RAILROAD COMMISSION TAKES JURISDICTION OVER TRUCKING COMPANIES IN HARBOR DISTRICT
Complete jurrstliction was assumed by the railroad commission over mo tor truck carriers operating betwo.-n Uos Anseles citj^proper and Ijns An geles harbor points, in a decision n n- dered November IS. The commission held that such operations constitute a transportation service over public highways not entirely within the cor porate limits of Ijos Angeles, ami :s r.-> entirely distinct from those of w.iter carriers by whom the shipments hauled by the motor carriers are >-c- ceived and delivered at UB» Ans^l^s harbor.
The decision was rendered by the railroad commission in proceedings brought on complaint of the Hodge Transportation system and the Los Angeles and San Pedro Transporta tion system against the Ashton Truck company and twelve other motor transportation companies operating between the city of Los Angeles and IXM Angeles harbor points. The com- phUnt alleged that defendants l;a.l never obtained from the railroad com mission certificates to conduct such operations, and had not conformed with the 'provisions of the Public Ut-lities act by filing rate schedules as required by that statute. ' The commission ordered the defendant companies to desist from their ine--al operations and to apply to the com mission for certificates, or to file rates and schedules within CO days of November 24, 1»°S, the effective date of the order, according to their re spective classification by the com mission.
The decision of the railroad com mission, which was rendered after extensive bearings by Commissioner Shore, will serve to dear up uncer tainty as to the commission's juris diction and rig-hl to regulate thest carriers.
The defendant, carriers fall within two classes, eight of them having be gun operations before May L. IS 17. aad thereby not being required to ob tain certificates from the railroad commission, but are required to fil>- tariffs of rates and schedules vith the railroad commission; and five of them who begun operations subse quent to Mar 1, 1917, and are re quired to obtain certificates to op erate, and to rie rates and schedules as provided by the Public Utilities act.
The commission points out in its decision that it is required by the Public Utilities act to assume juris diction over the operations of both these classes of mctor carriers. ho><!-

The commission, in recognition of, the enormous volume and urgency of I the Los Angeles business handled by| the defendant operators, exercised j lenience in permitting them to con- j tinue operating to a date sufficiently j far ahead to enable the carriers toj legalize their operations by making j proper applications to the commis sion, and to submit evidence showing that public convenience and neices-sity require their continuance.
The defendant companies who have been engaged in this traffic s:nce prior to May 1, 1917, and who accord ingly are not required to obtain cer- j tificates from the commission but are] required to file rates and schedules, [ are: Ashton Truck company. B. W. Belyea Truck company, California Truck company. Citizens' Truck com pany: Paul Kent Truck Co.. Inc.; Pioneer Truck and Transfer Co. of 1-os Angeles, Star Truck and Transfer company. Smith Bros. Motor Truck company.
The carriers whose operations were begun subsequent to May 1, 1917, and who are required to obtain certifi cates from the commission, as well as to file tariff rates and schedules, are: Pacific Transportation company: Scandia Truck and Transfer company,
Inc.; Carnrlchael-Skidmore corpora tion; Grey M, Skidmore. and Grey M. ' Skidmore, Inc.: Wade Shipping com- ! pany.
