Current state

• People practicing out of scope• Confusion over designations• Anyone may represent as a professional• Often the advice of a health and safety

professional is not sought, is disregarded, or is shopped around.

• New legislation for Service Providers• No recourse to address lack of competence, ethics,

MYTHHealth and safety providers do not cause the injuries. Employer’s often don’t listen and workers make bad choices, so why are we being ‘punished’.

TRUTHEmployers rely on and base important decisions on, our advice. This is about ensuring competency and ethical practice, as well as maintaining public confidence in the profession.

Roadmap PaperDescribes in detail the path to true professional regulation under law.

The Mission of the ASHSP is1. To serve the public interest by establishing the occupational health and

safety (OHS) professions operating in Alberta as fully-recognized professions protected and regulated by law.

2. To work with stakeholders to create the foundation for competent and ethical practice within Alberta.

3. To establish a self-regulatory body within Alberta to provide regulatory oversight for the OHS professions.

MYTHS• This must be done nationally by a National

organization.• All jurisdictions must do this together.

TRUTHS• The Constitution prohibits a national organization

from doing this. There needs to be a provincial statute (Act).

• Each jurisdiction must determine when and how to regulate in the interest of their population.

Page 12: Four Key Messages - Health & Safety Conference Society of ...€¦ · Government of Alberta, (1990), Principles and Policies Governing Professional Associations in Alberta, Edmonton,

Constitution Act, 1867s.92. In each Province, the Legislature may exclusively make Laws in relation to Matters coming within the Classes of Subjects next hereinafter enumerated…

13. Property and Civil Rights in the Province “Property and civil rights” have been interpreted by the courts to include the regulation of professions

What do the following have in common:

• Alberta Law Society• College of Physicians and Surgeons of Alberta• Association of Professional Engineers and Geoscientists of Alberta• College and Association of Registered Nurses of Alberta• College of Alberta Professional Forest Technologists• Chartered Professional Accountants of Alberta• Alberta Institute of Agrologists• Alberta Society of Professional Biologists• Association of the Chemical Profession of Alberta• Supply Chain Management Association of Alberta• Alberta Association of Landscape Architects

Page 13: Four Key Messages - Health & Safety Conference Society of ...€¦ · Government of Alberta, (1990), Principles and Policies Governing Professional Associations in Alberta, Edmonton,

Public InterestThe primary reason for regulating a

profession.

• protect service users and the public from incompetent or unethical providers of professional service;

• promote quality, efficiency and cost effectiveness in the provision of professional services;

• balance the rights and responsibilities of professionals, service users and the public; and

• enable service users to exercise informed judgment and freedom of choice with respect to the provision of professional services.
