1 Note about the author

My name is Aroha Waetford and I am of Ngati Haaua kei Waikato, Atihaunui-a-Paparangi, Ngarauru and Nga Puhi descent. I am employed by the Waitangi Tribunal Division as a researcher.

In 1992 I graduated with a Bachelor of Laws degree from Aucldand University in May, and was admitted to the bar as a barrister and solicitor in June. I have tutored Legal Systems at Aucldand Law School while also being employed as the Academic Coordinator for Maori Law students. I completed a report for Wai 143, about the Ngati Maru A to F blocks.

I was commissioned by the Waitangi Tribunal in November 1995 to write a report about the Kaupokonui Recreation Reserve. This is a report to investigate the block history of the Kaupokonui Recreation Reserve and its current ownership status. 1

2 THE CLAIM

The claim for Nga Ruahine was lodged at the Waitangi Tribunal on June 21 1990, and registered initially as Wai 132.2 The Nga Ruahine claim is now considered part ofthe Wai 143 Taranald claim.

The Kaupokonui Recreation Reserve ("Kaupokonui") has been identified as an ancillary claim for the Ngati Tu hapu ofNga Ruahine. The Kaupokonui reserve is one of numerous wahl tapu highlighted by Ngati Tu researcher, Ms Maraekura Horsfall, during her submission made before the Waitangi Tribunal at Aotearoa Marae, Okaiawa, in October 1991.3

3 LOCATION OF BLOCK

The Kaupokonui Recreation Reserve is situated along the east side of the Kaupokonui Stream starting from the mouth and following the bank upstream several hundred metres. Kaupokonui reserve consists of 8.1900 hectares (approx 20.2 acres) ofland, and is about 5 kilometres south­west of Manaia township, South Taranaki.

4 TRIBAL mSTORY

4.1 The Claimants

Ngati Tu is a hapu of the Taranaki tribe Nga Ruahine. ''Ngati Tu claims direct descent from Turi and Rongorongo of the Aotea waka."4 The hapu is named after their tipuna, Tuhaereao. Ngati Tu also claim descent fromTe Whanau A Tangaroa and Te Kahui Maunga, tangata whenua who were living in Aotearoa prior to 1350 AD.5

4.2 Ngati Tu hapu boundaries

According to Ngati Tu claimants, the rohe ofNgati Tu hapu stretches from lands to the east of the Otakeho River, to lands on the west side of the Kapuni Stream. These boundaries reach to the top of Taranaki maunga. Ngati Tu boundaries are shared with two other Nga Ruahine hapu. Ngati Haua is to the west, and Ngati Manuhiakai is to the east ofNgati Tu.6

4.3 Tribal History of Kaupokonui

The Kaupokonui reserve vicinity is of special cultural significance to the N gati Tu hapu. Centuries ago when Turi, captain of the Aotea waka, travelled about the Taranaki coast, he and his travelling party stayed for a time by the mouth of the Kaupokonui Stream.7 Following their arrival, ceremonial rites were carried out in connection to Turi' s sacred cloak, Huna-kiko, which Turi brought with him across Te Moana-nui-a-Kiwa.8 The ceremony took place on the eastern flat lands by the mouth of the Kaupokonui Stream. Huna-kiko, the sacred red cloak was spread out for the people to gaze upon it. Marae-kura was the name given to the place where the garment was laid. According to Reverend Hammond, the name Marae-kura indicated the building of an altar, and the spreading out of the sacred garment.9 Furthermore, the various ceremonies which took place were undoubtedly of a very sacred character.

Before Turi and his party moved on to Patea "they named the cliff head on the eastern side of the

river mouth Kaupokonui, after the head of Turi." In later years, the high land behind the cliff head, became the site of Matangi, a Ngati Tu kainga. On the hillside facing the sea, was another small settlement named TaurataLIO

5 BLOCK mSTORY OF KAUPOKONUI RECREATION RESERVE

5.1 Taranaki confiscations

In 1865, under the authority of the New Zealand Settlements Act 1863 and by an Order in Council dated 30 January 1865, the Middle Taranaki Block was confiscated from various Taranaki hapu. 11 The Kaupokonui area fell within the Middle Taranaki block confiscation reglOn.

