95 HANOVER DR. SEWER REPAIR – PROJECT #20-24 Sealed bids for the repair and replacement of two sewer service laterals located at 95 Hanover

Drive in North Litchfield (Pawleys Island) are due on or before Wednesday, August 5, 2020 at

3:00 pm. The Contractor shall repair the service lateral for the above listed address from the

mainline (including the wye) to the Right of way, and establish a 6” cleanout, which indicates the

end of the District’s responsibility. The other lateral, which serves the houses across the street,

shall be repaired to the edge of the pavement. (Cleanouts will NOT need to be established for

this second lateral). The main line is 8” truss material and the service line shall be 6” SDR 35

PVC. Pricing shall include unit pricing for all labor, equipment, and materials for proper

installation of all required items and following Georgetown County Water and Sewer District

(GCWSD), South Carolina Department of Health and Environmental Control (SCDHEC), and

South Carolina Department of Transportation (SCDOT) requirements and regulations. The

District will be providing the SCDOT Encroachment Permit for this project. The contractor shall

certify compliance with the S.C. Illegal Immigration Reform Act. Without in anyway limiting a

party’s liability, or responsibility under the agreement, the Contractor will, at its sole expense,

procure and maintain in effect during the term of this Agreement, with respectable and financially

responsible insurance companies the following minimum insurance. Approved contractors shall

submit certificates of insurance to the District for the following policies: Comprehensive general

liability insurance, including personal injury liability, Blanket contracted liability, and Property

damage liability coverage, General Aggregate $1,000,000, Personal injury $1,000,000, each

occurrence $500,000, automobile bodily injury and property damage liability insurance covering

owned, non-owned, rental, or hired autos. The combined single limit for bodily injury and property

damage shall not be less than $500,000, statutory workers compensation and employee liability

insurance as required by state law, Professional liability insurance in an amount not less than

$100,000. NO BID, PERFORMANCE, OR PAYMENT BONDS will be required for this project.

The sealed Bids shall be received by the Georgetown County Water and Sewer District at their

office located at 456 Clearwater Drive, Pawleys Island, S.C. until 3:00 PM, Wednesday, August

5, 2020. If mailing your Bid, mail to PO Box 2730 Pawleys Island, SC 29585. Georgetown

County Water and Sewer District is not responsible for late mail delivery. The District reserves

the right to reject any and all Bids.

Bid Item Description 

 

  The Hanover Dr. Sewer Repair project will consist of repairing two sewer service laterals off an 8” Truss pipe main.  The laterals shall be replaced with 6” PVC.  The gravity main at this location is approximately 12‐13 feet deep and along the edge of pavement along Hanover Drive in the North Litchfield Community.  CCTV attempts into the main line discovered lots of sand and silt near the laterals and the District was not able to get quality video.  

1 – 6” PVC DR35 ‐ Green 

This  item shall be paid out per  linear foot of pipe  installed/replaced.   All  labor, materials, and equipment required to complete the necessary repair shall be included in this cost.  The gravity main is approximately 12 ‐ 13 feet deep and therefore a trench box or other trench stabilization method will be required.   The cost under this  item shall also  include pipe material, pipe  lube, cleanouts, bedding stone, suitable fill, compaction, and base course material and other any other materials or equipment necessary to make the repair.  It shall also include any cost needed for connection of  the  sewer  lateral  to  the  truss main  line.   This may  include 8” PVC pipe and a Truss/PVC transition coupling.  Contractor shall include any costs needed for trench stabilization.  Contractor shall verify elevations and slopes to ensure the proper grade/slope of the lateral to the main.   A Post CCTV video inspection will be conducted after the repair.  The Contractor shall notify GCWSD staff immediately after repair is made to schedule CCTV.  

2 – 2” Asphalt Road Patch 

This  item  shall  be  paid  out  per  square  yard  and  include  all  labor, material,  and  equipment required to patch the existing roadway with a 2” patch in accordance to SCDOT specifications.  Contractor shall compact the road base (cost included under item 1) to ensure patch does not settle.  Approval of patch work shall be up to GCWSD and SCDOT.   

3– Asphalt Road Overlay 

This  item  shall  be  paid  out  per  square  yard  and  include  all  labor, material,  and  equipment required  to  overlay  the  existing  roadway  with  a  1.5”  overlay  in  accordance  to  SCDOT specifications.   The overlay shall cover both  lanes of the roadway and extend 25 feet past the trench excavation.  Approval of the overlay shall be up to GCWSD and SCDOT.   

4 – Well Point System 

This item shall be paid out in a lump sum cost and shall include all labor, material, and equipment required to install and maintain the well point system.  Contractor shall monitor the well point system  to ensure  there  is no  flooding of  yards during  the process  and  shall  re‐establish  any ditches and culverts that maybe compromised from the dewatering process.

5 – Concrete Driveway Repairs – 6” Thick  

This  item  shall  be  paid  out  per  square  yard  of  concrete  and  include  all  labor, material,  and equipment required to repair existing concrete driveways that have been damaged during the sewer repair.  Concrete repairs shall be done in accordance to SCDOT specifications and GCWSD details included in the drawings.   The Contractor shall be responsible for any quantity above that listed on the bid tab sheet. 

