The Georgia Composite Medical Board (GCMB) held its regular meeting on December 5, 2019,
at 2 Peachtree Street, Atlanta, GA 30303, to consider Medical Board matters.

CALL TO ORDER
Dr. Collins called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m.
AGENDA
Dr. Retterbush submitted a motion, seconded by Dr. Robinson to approve the agenda of the
December 5, 2019 meeting. The motion carried unanimously.
MINUTES
Mr. Law made a motion to approve the minutes of the November 7, 2019 meeting. Dr.
Retterbush seconded the motion and it carried unanimously.
CHAIR’S REPORT
Dr. Collins made the following report:
1. January meeting is the 9th of next month – anyone not able to attend?
2. The legislative session starts next month we may have some legislative items regarding the
compact and the laser law.
EXECUTIVE DIRECTOR’S REPORT
Ms. Hughes made the following report:
1. Email from Laureen Austin regarding a Board Certified Plastic Surgeon to provide office

procedures, i.e., fat grafts, under local anesthesia. The Board recommends referring Ms.
Austin to the Office Based Surgery Guidelines.
2. Email from Thalia Paz regarding Lasers. The Board recommends sending her the
Frequently Asked Questions for Lasers.
3. Email from Grace Foster regarding physicians dispensing CBD oil in office. The Board
recommends advising Ms. Foster that there are no rules or regulations for CBD oil. The
Board recommends sending the Low THC Rules.
4. Email from Commander Bobbi McGraw, Valdosta Police Department regarding AED.
The Board recommends advising Commander McGraw that you must be a licensed MD
to manage AED.
5. Email from Rebecca Kennedy
May a PA or APRN (who has been properly delegated the authority to prescribe
Schedule III controlled substances and pursuant to his/her job description or approved
Nurse Protocol Agreement, as applicable) enter into and sign a written treatment
agreement (or pain management agreement) with his/her patient when prescribing a
Schedule III controlled substance and see such patients for the required clinical visits in
order to satisfy the requirements of Rule 360-3-.06(f)? See Rules.
6. Email from Lisa Faircloth regarding Office-Based Anesthesia and Surgery Guidelines.
The Board emphasized that the Guidelines are recommendations.
7. Email from Kait James regarding laws regulating microneedling. The Board referred to
the Physical Therapy Board or Cosmetology Board.
8. Email from Patricia McCarty, M.M. – Highlights from October 23-25, 2019 FSMB
Board of Directors meeting. The Board accepted as information.
RULES COMMITTEE REPORT
Dr. Gross gave the following report.

PRESENTATION
The Board had a presentation from Dr. Rob Schreiner and Dr. Martha Wilber on the proposed
changes to Rule 360-3-.07 “Practice Through Electronic or Other Such Means.” The Board also
heard from Dr. Jean Sumner on this matter. There were other comments from the attendees.

After a lengthy discussion, the Board asked the group to prepare proposed changes and submit to
the Board for consideration at the January meeting.
CLOSED SESSION
Dr. Retterbush motioned seconded by Dr. Harbin to go into closed session to discuss
investigations and disciplinary matters, and it carried unanimously.

NURSE PROTOCOL ADVISORY COMMITTEE
Dr. Gross presented the Nurse Protocol Report:
The Committee recommended the following:
1. I had a question regarding placing IUDs neither of the MDs in my practice place IUDs. If
the delegating physician isn’t placing IUDs, then the APRN cannot place IUDs
either.
2. The scenario is an FNP works in one of our locations under the direction of a
Psychiatrist. In the past we understood that a FP Physician could not supervise a
Psychiatric Certified APRN because their specialty needed to be consistent however this

is a case where a Family Nurse Practitioner is supervised by and Psychiatrist – this FNP
has been trained in all areas of family medicine included mental health/behavioral health
in their training. The requirements for a FNP to work under a delegating physician
that practices psychiatry is that one must have at least one year of clinical
experience, a semester of coursework in psychiatry or one’s certification must
corresponds to the delegating physician.
3. Is an APRN allowed to keep prescribing even though it’s been over 30 days since the
application was submitted to the Board? The APRN was initially denied due to not
providing sufficient evidence of experience in psychiatry but is now resubmitting with a
resume as proof. If the application is going through the process to be approved, then
it is alright for an APRN to keep prescribing.
4. The APRN Committee asked the Board of Nursing if a psychiatric nurse practitioner
could be trained on the job to assess and prescribe for basic primary care needs like
hypertension and diabetes. The Board of Nursing responded that it would be within the
Committee’s discretion to determine what medical acts could be delegated to an
advanced practice registered nurse through a nurse protocol agreement.

using MAT (Medication Assisted Treatment); with the prescription of Buprenorphine (a