5.2 West Coast Royal Commission

Under the West Coast Royal Commission which operated between 1880-1884, thousands of acres of land was granted back to southern Taranaki hapuP Initially, in 1880, the Crown promised to return to southern Taranald hapu the Waimate Reserve which would consist of 25,000 acres of land. 13 By 1882, however, the proposed Waimate Reserve was reduced by approximately 5,000 acres. The Government's reason for reducing the reserves was to punish those Maori in collusion with Te Whiti and Tohu at Parihaka.14 Nga Ruahine Maori numbered as followers and supporters ofTe Whiti and Tohu.

Among the reserves granted to southern Maori within Nga Ruahine's rohe were a number of taunga walm (canoe landing sites).15 However, the canoe landing site, Maraekura, on the east bank of the Kaupokonui stream was not included in these grants. 16

6 PETITIONS - KAUPOKONUI RECREATION RESERVE

Almost forty years passed before any petitions were presented to Parliament for lands confiscated from the Ngati Tu hapu. Rangihuna Pire, a leading member ofNgati Tu, was responsible for the submission of a number of petitions for Ngati Tu lands over a period of almost two decades.

6.1 Rangihuna Pire's petitions

Pire's fIrst petition was presented in 1921.17 Pire, along with others, petitioned about a further grant of land in connection with the "Continuous Reserve" in the Taranaki District which was set aside for certain members of the Ngati Tu hapu. 18 According to the petitioners, the West Coast Royal Commission report of 15 March 1880 stated that a Continuous Reserve of approximately 25,000 acres, extending the whole distance between the Oeo and Waingongoro Rivers, would be set aside for Maori. 19 However following the West Coast Royal Commission report, Maori were granted only 20,348 acres. The petitioners, leading members of the Ngati Tu hapu, therefore claimed entitlement to a further grant of approximately 5,000 acres.

Lands excluded from the originally proposed 25,000 acre Continuous Reserve were surveyed into Crown land reserves, which were located within the Waimate Plains continuous reserves.20 The reduced Waimate Plains continuous reserves wyre set aside for "the Ngatiruanuis and the hapus who live at Weriweri, Mawhitiwhiti, Okaiawa and other places."21

The Kaupokonui Recreation Reserve area was not included in either the Crown land reserves or the Waimate Plains Continuous Reserves.

R N Jones, the Under Secretary of the Native Department, wrote to the Chairman of the Native Affairs Committee saying that:

... the reason the continuous reserve was reduced was that .... the Government determined to reduce the Continuous Reserve [on the Waimate Plains] by 5,000 acres on account of the continued complicity of the Native Residents with Te Whiti, and the Commissioner made the deduction accordingly. 22

The 1921 petition was addressed by the Sim Commission in 1927. On 17 February 1927, the Sim Commission examined Pire about his petition and found that the petitioners had not made out any case for relief. The case made in connection with Pire's petition was that:23

In the report of the West Coast Royal Commission of the 13th March, 1880, it was recommended that 25,000 acres of confiscated land should be set aside as a continuous reserve, extending the whole distance between the Oeo and Waingongoro Rivers. This reserve, on survey, was found to contain 25,363 acres, while the total area granted to Natives was only 20,348 acres. ( ... ) It appears from Sir William Fox's letter to the Native Minister of the 8th March, 1882 that the Government decided to deduct 5,000 acres from the reserve, and that is why more land has not been granted to the Natives. The Government was entitled, of course, to do that, as the Natives had not acquired any legal or moral claim to have full effect given to the recommendation of the Commission.

Dissatisfied with Government's response, Pire persisted and petitioned again in 1934-35, for the extra 5,000 acres promised by the West Coast Royal Commission, and also, about the subject of talmha.24 The Native Minister was advised by his Under Secretary, 0 Campbell, on 3 July 1936 that:

.... the prayer of the petitioners for compensation was covered by the recommendations of the Royal Commission of 1927 which resulted in the annual payment of £5,000 to the Taranald Maori Trust Board and in view of this it is recommended that you approve of no further action being taken with regard to this petition.

