The NCHR is empowered to investigate Human Rights violations, spread

Human Rights literacy, publish research on international law, raise awareness

about Human Rights protections, make recommendations for the

implementation of treaty obligations, and develop a national plan for the

promotion and protection of Human Rights.

The commission has all the powers of a civil court trying a suit under the Code

of Civil Procedure, 1908 (Act V of 1908). It may call for information or report in

cases of Human Rights form government or its organisations.

Section 09 of the NCHR Act XIV of 2012 bestows broad and overarching

mandate to the Commission which includes inter alia:

Ÿ To hear public petitions / complaints and take suo moto notices of Human

Rights violations;

Ÿ To direct or hold Inquires and Investigations in any incident of Human

Rights violation;

Ÿ To propose, amend or review legislation from Human Rights perspectives;

Ÿ To review the factors, including acts of terrorism that inhibit the enjoyment

of Human Rights and recommend appropriate remedial measures;

Ÿ To study treaties, other international instruments on Human Rights and

reports submitted by the Government of Pakistan on them including the

comments thereon, to make recommendations for their effective

implementation.

Ÿ To submit independent reports to the Government on the State of Human

Rights in Pakistan for incorporation in reports to the United Nations' bodies

or committees;

Ÿ To undertake and promote research in the field of Human Rights and spread

Human Rights literacy among various sections of society for the promotion

and protection of Human Rights in Pakistan;

Ÿ To develop a national plan of action for the promotion and protection of

Human Rights in Pakistan;

Ÿ To establish/declare Human Rights court at district level for the purpose

of speedy trial of offences arising out of violation of Human Rights.

Who we are

NCHR established in May 2015 under the National commission for Human

Rights Act 2012, is Pakistan's first National Human Rights Institution (NHRI).

The Commission has an extensive mandate which includes powers to take suo

moto notice of human rights violations, carry out fact finding missions and

investigate complaints of human rights abuses.

TORTURE CASES IN FAISALABD

From 2006-2012, Justice Project Pakistan probed

and found that around 1424 cases of police torture

were reported. The Medico-legal reports prepared

by the orders of Court affirms that the torture has

been taken place. The said issue was also ndhighlighted by the European Union in its 2

review report of GSP Plus status. The NCHR took

action and constituted a team headed by Chairman

NCHR. The said move of NCHR is also being

supported by Treaty Implementation Cell

established under the Attorney General of

Pakistan.

SOU-MOTU ON ALLEGED LEGAL CREATION OF PLOT IN A PLAYGROUND

IMPORTANT CASES

thOn 25 May 2018, NCHR took sou-motu action

on construction of a house(s) by CDA on a play

ground in sector F-11 /1. The report was sought

from CDA but no response was submitted to

NCHR. Keeping the gravity of the issue NCHR

summoned CDA and CDA requested adjournment

for the submission of para wise comments.

SOU-MOTU ON FOREST FIRES ON MARGALLA HILLS

NCHR took sou-motu notice of fire incident at the

margalla hills which started in mid of the April and

ended in the end of June. Furthermore was also

observed by the NCHR that the phenomenon of

fire on the margalla hills does occur quite

frequently. The civil society also raised their

observation on this issue. NCHR called report

from EPA, MINISTER OF CLIMATE CHANGE,

CDA, NDMA.

'barriers to access to Justice for women in

Pakistan'.

thŸ On 26 April 2018, National Commission for

Human Rights (NCHR) in collaboration with

PODA, a Pakistani NGO organized a

consultation on Minority rights, Freedom of

Religion or Belief 'Faith for Rights'.

A team led by Honorable Member ICT, Mr.

Chaudhry Muhammad Shafique visited different

Jails for assessing the Human Rights situation of

the prisoners and identifying the issues related to

the maladministration of the prison department. A

thOn 16 May 2018 “After Sunset” documentary

screened at NCHR office. “After Sunset” is

documentary on the awareness of spread of HIV

AIDS, and unfolds the story of a boy hailing from

Faisalabad, who has led a street life and how he

has been motivated through Behavior Change

Communication (BCC) to understand the

devastation of HIV and its spread.

sentenced to death under the ATA were convicted

for offences that bore little connection to

terrorism. The major issue under discussion was

the definition of the terrorism in the Act and

reforming it.

