ASHIM GHOSH, aged 31 yrs, a post polio paralysis of both lower limbs 80% disabled person, a resident of Paschimpara, Bongaon, North 24-Parganas, West Bengal applied for issue of a Voter Identity Card to the appropriate Election Commission office at Bongaon each and every opportunity offered by Election Commission of India. Unfortunately it is found that neither EPIC has been issued nor any reasons for non acceptance of request have been intimated. In this connection all detail particulars are furnished below for appraisal of every sympatric persons of India. [A] Applications made for enrolment as voter on standard format submitted by me and Electoral officers notice thereon for appearing for hearing are as follows. 1) Application receipt dated. 14.10.04 and hearing fixed on 12.11.04 - Attended. 2) Application receipt dated. 07.11.05 and hearing fixed on 25.11.05 - Attended 3) Application receipt No. WB-TTT-0554296 dt. Nil and hearing fixed on 09.12.00 - Attended.4) Application receipt dated. 22.01.07 and hearing fixed on 10.02.07. - Attended. 5) Application receipt dated. 24.11.08 and hearing fixed on 15.12.08. - Attended Result is NIL in each occasion i.e. EPIC not issued and reasons not made known. I had, though being a disabled poor person unable to move without 2 escorts had attended all hearings and chased with concerned offices but failed to get any sympathy from Election

commission office. Probably Disable persons are not liked by Election Commission office to allow being a Voter of country. [B] 1) According to North 24 Parganas District Primary School Council., School leaving certificate issued on 07.02.2007 for academic 1986-1989 my date of berth is 14.01.1978. 2) According to Bongaon High School (Estb-1886), Board Index No.: 149-125, Council Recogn. No.: F 369 / BS / (A) / 83, Certificate for session 1993-94 my date of berth is 14.01.1978.Both the certificates have been produced ECO as an authentic documents of my residence as well as date of berth. [C] Handicapped Certificate baering No. 2437 Dated.11.11.2003 [Code- OPH] issued in my favor by CDPO/ICDSP. Bongaon-Govt. of West Bengal is a government record showing my age, address, and disability for 80% assessed by Medical Board of the Govt.Hospital. Etc. [D] I am a Ration Card holder bearing No. 856413 dated 13.12.1996 issued by competent authority of Govt. of West Bengal, of my residence area of the locality. [E] I am having PAN Card bearing No. ASJPG1689E issued by Income Tax Department, Government of India. It may kindly be seen from what has been brought out at above that although all the above said documents mentioned at above were issued by Government authority over the years and brought to the knowledge of Election Commission Officers for enrolment as a Voter by issuing an EPIC card, which they ignored for 5 occasions during the years 2004 to 2008 as detailed at above. As I am an 80% OPD Disabled person, cannot move freely to meet and chase different officers / offices to get EPIC card, I have been NEGLECTED, IGNORED AND OTHERWISE treated, debarred to get an EPIC card. I am a very poor disabled person and in the event EPIC card is issued to me, I would have get a loan made available to Person With Disabilities under various scheme of Government of India which I am debarred due to extreme negligence / ignorance to a Disabled Person But for my acute disability, inability to speak & to move freely to meet DM & DEO at Barasat, I would have explained in detail the case in person for better appreciation and suitable remedial actions. In the light of matters / constraints brought out at above, I would like to request your good self to kindly pass suitable orders so that an EPIC card is issued to me at the earliest possible. In terms of directive, the enquiry team headed by Jt. BDO came to my residence and asked for documents for their inspection. Since the letter in question is issued from an Administrative Office of DEO / DM cum DEO it can be expected that it should be issued observing the official procedures prevailing for an administrative office in the country. Unfortunately it is observed that there exist some deviations and as such the case is being referred for confirmation. Deviations observed are as follows:- 1. My address being recorded not in accordance to the address used and communicated virtually leads to a confusion to others.2. No postal stamp is available on the cover of the letter in question and the same was delivered in a dilapidated condition from a person other than postal peon.. The details will be discussed at our next meeting. As desired by your honor and advised by superiors I stopped reminding you my case. Unfortunately on receipt of an e-mail from my “Personal Friend” i.e. "DEO N24" deonprg@gmail.com , in a semi official manner, I am rather compelled to re enter in to case for reasons mentioned below for your kind information & necessary action.