6.2 Petition regarding Canoe Landing sites - Kaupokonui Stream

Pire's third petition encompassed even wider matters of concern for Ngati Tu, including:25

1. Inquiries about the imprisonment of their tribal elders taken from Parihalca; 11. Preservation of the spirit and body of the Treaty ofWaitangi; iii. The Waimate Plains confiscation, and subsequent land grants from the West Coast Royal

Commission; iv. A canoe landing site containing 193 acres; v. Another canoe landing site, a 6 acre reserve situated to the south of the Kaupokonui

stream and taken by the Waimate County Council.

Pire's entire petition, like his earlier attempts, met with no success for the Ngati Tu hapu.

In a memorandum to the Native Affairs Committee Clerk, the Native Affairs Department Under Secretary, 0 Campbell, expressed surprise regarding the proposed size of the 193 acre canoe landing site.26 Campbell was unable to identify the landing place that the petitioners were claiming. Sections 31 and 32, Block II, Waimate Survey District were mentioned in the petition in reference to this particular canoe site. Campbell discovered that both sections were situated approximately 6 kilometres up the Mangawhero stream. Also, each section was leased "under the provisions of the West Coast Settlement Reserves Act, 1892, to the Public Trustee as trustee in the estate ofW Shearer Jnr, and to AL Campbell respectively."27

The second landing site mentioned in the petition was Section 127, Block VII, Waimate Survey District, consisting of 6 acres. This area was reserved for gravel purposes in 1898, and had since been vested in trust in the Waimate West County Council by an Order in Council in 1910.28

"The Commissioner of Crown Lands state[d] that this area [was] about two miles from the Kaupokonui Stream and about one mile inland, and that it could hardly be termed a canoe landing place."29

It is important to note that neither landing site identified in Pire's petition referred to the location of the Kaupokonui Recreation Reserve. When, however, Pire submitted an illustration of the landing site he was laying claim to, his sketch included the area of the Kaupokonui reserve.30

The land referred to in Pire's sketch was identified by P.H. Dudson, Registrar, Wanganui Native Land Court, as part of Sections 25 and 29 block VI Waimate SD. Having obtained Land Transfer searches, Dudson advised the Native Affairs Department Under Secretary "that the land is held by European owners under Land Transfer Certificates of Title."31

7 KAUPOKONUI RECREATION RESERVE

7.1 . Components of Kaupokonui Recreation Reserve

The following section details the block history about the four reserves of which Kaupokonui Recreation Reserve is comprised. History common to the four reserves will be identified as part of Section 25, Block VI, Waimate Survey District, while any further details are identified under each of the reserves individually.

Pursuant to the Reserves Act 1977, the Kaupokonui Recreation Reserve, consisting of 8.1900 hectares, was created in August 1982.32 The four reserves consolidated to form Section 84, which is now lmown as the Kaupokonui Recreation Reserve, were:33

~ Pt Lot 1 DP 6804 ~ Lot 1 DP 12278 ~ Section 8.1, Block VI, Waimate Survey District ~ Section 83, Block VI, Waimate Survey District

7.2 Section 25, Block VI, Waimate Survey District

Section 25, Block VI, Waimate SUrvey District, consisting of73 acres (approx 29.5 hectares), was part of the original Crown subdivision for the sale of Crown grants. On 24 January 1881, George Glenn purchased Section 25 for the sum of £483-12s-6p.34

On 12 April 1894, George Glenn's (deceased) interests were transmitted to C S Glenn, JAR M Glenn and R A Glenn.35

Thirteen years later, the interests of C S Glenn, JAR M Glenn and R A Glenn were transferred to J N Gamlin, on 22 August 1907.

