufferedPrevented or Failed Sowing/Plantingconditions with approximate areas inpercentage of the unit.

(ii) The Lumpsum payout under this coverwould be limited to 25% of the sum insuredand the insurance cover will be terminated.

(d) Conditions:

(i) The cover will be available for NAMEDcrops only.

(ii) Mere disbursement/sanction of loanwithout receipt/debit of premium before thenotification of calamity won’t make a farmereligible for claim.

(iii) The insurance company woulddisburse the claim within 30 days of theState’s order/notification invoking the eventof the insured risk provided the data onestimated area sown have been receivedfrom State Government.

(iv) The pay-out under the cover wouldbe disbursed by the insurance company onlyafter the receipt of Government share ofpremium subsidy.

(v) Insurance Cover would terminate forthe affected crop in a Notified InsuranceUnit once a claim under this section isinvoked and the Affected Insurance Unit//Crop would not be eligible for area yieldbased claim calculated at the end of theseason.

(vi) Once this provision is invoked, nofresh enrolment of farmers, for the affectednotified crops and areas would be done.

(vii) Once exigency is invoked it appliesto all the insured farmers in the NotifiedInsurance Unit for a given crop, includingfor those whose crop survived.

The State Government would continueto provide area sown and yield data basedon CCEs conducted in the such areas withinthe cut-off date.

Post-Harvest Losses:

(1) It is proposed to provide for assessmentof yield loss on individual plot basis in caseof occurrence of cyclone, cyclonic rains andunseasonal rains resulting in damage toharvested crop lying in the field in ‘cut andspread’ condition up to maximum period oftwo weeks (14 days) from harvesting for solepurpose of drying are Paddy, Pulses andGroundnut.

(a) Eligibility criteria:

(i) Available to all insured farmers, atfarm unit level, affected by above mentionedperils in a Notified Insurance Unit growingnotified crops for which insurance have beenavailed.

(b) Proxy-Indicators:

Report in the local media or reports ofthe agriculture/revenue departmentsupported by media reports and otherevidences.

(c) Loss assessment procedure:

Time and method of reporting the loss//claims.

(i) Immediate intimation (within 48 hours)by the insured farmer to bank/insurancecompany/Agriculture Department officialsthrough phone/FAX.

(ii) Intimation must contain details ofsurvey number-wise insured crop andacreage affected.

Localized Risks:

(1) It is intended to provide insurance coverat individual farm level to crop losses due tooccurrence of localized perils/calamities viz.Landslide, Hailstorm and inundation affectingpart of a notified area or a plot.

(a) Eligibility Criteria:

(i) Available to all insured farmers, atfarm unit level, affected by above mentionedperils in a Notified Insurance Unit growingnotified crops for which insurance has beenavailed.

(ii) Maximum liability is limited toproportionate Sum Insured of damagedcrop’s area. This would be based on theproportion of cost of inputs incurred duringsowing period to the sum insured.

(iii) Only those farmers would be eligiblefor financial support under this cover whohave paid the premium/the premium hasbeen debited from their account beforeoccurrence of the insured peril.

(iv) Maximum pay-out under this provisionwould be in proportion to cost of inputs,incurred up to the occurrence of insuredperil, subject to the sum insured. If the pay--out under area approach (based on CCEsdata) is more than localized losses, thehigher claims of two will be payable toinsured farmers.

(v) If the affected area under a notifiedcrop is more than 25% of the total insuredarea in a notified insurance unit, all theeligible farmers (who has taken insurancefor the notified crop, which has beendamaged, and informed about occurrenceof calamity in the farm within the stipulatedtime) in the notified insurance unit wouldbe deemed to have suffered localised lossand would be eligible for financial support.Percentage of loss would be arrived at byrequisite percentage of sample survey (asdecided by the Joint Committee) of affectedarea by the insurance company.

Time and method of reporting the loss//claims:

(i) Immediate intimation (within 48 hours)by the insured farmer to bank/insurancecompany/Agriculture Department officials tollfree number through phone/FAX.

(ii) Intimation must contain details of surveynumber-wise insured crop and acreageaffected.

(iii) Mobile application may be used forreporting incidents of localized risks forintimation of events including longitude//latitude details and pictures using NRSCMobile App.

