The following communication, dated 21 October 1981, has been received from thePermanent Mission of Peru.

STATE TRADING

1. By virtue of Legislative Decree No. 216 of 15 July 1981, economic activitiesreserved to the State, including commercial activities, may only be instituted forreasons of social interest or national security recognized by law. In such casesthe State shall conduct such activities:

- exclusively, or

- in association.

2. For the conduct of activities reserved to the State, only entities of thefollowing forms may be used: public-law enterprises, State enterprises governed byprivate law and mixed-economy enterprises.

3. In the case of association, persons other than State organs may participate inreserved activities only when granted a concession by the State.

4. The Peruvian State acts in the entrepreneurial sphere through the following:

- public-law enterprises- State enterprises governed by private law- mixed-economy enterprises- State shareholdings.

5. Public-Law enterprises are legal persons governed by public law or entities towhich that status has been expressly accorded, and they have the powers inherent inpublic administration or governmental authority under public law.

6. State enterprises under private law are legal persons governed byprivate law whose capital belongs entirely to the State. They may only takethe form of limited liability companies.

7. Mixed economy enterprises are legal persons governed by private law,which may only take the form of limited liability companies, and in thecapital and management of which the State participates in association withthird parties.

8. State shareholding consists in participation of the State in corporatebodies governed by private law, which do not possess the necessarycharacteristics to be classed as mixed-economy enterprises.

9. The following Peruvian public-Law enterprises have been converted intoprivate-law State enterprises:

Exceptionally, and until promulgation of further legal provisions, theseenterprises will retain their public-law attributes by delegation.

To fulfil the requirement of a notification concerning State-tradingenterprises coming within the scope of Article XVII, paragraph 1 of GATT, inconformity with the decision taken by the CONTRACTING PARTIES at thetwentieth session, the necessary information on the enterprises engaged intrade is annexed.

As regards the list of products imported under prior licensing, adetailed list is attached. This list is covered by ministerial DecisionNo. 715-80-EF/II of 12 September 1980 and additional provisions.

II. REASONS FOR THE CONCESSION

- The oil industry and trade in petroleum, similar hydrocarbons andtheir derived products, as well as basic petrochemicals, are ofpublic utility and essential for the complete security of the State.

- To maintain the profitability of production plants, fulfil integrationcommitments and ensure national supplies of essential and/orstrategic goods and products.

III. OPERATION OF THE ENTERPRISE

PETROPERU trades on the international market, making exports and/orimports according to the type of transaction carried out.

- In the case of crude oil, only firms which have operating contractsconcluded with PETROPERG may make export sales.

- PETROPERU has the concession for imports of crude oil and fuels.

- Private firms may freely import lubricant bases as an input forpreparation of the final product: lubricating oils and greases.

- In the case of petrochemicals, private traders are permitted toimport freely (except the products listed in paragraph 1 above).

- There is free competition between private traders in the marketingof the chemical products handled by PETROPERU.

DETERMINATION OF QUANTITIES

- The criterion for determining exportable quantities, is the surplusavailable after national demand has been satisfied.

- The quantities to be imported are determined on the basis of users'requirements on the domestic market.

- Exports may be made to any country without distinction, except wherean embargo has been imposed by the United Nations (case ofSouth Africa).

- In making imports, account is taken of the needs of users and of thespecifications called for by them and by PETROPERU.

COMPARISON OF PRICES

- Export prices fluctuate according to conditions on the internationalmarket (determined by supply and demand). The domestic selling pricefor the same product is based on manufacturing cost and marketingexpenses, plus a reasonable profit.

- Resale prices of imports are based on the cost of the product andthe profit needed to cover investments and expenses. In the case offuels, prices are fixed by the Government. The fuels, lubricantbases and chemical products imported by PETROPERU are those notproduced in the country.

- Long-term contracts are concluded only for fuels and lubricantbases.

PETROPERU makes its imports mainly in the United States Gulf andCaribbean areas because conditions of competition are favourable there.Exports are made to Japan under an agreement between PETROPERU and JAPECO(Japan Petroleum OiL Company) for the construction of the North Peru OilPipeline. Imports are made mainly from the Caribbean area because thismarket meets our needs.

III. OPERATION OF THE ENTERPRISE

- MINPECO is exclusively concerned with the export of ores.

- It competes freely with domestic and internationaL traders for theproduction not reserved to it by Legislative Decree No. 44.