On 27 April 1921, a further transfer of Section 25 took place from J N Gamlin to Alfred Gamlin.36

In 1933, Section 25, along with other sections, was subdivided to become part of Lot 2, DP

By 1936, Lot 2, DP 5415, along with other portions ofland, was transferred to James Winks.38

i. Lot 1 DP 6804

In 1949, James Winks subdivided Lot 2 DP 5415 to create Lot 1 DP 6804, consisting of9 acres 2 roods 10 perches (3.3139 hectares).39

On 9 February 1951, James Winks gifted Lot 1 DP 6804 to the Kaupokonui and District Beach Society (Incorporated).40

In June 1958, part of Lot 1 DP 6804 (1 acre 1 rood 19.8 perches) was transferred to the Waimate West County Council, to be used as a public road.41

On 17 June 1980, the Kaupokonui and District Beach Society (Incorporated) gifted Lot 1 DP 6804 to the Crown.42

ii. Lot 1, DP 12278

Lot 1, DP 12278 consisted of3.5250 hectares (approx 8.71 acres) and adjoined Lot 1, DP 6804.

On 20 June 1951, a Certificate of Title 168/40, was issued to James Winks for the balance ofland from Certificate of Title 140179.43 The balance ofland included Lot 1, DP 12278.

On 1 August 1958, Lot 1, DP 12278 was transferred to J D Elmes. Further transfers ofinterest took place in 1965.

In March 1977, the lands of Certificate of Title 168/40 were further subdivided by DP 12278 and created Lot 1.44 In July 1977, Lot 1, DP 12278 was gifted to the Crown as a recreation reserve

pursuant to the Reserves and Domains Act 1953.45

iii. Section 83

Section 83, a strip of road area, consisted of2 roods 12.6 perches (2342 square metres).

Pursuant to section 323 of the Local Government Act 1974, section 83 was transferred to the Crown by the Waimate West County Counci1.46 The transfer took place on 19 March 1980, and from the date of notice the said land was deemed to be Crown land subject to the Land Act 1948.47

On 19 January 1982, Section 83 was set apart as a reserve for recreation purposes subj ect to a lease dated 24 December 1981 which was granted to K J Fox and SPLay as joint tenants, pursuant to section 67 of the Land Act 1948.48

On 6 August 1982, Section 83 was classified a recreation reserve subject to the provisions of the Reserves Act 1977, and also subject to the abovementioned leases for Messrs Fox and Lay.49

iv. Section 81

Section 81, consisting of2 acres 3 roods, (approx 1.11 hectares) was classified as Crown land until approval was given in July 1925 that it be made a permanent reserve. 50

On 3 October 1925, Section 81 was temporarily reserved from being sold. 51 Such powers were provided under section 359 of the Land Act 1924 and section 69 of the Land for Settlements Act 1908. Two months later on 16 December 1925, Section 81 was permanently reserved as a recreation reserve under section 360 ofthe Land Act 1924.52

The following year, on 28 May 1926, Section 81 was declared a recreation reserve under section 26 of the Public Reserves and Domains Act 1908. The new reserve would be lmown as the

Kaupokonui Recreation Domain and be managed, administered, and dealt with as a public domain according to the Public Reserves and Domains Act. 53

7.3 Formation of Kaupokonui Recreation Reserve

On 6 August 1982, the four reserves, Lot 1 DP 6804, Lot 1 DP 12278, Section 83 and Section 81 were consolidated into the Kaupokonui Recreation Reserve.54 The Kaupokonui reserve, allocated a new section number, 84, was subject however to aJ1 existing lease dated 24 December 1981, and granted to KJ Fox and SP Lay.55 ~

The Waimate West County Council was appointed to control and manage the Kaupokonui reserve subject to the Reserves Act 1977.56 A further condition applied also whereby the Kaupokonui District and Beach Society (Inc) was appointed by the said Council for the day-to-

- day responsibilities of controlling and managing the reserve.

8 ISSUES ABOUT THE KAUPOKONUI RESERVE

Numerous petitions were presented to little avail by Rangihuna Pire, in the hope of regaining Ngati Tu tribal lands. The lack of success in Pire's attempts have culminated to the present Nga Ruahine claims submitted before the Waitangi Tribunal.

