WAITER OF AUSTRALIA SHOT
Chief Waiter Gillespio of theAuBlraliniBat tbeQuoou's hospitalin a vory critical condition and itis a quotion whether or no hoHyps through tho day. As thoAuBtralin was going out of thechannel on hor way to San Fran-cisco yesterday aftornoon, Gilles-pio was shot by AVado, tho colored000k of tho steamer. Not satieGcdwith knocking Gillespio over withone shot, ho emptied his fivo shoot-o- r
into his abdomen whilo thopoor follow lay stretched on thodoor between decks in tho neigh-borhood of tho saloon.
At tho timo of tho shooting, thopassongors wero all up on decknetting n laet clitupso of HawaiiNei. At tho first shot thoro wasilmost a panic. Homo of tho

was about tho only ono thatsoemed to havo her wils abouthor. She rau to tho rail andcalling to Captain Harry Evans, who had already got into tho pilotboat aftor his soaroh for Sherman, told him thnt a man had boenshot.
Evans was up tha ropo ladderin a jiffy. Ho ran bolow to whorotho negro and his victim woreai mo sigut 01 avane, tno negroleveled his rovolvor at him andgavo him to understand that hoknew ho was after him. Evansreplied: "What is tho maltorwith you. I am not after you I havocomo ciown to boo about tho manthat ib hurt. You were perfectlyjnstmou in snooting mm." vituthat tho negro turned and wontaway.
bvans immodirtoly went aboveand succeeded in getting a carbinoirorn utnef. Ullicer Lawless. Arm-ed with this ho wont bolow nnainfollowed by Chief Officer Lawlessand 0. Doylo who was abovo theAustralia for tho samo purpose asEvans. Tho negro was found infull possession of tho culinary de-partment. EvanB had his carbinealready at his shoulder and calledout to Wado to surronder. Thenegro ropliod with two" shots fromhis rovolver, which ho had filledwhilo, EvanB wont on deck to get agun. EvanB firod immediatelyniter mo second snot. Tno uecrodropped, saying: "I am dono for."With this Evans caught up thonegro s rovolvor from tho floorana went aboard to report toCaptain Houdlotto that ho hadkilled tho man. Whon ho wontueiow again no was sur-prised to find that thofollow could talk and that ho wasfumbling in his pockot for thocartridges which ho had got fromliiB room. Tho bullet from thocarbino had juat scraped tho sidoof tho ne'ero's faco.. Evans andJim Eupiho not tho irons onWado as soon as possible Thiswas not an oasy job as tho followkicked and buttod ferociously.Whon he was fitted out in nronnrshape he was takon into tho pilotuoai.
In tho meantimo poor Gillopsiolay in ono of the rooms Hnffnrinrfterribly. Aftor about an hour howas put into tho pilot bont. ThnAustralia then continued on horway. Just as Chief StnwanlSoeloy was going ap tho ropo lad--.li.M ntlm .-. "I'll i.mi uuui muviug vjinepsie, tnolatter said: "Mr. Soolv. nlenRojust break tho nows to mother andtell ber 1 will got over this allright." Upon arriving aBhoro,Wnuo was taken to tho polieostation and Gillensio to thohospital.
It scorns that Wado had nothingwhatover against Gillespie. Howas after "Sidney," tho butcher, who, upon seeing him with a ro-
volvor, dodged into ono of thorooms. Gillespio hnpnonod alonrat tho timo and called on Wado tohavo a little sonso about him. With this tho negro firod at thowhito man. Opium was at thebottom of the quarrol botwoen thocook and butcher.
It is a fortunate thing for Wadothat the pilot boat had not yet lofttho Bteamor whon ho did thoshooting. As it was, tho whitomen in tho crow had prepared aropo and were about to rig this ontho yard arm whon tho localauthorities stopped in. Wadowould havo beon a dead man longbefore tho island of Oahu disap-peared from Bight.
I'lio trial of tho nocro will notbo taken up until tho fato of thounfortunate man at tho hospital isloarned.