(1) Kindly see the mail in question dated 06.08.2010 placed below. I have a Personal Friendship with this mail ID (Not Sri.Binood Kumar) which has been reported to you vide my mails dated. 24.06.2010 & 26.06.2010. Copy of friendship letters in question are being forwarded to from original mail to you separately for perusal. Unless name and official designation is indicated at e-mail the same will be ignored for

the reasons mentioned. As regards e-mail dated 06.08.2010 the following are stated. <> Who has directed to whom has not been indicated. <> The word “in camera” has a specific meaning whereas used at the letter just to divert & impress the attention to a negative direction. The fact is the officials came to my residence with video camera to cover up proceedings in an open space with out obtaining my consent and thus illegal activity initiated. I had requested to provide a copy of the said video for my record vide my e-mail dated. 01.08.2010. <> Nothing new points have been indicated in the letter. Every aspects have been brought out vide e-mails listed below for ready appreciation. <> Sri.Chinmay Kar (Mama) who had addressed you earlier will send his comments separately <> The predetermined rejection without mentioning specific clause and the relevant Act against each documents produced though the same was requested. In case this vital information is not provided the same will be treated as an Arbitrator decision of a person having no bearing with relevant rules.

<> As regards suggestions made “You may file appeal petition before the District Election Officer and District Magistrate, North 24 Parganas” it is point out that on being dissatisfied with the proceedings for more than a decade, I had already placed my submissions before Sri. Binood Kumar, IAS, District Magistrate and District Election Officer as an Appellate Authority of my prayer which he has assured vide e-mail dated 22.06, 2010 & 13-07-2010 to me and to every one.

That I have been praying for issue of an epic to me since 2004 (earlier records damaged due to flood 2000 / not readily available) but without any result. I had submitted application on form 001C and again on form 16 but unfortunately AERO rejected the prayer made. Probably due to their extreme busy schedule it was not possible to go through this disabler’s submissions and lot of documents produced or the undersigned who cannot speak freely could satisfy their requirements.

Under the aforesaid circumstance it is prayed that the issue may kindly be reviewed by your honor as a special case considering the constraints of an extreme poor disabled right from very early childhood and oblige.

I would like to rely on deeds documents, certificates already supplied and submission/s before Ld. District Magistrate during the hearing.

Respected Sir,I have already requested all my friends & well-wishers not to enter into any correspondence with any one in respect of EPIC issue till a verdict is issued by Ld. District Magistrate. Be rest assured Sir, None will disturb you. I have submitted prayer for review as a special case before your good self.

1. I do not intend to engage any lawer for my prayer as being a poor man unable to bear higher charges of a lawer. I like to rely on documents already supplied and submissions made and to be made by me and my guardian Sri.Chinmay Kar (Mama), a Retd.CGS, Disabled (60%) Sr.Citizen, right side of body fully paralyzed cannot move freely outside. I am residing with Sri. Kar from my early childhood for more than 28 yrs at our permanent residence at Bongaon.

2. 19, 20 or 21st instant between 15 to 20 hrs will be convenient for me attend the special hearing. I will be carried to Kolkata on 18-08-2010 for medical check up. At present Sri.C.Kar is undergoing medical treatment at Kolkata. Sri.Kar has kindly agreed to hold the hearing at his Ty.Residence cum small office at Kolkata so that he can subscribe his knowledge, information’s to Hon’ble Judge. Hence I earnestly request you to hold hearing at Kolkata (address noted below) for convenience to both Disabled persons & nearer to your HQ.

Kolkata Ty. Address: - A/III, Mala Apptt, 57, Banerjeepara Road, Kolkata. [Just opposite to Brajamohan Tiwari Girl’s High School]Route by train: From DumDum by Metro Rail to get down a Netaji (Kudghat) stn. 4/5 minutes walking distance up to Brajamohan School. Riska @ Rs.6/- 40 minutes from DumDum Jn.

Rout by Road: Tollygunge Metro station à Karunamoyee Bridge à K.Bridge end turn left à Bot tola à turn right and get down school end on road bumper, Precede back door of the flat. As this is a main road no problem for Garaging a car. Tollygung to Flat is 8/10 minutes only.

Binod Kumar District Magistrate and DEO Barasat, North 24-Parganas, W.B.  (dmn24p@gmail.com)   Respected Sir,                         Sub: Issue of an EPIC pending for more than a decade.                         Ref: Your directives communicated vide e- mail dated. 23.12.09, 23-06-                               2010 and 13-07-2010                          As desired by your honor and advised by superiors I stopped reminding you my case. Unfortunately on receipt of an e-mail from my “Personal Friend” i.e. "DEO N24" deonprg@gmail.com , in a semi official manner, I am rather compelled to re enter in