8.1 Claimants'Request

The Ngati Tu claimants' request regarding the Kaupokonui Recreation Reserve was presented by Ms Horsfall, before the Waitangi Tribunal in October 199I,57 Written evidence, a letter from Conservation Officer, David JE Rodgers to S Hormann, the Regional Conservator, Wanganui identified the following Ngati Tu requests:58

11. N gati Tu were requesting the support of the Department of Conservation to help them regain authority over the Kaupokonui Recreation Reserve. Ngati Tu were wanting the Minister of Conservation and the Minister of Justice to transfer authority of the Kaupokonui area to a tribal Maori Trust which was to be set up for the running of the lands concerned.

Conservation Officer, David Rodgers suggested the following recommendation in his letter that:

A case [be put] to the Minister stating that the Ngati Tu Hapu when ready to take control of the business matters pertaining to the Reserve management and the N gati Tu Hapu are ready to select Trustees, that they then become the Local Body responsible for it.59

8.2 Current status of Kaupokonui Recreation Reserve

The current status of Kaupokonui Recreation Reserve is as mentioned earlier, the recreation reserve is vested in the South Taranald District Council, while day to day management is delegated to the Kaupokonui and District Beach Society (Inc).60 Existing leases of bach sites at the reserve are for a ten year term, and are perpetually renewable. Also, the deeds of lease are in the name of the Minister of Lands as lessor. "The vesting of the reserve subsequent to granting of the leases means that the council is now the lessor and can exercise all the relevant powers, including approval of assignment of leases.,,61

Currently, the issuing or reassigning of leases require the approval of the Minister of Conservation. However, once a reserve management plan has been prepared, such approval would no longer be necessary, and the council would be able to exercise all its leasing powers subject only to the policy contained within the Reserve Management Plan.62

The Kaupokonui Recreation Reserve encompasses wahl tapu which is of very special cultural significance to the Ngati Tu hapu, and, Nga Ruahine descendants as a whole. At present, the lack of active involvement in the management and ownership of the Kaupokonui reserve is an important issue of contention for Ngati Tu. Although the Kaupokonui canoe landing site has been set up as a reserve and is protected accordingly, the ownership and management status of the Kaupokonui Recreation Reserve has yet to revert to the N gati Tu hapu.

The ab,ove dealing, Abstract No 264102 involving transfer of Lot 1 DP 6804 and Part Secti9n 25, Block V1 Waimate Survey District from the above Society to the Crown was lodged for registration on 17 June 1980.

Registration of the dealing will be the culmination of long and involved negotiations between the two parties and the Society has made a request that the Certificate of Title, Volume 167 Folio 11, when cancelled, be returned to it for retention as part of its historical records.

If the duplicate copy of the title, which would normally be destroyed, could be clearly marked as "cancelled" to enable its return to the Society,_ it wo~ld be much appreciated.

"w.ElEREAS THE KAUPOKONUI .AND DISTRICT BEACH SOCIErY (INCORPORATED) (hereinafter

caJ.led "the Society") is seised of an estate in fee simple in all that parcel

of land under-described (called "the beach site ll) AND WHEREAS the Society

wishes to transfer the beach site to the Crown as a recreation reserve subject

to the Reserves Act 1977 without valuable consideration but subject to the

following conditions namely -

(a) The beach site shaJ.I be amalgamated as a reserve with adjoining

recreation reserves namely the land in Certificate of Title Volume

E1 Folio 1314 and Section 81 Block VI Waimate Survey District to be

known as the Kaupokonui Recreation Reserve (called "the said reserve ll ).

(b) The Crown shall use its best endeavours to close that part of the

Kaupokonui Heads Road which is presently unformed. and adjacent to

the said Section 81 and the beach site (called lithe unformed roadll ) -and to procure its reservation as a recreation reserve.

(c) The Crown will procure appointment pursuant to Section 28 of the

Reserves Act 1977 of the Waimate West County Coun9il to control and

; manage the said reserve as a recreation reserVe, subject to the

condition (pursuant to subsection 2 of Section 2~) that the Society

be delegated the responsibility for the day to day administration of

the said reserve.

