REQUIREMENTSAFTERAFFILIATION Anyschoolonaffiliationwiththeboardisrequiredtofulfillthefollowing requirements before starting classes on CBSEpatternaspertheconditionslaiddownintheaffiliationgrantletterandthesessionmentionedtherein:
• Clause 2.4.1: Staff and Service Conditions as per provisionscontainedinChapter5ofCBSEAffiliationByelaws
• Clause 2.4.2: Financial Resources as per the provisionscontainedinChapter6ofCBSEAffiliationByelaws.
• Clause2.4.3:FeesasperprovisionscontainedinChapter7ofCBSEAffiliationByelaws.
• Clause2.4.4:Electronic Clearing Service: Salary should be paid to the staffthroughElectronicClearingService(ECS)only.

• Clause2.4.5:ADMISSIONOFSTUDENTS(a) AdmissionintheschoolaffiliatedtotheCBSEshallbemadewithoutany
distinctionofgender,disability,religion,race,caste,creedandplaceofbirth etc. Reservation, if any, shall be governed by the applicableEducationAct/RulesoftheAppropriateGovernment.
(b) For the purpose of admission and extent of schools’ responsibility for
Free and Compulsory Education the school shall be governed by theprovisions of the Right to Children to Free andCompulsory EducationAct,2009andtherulesframedthereunder.
(c) TheschoolshallnottakeanydirectadmissionintheclassesXandXII(d) The school shall not take any direct admission in the classes X and XII
without following the procedure prescribed by the Board in this regard.

• Clause 2.4.6:CURRICULUMANDSYLLABUS(a) TheschoolwillfollowthecurriculumandthesyllabusprescribedbyCBSE/NCERT.
(b) The schoolwill follow the schemeof study for different classes asprescribedintheExaminationByelawsoftheBoard.
• Clause2.4.7:BOOKS(a) TheSchoolmayprescribe theNCERT textbooks in the classesandsubjects in which these have been published by the NCERT. Extremecareshouldbetakenintheselectionofbooksofprivatepublisherssothat there is no objectionable content that hurts the feeling of anyclass,community,genderoranyreligiousgroupinsociety.

b) The School shall put a list of prescribed books on itswebsite with the written declaration duly signed by theManager and the Principal to the effect that they havegonethroughthecontentsofthebooksprescribedbytheschool and own the responsibility. If a school is foundprescribing a book having any objectionable content, theresponsibilityforsuchcontentshallliewiththeschoolandactionwillbeinitiatedagainsttheSchoolbytheBoard.

• Clause2.4.8:QualityofEducationTheschoolmustbequalitydrivenandmust strive forexcellence inallaspectsofitsactivities.ItmustfollowthedirectionsissuedbytheBoardfromtimetotimeregardingintroductionofinnovativepracticesinareasofcurriculum,pedagogyandevaluation.• Clause2.4.9:Website Every affiliated school will develop their own website containingcomprehensive information such as Affiliation Status, details ofinfrastructure, details of teachers including qualifications, number ofstudents, address-postal and e-mail, telephone nos., copies of transfercertificatesissuedetcasmaybedirectedbytheboardfromtimetotime.Thewebsitesocreatedshouldalsohaveinformationwithregardstofeescharged.

• Clause2.4.10:PhysicalEducationTeacherEvery school should appoint Physical Education Teacher in theprescribed grade with PET to pupil ratio of 1:5 at each stage i.e.Primary Level/ Secondary Level and Sr. Secondary Level and theyshould be designated as PRT (Physical Education), TGT(PhysicalEducation)andPGT(PhysicalEducation).• Clause2.4.11:SpecialEducatorEverySecondaryandSeniorSecondaryschoolshouldappointaperson on full time basis for performing the duties of SpecialEducator. The appointment and qualifications of SpecialEducator shall be in accordance with guidelines laid down bythe Board and the minimum requirement s laid down by theRehabilitationCouncilofIndiainthisregard.

