Dr. Retterbush made a motion, seconded by Dr. White, to approve the minutes of the

September 13, 2012 Board meeting. The motion carried unanimously.

EXECUTIVE DIRECTOR’S REPORT

Ms. Hughes presented the following report to the Board:

1. In response to a request from Lori Donaldson regarding a non-physician being a

member and own equity in a LLC, the law is silent on the corporate practice of

medicine and Ms. Donaldson should consult an attorney for this research.

2. In response to a request from Barbara Crouse regarding if and when an OB/GYN

can discontinue care of a patient – an OB/GYN physician may discontinue care of

any patient as long as sufficient notice is given. .

3. In response to a letter from Todd Moody regarding cardiac devices to patients, the

Board requires more information to determine if this falls within OCGA 43-34-

31.

4. The Board determined that the legality of advertising for physicians to sign orders

for flu shots is the same as for pharmacists, making sure that the law is followed.

Board regarding Institutional License. Peter Buckley, Lee Little, and Meg Fisher

presented the information to the Board.