Who to be reported i.e. Channel of reporting:

The banks would verify the insured detailslike crop insured, sum insured, premiumdebited and date of debit before sending thesame to insurance company.

Documentary evidence required for claimassessment:

* Duly filled Claim form along with allrelevant documents is requisite for payment

of claims. However, if information on all thecolumns is not readily available, semi-filledform may be sent to the insurance companyand later within 7 days of the loss, filled formmay be submitted.

* Evidence of crop loss through capturingpictures using mobile application, if any.

* Local Newspaper cutting to substantiateoccurrence of loss event and severity of theloss, if any.

Appointment of Loss Assessors by theInsurance Company:

The loss assessors would be appointed bythe insurance company for assessment oflosses due to the operations of Localized Risks(Yield Insurance).

The loss would be jointly assessed by ateam comprising of loss assessor appointedby the insurer, block level agriculture officerand the concerned farmer.

* Maximum liability would be limited toproportionate Sum Insured of damagedcropped area.

Important conditions:

(i) Mere disbursement/sanction of loanwithout receipt/debit of premium before theoccurrence of insured peril would not make afarmer eligible for claim.

(ii) When affected area is limited upto 25%of total insured area in the notified insuranceunit, the losses of eligible farmers would beassessed individually provided they have paidpremium prior to occurrence of insurance peril.

(iii) The pay-out under the cover would bedisbursed by the insurance company only afterthe receipt of Government share of premiumsubsidy.

(iv) The insurance company would disbursethe claim, if payable within 30 days of surveyof loss.

(v) If, at the end of season, based on theyield data, claim is more than the claim underthis cover, the balance would be paid at theend of the season under widespread claims.

(vi) Farmers getting enrolled or whosepremium is debited after occurrence ofinsurance peril would not be eligible forfinancial support under this cover.

Procedure for Settlement of Claims to thefarmers:

(1) The insurance company would disbursethe claim only after receipt of Governmentshare in premium subsidy.

(2) In case of farmers covered throughFinancial Institution, claims shall be releasedonly through electronic transfer, followed byhard copy containing claim particulars, toindividual bank branches/nodal banks/PACswhich will credit into accounts of individualfarmers within a week of receipt of funds fromthe Insurance companies and shall provide acertificate to the insurance companiesalongwith list of farmers benefited. BankBranch should also display particulars ofbeneficiaries on notice board and also uploadthe same on crop insurance portal.

(3) In case of farmers covered on voluntarybasis through intermediaries/directly, payableclaims will be directly credited to theconcerned bank accounts of insured farmersand details of the claims may also intimatedto them. The list of beneficiaries may also beuploaded on the crop insurance portalimmediately.

(4) In case of claims under prevented/failedsowing, localized calamities, postharvestlosses; insurance company will process theclaims after assessment and shall release theclaims as per the procedure.

(5) Insurance companies shall resolve allthe grievances of the insured farmers andother stakeholders in the shortest possibletime.

10. Commission and Bank Charges.— Bankand other financial institutions etc. shall bepaid service charges @ 4% of the premiumcollected from farmers. Rural agents engagedin providing insurance related services to

farmers would be paid appropriatecommission as decided by the insurancecompany, subject to cap prescribed underIRDA regulations.

11. Service Tax.— PMFBY is a replacementscheme of NAIS/MNAIS, and hence exemptedfrom Service Tax.

12. Role and Responsibilities of variousAgencies.— For successful implementationand administration of scheme, roles ofvarious Agencies/Institutions/GovernmentDepartments/Committees are spelt out herein.

State/UT Governments:

(a) District Level Monitoring Committee(DLMC) would provide fortnightly cropcondition reports and periodical reports onseasonal weather conditions, loans disbursedextent of area cultivated, etc. to concernedinsurance company. DLMC shall also monitorconduct of CCEs in districts.

(b) Uploading of requisite information ofnotification on the crop insurance portalin Co-ordination with the selectedImplementing Insurance Companies withinone week from the date of notification.

(c) Issuance of necessary instructions toRegional Meteorological Centres of IMD andother Government/quasi Government agenciesfor supplying weather data on real-time basisto insurance company.

(d) To undertake extensive awareness andpublicity campaigns of scheme amongstfarming community through agriculture andextension Departments to maximize coverageof the farmers specially non-loanee farmers.

