Tom Grant Jr. – Real Estate Magnate Brokered High-Profile Deals Across Tulsa(Tim Stanley World Staff Writer: Reprinted with permission from Tulsa World)

When Tom Grant first began scouting the area for a big commercial venture, Tulsans were as likely to encounter cows as cars at 71st Street and Memorial Drive. But its days as open farmland were numbered. The project broker, Grant was able to secure more than 150 acres in the vicinity, and as a result, three years later in 1976, Woodland Hills Mall would open to the public. Becoming the driving catalyst for 71st Street corridor development, the mall helped ignite the growth to the south that would change the face of Tulsa forever.

Grant's impact on the local landscape wasn't limited to the mall or south Tulsa, however. Over his 50 years in the commercial real estate business, he would broker deals on countless properties, including such high-profile ones as the Mayo Hotel and the Petroleum Building in downtown Tulsa, while developing retail centers, apartments and other projects of his own. Thomas Garner "Tom" Grant Jr., a former president of the National Association of REALTORS® and a longtime organization board member, died May 15 at St. Francis Hospital. He was 85.

A Tulsa native who was senior class president in 1944 at Will Rogers High School, Grant went on to graduate first from Duke University, and from there got his law degree at the University of Oklahoma. Grant's father, T.G. Grant Sr., was a prominent regional commercial and industrial real estate agent. For several years Grant worked with his father's Tulsa firm, T.G. Grant Co., and continued there after it merged to become Whiteside & Grant, REALTORS®. But in 1963, Grant decided to go out on his own. "It was a big step and kind of risky - he and Mom had had all of us at that point, eight children in 10 years," said his daughter, Cathy Grant of Tulsa, who is in residential real estate. "But it was the right move. Dad was a real real estate genius."

Over the next 40 years, Grant would build a client list that included Sears, Safeway, Phillips Petroleum, Sun Oil, Jones & Laughlin Steel, TG&Y, Dayton-Hudson, F.W. Woolworth Co., Quality Inn and many others. He was active with the Greater Tulsa Association of REALTORS®, as well as state and national real estate associations. In 1978, he was elected president of the 700,000-member National Association of REALTORS®. He remains the only Oklahoma REALTOR® to hold the post.

Rodger Erker, president of the Greater Tulsa Association of REALTORS®, said of Grant: "I am proud to call him my mentor. Tom was a gentleman beyond compare and a man of unquestioned integrity. He was a great example of cooperation among REALTORS®." Erker added that he attended many national association meetings with Grant, "and to be there in his presence and see the great respect REALTORS® from across the country, including other former presidents, had for him was amazing."

In Tulsa, Grant also served on the boards of Woodland Hills Bank and St. John's Medical Center. He was named to the Tulsa City-County Library's Hall of Fame for his support of the library. "There was no fluff, no razzle dazzle with Dad; what you saw was what you got. He had a brilliant mind. And he absolutely loved real estate," Cathy Grant said. Retiring was never really an option, she added. As her grandmother used to tell her and her siblings about their father, "Tommy has been on the payroll since he was 6 years old" - the age at which he had begun his first job, selling the Saturday Evening Post. He "semi-retired" about 10 years ago, his daughter said. "But even then, he was still doing real estate deals out of the house." --

Commercial Transactions, Income Up in 2011 NAR’s commercial members saw an increase in transactions and median gross annual income last year, NAR’s 2011 Commercial Member Profile shows. Among the findings: Median sales transaction volume was $2,010,500 among members who reported at least one closed transaction last year. The median dollar value of sales transactions was $414,300, and the median square footage was 9,600. More.

Q: When do I need to change my Corporate/Lender Owned listing to Pending?A: All status changes are to be filed with the MLS within three (3) business days of receipt of the change. This rule includes Pendings for Corporate or Lender Owned listings. Section 3.0, (c) of Article 1 of the NORES Rules and Regulations states, “In the case of Corporate Listings, Listing Participant shall have the responsibility to change the listings to a Pending status, upon verbal acceptance of a contract.”

