Those in the business of container shipping should beware – you have less than nine months before container weight verification becomes mandatory in July next year.

And, wherever you fit into the movement of containers, you must to be up to speed on all the relevant requirements of this latest International Maritime Organisation (IMO) container weight verification protocol.

“SA exporters and pack houses,” said Dave Watts, maritime consultant to the SA Association of Freight Forwarders (Saaff), “should make themselves aware of the new requirements and ensure that they have sufficient weighing and recording capacity.”

And the first of a planned series of national workshops on the IMO protocol held in Durban last week by the SA Maritime Safety Authority (Samsa) revealed a threat behind the requirement

In this week’s column we pose some questions relating to the Customs Duty Act, 2014 and the Customs Control Act, 2014.

The process of drafting these Acts has been a protracted affair, to say the least, marred by delays and postponements. Add to this the fact that the exact date of the Acts’ introduction is still not known.

Presently the Acts are subject to proposed amendment, and then the rules to the acts are still being formulated, subject to a process of some consultation. Then, what about the DA forms. Would these be subject to any change? (DA the acronym for “doeane en aksyns”, in English it’s

“customs and excise”). No proposed forms have yet been published as part of the consultation process.

All remains quite confusing.

Why rush publishing Customs Acts?Why were the Customs Duty Act, 2014 and the Customs Control Act, 2014 published at the time that they were? For they still have not entered into force, and there is still no definitive date for them to do so. So why publish them? Add to this the fact that the Acts have already been subject to proposed amendment in two Taxation Revenue

Amendment Bills. It was subject to proposed amendment even before it entered into force.

Is one to deduce that the drafting of the Customs Duty Act, 2014 and the Customs Control

Act, 2014 were rushed? If so, why the rush?

Customs Acts TrainingWe question why any company would presently willingly invest in sending their staff to attend a training course or workshop on the Customs Duty Act, 2014 and the Customs Control Act, 2014.

They would be attending training on two 2014 Acts (still to be enacted), for which the rules to the acts are still being devised and deliberated on, and which, in all likelihood, will at best be introduced in phases, and then only in mid-2016 (best case).

With a flood of applicants having gobbled up all the original R5-billion funding, the manufacturing competitiveness enhancement programme (mcep) has slammed its door on any further applications till next year.

The department of trade and industry (dti) will continue to honour all approved applications, and a new application window will be opened in April 2016 – but only “pending availability of funds”.

And although that’s a bit dubious, Peggy Drodskie, chief operating officer of the SA Chamber of Commerce & Industry (Sacci), has a hunch that something will be made available. “The minister of finance in his mini-budget sounded pessimistic about the availability of such funding,” she told FTW. “But it is my gut feeling that something will become available.”

This, she added, because people who went into manufacturing tended to have a higher level of commitment than in a normal business operation. And the funding allows for expansion – an area where Drodskie is sure a lot

of the funding has gone.The dti also launched the programme

at an appropriate time, with mcep – designed as an incentive to support enterprises in the production sectors of the economy – appearing soon after the onset of the global economic recession. And, it added, allowing manufacturers “to weather very adverse market conditions and secure higher levels of investment”.

Drodskie also felt that the non-profit body, the Manufacturing Circle, played a distinct role in promoting this valuable mcep funding. Formed in 2008, the Manufacturing Circle is made up of a number of SA’s leading medium to large manufacturing companies from a wide range of industries. It interacts with government and other stakeholders in order to review, debate and help formulate policies that will have a positive impact on SA’s manufacturing base.

To date, the dti has dispensed funding to 1 153 entities which were looking to acquire capital equipment and reengineer their business processes. That works out at an average funding level of R4.34m.

With a large number of the Far East countries

needing cold treatment for the shipment of citrus from South Africa,

Mediterranean Shipping Company has beefed up its personnel and services to meet the cold treatment demands. “This requires more attention from us,” says Ian Fairlie, reefer and marketing manager of MSC Cape Town.

According to him, MSC customers now have a choice of three services calling South Africa into the Far East, including a direct service calling Cape Town. “This service is particularly aimed at the deciduous fruit shippers from the Western Cape,” he comments.

MSC has also seen growth from fruit exporters on its West African service, he adds, noting that the direct route from Cape Town offers “very competitive” transit times into the main African markets.

Fairlie told FTW that MSC had a dedicated team that continuously monitored the global shipments of each cold

treatment container, regularly recording temperature fluctuations. “This hands-on focus has increased shippers’ confidence in the integrity of their perishables shipments and we’ve seen a growth in volumes as a result,” he says.

Challenges at the port of Cape Town – such as wind delays – have also been addressed says Fairlie, pointing out that the port’s use of straddle carriers has been good news for Northern and Western Cape grape exporters as they are now able to get their products out more quickly to the United Kingdom and Europe for the upcoming festive season.