(e) To furnish to the insurance companiesthe insurance unit-wise area sown of insuredcrops within two months from the sowingperiod.

(f) Assist insurance companies forassessment of crop loss of individual insuredfarmers caused by localized perils and alsoassist in post-harvest losses.

(g) Will allow insurance companies to co--observe and witness CCEs, and permit themto access various records including Form-2//Table-B at grass root/district/state level usedfor recording data of CCEs by States. AudioVideo recording of CCEs shall be implementedbesides other process to ensure accuracy ofCCE.

Insurance Companies (IA):

(a) Insurance companies to liaise with StateGovernments and agencies/institutions//committees involved in implementation ofPMFBY.

(b) Furnish the necessary data/informationto SLCCCI as may be required as per thenotification.

(c) Underwriting—responsibilities of proces-sing and acceptance of risk.

(d) Claim processing/finalization on receiptof yield data from States/UTs and paymentwithin the prescribed timelines.

(e) Redressal of all Public Grievances withinthe time fixed by IRDA.

Financial Institutions/Banks:

(a) To communicate Notification, as well asother directives, guidelines, etc. to allagencies within their jurisdictional area.

(b) Ensure that all agencies within theirjurisdictional area sanction additional loancomponent to loanee farmers towardspremium payable by them.

(c) Ensure that all service (subordinate)bank branches within their jurisdictional areaserve all non-loanee farmers desiring andeligible to take insurance cover under PMFBY.Such service will include opening bankaccount of non-loanee farmers, guiding themto fill up proposal forms, accepting premiumfrom them and maintaining records etc.

(d) Ensure that, for both loanee and non--loanee farmers separately, premium and relateddata is remitted to nodal bank, whereverapplicable, within the prescribed time.

(e) Lead bank/Nodal Banks should ensurethat all the eligible crop loans/seasonaloperational loans taken for notified crop(s)are fully insured and the conditions stated inthe declarations submitted have beencomplied with. No farmer should be deprivedfrom insurance cover. Nodal banks therefore,should make all out efforts and pursue theirbranches for enrolling all eligible loaneefarmers and interested non-loanee farmersunder crop insurance.

In case, claims have arisen during cropseason then respective bank and its brancheswould be responsible to make payment of theadmissible claims to loanee farmers who weredeprived from insurance cover to their crops.

(f) Concerned Bank and its branches shouldensure submission to insurance companieswithin stipulated time the notified crop-wise,insurance unit-wise Declarations in prescribedformat, along with consolidated premiumpayable separately for both loanee farmersand non-loanee farmers. If Concerned Bankand its branches keep the amount of premiumcollected beyond the defined timelines thenthey will be liable to pay interest (at prevailingrate of interest for saving account) for thedelay period to the insurance company.

(g) Nodal bank/Branches will alsoarrange for onward transmission to service(subordinate) bank branches/PACS,compensation amounts as received frominsurance companies with all details, to becredited to beneficiary accounts.

(h) The Nodal Banks/Administrative officeswould also collect the list of individual insuredfarmers with requisite details like name,fathers’ name, Bank Account number, village,categories—Small and Marginal/SC/ST//Women, insured acreage, insured crop(s), suminsured, premium collected, Governmentsubsidy etc. from concerned PACS/BankBranch in soft copy for further reconciliationand send the same to the concerned insurancecompany within 15 days after final cut-off datefor submission of proposal to insurancecompany.

(i) The insurance company shall acknow-ledge all the declarations submitted by thebanks mentioning the details of crop, area, suminsured etc. The banks should cross check withtheir records and aberrations, if any, shouldbe brought to the notice of the insurancecompany immediately. If no response isreceived from banks within 15 days, thedetails given in the acknowledgement shallbe considered final and no changes would beaccepted later on.

(j) To credit the claim proceeds of PMFBYreceived from insurance company to respectivebeneficiary bank account within seven days.If Bank Branches/Nodal banks keep the claimsamount beyond the defined timelines thenthey will be liable to pay interest (at prevailingrate of interest for saving account) for thedelay period to the eligible farmers. The listof beneficiary cultivators with claim amountshall be displayed by the Branch/PrimaryAgricultural Co-operative Society (PACS) anda copy shall also be provided to the Chairman//Sarpanch/Pradhan of the Village Panchayat.The Banks shall issue a certificate to theinsurer that entire money received forsettlement of claims has already been creditedinto the account of beneficiaries.