6 – Seeding / Sod Yard  

This item shall be paid out in lump sum to seed or sod the grassed yards that will be disturbed during the repair of the sewer gravity main.  Cost shall include all labor, material, and equipment required to repair yards back to pre‐existing conditions.   Approval shall be up to GCWSD and SCDOT and final payment will not be made until grass has been established. 

 

It is the responsibility of the contractor to schedule a site visit prior to bid submittal to ensure full expectations and existing conditions for the project.   Site visits with staff can be scheduled by calling Matt Lowenbach at 843‐436‐6156, however staff is not required to be present during site visit.  Record drawings and details are attached to the bidding documents as a resource to the bidding contractor however, it will be the contractor’s responsibility to verify field conditions on site, including notification to 811 before work is to begin.

AGREEMENT BETWEEN OWNER AND CONTRACTOR

FOR CONSTRUCTION CONTRACT

THIS AGREEMENT is by and between Georgetown County Water and Sewer District (“Owner”) and . .(“Contractor”). Owner and Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows: ARTICLE 1 – WORK 1.1 Contractor shall complete all Work as specified or indicated in the Contract Documents. The Work is

generally described as follows:

Furnish all labor, equipment, and materials as required or as necessary to complete the point repair located at 95 Hanover Dr in the North Litchfield Community of Georgetown, SC. The Contractor shall repair the service lateral for the above listed address from the mainline (including the wye) to the Right of way, and establish a 6” cleanout, which indicates the end of the District’s responsibility. The other lateral, which serves the houses across the street, shall be repaired to the edge of the pavement. The main line is of 8” Truss material. The Contractor shall account for repairing the wye onto the main as well as the 6” service line. All material replaced shall be SDR 35 PVC material. The Contractor has looked over all Contract Documents, has visited the site and has full understanding of all project requirements. Unit costs are listed below in Section 5.01 B. All work shall be done in accordance and acceptance to Georgetown County Water and Sewer District (GCWSD), South Carolina Department of Health and Environmental Control (SCDHEC), and South Carolina Department of Transportation (SCDOT) specifications and regulations.

ARTICLE 2 – THE PROJECT 2.01 The Project for which the Work under the Contract Documents may be the whole or only a part is

generally described as follows:

95 Hanover Dr. Sewer Repair – GCWSD Project #20-24 ARTICLE 3 – ENGINEER 3.01 The original project was designed by Leon Campbell & Associates. However, seeing as this is a repair

project, a new design has not been completed. Marked up record drawings showing the area in need of repair have been provided by the owner, Georgetown County Water and Sewer District. The owner assumes all duties and responsibilities, and have the rights and authority assigned to owner in the Contract Documents in connection with the completion of the Work in accordance with the Contract Documents.

ARTICLE 4 – CONTRACT TIMES 4.01 Time of the Essence

A. All time limits for Milestones, if any, Substantial Completion, and completion and readiness for

final payment as stated in the Contract Documents are of the essence of the Contract.

4.02 Days to Achieve Completion and Final Payment

A. The Work will be completed within 45 calendar days of the Notice to Proceed. 4.03 Liquidated Damages

A. Contractor and Owner recognize that time is of the essence of this Agreement and that Owner will suffer financial loss if the Work is not completed within the times specified in Paragraph 4.02 above, plus any extension thereof allowed in accordance with Article 12 of the General Conditions. The parties also recognize the delays, expense, and difficulties involved improving in a legal or arbitration preceding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty), Contractor shall pay Owner $100.00 for each day that expires after the time specified in Paragraph 4.02 for Completion until the Work is complete.

ARTICLE 5 – CONTRACT PRICE 5.01 Owner shall pay Contractor for completion of the Work in accordance with the contract Documents an

amount in current funds equal to the sum of the amounts determined pursuant to Paragraphs 5.01.A, 5.01.B, and 5.01.C below:

As provided in the General Conditions, estimated quantities are not guaranteed, and determinations of actual quantities and classifications are to be made by owner as provided in the General Conditions. Unit prices have been computed as provided in the General Conditions.

ARTICLE 6 – PAYMENT PROCEDURES 6.01 Submittal and Processing of Payments

A. Contractor shall submit Applications for Payment in accordance with the General Conditions. Applications for Payment will be processed by owner as provided in the General Conditions.

6.02 Progress Payments; Retainage

A. Owner shall make progress payments on the basis of Contractor’s Applications for Payment on or about the twentieth (20th) day of each month during performance of the Work as provided in Paragraphs 6.02.A.1 and 6.02A.2 below. All such payments will be measured by the schedule of values established as provided in the General Conditions (and in the case of Unit Price Work based on the number of unites completed) or, in the event there is no schedule of values, as provided in the General Requirements:

1. Prior to Substantial Completion, progress payments will be made in an amount equal to

the percentage indicated below but, in each case, less the aggregate of payments previously made and less such amounts as Engineer may determine or Owner may withhold, including but not limited to liquidated damages, in accordance with the General Conditions:

a. 90 percent of Work completed (with the balance being retainage); and b. 90 percent of cost materials and equipment not incorporated in the Work (with the

balance being retainage).