- Domestic supplies take priority. Exportable suspluses are Calculatedby subtracting from total production what is required for the domesticconsumption by foundries. ,-,i;-\<es and processing plants.

EMPRESA NACIONAL PESQUERA S.A. (PESCAPERU S.A.)

(National Fisheries)

I. SPECIAL CONCESSIONS

Imports of fish oil for direct human consumption mixed with vegetable oil.

Legal basis

- Legislative Decree No. 54 of 20 March 1981.

II. REASONS FOR THE CONCESSION

The purpose of this measure is to reduce the price of this essential itemof the people's diet.

Legislative Decree No. 17 of 16 January 1981 authorizes PESCAPERU toimport 60,000 metric tons of fish oil.

III. OPERATION OF THE ENTERPRISE

PESCAPERU is an enterprise which carries on production and marketingactivities for products prepared from marine biological species for direct orindirect human consumption and for industrial uses.

- The enterprise makes both exports and imports.

- Private traders may import oil, since there is no legal obstacle totheir doing so.

- There is free competition between private traders and PESCAPERU.

- In deciding on imports and/or exports priority is given to thedomestic needs of the country.

- Exports are made only under commercially competitive conditions ofsupply and demand.

- In making imports of oil, assessments are based on expediency,quality and prices offered.

- Domestic prices are fixed on the basis of the average prices ofimports and exports during the preceding quarter.

- No long-term contracts are made.

EMPRESA SIDERURGICA DEL PERU (SIDERPERÚ)(Iron and Steel Corporation of Peru)

I. SPECIAL CONCESSIONS

Corrugated bars for building.

This is the only product which requires a prior import licence(industrial sector transaction).

Legal basis

Ministerial Order No. 380-81 EF/CO.

II. REASONS FOR THIS PREROGATIVE

The prior licensing is to regulate imports in accordance with theproduction programme of SIDERPERU, since otherwise the low tariff forcorrugated bars (5 per cent) would encourage uncontrolled imports, whichwould affect national production.

III. OPERATION OF THE ENTERPRISE

SIDERPERU is a producer which markets its own products using distributionchannels, either direct or through traders, to reach the finaL user.

It makes occasional exports and periodical imports, by public tender, ofcold-rolled coils for the production of tinplate.

- At present there is free competition between private importers andSIDERPERU.

- Private traders are permitted to import iron and steel products.

- Imports are fixed according to the results of the budget for salesand the production programme.

EMPRESA NACIONAL DE COMERCIALIZACION DE INSUMOS (ENCI)

(National Imports Marketing Corporation)

I. PRODUCTS FOR WHICH ENCI HAS EXCLUSIVE MARKETING RIGHTS

(a) Cotton fibre and seed

The Corporation is responsible for the domestic and foreign marketingof all cotton grown in the country.

- Under Decree Law No. 20736 of 17 September 1974, the State assumedexclusive rights for the domestic marketing of cotton fibre and seed,as from the crop-year 1975-76. It undertakes marketing for theEmpresa Péblica de Harina y Aceite de Pescado (EPCHAP) (Fish Meal andFish Oil Corporation). Supreme Decision No. 072-78 of 25 October 1978provides for the transfer of marketing functions from EPCHAP to ENCI.

(b) Coffee

ENCI has the exclusive right to sell, on the international market, thecoffee supplied by growers and traders.

Domestic marketing is carried out direct by the growers and tradersthemselves.

- By Decree Law No. 19832 of December 1972, the State undertook theforeign marketing of coffee, charging the Empresa Publica de ServiciosAgropecuarios (EPSA) (Public AgricuLtural Services) with exclusiveresponsibility for the export of coffee, and of its sub-products andderivatives of all kinds.

- Supreme Decision No. 072-78-PE of 24 October 1978 provides that ENCIshall be responsible for coffee exports as from 1 November 1978.

(c) Fertilizers

ENCI is exclusively responsible for the import and domestic marketingof fertilizers, including national production. For domestic marketing ituses a network of approximately 350 private sales agents.

- Decree Law No. 20705 of 27 August 1974 grants exclusive rights forthe import and domestic marketing of fertilizers.

- Supreme Decision No. 039-76-CO/CI of 17 March 1976 makes ENCIresponsible for the marketing of fertilizers produced by FERTISA andINDUS.

- By a contract of 7 December 1976, ENCI assumed responsibility formarketing the ammonium nitrate produced by the Cachimayo Corporation.

- Supreme Decision No. 106-77-CO/AJ of 18 August 1977 makes ENCIexclusively responsible for the domestic and foreign marketing of thenational output of phosphate rock.