to case for reasons mentioned below for your kind information & necessary action. (1)     Kindly see the mail in question dated 06.08.2010 placed below.  I have a Personal Friendship with this mail ID (Not Sri.Binood Kumar) which has been reported to you vide my mails dated. 24.06.2010 & 26.06.2010. Copy of friendship letters in question are being forwarded to from original mail to you separately for perusal.  Unless name and official designation is indicated at e-mail the same will be

ignored for the reasons mentioned. As regards e-mail dated 06.08.2010 the following are stated. <> Who has directed to whom has not been indicated. <> The word “in camera” has a specific meaning whereas used at the letter just to divert & impress the attention to a negative direction. The fact is the officials came to my residence with video camera to cover up proceedings in an open space with out obtaining my consent and thus illegal activity initiated. I had requested to provide a copy of the said video for my record vide my e-mail dated. 01.08.2010. <> Nothing new points have been indicated in the letter. Every aspects have been brought out vide e-mails listed below for ready appreciation. <> Sri.Chinmay Kar (Mama) who had addressed you earlier will send his comments separately <> The predetermined rejection without mentioning specific clause and the relevant Act against each documents produced though the same was requested. In case this vital information is not provided the same will be treated as an Arbitrator decision

of a person having no bearing with relevant rules.  

<>  As regards suggestions made “You may file appeal petition before the District Election Officer and District Magistrate, North 24 Parganas” it is point out that on being dissatisfied with the proceedings for more than a decade, I had already placed my submissions before Sri. Binood Kumar, IAS, District Magistrate and District Election Officer as an Appellate Authority of my prayer which he has assured vide

e-mail dated 22.06, 2010 & 13-07-2010 to me and to every one.    

                      In the light of above it is to submit that submissions made to DM cum DEO as an Appellate Authority from the date of application, followed by different contradictory letters on the face of DM/DEO’s specific instructions, DM/DEO’s assurance, friend’s letter, request made by social workers, and latest submission till date as noted below are all culminated and construed as entire submission with presentations before the Ld. Sir,        As directed, I am to inform you that your application for inclusion of name in the Electoral Roll of 95-Bongaon (Uttar) A.C , part No-138 has  not been accepted. The

observation of AERO, 95-Bongaon ( Uttar) A.c as " During the spot enquiry , in camera, he has failed to produce his birth certificate or his parents death certificate. Moreover, he has confessed that he has no blood relation with Shri Chinmay Kar & Sri kar is not his own 'mama'. So , in the absense of his birth certificate or parent's death certificate and from his own confession, he has failed to prove his family linkage and citizenship beyond doubt. Hence his prayer for incusion of his name is rejected."      This is to inform the decision of AERO, 95-Bongaon (Uttar) about  the non-acceptance of you claim. This case is taken for hearing on this day. The

petitioner is absent and none on behalf of the petitioner

appeared before me.

This is an Appeal Petition filed by Shi Ashim Ghosh

against the Order of AERO, 95 Bongaon (SC) AC. Shri

Ashim Ghosh has sent an email to me claiming that he is

a disabled person and his name was not being enrolled

in the Electoral Roll despite application. I had directed

the AERO, 95 Bongaon (SC) AC. to mail him Form No.6

and accept the filled up Form No.6 received through

err-oil. In view of his disability, I had also directed the

AERO to depute a person to get the form signed by him

and also send a person for enquiry, if needed, so that

Shri Ashim Ghosh may not face any inconvenience of

taking trouble to reach to the Office of ERO/AERO. Also,

ERO/AERO has been directed to send the LCR. The

Order of Block Development Officer and AERO, 95,

Bongaon (SC) AC. is reproduced below:

"During the spot enquiry, in camera, he has failed to

produce his Birth Certificate or his parents death

certificate. Moreover, he has confessed that he has no

blood relation with Shri Chinmoy Kar and Sri Kar is not his

own MAMA So, in the absence of his birth certificate or

parents' Death Certificate and from his own confession,

he has failed to prove his family linkage and citizenship

beyond doubt. Hence, his prayer for inclusion of his

name is rejected."

From the order of AERO it is evident that he has not

been satisfied regarding claim of citizenship of Shri Ashim

Ghosh.

The appeal matter was taken up. Shri Ghosh sent an

email requesting a hearing at his place or at the place

of Shri Chinmoy Kar in Kolkata. He also requested for e- I

telephone call at telephone No. 2402-6000. As per his

request, the date was fixed on 23.08.2010 for hearing

through Skype Video Call. However, as there was a

problem with the internet connection at his end, the

Skype Video Call could not take place. I then dialed his

telephone number and held hearing. He was requested

to read the relevant provision of Representation of

People Act and also the Citizenship Act, 1955 so that he

will be fully aware. It was sent to him through email well

ahead for his convenience. It was specifically mentioned

for engagement of a lawyer, if he so thinks to represent

his case. He replied back through mail and decided not

to engage any lawyer.