• 2.4.12:COUNSELOR&WELLNESSTEACHEREvery Secondary and Senior Secondary school shall appoint apersononfulltimebasisforperformingthedutiesofCounselor&Wellness teacher. Schoolhavingenrolmentoflessthan300students in classes from IX to XII can appoint a Counselor &WellnessTeacheronpart-timebasis.• 2.4.13:DUALAFFILIATIONA school affiliated with the Board is not allowed to have dualaffiliationi.e.simultaneousaffiliationwithtwoboardswiththesamesetofinfrastructureandland.In case the affiliationhasbeen grantedunder switchover category,theschoolisrequiredtowithdrawitsstudentsfromtheclassesoftheboard,towhichitwasearlieraffiliated,inphasedmanner.

• Clause2.4.14:COMMENCEMENTCERTIFICATETheBoard shall require the school to submit commencement certificate intheprescribedmannerandformattotheeffectthattheschoolhascompliedwith all the conditions imposed in the grant letter and the provisionscontainedinclause2.4andsub-clausetheretoandshallstartclassVIorIXorXIonconfirmationofaffiliation.TheformatofcommencementcertificateisgivenatAppendix–VIIIofAffiliationByeLaws,2018.
• Clause4.8:ENROLMENTANDSECTIONRESTRICTIONINEACHCLASSTheoptimumnumberofstudentsshallbe40ineachsection.Availabilityofone square meter Built-up Floor Area per child in the class rooms is anabsolute necessity in the school. Subject to this the details of the allowedsections, as per the rules of these byelaws and availability of land andinfrastructure,aregivenatAppendix–VofAffiliationByeLaws,2018.
EXTENSIONOFAFFILIATION
• The Board after initial affiliation may grant extension ofAffiliation fora furtherperiodof5yearsprovidedtheSchoolconformsfullytothenormsofaffiliationundertheseByelawsandtheotherconditionslaiddownforextensionfromtimetotime.
• Clause10.3.1: Itwillbe theresponsibilityof theschool toapplyforextensionofaffiliationwithrequisitefeeaspertimeframegiveninAppendix–IofAffiliationByeLaws,2018.
• Clause10.3.2:AffiliationgrantedtoaschoolwillremainvalidonreceiptofapplicationofaschoolforextensionofAffiliationsubjecttothefinaldecisionsoftheBoards.
APPLICATIONFORADDITIONALSUBJECTS• The schools affiliatedwith theBoardup to Senior Secondarylevel are allowed to sponsor candidates in the Board’sExamination in thespecifiedsubjects forwhichaffiliationhasbeengranted.However, theschoolmayrequireaddingmoresubjects for affording more choices to the candidates, theadditional subjects are allowed to the schools as perproceduregiveninensuingsub-clauses:
• Clause10.4.1: Itwillbe theresponsibilityof theschool toapply for additional subjects with requisite fee as per timeframegiveninAppendix-IofAffiliationByeLaws,2018.
APPLICATIONFORADDITIONALSUBJECTS:Contd.• Clause10.4.2:Theboardmayconductaninspectiontoassessthe suitability of the facilities available with respect to theteachingofthesubject(s)applied.
• Clause10.4.3:NoSchoolispermittedtostarttheclassesinthe applied additional subjects, evenduring thependencyofthe application. The school shall start classes in theseadditional subjects only after getting express approval fromtheBoard.
PeriodicInspectionandInspectionforExtensionofAffiliation• Clause 11.2.1: The Board may cause inspection of an affiliatedSchoolat the timeofextensionorafterspecifiedperiodsany timeduring the affiliation period. The periodicity, of such inspectionsshallbedeterminedbytheBoardfromtimetotime.
• Clause11.2.2: ThePeriodic Inspectionmaybe carriedoutbyanInspection Committee consisting of one or more membersappointedbytheBoard.
• Clause 11.2.3: Reliance will be placed on the outcome basedmethodology for making the inspection process more academicoriented.
Clause11.4:SURPRISEINSPECTION• TheBoardmayany timegetanaffiliatedschool inspectedbyacommittee of one ormorememberswithout giving any notice totheschool.

