OHSA Workplace Violence & Harassment Provisions – Human Rights Complaints & WSIB Mental Stress ClaimsJeremy Warning, Partner, Mathews Dinsdale & Clark LLP

Deanah Shelly, Partner, Mathews Dinsdale & Clark LLP

Prevention of workplace injuries, including mental stress injuries is enshrined in the Occupational Health and Safety Act (OHSA) and Canada Labour Code Part II. Human Rights obligations also require the employer to have a policy, program and process for complaints. Recent changes to the Ontario WSIB entitlement provisions (and those in other Canadian jurisdictions) allow for injuries as a result of WPV and complicate the workplace investigation process further. What are these legislative provisions and obligations? How does an employer and its OHS, HR, and Disability Management staff work through this complicated workplace issue? Who does what, when and how? This session will provide an overview of the legislative provisions and some key practical takeaways for those involved.

The Future Work of the OHS ProfessionDavid Johnston, CRSP, EP, Director, Environment, Health and Safety Toronto Hydro-Electric System Limited

Since the enactment in 1979 of the Occupational Health and Safety Act in Ontario, employers and education institutions have increasingly embraced and supported the concept of the safety practitioner and the important role the profession contributes to safer and more efficient workplaces. In the spring of 2019, the Board of Canadian Registered Safety Professionals (BCRSP) and the Canadian Society of Safety Engineering (CSSE) conducted a survey on regulating the OHS profession. The survey results showed 90% believe there is value in regulating the practice of safety, but only 70% believe the profession is ready for regulation. This session will discuss the evolution of the profession, the implications and benefits of regulating the profession and the BCRSP’s progress in the development of a National Framework for title recognition and legislated status for the health and safety profession.

Chemical Hazard Assessment for Small to Medium Sized BusinessesThomas Tenkate, DrPH, FEHA, FRSPH, CRM, Associate Professor & Director School of Occupational & Public Health, Ryerson University

WHMIS training is obligatory across the country and it includes knowledge of chemical Safety Data Sheets (SDSs). Despite this, many workers do not have a good understanding of the health impacts of chemicals they use in their workplaces. This is a particular issue for small to medium sized businesses (SMEs) who do not have regular access to OHS professionals. This session will tell you about a tool created by the Ryerson team to help you better understand SDSs and to prioritize health hazards of your workplace chemicals. The Chemical Hazard Assessment and Prioritization (CHAP) tool was piloted by six workplaces for effectiveness, usability, and usefulness. Attend this session to hear more about the results of the pilot testing and see a demo of the electronic version of the CHAP tool now in trial.

The Unhappy AccidentRodd Wagner, NY Times Bestselling Author

Rodd began his career as a newspaper reporter covering ‘cops and courts’, including the emergency services that respond to fatalities. The question that’s bothered him since is the same one that bothers every accident investigator: “What

were they thinking?” While obsessing over these ‘fatal flubs’, Wagner sifted through fatal accident reports and stats for a decade. His research revealed that the root causes of what gets us killed are, for those of us lucky enough to avoid such an accident, the root causes of our unhappiness. We lack the psychological wiring to be as safe as we could be, or as happy. Knowing how these mental mistakes happen, when they will happen, and countering them, is key – when all else has failed – in staying safe.

You will be challenged to assess your awareness of the risk; change your attitude towards driving; remove the word “accident” from your vocabulary; slow down – speed kills; drive as an art and not as an act; and wear your seat belt. As a parent, grandparent, co-worker, manager or business owner, do you know what your greatest risk for injury or death is?

Contractor Management Landscape, Priorities and Resolutions Richard Cerenzio, Senior Director, Corporate HSEQ, ISN

Outsourcing work to contractors continues to increase. This presentation will examine the contractor management process and the risk concern. The priorities that are recognized by organizations when working with contractors will be discussed. You will hear about the importance of training employees on how to better define serious injury or fatality (SIF) exposure by identifying common precursors that can lead to SIFs, focusing on events that have a higher SIF potential, continually reinforcing a safety-first culture among employees and contractors, and more.