(k) Soft copy of the beneficiary farmerswould also be uploaded directly on CropInsurance portal by bank branch/PACSthrough Nodal Bank to concerned insurancecompanies for uploading the same in theirweb-site.

(l) To permit insurance company with accessto all relevant records/ledgers at the NodalBank/Branch/PACS at all times for the purposeof implementation of the scheme.

(m) Banks should ensure that cultivator maynot be deprived of any benefit under thescheme due to errors/omissions/commissionsof the concerned branch/PACS, and in case ofsuch errors, the concerned institutions shallonly make good all such losses.

Lending Banks/RFIs:

(a) To educate the cultivators on the schemefeatures.

(b) To maintain the records of proposalforms, the other relevant documents andstatements for the purpose of scrutiny//verification by insurance company or itsauthorized representatives and DLMC.

(c) Allow insurance company access to allrelevant records and registers at offices ofNodal Bank and service (subordinate) bankbranches within their jurisdictional area.

(d) To capture all relevant data includingland and crop details of all loanee farmerscovered compulsorily as well as non-loaneefarmers availing crop insurance through them.Under administrative mechanism, banks aredesignated as terminal service points forfarmers. Hence, it is their duty to ensurecompulsory coverage of all eligible loaneefarmers and all interested non-loanee farmers.In case of any misreporting by Nodal Bank//branch/PACS in case of farmers coverage,concerned bank only will be liable for suchmisreporting and its consequences.

Designated Insurance agents:

(a) To educate the cultivators on the schemefeatures.

(b) To guide the cultivators for filingup the insurance proposal in the prescribedforms and collecting the required documentsfrom Non-Loanee cultivators.

(c) Underwrite and collect the premium onbehalf of Insurance Company, strictly as perthe provisions of the scheme.

(d) To prepare the consolidated statementsof Non-Loanee cultivators and forwarding thesame to the insurance company along withthe premium amount well within the stipulatedtime.

(e) The designated Insurance agents shallalso prepare the list of individual insuredfarmers with requisite details like name,father’s name, Bank Account number, village,categories–Small and Marginal/SC/ST/Women,insured acreage, insured crop(s), sum insured,premium collected, Government subsidy etc.in soft copy and send the same to the

concerned insurance company within five daysafter final cut-off date.

(f) The designated Insurance agents shouldensure that insured farmers may not bedeprived of any benefit under the schemedue to errors/omissions/commissions of them,and if any, the concerned agents/insurancecompany shall only make good all such losses.Necessary administrative and legal actionmay also be taken for lapses in service//malpractices, if any, reported.

Loanee farmers:

(a) As the scheme is compulsory for allloanee cultivators availing SAO loans fornotified crops, it is mandatory for all loaneecultivators to insist on insurance coverage asper provisions of the scheme.

(b) Any change in crop plan should bebrought to the notice of the bank within oneweek of sowing.

(c) Insurance Proposals are accepted onlyupto a stipulated cut-off date, which will bedecided by the SLCCCI.

(d) Give information of any loss due tolocalized risk or post harvest loss due tospecified perils of cyclone, cyclonic rains andunseasonal rains resulting in damage toharvested crop lying in field in “cut andspread” condition to concerned bank branch//financial institution/channel partner/insurerwithin 48 hours.

Non-Loanee cultivators:

(a) Non-Loanee cultivators desirous ofavailing insurance under PMFBY for anynotified crop in any notified insurance unitmay approach nearest bank branch/PACS//authorized channel partner/insuranceintermediary of insurance company withincut-off date, fill-up proposal form completelyin prescribed format, submit form anddeposit requisite premium to bank branch//Insurance Intermediary along with necessarydocumentary evidence regarding hisinsurable interest in cultivating land/crop(e.g. ownership/tenancy/cultivation rights)proposed for insurance.

(b) The farmer desiring for coverage shouldopen/operate an account in the branch of thedesignated bank, and the details should beprovided in the proposal form.

(c) The farmers should mention their landidentification number in the proposal.

(d) The farmer must provide documentaryevidence with regard to possession ofcultivable land.