Expert Consultation on Reviewing the Implementation of UNCAT in Pakistan

On 26th June 2018, NCHR organized an Expert

Consultation on reviewing the implementation of

UNCAT in Pakistan. The main objectives of this

exercise are to review the current status of

Pakistan's state obligation under United Nations

Convention against Torture and discuss

effectiveness of measures Pakistan has taken so

far to reduce or eradicate torture and also to

discuss the role of NCHR in monitoring the

implementation of the concluding observations by

UNCAT.

Focused Group Discussion on the

Training Needs of Police on Women

Protection

FOCUSED GROUP DISCUSSION

thOn 25 April 2018, a focused group discussion

was held at NCHR office Islamabad for discussing

the training needs of police regarding their

sensitization on women rights. The meeting

intended to conduct a review of existing training

needs and practices to suggest appropriate future

capacity building interventions.

Expert Consultation on Anti-terrorism Act 1997

thOn 6 June 2018, An Expert Consultation on Anti-

Terrorism Act 1997 was organized by NCHR for

discussing the issues of broadness and vagueness

Development of Training Module on Child Rights for ICT Police

NCHR in collaboration with civil society

organizations, initiated the development of Police

training module on Child Rights. A series of

meetings have been organized by NCHR with

Islamabad Police and the working group involved,

in the development of module. The meetings were

attended by AIG Operations, Mr. Asmatullah

Junejo, DIG Operations Faisal Ali Raja, SPARC,

Sahil, Vision, Save the Children and Group

Development Pakistan.

Focused Group Discussion on the Child Protection Mechanisms

thOn 18 April 2018, a focused group discussion

was organized with the major objective of

suggesting the means and ways for improving the

coordination of existing Child Protection

Mechanisms, thus making the institutional

framework to work in harmony and synergies with

each other for an effective Child Protection

System in ICT. The invitees included Ministry of

Human Rights, Islamabad Police, Prosecution

department, ICT Administration etc.

Meeting with the stakeholders on Inter-Agency Protocol for Child Protection

Stakeholders gathered at NCHR for discussing the

Inter-Agency Protocol for Child Protection in

ICT. The stakeholders included Ministry of

Human Rights, ICT Administration, Islamabad

Police, National Child Protection Centre and

Crises Centre.

Coordinator visited Borstal Institute &

Juvenile Jail, Faisalabad and inspected various

sections/facilities provided to the juvenile

prisoners.

thŸ On 6 June 2018, team of NCHR, Regional

Office Punjab under the supervision of Ms.

Kishwar Shaheen Awan, Member NCHR

Punjab visited “Zeest Welfare Foundation”

mandated to education & training for children

with special needs. The objective of the

inspection was to monitor the conditions of

mentally retarded children and fulfilment of

their rights.

thŸ On 12 June 2018, in pursuance of the orders

of the Honourable Chairman NCHR team of

NCHR, Regional Office Punjab team visited

villagers of Kot Asadullah and Kalalanwala,

regarding issue of physical impairment owing

to the consumption of highly toxic ground

water for the past two decades.

stŸ On 21 June 2018, Ms. Kishwar Shaeen Awan,

Member NCHR, Punjab along with her team

visited Kasur and conducted a fact fining

inquiry regarding the cases of six minors who

were being abused within two days in the

month of April, 2018.

thŸ On 26 June 2018, Ms. Kishwar Shaeen Awan,

Member NCHR Punjab along with her team

visited District Sheikhupura and inspected

prison with women prisoners and children at

District Jail, Sheikhupura.

thŸ On 16 April 2018, Brook Delegation held a

meeting with the team of NCHR, Regional Office Punjab and discussed the issues of rights of the owners of the animals working in the mines. The delegation appreciated the efforts of NCHR to protect the rights of the Mine Workers.