Q: What is defined as an Active listing?A: If a listing is currently for sale; an offer has not been accepted and the listing offers cooperation and compensation through the MLS, it should be listed as Active [Section 2.2, (a) of Article 1 of the NORES Rules and Regulations]. This is a rule NORES Participants and Users agree to abide by, and cannot be negated by agreements made by seller and buyers or brokers. If a contract agreement (that does not meet the Contingent Category) is made with the seller to continue marketing even after an offer has been accepted, the listing shall be changed to Pending in the MLS within three (3) business days of the offer being signed by both parties.

Q: When can a listing be shown as Contingent?A: A listing can only be shown as Contingent in the MLS if the contract meets one of the following [Section 2.2, (d) of Article 1 of the NORES Rules and Regulation]:

The Contract of Sale is contingent upon the buyer’s property • (which is on the market but not presently under contract) being sold and closed. In other words, the buyer’s property is on the market for sale, but the buyer has not entered into a Contract for the Sale of the their property. Contingent may also be used for a short sale, where an offer has been accepted by the seller and has been • submitted to the seller’s lender for approval. The “Short Sale” field must be marked “Y” or “Yes.” Upon the seller’s lender approval of the contract (written or verbal), the Listing Participant shall have three (3) business days to change to Pending.

Note: The listing broker can place the listing in either the “Contingent” or “Pending” category.

Q: Do I have to provide Seller Disclosure/Disclaimer information in the NORES MLS system?A: Yes, all legally required Seller Disclosure/Disclaimer information (except where seller expressly directs that such disclosure documents not be disseminated through the MLS) is required to be submitted to the MLS. [Section 2.4, of Article 1 of the NORES Rules and Regulation.]

CALLING ALL GTAR MEMBERS:For the last six years, our GTAR Community Relations Committee has spearheaded the highly successful effort of Backpacks for Kids, in which children selected through Family & Children's Services receive a back-to-school backpack. This idea came about from realizing that so many children in our community are in need, and from the idea of giving as many children as possible a positive start to the school year. It was realized that school supplies were typically provided, but that many children needed school clothes and shoes.

In these six years, the Community Relations Committee, with your support, has raised $74,184 and given more than 1,500 backpacks to children in need. This year is a challenging one. We are very aware of the challenges in our community right now and the financial demands that face everyone.

GTAR receives media coverage and support of its Backpack for Kids effort every year, which in turn informs the community of what REALTORS® are doing in our area to give back. So therefore we need everyone’s support to continue this effort.

Can you please support Backpacks for Kids through your generosity of a donation of $25.00 or more?

This year our goal is to raise $17,500 to fund 350 backpacks; each backpack costs approximately $50 to fill. The deadline to reach our goal is June 30, 2012. We purchase products from Walmart in order to obtain the best possible cost per item, and coordinate with everyone behind the scenes by the end of June, in order to be able to prepare and distribute the backpacks at our August pizza party. To see a child’s face and their smiles and gratitude when they open their backpacks is so worth the effort—and it’s GTAR members, like you, who make it possible to touch and affect a child’s life in such a positive way.

We are grateful to you in advance for your gift of generosity. A donation form is on page 6 of this newsletter. You can mail or drop off your check, payable to the GTAR Foundation, at the GTAR/NORES office. (All donations are tax deductible!)

How to Talk About the 3.8% Sales Tax RumorTalking Points• There is a 3.8 percent tax in the healthcare reform bill; however much of the information circulating on the Internet is grossly inaccurate – the tax is not a transfer tax and it will not be imposed on all real estate transactions.

• The new tax will apply to high-income households and their “unearned” investment income, including capital gains, dividends, interest, and rents minus expenses.

• The 3.8 percent tax will take effect beginning January 1, 2013.

Make VA ARM Program Permanent, NAR SaysThe authority for ARM loans backed by the U.S. Department of Veterans Affairs expires on September 30, 2012. The House VA Committee passed legislation, HR 4482, by Rep Jeff Miller (R-Fla.), to make these loans permanent. The bill now moves to the House floor. NAR joined with the Mortgage Bankers Association and the National Association of Home Builders in a letter to Congress urging making the loans permanent.