(e) The cultivator must furnish area sownconfirmation certificate.

(f) The farmer should ensure that he getsinsurance coverage for a notified crop(s)cultivated/proposed to be cultivated, in a pieceof land from a single source. In other word,Double insurance is not allowed. The insurancecompany shall reserve the right to repudiateall such claims and not refund the premium aswell in such cases.

Company may also take legal action againstsuch farmers.

(g) Give information of any loss due tolocalized risk or post-harvest loss due tospecified perils of cyclone, cyclonic rains andunseasonal rains resulting in damage toharvested crop lying in field in “cut andspread” condition to concerned bank branch//financial institution/channel partner/insurerwithin 48 hours.

The implementation of the scheme will begoverned by operational guidelines on PMFBYand administrative approval issued byDACFW, GOI In the event of any conflict inprovisions in this notification and operationalguidelines for PMFBY issued by DACFW, GOI,latter will prevail.

Whereas the Government of Goa is of the opinion that the ancient monument as specifiedin the Schedule hereto (hereinafter referred to as the “said monument”) require protectionunder the Goa, Daman and Diu Ancient Monuments and Archaeological Sites and RemainsAct, 1978 (Act No. 1 of 1979) (hereinafter referred to as the “said Act”).

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of thesaid Act, the Government of Goa hereby gives two months notice of its intention to declarethe said monument to be protected monument. Any person interested in the said monumentmay forward his/her objections to the Director, Directorate of Archives and Archaeology,Government of God, Panaji, before the expiry of period of two months from the date ofpublication of this notification in the Official Gazette.

In exercise of the powers conferred by sub--section (1) of section 64 read with sub--section (g) of section 5 and sub-section (i) ofsection 12 of the Water (Prevention andControl of Pollution) Act, 1974 (Central Act 6of 1974), the Government of Goa hereby makesthe following rules, namely:—

1. Short title and commencement.— (1) Theserules may be called the Goa State PollutionControl Board (Qualifications and other Termsand Conditions of Service of the Chairmanand Member-Secretary) Rules, 2016.

(2) They shall come into force from the dateof their publication in the Official Gazette.

2. Definitions.— In these rules, unless thecontext otherwise requires,—

(a) “Act” means the Water (Preventionand Control of Pollution) Act, 1974 (CentralAct 6 of 1974);

(b) “Board” means the Goa State PollutionControl Board constituted under section 4of the Act;

(c) “Chairman” means the Chairman ofthe Goa State Pollution Control Board;

(d) “Government” means the Governmentof Goa;

(e) “Member-Secretary” means theMember-Secretary of the Goa State PollutionControl Board.

3. Educational and other qualifications fornomination as Chairman.— No person shall beeligible for being nominated as the Chairmanunder clause (a) of sub-section (2) of section4 of the Act, unless he,—

(a) holds a Masters Degree inEnvironmental Sciences and EnvironmentalManagement; or (a) holds a Bachelors

Degree in Engineering/Technology inEnvironmental Engineering or an equivalentdegree thereto; and has practical experiencein respect of matters relating toenvironmental protection and abatementof pollution at least for a period of fifteenyears; or

(b) holds a Bachelor’s Degree in Geology//Botany/Chemistry or an allied subjects,wherein basic knowledge of ecology andenvironment is part of curriculum, from arecognised University or Institution and hasa practical experience in administeringinstitutions dealing with the environmentalprotection and abatement of pollution(including subsequent developments intheory and practice as in industrial pollutionmitigation, water treatment or air pollutioncontrol devices) at least for a period offifteen years;

(c) Knowledge of Konkani;

(d) Desirable:- Knowledge of Marathi;

(e) shall be a resident of Goa for at leasta period of 15 years.

Note 1:— A doctoral degree in environmentalmanagement from a recognised University orinstitute and excellent record of peer reviewedresearch publications and experience oforganising environment related trainingprogrammes for service personnel, shall be aconsidered as desirable qualification.

Note 2:— An officer working under theGovernment or public sector undertaking orUniversity or an autonomous body or statutorybody may be considered for nomination as theChairman on deputation basis:

Provided that the period of deputationincluding period of deputation in another ex--cadre post held immediately preceding thisappointment in the same or some otherorganization or department shall ordinarily notexceed three years.