Punjab organized an awareness & orientation

session with students of Government Girls

Higher Secondary School, Lahore. The

functions of NCHR, human rights envisaged

delegation of UN Women from Islamabad and

Lahore. The delegation briefed about the

project of UN Women “Violence against

Women” and rights of women living in Darul

Amans being run by the Social Welfare

Office Punjab participated in consultation on

“Gender Based Violence” organized by

Rehnuma Family Planning Association of

Pakistan at its Regional Training Institution,

for Human Development (DCHD) in

collaboration with NCHR Regional Office

Punjab organized a convention involving all

major stakeholders in the protection of

Women Human Rights Defenders including

the representat ives of Civil Society

Organization, National and Provincial

Commissions on the Status of Women, bar

associations, lawyers and media specialists.

The participants were given orientation about

the National Commission for Human Rights

Act, 2012, its functions, mandate and role in

the promotion and protection of human rights.

objective of the consultation was to give

comments on the draft of Child Protection

Policy prepared by Search for Justice.

thŸ On 8 June 2018, Ms. Kishwar Shaheen Awan,

Member NCHR, Punjab participated in a

Provincial Consultation on “Child Domestic

L a b o u r ” o r g a n i z e d b y s e a r c h f o r

Justice/Children Advocacy Network in

collaboration with Labour & Human

Resourced Department and NCHR Punjab.

The objective of the consultation was to obtain

comments of representatives of Government

Officers and Civil Society Organizations on

the draft bill of Child Domestic Labour, 2017.

workshop was to give orientation about

thŸ On 16 April 2018, a meeting of Regional Office NCHR, KP team was held with Probation Officer Charsadda in his Office in district courts Mardan Charsadda.

thŸ On 25 May 2018, National Commission for

Human Rights, Regional Office KP organized a seminar on “Interfaith Harmony” to develop consensus among Minority Communities on d i ff e r e n t i s s u e s f a c e d b y M i n o r i t y Communities of KP and to develop action plan along with responsibilities for future way forward.

Rights situation a team of NCHR, Regional

Office KP visited Child Shelter Home

“Zamung Kor” in Amirabad Colony

Charsadda.

thŸ On 17 April 2018, NCHR KP team visited

Sarhadi Yateem Khana (Orphanage) Mardan th

and on 18 April 2018 Pak Sweet Home,

Mardan, to oversee Human Rights situation.

thŸ On 4 April 2018, on the directions of

Chairman NCHR a fact finding team to probe

the death of Sher Afzal, under the custody of

Police in central Jail Bannu, visited Central

Prison Bannu. The team also visited village

Zeran, Parachinar, Kurram Agency to meet

victim family.

stŸ On 31 May 2018 coordinator NCHR, KP

office visited Gurdwara Jogan Shah and met Charanjit Sing family, he also visited Police Station Inqilab Peshawar to investigate the case of Charanjit Sing. NCHR team also met the Invest igat ion Officer and visi ted Superintendent Police Office, Saddar Circle, Peshawar and had a detailed meeting with Shoukat Hayat, Superintendent of Police. The team has also had a meeting with the leaders from minority community and took their views on the murder of Mr. Charanjit Sing.

attended a Seminar on 'Policy advocacy and

research to strengthen implementation of Pro-

w o m e n l e g i s l a t i o n a n d G e n d e r -

BasedViolence (GBV) response Services in

Khyber Pakhtunkhwa' organized by Blue

Veinz to share the findings of the research

focusing on identification of influencers and

drivers of Child Marriages in KP.

where, she met Mr.Wasif Ali DS railways

Quetta. Mr. Wasif gave a brief presentation

about the Balochistan Railway Department.

stŸ On 21 May 2018, Member Balochistan,

National Commission for Human Rights Ms.

