    They1re still holding onto the hope that after @/ years of failed federal

    inter%entions, this time, !ashington 3ill get it right$

    "n his address tonight, President Obama lauded his Ra&e to the Top

    Program and &ontinued to promote national standards$ He also taled

    he plans to &ontinue !ashington1s edu&ation spending spree$

    3ould allo3 states to opt out of onerous federal programs su&h as those

    Tonight, the President, defending his health &are plan, stated A"f you

    ha%e ideas about ho3 to impro%e this la3 by maing &are better or mor

    affordable, " am eager to 3or 3ith you$ Unfortunately, he did not

    e7press any &on&ern regarding the &onstitutionality of the bill$ *s

    Heritage has des&ribed here, the health &are mandate is both

    unpre&edented, and un&onstitutional$ * federal &ourt in irginia has

    already agreed, de&laring the mandate un&onstitutional, and a ma2ority

    of states are &hallenging the mandate in &ourt in =lorida$

    The mandate1s &onstitutional defe&t is a ma2or problem for Obama1s

    offer to 2ust modify the e7isting, ill&on&ei%ed bill, be&ause as President
