All of the above 103 persons, on promotion as Senior Tax Assistants, will be placed in the

seniority list of that cadre, immediately below the last person appearing in the revised

panel for the V. Y.: 2014 - 15, as drawn up by the review DPC in implementation of the

judgement of the Hon'ble Apex Court in the N. R. Parmar case.

iii) Person appearing at S1.No. 21, who has passed the departmental examination for

ministerial staff in relaxed standard, is being allowed promotion as Senior Tax Assistant

against unreserved vacancies temporarily, keeping in abeyance the operation of DOP&T's

O.Mo.No.36012/45/2005-Estt.(Res.} dated 10.08.2010 in view of certain judgement of

the judiciary viz judgement of Hon'ble Punjab & Haryana High Court, in CWPNo. 13218

of 2009 (0&M), in the case of Lachhmi Narain Gupta & Ors. - vs. - Jarnai1 Singh & Ors.

and also in view of the fact that the said judgement is still under judicial review in the

Hon'ble Apex Court. The promotion of this person is subject to review of finality of the

matter either by DoP&Tor by the Hon'ble Supreme Court. He will be liable to reversion, if

required, on such review and he will not be entitled to claim any benefit of this promotion

on that event. The inter-se seniority of the above person in the promotional cadre of Sr.

Tax Assistant, as determined in the table above is provisional. It will be determined

finally on the finalization of the matter either by DoP&T or by the Hori'ble Supreme

Court.

iv) Person appearing at S1. Nos. 18, who has passed the departmental examination

for Ministerial Staff in General standard, is selected for promotion as Senior Tax

Assistant against available ST vacancies keeping in abeyance the DoP&T's O.M. dated.10.08.2010. Person appearing at S1. No. 16, who has passed the departmental

examination in general standard also, is temporarily adjusted against unreserved

vacancy due to non-availability of SC vacancy but subject to adjustment against future

SC vacancy. Such dispensation is adopted keeping the DoP&T'sOM dated 10.08.2010 in

abeyance.

v) Promotions of persons appearing at S1.Nos. 12 & 15 in the promotional cadre of

Sr. Tax Assistants are allowed completely on provisional basis. Such promotions will be

regularized only after the regularization of their services in the entry cadre ~of Tax

Assistants, on favourable verification of caste certificates produced by them at the time of

their joining at the entry grade.

vi) Promotion of the above said persons are given on the basis of the existing

Recruitment Rules as directed vide by Board's letter dated 17.06.2015, and as per the

Order No.124 r dated so" Sept., 2015/ F.No.5E/3/2001-02/Part-1Page 5 of 7

revised gradation lists of the feeder grade (TaxAssistant) as drawn up in implementation

of the Hon'ble apex court's judgement in N. R. Parmar case and as notified in Itax.net.

vii) The promotees concerned are also liable to be reverted without prior notice for any

reason at any time.

viii) The above persons are hereby asked to exercise their option within one month of

the date of promotion in the matter of fixation of pay on such promotion in terms of

Clarification 2 of O.M.F. No.lj Ij2008-1C G.I.M:F, Deptt. of Expenditure

(Implementation Cell) dated 13th September, 2008.

ix) The above persons may please note that in the event of their refusing promotion,

they will be debarred from promotion to the post of Sr. Tax Assistant for a period of one

year from the date of refusal of said promotion or till a next vacancy arises whichever is

later as per the D.O.P. & T's OMNo. 22011j5j91-Estt(D) dated 27.03.97.

PART-II: Posting

i) The officials will on promotion as Sr. Tax Assistant join in their respectiveoffices as mentioned in eol.5 until further orders.

ii) The promotees concerned are direoted to join on promotion at the earliest. Theyare also directed to intimate in case of declining promotion to the post of Sr. TaxAssistant, if any, to this office immediately.

iii) The above posting on promotion are purely temporary and .the promoteesconcerned are liable to be transferred to any office within the West Bengal & Sikkimregion at any time.

iv) Heads of office are requested to ensure that the copy of the joining report is sentto the office of the Addl. j J.C.I.T., Hqrs., (Personnel & Establishment), Kolkata as soonas the said person joins on promotion.
