The Governor of Haryana is pleased to promote/transfer/posting the

following HES—II officers as HES-I officers in grade of Rs. 15,600-39,100 plus

Grade Pay Rs. 6,400 with immediate effect and on their promotion as HES-I

they are posted at the place mentioned against their names with the terms and

conditions mentioned below: -

Terms and Conditions:-The inter-se-seniority of the promotees shall be subject to the claim of their

seniors, who have not been promoted in these orders due to various reasons

and for whom the posts have been kept reserved

If any officer is found senior to these officers at any stage due to re-fixation

of his/her seniority in his/her feeder cadre, he/she will be reverted without

giving any notice

They will remain on probation for a period of one year and which can be

extended if their services are not found satisfactory

Their promotion is subject to the condition that if anything adverse

regarding their integrity in anyone of their non-available ACRs mentioned

against their name is found doubtful then they will be reverted without any

notice.

5. These promotions are subject to the final outcome of CWP No. 11844 of

2011 titled as Vandana Gupta & others Vs. State of Haryana & others and

also final decision of the Department on seniority dispute.

If they are willing to accept this offer of promotion as HES-I on the above

terms and conditions, he/she should submit his/her joining report as per

aforesaid directions to this Directorate within 15 days, otherwise their orders

will be stand cancelled automatically

Whereas various Writ Petitions were filed, praying to direct

the respondents to adjust them on various posts which they are/were

holding and show cause notices have been issued or have been

relieved due to various reasons cited therein.

Brief facts of the case are that some of the guest teachers

who were not having subject combinations or the requisite

qualifications, required under the relevant Service Rules at the time of

initial appointment on guest faculty basis including those who

completed the subject combination or the requisite qualification

subsequently while continuing on the said post as guest teacher, were

issued show cause notice for terminating their services. In addition to

this, some of the guest teachers, against whom regular teachers were

appointed on promotion or otherwise, were relieved and they were the

guidelines issued by the department in this regards, in view of the fact

that they were not having subject combinations or the requisite

qualification, required under the relevant Service Rules at the time of

initial appointment or guest faculty basis. Subsequently, all the

categories of teachers mentioned above filed various Civil Writ

Petitioner (CWPs) in the Hon'ble High Court and the same have been

disposed of with the following order dated 05.08.2011:

"All these writ petitions are disposed of with a direction to

the petitioners to appear before the respective authorities which have

issued show cause notice in each case. The said authorities, after

obtaining replies to the respective petitioners to the show cause

notice, shall forward the case to the Director, Elementary Education,

by fixing a date of hearing before the Director in consultation with the

Director, Elementary, thereafter, would afford due opportunity of

hearing to the petitioners and pass an order in accordance with law.

The petitioners shall be at liberty to raise all the pleas that they may

wish to urge against the proposed action. Needless to mention that

the Director in accordance with law. If any of the petitioner makes a

request for being represented by a counsel, the same shall be

considered by the Director and appropriate order made thereon. The

The present petitioner filed CWP No. 6613 of 2011 titled as

Suman Rani V/s State of Haryana and others and the same was

decided on 04.10.2011 in terms of CWP No. 8869 of 2011 titled as

Seema Rani V/s State of Haryana decided on 04.10.2011 as detailed

above. She was appointed as S.S. Mistress on 16.11.2007 in GHS

Nimnabad (find). Thereafter, she was dislocated on 04.12.2010 due to

Subject Combination.

I have gone through the Hon'ble Punjab and Haryana High

Court Order dated 04.10.2011 passed in CWP No. 6613 of 2011 as

detailed above, Hon'ble Punjab and Haryana High Court order dated

30.03.2011 passed by Ist Division Bench in CWP No. 6090 of 2010

titled as Tilak Raj V/s State of Haryana, order dated 13.09.2011

passed in CWP No. 6613 of 2011 titled as Smt. Suman Rani V/s State

of Haryana & Others, application of the said incumbent dated

26.09.2011 and various instructions and guidelines issued pertaining

to the appointment/adjustment of guest faculties in schools. Now he

has acquired the prescribed qualification while continuing as guest

teacher in the year 2008. Hence, it would be just, fair and equitable to

re-adjust Smt. Suman Rani on the said post in accordance with

adjustment guidelines of the Department dated 02.12.2008 and the

said incumbent-Smt. Suman Rani will continue upto 31.03.2012 only

as per judgement in Tilak Raj's case (Supra).