The Hawaiian Qovornment isnow on record with resprct to tbeSeptember elections. It maiutainsthat this is not a matter of suflicieat import to request instructionsfrom tbe Washington authorise;that the. municipal law as express-ed in tbe Constitution of tbo He-publ-
ic
of Hawaii must bo followol; that further consultation withWaBhiugtonautboritics is usolessBad the Newlands Resolution ifr
e'ear on tbo point. If the Hawaiian Government is
ia duty bound to carry out tbo lawf jund iu the. Constitution of thfRepublic ofHawaii without furtberquestioning of tbo Frcsidout, if itis under tbo obligations of an oatho? office under tbo American lawt) make no changes in require-ments of the constitution, whatright has it to demand that thevoters of tbo Hawaiian Republic, who have inot taken tbo oath pre-
vious to annexation, shall bo re-
quired to take a now oatht'jo text or title of whichis not found in tbo constitution ofthe Republic uf Hawaii, the Now-land- s
Resolutions or any of theinstructions received by tlio localgovernment from Washington ?
Tbe Hawaiian Government as-
sumed tbo authority to change theoath required of eleotorB by virtueof an articlo iu tbo Hawaiian Cou-B'ifuti-
readiugo folltwi:"Until otherwUo providd by
law the president, with tbu upproval of tho Cabinet, shall havopower to make ruleB and regula-tions not iticomistent herewith, for administering tbo oaths andholding ttloctions provided for bythis constitution,"
Acting under its assumed poworto "make rules and regulations""for administciing tbe oaths andholding tbo elections," tbe Ha-
waiian Government has changedtbo wording and interpretation oft'le constitution of Hawaii. Tbeoccasion for this is tbe annoxatiou of Hawaii to the UnitedStates and tbo assumed uecesbityfor mooting tbo ohangod conditions.
AVhon it comoj to a discussionof tho advisability of Inkling tbeSoptombor oJeclions and spendingtho poop'o'n money ueedlo-sly- , theHawaiian Govornmont assumesthat the folio sing passage in tho
''JW'1 'j
Newlands Resolution which isnil tbo American law tbo territorybap, bns no beoriDg oa tho sub-
ject:
Until Congress shall providofor tho government of such islands,mi tuo civil, uuiciai anu mili-tary powers exorcised by thoofficers of tbo existing gov-ernment in said islands shall bovested in such person or ptrsonsand shall bo oxorciscd in such amanner as tho President of tboUnited States shall diroct."
The Hawaiian Govornmontthen turns to this part of tho New-land- s
Resolution:
"Tho municipal legislation ofthe Hawaiian Islands not onaotcdfor tho fulfillment of tbo treatiesso extinguished, and not incon-sistent with this joint resolution, nor contrary to tbo Constitutionof tbo United Stitos, nor to anytreaty of tbo United StatcB, shallremain in forco until tbo Cou-gre- BB
of tbo United States shallotborwiso detcrmino."
By virtuo of this section of thoresolution, the Hawaiian Govorn-mont maintains that it cannotconsider any proposition lookingto the suspension of theelection law, that tbo gov-
ornmont and tbo pooplo aroforced to hold tho olection whe-trio- r
they want it or not.
Hera wo havo a local govern-ment that maintains its right toobango tbo constitution of tho Re-
public ouo day, and tho next dayclaims that it can do nothing toeavo tho peoplo'a monoy becausetho NowlandB Resolution com-
mands that municipal laws shallremain without obango till Con-
gress shall otherwise dotormino. If Arlich 79 of the Constitution
of tho Ropublio couplod with tbeResolution, empowers tbo Ha-
waiian Exccutivo to manipulatetbo oath, which is as much a partof tho municipal law as the arti-
cles defining tho duties of legislators or officers of tbo Ropublio, thou Articlo 79 of tho constitutioncoupled with tho Newlauds Resolution certainly empowers theHawaiian Executive to make anynumber of changes in tho "rulesand regulations" affecting "holding elections."
Tbo attitudo of tho govornmontin refusinc to contemplato tbosuspension of tbo olection laws isnot consistent, and its refusalto seek information from Wash-ington domonstratos tho govern-ment's indifference to tho interestsof tbo peoplo of Hawaii.
With this record tbo HawaiianGovornmout approaches tho September elections. On this recordwill tbo Hawaiian Government bojudged as to its desiro to considerthe best interests of tho pooplo ofHawaii in their effort to obtainfrom Congress an Amorioan territorial law.

Old Puttier- - Time.Grim and hoary, laden with hour glass
and scythe is not one of the laborers whoassists much In the Improvement of one'sown pergonal appearance or In the satisfac-tory presentation, to the view of passersby, of that neatest of all appurtenancesto a Honolulu home, viz: a well-kep- t
lawn. Far more useful than old timesscythe Is an California ClipperLawn Mower, which the Pacific Cycle& M'f'g Co., In the Ehler's block, havenow on sale and which Is offered to loversof a smooth lawn at a low price."smooth as a billiard table is tne lawn otMr. So and So." How pleased the pos-sessor of such a lawn must be when hehears that statement and knows that hisnext door neighbor could have as good alooking lawn with no more labor than amower, and a California Clipper Is adandy.1 s

PAVING KING TANU
Washington, May C No fur-ther advices havo reached thoStato Department from Samoaand it is that none willnow bo hud until the eastern mailarrives, about five days timo.
Tho commission is due at Apianoxt Wednesday and tho depart-ment's information is that there isno clanger of further outbreakmeanwhile Thoro is nothing intho reports tothodepartment tend-in- g
to sustain tbo statement thatUnited States Consul Osborn hasantagonized tho British and Am-ericans in Apia oponly adheringto tho German position.
Eeauoctiocr tho ronortod refusalof tbo consul to pay the salary ofKing Tanu, although nothing isknown of tho details, the disposi-tion ia to approve of this actionin tbo mattor. It is not knownhero officially that Mr. Osborn isacting in any such capacity, aspresident of tho municipal coun-cil, but in viow of tho withdrawalof tho Gorman official, Dr. Raffol, who ocoupied that position untilrecently, it is not improbable thattho duties of tho place may havoclovojved on tho American consul. In viow of tho questionable legal-ity of the provisional govornmont,it is boliovod that Mr. Osbornwould scarcely bo jueti6od in as-
suming tho risk of making pay-ments upon tho salary of theKing whoso titlo is called intoquestion by Germany.
In tho finals of tho ladies' doubles in tho tennis tournamont yea- -
toruay atternoon, Miss Hoffmanand Miss Scott won against Mrs.Gunn and Miss Hart. Tho matohwas an extremely oxoiting onethroughout. The wholo fivo setsworo ployed. Tho first and fourthsots woro won by Mrs. Gunn andMiss Hart whilo tho Becond, thirdand fifth woro won by Miss Hoff-man and Miss Scott. Tho thirdBet stood 0-- 7 at tho end.