iv) anunaidedschoolnotreceivingaidorgrantstomeetwholeorpartofitsexpensesfromtheappropriateGovernmentoralocalauthority
DEFINITIONOFA‘SCHOOL’ASPERRTE:
RTEClause12(1) ForthepurposeofthisAct,aschool:(c) specified in sub-clauses (iii) and (iv) of clause (n) ofsections 2 shall admit in class I, to the extent of at leasttwenty-fiveper centof the strengthof that class, childrenbelonging to weaker section and disadvantaged group inthe neighbourhood and provide free and compulsoryelementaryeducationtillitscompletion:• Provided further that where a school specified in clause(n) of section 2 imparts pre-school education, theprovisionsofclauses(a)to(c)shallapplyforadmissiontosuchpre-schooleducation.
(1) No school, other than a school established, owned orcontrolledbytheappropriateGovernmentofthelocalauthority,shall after the commencement of this Act, be established offunction,withoutobtainingacertificateofrecognitionfromsuchauthority, bymaking an application in such form ofmanner, asmaybeprescribed.(2) Theauthorityprescribedundersub-section(i)shall issuethecertificateofrecognitioninsuchform,withinsuchperiod,insuchmanner,andsubjecttosuchconditions,asmaybeprescribed:• Provided thatno such recognition shallbegranted toa schoolunlessitfulfilsnormsandstandardsspecifiedundersection19.

(3) Onthecontraventionoftheconditionsofrecognition,theprescribedauthorityshall,byanorderinwriting,withdrawrecognition:• Providedthatsuchordershallcontainadirectionastowhichoftheneighbourhoodschool,thechildrenstudyinginthederecognisedschool,shallbeadmitted:
• Providedfurtherthatnorecognitionshallbesowithdrawnwithoutgivinganopportunityofbeingheardtosuchschool,insuchmanner,asmaybeprescribed.
RTECLAUSE18
(4) Witheffectfromthedateofwithdrawaloftherecognitionundersub-section(3),nosuchschoolshallcontinuetofunction.
(5) Anypersonwhoestablishesorrunsaschoolwithoutobtainingcertificateofrecognition,orcontinuestoranaschoolafterwithdrawalofrecognition,shallbeliabletofinewhichmayextendtoonelakhrupeesandincaseofcontinuingcontraventions,toafineoftenthousandrupeesforeachdayduringwhichsuchcontraventioncontinues.
RTECLAUSE18
(1)No school shall be established, or recognised, under section18,unlessitfulfilsthenormsandstandardsspecifiedintheSchedule.(2)WhereaschoolestablishedbeforethecommencementofthisActdoesnotfulfil thenormsandstandardsspecified intheSchedule, itshall take steps to fulfil such norms and standards of its ownexpenses, within period of three years from the date of suchcommencement.(3)Whereaschoolfailstofulfilthenormsandstandardswithintheperiodspecifiedundersub-section(2),theauthorityprescribedundersub-section(i) of section 18 shall withdraw recognition granted tosuchschoolinthemannerspecifiedundersub-section(3)thereof.
RTECLAUSE19
(4)Witheffectfromthedateofwithdrawalofrecognitionundersub-section(3),noschoolshallcontinuetofunction.(5) Any person who continues to run a school after therecognitioniswithdrawn,shallbeliabletofinewhichmayextendtoonelakhrupeesandincaseofcontinuingcontraventions,toafine of ten thousand rupees for each day during which suchcontraventioncontinues.

• TheBoardincompliancetosection18(1)ofRTE2009Act stipulates underAffiliationBye Laws,2018 that “Schools seeking affiliationwith theBoard shall submit formal prior RecognitionCertificate from concerned State EducationDepartmentasperextantrulesandprovisionscontainedinRTEAct-2009”.
• In Addition, towards compliance of NationalCurriculum Framework-2005 and RTE-2009,making a minimum of 5 days of in-servicetraining programmes per year of teachersmandatory(Chapter16ofAffiliationByeLaws).