Beefed up services meet cold treatment demands

MSC now offers shippers a direct service calling Cape Town and serving the major reefer destinations in the Far East.

The drought is expected to result in a 29% decrease in South Africa’s summer crops compared to last year.

Agriculture minister Senzeni Zokwana said that South Africa had now declared five of its nine provinces as drought disaster areas for agriculture.

He commented that one of the driest seasons on record had severely affected the country’s 2014-2015 harvest, especially summer crops such as maize, sunflowers, soya beans and sorghum.

Last year’s maize output was about 14.3 million tonnes. This year it is expected to shrink to 9.8 million tonnes, a 31% decrease, Zokwana said.

The food and beverage sector has been identified as a key area of export growth for the Western Cape economy.

According to the provincial department of economic affairs, agri-processing currently contributes around R12 billion to the local economy and has created an estimated 79 000 jobs.

Growing these figures is a key target for the provincial government which has prioritised agri-processing as part of its Project Khulisa initiatives. The programme, launched officially in September, has set a target of doubling the agri-processing sector over the next five years.

This will see the province investing in new infrastructure projects and improving regulation for the industry while also promoting and supporting Western Cape products locally and abroad. China is a big target market but there is also a big focus on Africa where Angola and Nigeria are strong contenders.

Over the past few years there’s been a significant increase in agricultural

exports from the Western Cape to West Africa. The number of apples and pears moving to this region has increased dramatically as have several wines. One of the most consumed South African products in Angola at present is said to be JC le Roux sparkling wine.

Western Cape premier Helen Zille says that through Project Khulisa – which means “to grow” in isiXhosa – they can fast-track economic growth by focusing on several sectors. Through the project the province intends to find new markets for Western Cape products, breaking the heavy reliance on traditional trading partners such as the European Union (EU). Currently at least 30% of all agricultural exports are bound for the EU.– Liesl Venter

Beverage forwarder JF Hillebrand has taken its commitment to

the wine industry beyond logistics.

The company has for the past ten years been involved with the Pebbles Foundation, a non-profit organisation that establishes and manages early childhood development facilities and after-school provision for children living in farm communities in the Western Cape.

But, says Charmaine Gola, Pebbles fundraising and PR coordinator, it is not just the funding that makes a huge difference to the organisation; it is the involvement of the JF

Hillebrand staff that is of equal importance. 

“The staff has done everything from volunteering at our end-of-year party for the children to making sandwiches and soup for the families,” she says. “They give of their time and that makes a huge difference in the lives of these children.”

Jackie Chippendale, JF Hillebrand HR manager, says their involvement with Pebbles is really an extension of their business.

“Initially Pebbles started out addressing the needs of children affected by Foetal Alcohol Syndrome and that really hit home,” she explains. “Taking our business into consideration, since we are highly devoted to skills development in our

industry and the economy at large, we are very aware that the adults we employ today start their cognitive development as children, in fact before then.  So it has always been our passion to develop skills within the wine industry but it needed to start somewhere.”

“Pebbles is the one project the company immediately identified with and the staff love being involved.

“We use every opportunity to visit Pebbles. Our staff is extremely passionate about the project and the work that the organisation does.”

According to Gola the continued investment in Pebbles by companies such as JF Hillebrand has

allowed the non-profit organisation to develop.

Today it supports several centres in farm communities in the Western Cape ensuring that more than 1000 children are given quality early childhood development and education.

“We maintain a focus on disadvantaged children and families and deliver programmes that target children as young as three months right through their schooling years until they are ready to be adults actively contributing to society,” she says. “We supplement the inclusive education programme with a nutrition programme coupled with health and social services through a clinic.”

As cyber space becomes the new zone for crime and conflict, a word of warning has been sounded on the global vulnerability of ports.

Cybercrime attacks could potentially interrupt vessel and cargo movement or even shut down networked computer systems for days, said Brett van Niekerk, University of KwaZulu-Natal honorary research fellow and maritime sector information security analyst.

Speaking at the recent African Ports Evolution conference in Durban, he said simply upgrading cyber security technology was not enough. “Senior executives need to take responsibility and create employee awareness of the dangers of cybercrime,” he said.

“Ports are generally insufficiently protected in cyber space and the main contributor is probably the awareness and understanding of what can happen if there is a breach of the corporate and operational network. There can be a significant operational and financial impact if the worst case scenario does happen,” Van Niekerk said.

As ports and freight forwarders moved to automation to improve

efficiencies making business increasingly IT dependent, vulnerability to cybercrimes had increased, he said. Examples of security breaches include a hacker’s accidental shutdown of Houston Port in the US for a few weeks and smugglers hacking into the Australian customs system to check if their cargo was under suspicion – in which case it would be abandoned.

