Biosecurity (Serpentine Leafminer) Control Order 2020 under the Biosecurity Act 2015 I SATENDRA KUMAR Director Plant Biosecurity and Product Integrity Biosecurity and Food Safety Branch Department of Primary Industries Regional NSW with the authorisation of the Minister in pursuance of section 78 of the Biosecurity Act 2015 (ldquothe Actrdquo) and pursuant to Part 6 of the Act reasonably believing that this order is necessary to minimise or manage the biosecurity risk arising from the presence spread or increase of the pest serpentine leafminer within the State make the following control order Dated this 26th day of November 2020

2 Commencement

This control order commences on the date on which it is published on the Departmentrsquos website

3 Duration of control order

This control order has effect for 6 months from the date of commencement

4 Definitions

In this control order approved insecticide means a treatment that is approved by the APVMA or is a registered product for use on serpentine leafminer Note A list of permits approved by the APVMA and registered products for the management of SLM is available on the website of the Department of Primary Industries APVMA means the Australian Pesticides and Veterinary Medicines Authority

infested premises means premises that the person in charge knows or ought reasonably to know contains SLM host plants that are showing visible signs of leafminer damage leafminer damage means trails or lsquominesrsquo that can appear as light green to white winding trails or patterns on the surface of leaves or pods of a SLM host plant person in charge in relation to premises includes (a) the owner of the premises (b) a person who has the premises in their possession care custody or control serpentine leafminer or SLM means the pest of the species Liriomyza huidobrensis SLM Control Zone ndash see clause 6 SLM host plant means any plant belonging to a species specified in the Schedule and includes any part of such a plant SLM host potted plant means a SLM host plant that is being grown or raised in a pot seedling tray or other container the Act means the Biosecurity Act 2015

5 Biosecurity matter and biosecurity risk [s63(a)] (1) The biosecurity matter to which this control order relates is serpentine leafminer (2) The biosecurity risk to which this control order relates is the risk of an adverse

effect on the economy and the community that arises from the presence spread or increase of serpentine leafminer within New South Wales

6 SLM Control Zone ndash Whole of NSW [s63(b)]

(1) The control measures specified under this control order apply in relation to the

whole of New South Wales

(2) The control zone is called the SLM Control Zone 7 Regulation of movements out of infested premises in the SLM Control Zone

[ss63(d) 68 69(c) and (e)]

(1) A person in charge of an infested premises in the SLM Control Zone must ensure that a SLM host plant is not moved out of the infested premises unless one of the following control measures has been carried out

(a) the SLM host plant has been inspected and is not showing any visible sign

of leafminer damage or

(b) the SLM host plant has been treated in one of the following ways

(i) in the case of a SLM host potted plant ndash by saturation spraying by applying (by the method of spraying) an approved insecticide in accordance with all label directions or APVMA permit conditions for the treatment of SLM on all exposed parts of the SLM host potted plant (including the trunks stems leaves buds flowers fronds and other isolated parts) to the point of run-off

(ii) in the case of all other SLM host plants

(A) treated with an approved insecticide in accordance with all label

directions or APVMA permit conditions for the treatment of SLM or

(B) treated with methyl bromide fumigation at the rate of 32 gmsup3

for 3 hours at 21degC (2) This clause does not apply in relation to any of the following parts of a SLM host

plant (a) any fruit or vegetable (other than edible seed pods of peas (Pisus sp) and

beans (Phaseolus sp)) that does not have any leaves attached to it Notes 1 Like the leaves of SLM host plants edible seed pods of peas and beans can be

infested with SLM and show SLM damage and so are subject to the control measures in subclause (1)

2 Leaves that are attached to fruit and vegetables of SLM host plants are subject to the control measures in subclause (1)

(b) any roots or trunks that do not have any leaves attached to them (c) any grain seeds corms or tubers (d) any flowers that do not have any leaves attached to them (e) a part of the SLM host plant that has been processed including by being

cooked dried canned juiced or pickled (f) a part of the SLM host plant that has been prepared as hay or silage

(g) a part of the SLM host plant destined for waste or recycling by deep burial

or composting

2 Definitions

In this Instrument red sea urchin means fish of the species Heliocidaris tuberculata sea urchin and turban shell restricted fishery means the restricted fishery declared under Part 9 Division 1 of the Fisheries Management (General) Regulation 2019 TAC determination has the same meaning as in section 40A of the Act the Act means the Fisheries Management Act 1994