Growth Threatens Rural Areas' RHS EligibilityMany communities are losing eligibility for rural housing programs because their populations have grown, NAR says in a letter to Congress it sent jointly with the Mortgage Bankers Association and the National Association of Home Builders. Congress set the definition of "rural" in 1974, and it has not been updated. The letter urges Congress to grandfather existing communities, and to also update the existing definition to account for population growth. A Senate Agriculture Appropriations bill includes a one year grandfather provision. Members of Congress are also considering including a longer grandfather clause or a definition change as part of the bill.

Rules Would Govern Origination CompensationThe Consumer Financial Protection Bureau (CFPB) has released an outline of proposals for rules governing compensation for mortgage loan originators. The proposed rule will address compensation origination fees, discount points, and the screening and qualifications of mortgage loan originators. A group of small business experts will review the proposals under consideration and other alternatives before the CFPB publishes a proposed rule. The CFPB expects to publish its proposed rule this summer.

Much Still Happening on REALTOR® RallyOklahoma’s delegation of REALTORS® were unified in the message, “We put the HOME in Oklahoma!” Oklahoma Association of REALTORS® President David Momper of Tulsa said, “There was such energy and momentum in the crowd. We’re committed to helping Oklahomans achieve the dream of homeownership. Part of that is removing obstacles that may make it more difficult for people to buy or sell real estate.” REALTORS® are concerned about two major issues: the loss of flood insurance and the Mortgage Interest Deduction. The Rally to Protect the American Dream on May 17 was a great success and there’s still more you can do to keep the spirit alive. You can upload your pictures to the Flickr pool, tag yourself in the 20-billion pixel FanCam, view the 2-minue video recap, and add your name to the virtual rally.

New Broker Relationships Bill Signed by Governor on May 15, 2012Reforms to Oklahoma’s Broker Relationships Act (HB2524) were signed by Oklahoma Governor Mary Fallin, and take effect November 1, 2013. With this law being at the root of how real estate is transacted, there is considerable education and forms that need to be updated. To allow for the transition, the new law will take effect November 1, 2013. Agents whose licenses expire before November 1, 2013, and need continuing education in the Broker Relationships (BRA) Core category will take the current curriculum. As more information becomes available we will let you know.

New OREC Rules Effective July 1At the Oklahoma Real Estate Commission’s (OREC) March 14 meeting, the Commission gave their final approval on new rules slated to go into effect July 1. To read a complete version of the full rules, click here. The change that will be most noticed, perhaps, by members is the addition of earthquake damage to Question 20 in the Residential Property Condition Disclosure Statement. BROkER MANAGER, BRANCH BROkER OR PROPRIETOR BROkER?

If your license type is a Broker Manager (BM), Branch Broker (BB) or Proprietor Broker (BP), even if for ONE day during that license term, AND your real estate license expires on or after June 30, 2012 (not before), then you are required to attend and complete an approved 15-hour Broker in Charge (BIC) class AND an additional 6 hours of required subject matter in at least two core courses prior to your license renewal. The core subject matter courses are Fair Housing (FHR), Broker Relationships (BRA), Professional Standards of Conduct (PSC), and Hot Topic (HOT) which would be current laws and rules or current topic affecting the real estate industry.

Anyone holding a Sales Associate (SA) or Broker Associate (BA) license may attend a 15-hour BIC class, in it’s entirety, in lieu of the 12 hour required and one 3 hour elective, PLUS complete an additional 6 hours of required or elective subject matter prior to your license renewal. OREC’s CE requirement is still a total of 21 hours, regardless of the type of license you hold (unless it’s a provisional license). Check the Continuing Education page in this newsletter and tulsarealtors.com. There will be an opportunity to take the Broker in Charge course at GTAR every month through June, and beyond as needed. It doesn’t matter if you are a one-person office or a gazillion-person office, residential or commercial—OREC’s new CE requirement applies to you!