4. Age Limit for nomination of Chairman.—The age limit for nomination as Chairman shallbe sixty-two years as on the last date for thereceipt of applications.

5. Selection Committee for selection of theChairman.— The Chairman shall be nominatedby the Government on the recommendationof the Selection Committee consisting of thefollowing members, namely:—

(i) Chief Minister — Chairman.

(ii) Minister for Environment — Member.

(iii) Leader of Opposition — Member.

(iv) Chief Secretary — Member.

(v) Secretary (Environment) — Member.

(vi) Secretary (Law) — Member.

(vii) An expert member to benominated by theChief Minister — Member.

6. Educational and other qualifications forappointment as Member-Secretary.— No personshall be eligible for being appointed as theMember-Secretary under clause (j) of sub--section (2) of section 4 of the Act, unlesshe,—

(a) holds a Masters Degree in Environ-mental Engineering/Technology or MastersDegree in allied sciences where pollutioncontrol forms part of curriculum, from arecognised University or institution and hehas practical experience in environmentalprotection and abatement of pollution(including subsequent developments intheory and practice as in industrial pollutionmitigation, water treatment or air pollutioncontrol devices) at least for a period of tenyears;

(v) As expert member to benominated by theChief Minister — Member.

9. Salary and allowances of Chairman.— Thewhole time Chairman shall be paid monthlysalary and allowances as decided by theGovernment.

10. Salary and allowances of the Member--Secretary.— The Member-Secretary shall bepaid monthly salary and allowances asdecided by the Government.

11. Power to relax.— Where theGovernment is of the opinion that it isnecessary or expedient so to do, it may, byorder, for reasons to be recorded in writing,relax any of the provisions of these rules

Whereas certain draft rules which theGovernment of Goa proposes to make so asto amend the Goa Housing Board (Registration,Allotment and Sale of Tenements) Rules, 2016were pre-published as required by sub-section(1) of section 128 of the Goa Housing BoardAct, 1968 (Act No. 12 of 1968) (hereinafterreferred to as the “said Act”), underNotification No. 2/59/2016/HSG/Part dated16-09-2016, published in the Official Gazette,Series I No. 25, dated 22-09-2016 invitingobjections and suggestions from all personslikely to be affected thereby, before expiry offifteen days from the date of publication ofthe said Notification in the Official Gazette;

And whereas, the said Official Gazette wasmade available to the public on 22ndSeptember, 2016;

And whereas, the objections andsuggestions received from the public on thesaid draft rules have been considered by theGovernment.

Now, therefore, in exercise of the powersconferred by sub-sections (1) and (2) of section128 read with section 58 of the Goa HousingBoard Act, 1968 (Act No. 12 of 1968), and allother powers enabling it in this behalf, theGovernment of Goa hereby makes thefollowing rules, namely:—

1. Short title and commencement.— (1) Theserules may be called the Goa Housing Board(Registration, Allotment and Sale ofTenements) (First Amendment) Rules, 2016.

(2) They shall come into force from the dateof their publication in the Official Gazette.

2. Amendment of rule 6.— In rule 6 of theGoa Housing Board (Registration, Allotmentand Sale of Tenements) Rules, 2016(hereinafter referred to as the “principalRules”), in sub-rule (1), the expression “andalso a resident of State of Goa for the lasttwenty five years” shall be omitted.

3. Amendment of rule 13.— In rule 13 of theprincipal Rules, in sub-rule (3), in the proviso,for the figures “10%” and “15%”, the figures“2%” and “5%” shall be respectivelysubstituted.

4. Amendment of rule 19.— In rule 19 of theprincipal Rules, after sub-rule (1), the followingsub-rule shall be inserted, namely:—

“(1A) where the Government is of theopinion that it is necessary or expedientso to do, it may, by order, for reasons to berecorded in writing, relax any of theprovisions of these rules.”

Preamble.— As a tribute to Late DilipSardessai Cricket Legend and to inspire ourupcoming Sportspersons to attain greaterheights at the International Arena, theGovernment of Goa has instituted a SpecialAward to be named after Late Dilip Sardessai,as the:

The Dilip Sardessai Sports ExcellenceAward

This Award will be presented annually on29th August on the occasion of National SportsDay in Goa to the highest achiever amongstGoan Sportspersons representing the Countryat any recognized International Level SportsCompetition during the preceeding year.