Fazila Alliani visited Quetta and met the

officials from Directorate of Mines &

Minerals regarding the incident of Gas

explosion that trapped mine workers under

debris in Marwar area of Balochistan. Chief

Inspector of Mines Mr. Iftikhar Ahmed gave

briefing about the issues in Mine areas of

Balochistan.

Meeting with mine owners Balochistan

ndŸ On 22 May Mst. Fazila Aliani met the mines owners of Balochistan and discussed all issues of coal mines in the area. She also discussed the issues with President All Pakistan labour federation Quetta, Mr. Sultan Muhammad khan in Islamabad in Senate meeting on coal mines incident of Balochistan.

Ÿ Ms. Fazila Alliani suggested to hold a workshop

in order to sort out the difficulties faced by the

railway department in Balochistan Region and

NCHR received three complaints regarding th

missing persons from Quetta Balochistan on 4

April 2018. The complaints were forwarded to

Ministry of Interior, Ministry of Defence and

Home Ministry Balochistan. NCHR conduct nd

hearing on 22 May 2018 and asked the SHO to

lodge FIR of the three missing persons

immediately, which was complied with. Soon

after registering the FIR, NCHR received news

that all three missing persons returned home th

safely on 13 June 2018 after eight months.

All the three families expressed gratitude to

Member Balochistan NCHR Ms. Fazila Aliani

and NCHR for their efforts.

stŸ On 21 April 2018, a meeting was held with the Provincial Election Commissioner Sindh, Mr. Muhammad Yousuf Khan Khattak at Election Commission Office Karachi. National Commission for Human Rights NCHR along with civil society participated in the meeting.

thŸ On 10 April 2018, a meeting was held at National Commission for Human Rights NCHR regional office Karachi to discuss the issues of Labour. Ms. Anis Haroon Member NCHR Sindh presided the meeting. Mr. Ben Rutledge Senior Advisor –UNGPs and representatives from PILER participated in the meeting.

ACHIEVEMENT

Ÿ National Commission for Human Rights NCHR shared the fact finding report “ A Glance of Nightmare of Drugs in Rehri Goth Village Karachi ” With the Inspector General Police IGP A.D Khawaja and Additional Inspector General Police Dr. Aftab Ahmed Pathan and requested to take action against the drug dealer in Rehri Goth and save the life of youth.

Ÿ On the request of Commission then I.G.P took the action in the slum area and police raided at different points in the village. Police arrested some local drug dealers from the village and surrounding area and seized drugs.

Ÿ Local villagers appreciated Commission initiative to save of a generation. The villagers requested to provide facility to rehabilitate the youth addicts.

Conference was organized by Pakistan

Institute of Labour Education and Research

(PILER) in collaboration with National

Commission for Human Rights (NCHR) and

Sindh Human Rights Commission (SHRC) at

Hotel Regent Plaza, Karachi Chairman

NCHR Justice (R) Ali Nawaz Chowhan was

the guest speaker. Various sessions were

conducted on the problems of workers in the

context of Labour Rights, Human Rights and

Right to Development.

Ÿ On the directions of Member Sindh NCHR,

Coordinator Sindh NCHR along with

Complaint Assistant and Human Right fellow

visited Liquatabad Police Station and

Firozabad Women Police Station.

Ÿ On 29th May 2018 Charanjeet Singh, a Sikh

community leader and human rights activist,

was shot dead in broad daylight in Scheme

Chowk, Budhabir area, Peshawar. Member

Minorities, Ishaq Masih Naz with his

coordinator Aamir Sattar visited Peshawar on th

4 June 2018 for condolence with late Sardar's

family and Sikh community and also held a

meeting with SP, Shakut Khan regarding the

said case.

Meeting With Christian Community at Youhana Abad On Easter Festival

Ÿ Easter Festival has a great significance for

Christian Community. Member Minorities,

to celebrate the festival.

District Jail Lahore (DJL). Superintendent Jail

Mr. Asad Javed Warraich along with Deputy

mandate, mechanism and functions for the

promotion and protection of human rights.