(d) Food products and inputs

Since the middle of 1979, ENCI has been responsible for the domesticmarketing of the food products and inputs which it imports: wheat, maize/sorghum, soya oil and dairy products. As from May 1981, the State terminatedthe exclusive right of ENCI to import maize and sorghum.

- Ministerial Order No. 00834-79-AA-EPSA of 2 July 1979 transfers toENCI responsibility for the domestic marketing of wheat, oil inputsand dairy inputs and products.

- Ministerial Order No. 01031-79-AA-ENCI of 24 August 1979 provides forthe transfer from EPSA to ENCI of the domestic marketing of maize/sorghum and dried vegetables.

- By an agreement concluded with the Ministry of Health, ENCI undertakesto acquire for that Ministry certain quantities of starchy maize andtarwi, for the School Meals Programme.

II. STATUS OF EACH PRODUCT, REASON AND PURPOSE OF APPLICATION FOR PREROGATIVES

(a) Cotton fibre

- Cotton is a product which is considered essential for the nationaleconomy.

- To guarantee the producer the profit due to him, through the free playof undistorted market forces.

- To ensure normal supplies for the national textile industry.

(b) Coffee

- Coffee is a product which is considered essential for the nationaleconomy.

- To guarantee producers the profit due to them, through the free playof undistorted international market forces.

- To obtain the best possible prices on the international market.

- Greater administrative capacity for implementation of internationalagreements (export quotas).

(c) Fertilizers

- Fertilizers are basic inputs for the develpment of Peruvian agriculture.

- To ensure adequate supplies of fertilizers in terms of quantity, qualityand avaiLability, at the lowest possible cost.

- To promote maximum consumption of fertilizers throughout the countryon a rational basis.

- To encourage the adoption of rational consumption patterns through useof the fertilizers which are technically and economically most efficientfor each zone or region, giving priority to those produced in Peru.

(d) Food products and inputs

- To ensure national supplies of the food products and inputs essentialfor. the population.

- To reduce marketing costs to a minimum.

- To provide incentives for producers situated in or near rain-forestareas.

- To help improve the diet of the population.

III. OPERATION OF ENCI

The corporation uses three marketing procedures.

(a) For account of the State

For account of the State it handles food products and inputs subject toprice controls: maize, wheat, oil inputs and dairy products and inputs.

(b) For account of producers

Under this procedure it markets coffee and cotton. The economic return onsales, less the ENCI commission, is remitted in full to the producers.

(c) For own account

Under this procedure are marketed fertilizers and food products andinputs not subject to price controls, such as potatoes and dried vegetables.

These products, acquired from national production or from abroad, arehandled through their full commercial cycle: purchase, storage, distributionand sale, the entrepreneurial risks being borne by ENCI.

EMPRESA CUMERCIALIZADORA DEL ARROZ (ECASA)(Rice Marketing Corporation)

I. SPECIAL CONCESSIONS

Marketing of rice at the national Level, with exclusive right to acquirethe total production of rice in husk.

Legal basis

Decree Law No. 22713 of 3 October 1979, Articles 2 and 4.

II. REASONS FOR EXCLUSIVE MARKETING

To help ensure national supplies of food products and inputs essentialfor feeding the population, and to minimize marketing costs.

EMPRESA PERUANA DE SERVICIOS PESQUEROS (EPSEP)

(Peruvian Fishing Services)

l. SPECIAL CONCESSIONS

- 10 per cent of hake frozen on board processing trawlers.

- 100 per cent of fish other than hake caught with it by these vesseLs.

LegaL basis

Supreme Decree No. 06.81.PE, Chapter IX, Article 35:

- "Rerulations for the operation of fish-processing trawlers".

II. REASON FOR THE CONCESSION

To regulate the supply and prices of marine biological products fordirect human consumption, by providing services and participating in thesupply and marketing of these products.

Legal basis

Legislative Decree No. 053 of 20 March 1981: "Law on the PeruvianFishing Services".

III. OPERATION OF THE ENTERPRISE

- The enterprise is organized as a legal person under private law in theform of a limited liability company, to give effect to the above-mentioned prerogatives.

- The enterprise is of an executive character and comes under theauthority of the Ministry of Fisheries.

- There is competition between private traders and EPSEP.

- The amount of exports is determined by marketing surpluses on thedomestic market and requirements on the international market.

- The State negotiates the terms of long-term contracts.