Occupational Health for Safety: Injury Mitigation Through Innovative Approaches to Health and Wellness PromotionDr. Farrell Cahill, Lead Researcher, Horizon Occupational Health Solutions

Traditionally OHS providers have attempted to standardize a health and wellness approach with the hopes of evoking a meaningful impact on the health and safety of its employees. Dr. Cahill has discovered that these programs are fundamentally flawed in their approach, and are not utilizing the correct Key Performance Indicators (KPIs). He will share a two-pronged approach where preventive measures must be supported by new and innovative critical actions and the implementation of interventions must be practical. The consequences of employing physically unfit individuals for a physically demanding job in safety sensitive environments can be costly, both in human and economic terms.

Smartphones and the Pursuit of Workplace WellnessJim Lees, M.SW. RSW, Social Worker/Private Consultant

Smartphones have been blamed for everything from shorter attention spans and depression to the destruction of our youngest workplace generation.  This session examines the impact smartphone technology has on our behaviour, emotional life, physical selves, personal interaction and cognitive processes. Because developing a healthier relationship with our smartphone is not a “one-size fits all” proposition, we will overview a range of concepts and approaches in order to provide participants with strategies that fit individual circumstances. To facilitate audience participation, please bring your phone, tablet or laptop as we will be doing polling during the session.

Developing Actionable Recommendations for the Integration of Workplace Safety & Wellness Initiatives Dr. Aviroop Biswas, PhD., Associate Scientist, Institute for Work & Health

Integrated worker health programs that include workplace wellness and occupational health and safety OHS activities can have greater benefits to the overall health and safety of workers compared to those that focus on OHS or individual behaviour change alone. It can be beneficial for organizations to coordinate OHS and wellness efforts rather than develop separate programs and activities that compete for resources. Dr. Aviroop Biswas will share recommendations from a recent study he led which cross-references existing research evidence with practitioner (e.g. HR and OHS professionals) insights to understand what matters most to workplaces when integrating safety and wellness initiatives.

Attend this session to learn how to effectively promote safety in a language that senior management understands. Understand how to express workplace safety in terms of risk management and demonstrate the direct impact of safety efforts on the company’s bottom line.

COR 2020 – Requirements and Mapping to Legislative IncentivesDavid Steinschifter, Manager, Strategic Programs Infrastructure Health & Safety Association (IHSA)

COR 2020 is an update of the IHSA COR program to align with the Ontario Ministry of Labour, Training and Skills Development (MLTSD) Accreditation Standard recently released as “Supporting Ontario Safe Employers”. This updated standard and audit provide a road-map for workplaces to implement an effective occupational health and safety management system which satisfies the bidding requirements of Ontario’s buyers of construction requiring COR as well as the criteria to be recognized by the Ministry. Workplaces striving to achieve COR 2020 are able to gain a financial incentive through the WSIB’s Health & Safety Excellence Program as they implement their program. Attend this session to learn about the process itself and resources and guidance available to achieve COR 2020 and improve your workplace health and safety outcomes.

Stop Cutting Corners – Safety Is In Your Hands!Duane Janiskevich, Gripping Insights Consulting

Cutting corners is when part of a process is removed while attempting to achieve the original result. Usually it’s done to save time, effort or money, but often it results in sacrificing quality or safety. On November 22, 2008, a small unsafe decision had a dramatic impact. Duane used the wrong tool and used it incorrectly, placing him on the receiving end of a table saw kickback. In a split second his right hand was crushed; his middle finger and thumb severed. Duane will tell you about the anger, pain, victimization and loss, but leave you with forgiveness, perspective, perseverance and hope. A serious reflection of the risks you take when you decide to cut corners. Duane is a humorous and passionate story-teller who draws insight from his life experiences and shares them with his audience.