The Election Department of this office submits that

before name of ShriGhosh is enrolled, he has to establish

that he is an Indian Citizen. Accordingly, Shri GKosh was

requested to state as to under what provision of the

Citizenship Act he claims' citizenship. Shri Ghosh

requested thct Shri Chinmoy Kar will plead on his behalf

over telephone.

Shri Chinmoy Kar, in turn, questioned that let it be

established that he is not an Indian Citizen. This was

countered by Election Department that Form 6 has been

filed by ShriAshim Ghosh and the onus of establishing his

eligibility lies with Shri Ashim Ghosh. I agree to the

contention of the Election Section and accordingly Shri

Ashim Ghosh and Shri Chinmoy Kar are once again

asked to state as to under what provision e.g.

Citizenship by birth (section 3)/Citizenship by

Naturalization (Section 6)/Special Provision of Citizenship

(Section 6A) etc. is claimed by him.

They replied they had not studied the Act and

requested for 7 days time to make their further

submission.

Accordingly, the time of 7 days is allowed. The next

hearing took place on 30.8.2010 at 11AM. The petitioner

was once again advised to think if he would like to

engage a lawyer who can appear before District

Magistrate on 30.8.2010 at 11 AM and plead on his

behalf. In case they are not in a position to engage

lawyer, Video/Audio pleading will take place on that

date and time.

On 30.08.2010, Sri Ghosh engaged Sri Anirban

Chakraborty, Ld. Advocate to plea on behalf of him.

Seen the Vakalatnama filed by Ld. Advocate Sri Anirban

Chakraborty on behalf of Ashim Ghosh.

The Ld. Advocate stated that his claims to be an

Indian Citizen under Section 3 of the Indian Citizenship

Act, 1955. As the date of birth of this client in 14.01.1978,

as per Form 6 submitted, I asked documentary evidence

of the date & place of birth to be produced, to which

the Ld. Advocate states that there is no such evidence.

Instead, he submits a photocopy of an Indian

Passport in the name of one SANTIGHOSH of village -

Khairamari, PS.-Bongaon, Dist.-North 24-Parganas, as

belonging to the mother of Shri Ashim Ghosh., He also

submitted photocopies of a Duplicate School Leaving

Certificate of Paschimpara Primary School, a certificate

noting the date of birth of Shri Ashim Ghosh issued by the

Head Master, Bongaon High School and a certificate

issued by Councillor, Bongaon Municipality.

The Election Department submits that there is no

evidence that Smt. Santi Ghosh is the actual mother of

Shri Ashim Ghosh. On the contrary, everything submitted

by the Applicant with his application in Form 6 suggests

that both of his parents are dead. Accordingly, the

Election Section submits that the mother is fake.

On perusal of the photocopies of the passport, it

appears that Smt. Santi Ghosh has a male child whose

name is Asit and he was born in 03.03.1976. The name

and the date of birth do not match with the records

submitted by ShriAshim Ghosh.

On enquiry, the Ld. Advocate says that Asit is the

pet name of ShriAshim Ghosh. He also pleaded for some

more time to get thoroughly acquainted with the case.

As per direction, the Election Department verified

the authenticity of the School leaving Certificate

submitted through Block Development Officer, Bongaon,

Block Development Officer, Bongaon in his memo no.

109/Elec dated 27.09.2010 informed that the School

Certificate produced by Sri Ghosh is genuine and also

informed that Smt. Shanti Ghosh declared herself as Sri

Ghosh's mother/ guardian because his father is not alive.

The matter was also referred to SP(DIB, North 24-

Parganas for verification and .stotus of Indian Nationality

of Sri Ashim Ghosh. SP (DIB), North 24-Parganas placed

his report vide memo no. 2567/BD Section dated

22.09.2010 informing that Sri Ghosh could not produce

any document to establish his Indian Nationality.

On perusal of the above, it appears to me that Sri

Ashim Ghosh could not establish his Citizenship status

beyond doubt. Hence his appeal to enroll his name in

the Electoral Roll of 95-Bongaon uttar (SC) Assembly

Constituency can not be accepted and it is hereby

rejected. Electoral Registration Officer, 95-Bongaon uttar

(SC) Assembly Constituency, Sub-Divisional Officer,

Bongaon and also Block Development Officer, Bongaon

is informed accordingly. Sri Ashim Ghosh is' to be

informed through e-moil. The case is hereby disposed.