2. Upon written request by the Contractor and a determination by the owner that the work has reached fifty (50) percent complete, no additional retainage will be withheld unless the Owner deems it necessary to protect the interest of the Owner. If approved by the owner, the retainage withheld after the fifty (50) percent completion milestone will equal the total contract value times five (5) percent until the Work is substantially complete.

3. Upon Substantial Completion, Owner shall pay an amount sufficient to increase total

payments to Contractor to 95 percent of the Work completed, less such amounts as owner shall determine in accordance with the General Conditions.

A. Upon receipt of the final Application for Payment accompanied by owners recommendation of payment in accordance with the General Conditions, Owner shall pay Contractor as provided in the General Conditions the remainder of the contract Price as recommended by owner less any sum Owner is entitled to set off against, including but not limited to liquidated damages.

ARTICLE 7 – INTEREST 7.01 All moneys not paid when due as provided in the General Conditions shall bear interest at the maximum

legal rate. ARTICLE 8 – CONTRACTOR’S REPRESENTATIONS 8.01 In order to induce Owner to enter into this Agreement Contractor makes the following representations:

A. Contractor has examined and carefully studied the Contract Documents and the other related data identified in the Bidding Documents.

B. Contractor has visited the Site and become familiar with and is satisfied as to the general, local,

and Site conditions that may affect cost, progress, and performance of the Work.

C. Contractor is familiar with and is satisfied as to all federal, state, and local Laws and Regulations that may affect cost. Progress, and performance of the Work.

D. Contractor has carefully studied all: (1) reports of explorations and test of subsurface conditions

at or contiguous to the Site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or contiguous to the Site (except Underground Facilities) which have been identified in the Contract Documents as provided in the General Conditions and (2) reports and drawings of a Hazardous Environmental Condition, if any, at the Site which has been identified in the Contract Documents as provided in the General Conditions.

E. Contractor has obtained and carefully studied (or assumes responsibility for doing so) all

additional or supplementary examinations, investigations, explorations, test, studies, and data concerning conditions (surface, subsurface, and Underground Facilities) at or contiguous to the Site which may affect cost, progress, or performance of the Work or which relate to any aspect of the means, methods, techniques, sequences, and procedures of construction to be employed by Contractor, including any specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents, and safety precautions and programs incident thereto.

F. Contractor does not consider that any further examinations, investigations, explorations, test,

studies, or data are necessary for the performance of the Work at the Contract Price, within the Contract Times, and in accordance with the other terms and conditions of the Contract Documents.

G. Contractor is aware of the general nature of work to be performed by Owner and others at the

Site that relates to the Work as indicated in the Contract Documents.

H. Contractor has correlated the information known to Contractor, information and observations obtained from visits to the Site, reports and drawings identified in the Contract Documents, and all additional examinations, investigations, explorations, tests, studies, and data with the Contract Documents.

I. Contractor has given Engineer written notice of all conflicts, errors, ambiguities, or discrepancies

that Contractor has discovered in the contract Documents, and the written resolution thereof by Engineer is acceptable to Contractor.

J. The Contract Documents are generally sufficient to indicate and convey understanding of all

terms and conditions for performance and furnishing of the Work.

K. Contractor and its Subcontractors are financially solvent, able to pay all debts as they mature and possessed of sufficient working capital to complete the Work and perform all obligations hereunder.

L. Contractor is able to furnish the plan, tools, materials, supplies, equipment and labor required to

complete the Work and perform its obligations hereunder.

M. Contractor is authorized to do business in the State of South Carolina and properly licensed by all necessary governmental and public and quasi-public authorities having jurisdiction over it and over the Work and the Project.

N. Contractor’s execution of this Agreement and its performance thereof is within its duly

authorized powers.

O. Contractors possesses the experience and expertise in the administration, construction, management, and superintendence of projects of the size, complexity and nature of this particular Project, and that it will perform the Work with the care, skill and diligence of such a Contractor.

ARTICLE 9 - MISCELLANEOUS 9.00 Terms

A. Terms used in this Agreement will have the meanings sated in the General Conditions and the Supplementary Conditions.

9.01 Assignment of Contract

A. No assignment by a party hereto of any rights under or interests in the Contract will be binding on another party hereto without the written consent of the party sought to be bound; and specifically but without limitation, moneys that may become due and moneys that are due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents.

9.02 Successors and Assigns

A. Owner and Contractor each binds itself, its partner, successors, assigns, and legal representatives to the other party hereto, its partners, successors, assigns and legal representatives in respect to al covenants, agreements, and obligations contained in the contract Documents.

9.03 Severability

A. Any provision or part of the Contract Documents held to be void or unenforceable under any Law or Regulation shall be deemed stricken, and all remaining provisions shall continue to be valid and binding upon Owner and Contractor, who agree that the Contract Documents shall be reformed to replace such stricken provision or part thereof with a valid and enforceable provision that comes as close to possible to expressing the intention of the stricken provision.