The transfer of the beach site is subject to the existing rights of

unregistered lessees of dwellings and other buildings on the beach

site and the Crown shall forthwith on execution of the transfer

herein execute leases to the said lessees, which said leases are to

be for a term of 10 years perpetually renewable, the first such term

to be extended to include the broken period from the date of the lease

to 31 December 1981; the annuaJ. rental to be $50-00 per annum until

y 31 December 1981 and thereafter at 2 percent of the Capital Value (as

that term is defined in the Valuation of Land Act 1951) appearing on

the District Valuation Roll as at 31 December 1981, which rental shall

be re-assessed at five-yearly interva~s according to the Capital Value

appearing on the District VaJ.uation Roll for the District at the time of

the reassessment; which rental may be reduced by the lessor if such

rental is in its opinion inequitable; the leases are to be assignable

and subject to such other terms and conditions as are agreed to prior

to the execution of this transfer.

(e) If upon survey it is found that a dwelling owned jointly by

Dr K J Fox of Manaia and Dr P S Lay of Kaponga occupies the unformed

road (but not otherwise) the Orown shall use its best endeavours

to ensure the occupants are give~ a personal lease for their

lifetimes only of the site of the said dwelling and otherwise

pursuant to the Reserves Act 1977.

(f) The Orown shall not alter or disturb the existing contours of the

beach site and shall ensure that the greatest area possible is set

aside for the enjoyment of the casual visitor.

AND ~ the Orown accepts the gift of the beach site as a recreation rese.rve

subject to the recited conditions

AND ~S the said Oouncil has agreed to accept appointment to control and

manage the said reserve subject to the recited conditions

NOW THEREFORE the Society by way of gift doth hereby transfer to HER MAJESTY

THE QUEEN as a recreation reserve subject to the Reserves Act 1977 all its

estate and interest in the beach site being an estate in fee simple in all that . -. ~,~

Publio Works Amendment Act, 1911, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor·General of the Dominion of New Zealand, acting by and with the advioe and consent of the Executive Council of the said Dominion, doth hereby revoke the license dated the twentieth day of November, one thousand nine hundred and sixteen, and published in the New Zealand Gazette N 0.131, of the twenty-third day of November, one thousand nine hun­dred and sixteen, authorizing the Riocarton Borough Council to erect electrio lines in the Borough of Riocarton and portions 'of the Christchurch City and Waimairi County, and doth-=­subject to the conditions set forth in the Schedule hereto, and to the regulations made under section two of, the 'aforesaid Act, and dated the ninth day of October, one tholLsand nine hundred and twenty-two, and published in the New Zealand Gazette of the twelfth day of the same month, or any regula­tions hereafter made in amendment thereof or in substitution therefor (and hereinafter collectively referred to as " the regu­lations "), and which regulations shaIl be deemed to be in­corporated herein-hereby authorize the Riccarton Borough Council (hereinafter referred to as' "the licensee") to erect and maintain electric lines for lighting, power, and heating purposes within the area of supply hereinafter described, suoh electric lines at present proposed to be erected being indicated by means of yellow and green lines on the plan marked P.W.D. 64483, and deposited in the offioe of the Minister of Publio Works at Wellington, in the Wellington Land Distriot.

SCHEDULE. 1. AREA OF SUPPLY.

THE area of supply comprises the 'Borough of Riccarton as at present constituted, and portions of the Christchurch City and Waimairi County. As the said area is more partioularly de­lineated on the plan marked P.W.D. 64483, deposited as here­inbefore referred to.

2. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraphs (c) and (e) of clause 2 of the regulations. The primary distribution voltage shall be approximately 3,300 volts between phases. The seoondary distribution voltage shall be approximately 400 volts between phas~s and 230 volts between any phase and neutral.

3. DURATION OF LWENSE.

This license shall, unless sooner determined in accordanoe with the provisions hereinaft.er expressed, continue in force for a period of forty-two years from the date hereof. Opon the expiry of the said term, or upon the sooner determination of this license by revocation or otherwise, all rights hereby granted to the licensee shall thereupon ceMe and determine; but suoh expiration or determination shall not relieve, the licensee of any liability theretofore inourred under this license.