2 Definitions

In this Instrument red sea urchin means fish of the species Heliocidaris tuberculata sea urchin and turban shell restricted fishery means the restricted fishery declared under Part 9 Division 1 of the Fisheries Management (General) Regulation 2019 TAC determination has the same meaning as in section 40A of the Act the Act means the Fisheries Management Act 1994

3 Notice of TAC determination for red sea urchin

Pursuant to section 40H of the Act the TAC determination for red sea urchin in the sea urchin and turban shell restricted fishery for the fishing period 1 January 2021 to 31 December 2021 (both dates inclusive) as determined by the Total Allowable Fishing Committee pursuant to section 40D of the Act and clause 134 of the Fisheries Management (General) Regulation 2019 is 60 tonnes

infested premises means premises that the person in charge knows or ought reasonably to know contains SLM host plants that are showing visible signs of leafminer damage leafminer damage means trails or lsquominesrsquo that can appear as light green to white winding trails or patterns on the surface of leaves or pods of a SLM host plant person in charge in relation to premises includes (a) the owner of the premises (b) a person who has the premises in their possession care custody or control serpentine leafminer or SLM means the pest of the species Liriomyza huidobrensis SLM Control Zone ndash see clause 6 SLM host plant means any plant belonging to a species specified in the Schedule and includes any part of such a plant SLM host potted plant means a SLM host plant that is being grown or raised in a pot seedling tray or other container the Act means the Biosecurity Act 2015

5 Biosecurity matter and biosecurity risk [s63(a)] (1) The biosecurity matter to which this control order relates is serpentine leafminer (2) The biosecurity risk to which this control order relates is the risk of an adverse

effect on the economy and the community that arises from the presence spread or increase of serpentine leafminer within New South Wales

6 SLM Control Zone ndash Whole of NSW [s63(b)]

(1) The control measures specified under this control order apply in relation to the

whole of New South Wales

(2) The control zone is called the SLM Control Zone 7 Regulation of movements out of infested premises in the SLM Control Zone

[ss63(d) 68 69(c) and (e)]

(1) A person in charge of an infested premises in the SLM Control Zone must ensure that a SLM host plant is not moved out of the infested premises unless one of the following control measures has been carried out

(a) the SLM host plant has been inspected and is not showing any visible sign

of leafminer damage or

(b) the SLM host plant has been treated in one of the following ways

(i) in the case of a SLM host potted plant ndash by saturation spraying by applying (by the method of spraying) an approved insecticide in accordance with all label directions or APVMA permit conditions for the treatment of SLM on all exposed parts of the SLM host potted plant (including the trunks stems leaves buds flowers fronds and other isolated parts) to the point of run-off

(ii) in the case of all other SLM host plants

(A) treated with an approved insecticide in accordance with all label

directions or APVMA permit conditions for the treatment of SLM or

(B) treated with methyl bromide fumigation at the rate of 32 gmsup3

for 3 hours at 21degC (2) This clause does not apply in relation to any of the following parts of a SLM host

plant (a) any fruit or vegetable (other than edible seed pods of peas (Pisus sp) and

beans (Phaseolus sp)) that does not have any leaves attached to it Notes 1 Like the leaves of SLM host plants edible seed pods of peas and beans can be

infested with SLM and show SLM damage and so are subject to the control measures in subclause (1)

2 Leaves that are attached to fruit and vegetables of SLM host plants are subject to the control measures in subclause (1)

(b) any roots or trunks that do not have any leaves attached to them (c) any grain seeds corms or tubers (d) any flowers that do not have any leaves attached to them (e) a part of the SLM host plant that has been processed including by being

This Instrument is the Fisheries Management (TAC Determination ndash Red Sea Urchin) Instrument 2020

2 Definitions

In this Instrument red sea urchin means fish of the species Heliocidaris tuberculata sea urchin and turban shell restricted fishery means the restricted fishery declared under Part 9 Division 1 of the Fisheries Management (General) Regulation 2019 TAC determination has the same meaning as in section 40A of the Act the Act means the Fisheries Management Act 1994

3 Notice of TAC determination for red sea urchin

Pursuant to section 40H of the Act the TAC determination for red sea urchin in the sea urchin and turban shell restricted fishery for the fishing period 1 January 2021 to 31 December 2021 (both dates inclusive) as determined by the Total Allowable Fishing Committee pursuant to section 40D of the Act and clause 134 of the Fisheries Management (General) Regulation 2019 is 60 tonnes