The Award will comprise of a Bronze Plaqueof Late Dilip Sardessai, a Citation and willcarry a purse of Rs. 2.00 lakh (Rupees twolakh only).

The Dilip Sardessai Sports ExcellenceAward

1. Rules.— These Rules will be called as“The Dilip Sardessai Sports Excellence AwardRules”.

2. Objectives.— (i) To pay tribute to Goa’sGreatest Test Cricket Legend the Late ShriDilip Sardessai.

(ii) To inspire our upcoming Sportspersonsto attain greater heights in Sports at theInternational Arena.

3. The Award.— The highest achieveramongst the Goan Sportspersons at any ofthe below stated recognized InternationalSports competitions at the Senior level duringthe preceding year (April 1 to March 31) shallbe honoured with the Dilip Sardessai SportsExcellence Award:

1. Olympics

2. World Championships (Including CricketWorld Cup Matches recognized by theICC)

3. Asian Games

4. Commonwealth Games

5. Other International recognized Events

6. Cricket Test Matches

The Award will comprise of a Bronze Plaquewith the Relief of Late Dilip Sardessai, aCitation and a cash amount of Rs. 2.00 lakhsexempt from Income Tax and Wealth Tax inthe year in which it is disbursed.

The Award will be presented annually on29th August on the occasion of the NationalSports Day.

4. Proposals For Award:

4.1 Proposals for the Award shall besubmitted every year by the 31st ofMay for the preceding year ending31st March, for consideration of theGovernment on the requisite Proformaas detailed at Annexure–I.

4.2 In case the application is received after31st May, it will not be considered forthat year and will not be carried for thenext year.

4.3 Proposals may be sent to theDirectorate of Sports & Youth Affairs bylocal Members of Parliament, M.L.A’s,State Government Departments, the

Sports Authority of Goa or RecognisedState Level Sports Associations.

4.4 On receipt in the Directorate of Sports& Youth Affairs on prescribed proformaduly completed, the application will bereferred to the Ministry of Youth Affairs& Sports, Government of India. SAI//National Sports Federation/SAG/StateSports Associations to verify and certifythat the Sports achievements mentionedtherein are factually correct orotherwise.

4.5 Notwithstanding the above, theDirectorate of Sports & Youth Affairsretains the right to further investigateand examine the Sports achievementsof an applicant for consideration of theircandidature for this Award.

4.6 The Directorate of Sports & Youth Affairsshall constitute a Committee under theChairmanship of Secretary, Sports &Youth Affairs, comprising of eminentSportspersons/Sports promoters/SportsAdministrators of long standing andunimpeachable integrity for consideringthese applications and for taking a finaldecision on the Award. The decision ofthis Committee shall be final andbinding on all and cannot be challengedin any Court of Law.

5. General:

5.1 This Award will be in addition to anyother award of the Government orotherwise, which may be available tosportspersons for same achievements.

5.2 This Award will be given to aSportsperson only once in his/herlifetime.

5.3 Canvassing for the Award in any formis prohibited. Anybody found socanvassing in his favour may bedebarred from consideration.

5.4 The Award can be given posthumously.In that event, the cash and other thingswill be given to the legal heirs of thehonoured sportsperson.

6. Annulment and Cancellation of Award:

6.1 The Award may be cancelled in case itis found that it has been obtained bypractice of fraud or misrepresentationor annulled/withdrawn for valid andsufficient reasons on the ground thatthe Awardee has not conducted himselfhonourably subsequent to the date ofconferment of the Award. This decisionwould be taken by the duly constitutedCommittee as specified in para 4.6above.

6.2 In the event of annulment/cancellation//withdrawal of the Award, a simplenotification by the Directorate of Sports& Youth Affairs to that effect will bedeemed proper and sufficient.

6.3 The annulment/cancellation/withdrawalcannot be disputed in any Court of Law

and the decision of the Department shallbe final and binding.

6.4 The Government shall have the right torestore the Award after the annulment//cancellation/withdrawal, if it so deemsfit.

6.5 The Marking Scheme shall be asAnnexure–II.

The scheme is approved by Governmentof Goa, Finance Department vide U. O.No. 1400000472 dated 07-10-2016.