4. C.lLU\GES FOR ELEOTRICAL ENERGY.

The charge for eleotrical energy shall not exceed 9d. per' unit for ,lighting purposes, and 4d. per unit for motor-power, heat­ing, or cooking purposes; provided that" lighting purposes " shall include the operation of motor generators for lighting purposes.

5. CONVERSION OF LINEs FROM EARTH-WORxnw TO METALLW.

Notwithstl1Ilding anything herein oontained, the licensee shall bear the coat of converting the Railways or Post and Telegraph Department's lines which are now erected from earth-working to metallic if such conversion is required by the Minister of Railways or the Minister of Telegraphs, owing to electrical interference arising from the licensee's lines.

6. TELEGRAPH-LINES.

The licensee shall reotify to the satisfaction of the Minister of Telegraphs or the Minister of Railways any interference or disturbance caused by ·the ereotion or operation of the licensee's system that affeots the satisfaotory working ,of the telegraph-lines which are the property of the Telegraph De­partment or the Railway Department,and which were erected prior to the licensee's lines.

8. ROUTES RESERVED FOR GOVERNMENT Lmis. The lioensee shall not, without the oonsent in writing .of the

Minister of Public Works, erect any eleotrio lines along the routes of the Government main trunk transmission-Iiues.

I N pursuance and exercise of the powers conferred on him by the Shearers' Accommodation Act, 1919, His Excel­

lency the Governor-General of the Dominion of New Zealand, aoting by and with the advice and consent of the Exeoutive Council of the said Dominion, doth hereby make the follOwing regulations for the purposes of the 'said Act; and:doth hereby declare that these regulation~ shall come into force as from the date of their publication in the New Zealand Gazette.

SCHEDULE. 1. SAVE in exceptional ciroumstances, no person. shall sleep in the dining-quarters or cooking-quarters.

2. Where sufficient water is available a plunge bath or shower bath and suitable and reasonable equipment for 'the washing of clothes with an adequate supply of hot water for bathing, and for the washing of clothes shall be provided.

3. Where sufficient water is not available for the purposes. of the last preoeding clause other reasonable equipment for bathing and for the washing of clothes shall be provided to ,the satisfaction of the Inspeotor.

4. All killing-pens shall be kept to the satisfaction of the: Inspector in a sanitary condition and at a sufficient distance from the dining, sleeping, and cooking quarters.' ,

5. A ftY"'Proof safe of suitable size shall be provided for use in couneotion with the cooking quarters. '

6. Every employer shall, if so required by the Inspector, notify him as nearly as possible of the date when he intends to commence shearing.,

7. Sanitation shall comprise earth-closets or some \>t4er effective method of disposal of sewage. Where earth-closets are provided they shall be situated in a position to' be approved by the Inspeotor, not being less than twenty-five yards from' either the sleeping-quarters, the dining-quarters, or the cook­ing-quarters, and not less than fifty yards from the wa.ter­supply. A sufficient supply of disinfectants shall also .be provided. "

8.' Satisfactory provision shall be ~ade for the diRposal of . garbage and drainage from the dining and cooking quarters"'\ ' so that snch refuse shall not create, a nuisance or be detri- ' mental to health.

Further to your request for the status of the above reserve I advise as follows : .

The reserve is gazetted as recreation reserve and is vested in the South Taranaki District Oouncil. Day to day management is delegated to the Kaupokonui and Oistrict Beach Society Incorporated.

Legal Interpretation:

The transfer and lease documents are quite olear that the leases of oottage sites at Kaupokonui Beach reserves are leases for the term of ten years: Perpetually renewable.

The deeds of lease are in the name of the Minister of Lands as lessor. The vesting of the reserve subsequent to granting of the leases means that the council is now the lessor and can eX,etcise all the relevant powers, including approval of assignment of leases.

Council can issue or reassign leases however in each case this requires the approval of the Minister of Conservation. Once a