Cannabis Use and the Canadian WorkplaceDr. Nancy Carnide, PhD. Associate Scientist, Institute for Work & Health

The legalization of non-medical cannabis in Canada has shone a spotlight on impairment in the workplace, and possible occupational health and safety consequences. But what do we really know about Canadian workers’ use of cannabis and how they think about cannabis use at work? Has any of this changed since legalization? Dr. Carnide will describe a multi-year study currently being conducted by the Institute for Work and Health on cannabis use and the Canadian workplace. The study involves surveying workers from a wide range of industries and occupations across Canada. Dr. Carnide will share some of the findings from the first two surveys to come out of this study: one before legalization, and another conducted nearly a year later. Learn about Canadian workers’ cannabis use patterns (including their use before and at work), what they know about cannabis, their thoughts on the risks and impacts of cannabis use and work, and what the culture around cannabis is at their workplaces.

Unleashing Your Disruptive BehaviourGraham Sherman, Tool-Shed Brewing Company

Truly standing out in a tough economy, against monster-sized competition requires the use of part of our brains we don’t often access. In fact, we’ve been taught to suppress our disruptive

behaviour since childhood — but now it’s time to harness those powers of disruption for the benefit of successes as entrepreneurs. Graham Sherman has been shaking things up since he worked on private-sector government and military contracts throughout Afghanistan, to when he began brewing beer and changing the game for small breweries across Alberta. Tool Shed Brewing Company’s unique approach to disrupting the market has led to it being nominated for Canadian Entrepreneur of the Year; being named as Calgary’s “Top 40 under 40”; and the brewery’s position in the top five percent of breweries in North America. After hearing Sherman’s story and insights, you’ll walk away incredibly inspired and with a clear path to unleashing your own disruptive behaviour to transform your business.

Managing Risk:  An Electrical Inspection PerspectiveDr. Joel Moody, Director Safety, Risk, Policy & Innovation Electrical Safety Association

The Electrical Safety Authority (ESA) is an Administrative Authority acting on behalf of the Government of Ontario with a mandate to promote and undertake activities which enhance public electrical safety.  ESA is also responsible for administering regulation in four key areas, one of which is the Ontario Electrical Safety Code.  Inspections, investigations and enforcement (II&E) activities help to manage risks to the public interest.  Risk management is a continuous improvement process that identifies potential hazards and undesirable events; understanding their likelihood and consequences; and taking steps to control the risks if necessary.  To achieve these results, a good risk management process considers both real and perceived risks and all stakeholders’ needs.  ESA’s wiring inspection activities is a place where risk management practices are applied.  Starting in 2020 ESA will move to a risk-based approach for electrical wiring.  This means spending more effort on high-risk electrical wiring work, and less on low risk work without compromising health and safety. If your workplace does any electrical work or hires contractors to do it for you, attend this session to learn more.

Making Mental Health A Workplace PriorityDr. Bill Howatt, Chief of Research, Workplace Productivity Conference Board of Canada

The statistics are staggering. One out of four Canadians are impacted by mental health per year, and seven out of ten are in the workforce. Stigma about mental health continues to be a major issue, and organizations are challenged with attempting to support employees at risk of or suffering with a mental illness. What are the elements of a psychological health and safety management system that can ensure psychological safety is ingrained in your organization’s culture? Join Dr. Howatt for a discussion of the elements necessary to ensure success. Dr. Howatt is a behavioural scientist, known as one of Canada’s top experts in mental health issues in the workplace.

Safe Lifting TrainingDon Patten, RKin. BHK. CCPE, CRSP, Ergonomics Specialist Workplace Safety & Prevention Services (WSPS)

Training programs for safe lifting vary greatly using a wide variety of examples and scenarios. The content however is surprisingly the same, with an emphasis on learning a safe handling technique known as “straight back, bent knees.” This training approach focuses on behaviours, paying little attention to the individual learner’s interaction with a changing work environment. Attending this session will outline essential elements of a safe lifting program to ensure your employees receive training that is memorable and transferable to real work situations.