Van Niekerk said US Brookings Institute and European Network Information Agency reports into port security showed a low awareness of maritime cyber risks with insufficient

consideration in regulations in the EU. Despite huge sums spent on national security and ports, many of which didn’t conduct vulnerability assessments, very little was being channelled into cyber security in the US, he added.

“The US and EU are generally leaders in cyber security,” he said,” and this is what is coming out – that the ports are vulnerable.

Cyber criminals could target operations by either shutting down networked systems, or gaining control of conveyors and other automated equipment in smart ports that could lead to containers being dropped, personnel injuries, slower production, ships being overloaded and even to spillages and environmental damages. Research had also shown that vessels were potentially vulnerable to pirates who could track their voyages online and hack into their GPS systems to stage a hijacking, he added.

“Maritime regulations haven’t really considered cyber security as a major

issue. It is now starting to come up as some of the

major shipping lines are forming alliances in order to address this but not in a holistic approach,” he said.

“There may be a need for some possible changes to current processes of pre-

advice submission,” Watts added. “Nonetheless, containers without the necessary endorsements on the pre-advice will not be allowed to access terminals.”

Samsa believes that, due to challenges accessing weigh bridges, most shippers will utilise what it terms “Method 2”.

This is a process of weighing each package loaded into a container

along with dunnage etc and adding the total to the container’s tare weight.

“Clearly,” said Watts, “shippers or their appointed packing facilities will require accurate weighing capacity – along with some kind of quality management system such as ISO 9001.”

4 January 2016. That is the deadline for South Africa to sort out its issues around the importation of poultry from the United States or be suspended from the African Growth and Opportunity Act (Agoa).

Whilst government officials seem to be less than fazed by the warning from President Barack Obama issued on November 5 this year giving the country exactly 60 days to resolve all outstanding issues around US poultry imports, there is grave concern around the impact of suspension from Agoa for all agricultural export products especially in the Western Cape.

The province contributes 70% to the total agricultural

exports of South Africa. Missing this trade opportunity would have a damning impact on the regional economy, said Beverley Schäfer, Western Cape spokesperson on economic opportunities, tourism and agriculture.

“I am not convinced that Minister Rob Davies fully understands what the unintended impact of losing this trade deal will be for South Africa. Much like Minister Malusi Gigaba failed to see the unintended consequence of the visa regulations on the South

African tourism industry,” she said.

According to Schäfer the province’s agriculture sector relies heavily on the trade of citrus fruit.

“South Africa exports citrus

fruits to the value of $700 million to the United States. Should the Agoa deal fall through, 85 000 jobs in the citrus farming sector alone will be at risk.”

Geordin Hill-Lewis, DA shadow minister of trade and industry, told FTW the country’s reputation as a reliable, trustworthy trading partner was at stake.

“Most damaging is that this threatens thousands of jobs on farms across the country.”

He said Obama’s warning was as a result of the out-of-cycle review of South Africa and was only applicable to agricultural goods and not all goods that fell under the Agoa agreement.

“If we can resolve the differences before then, there is still a chance to overturn the suspension and avoid disaster,” he said. “We need to ensure that we urgently resolve the outstanding technical obstacles that are preventing us from honouring the commitments we made to the USA earlier this year. I hope this happens in the next two or three weeks, but the

pace has been so slow up until now that I am not confident. The constant delays and missing deadlines are exactly why we are now in this situation.”

Davies, however, last week said South Africa’s negotiators had been well aware of this authority to suspend a country’s trade benefits in terms of the Agoa Extension and Enhancement Act where the US believed that a beneficiary of Agoa was “not making continual progress toward the elimination of barriers to United States trade and investment”.

He said South Africa wished to submit on record that it had been making continual progress during the past few months to implement the agreement reached in Paris in June this year.

The main issues on the table between the US and South Africa are around the opening of the SA market to US poultry, beef and pork. At the Paris meeting South Africa agreed to open the South African market to the US for

65 000 tons of bone-in chicken pieces through a rebate facility.

The International Trade and Administration Commission issued a draft regulation in this regard on October 30, 2015. The process of creating this quota was envisaged to be concluded well before the 31st of December this year, the dti said in a statement.

Davies maintains that the issues at hand are about animal health and are very complex. “A balance has to be found between trade opening and animal health. In the case of the poultry issue the negotiation has been more complex because the US is seeking an agreement on the health standards/regulations that would apply if/when there is another outbreak of Avian Influenza in the United States. The US requires South Africa to keep the market open to US poultry from those US States that are not affected during such an outbreak,” reads a statement from his office.
