SRB systems office and as such “operations” are located in Australia, namely Adelaide, and SRB system ONLY sells its product, including the Patented Spartan Sideform System of which the aluminium extrusion, the subject of this application for exemption, to overseas markets where we have patents and patents coverage etc. We do not and cannot sell the said aluminium extrusion in Australia, nor can anyone else for that matter manufacture and or even sell the said extrusion in Australia other than ITW Australia or their nominee as ITW Australia own the said patents. If we, or anyone else for that matter, were to “produce” these extrusion in Australia or New Zealand and or make the said extrusions available for sale in Australia or New Zealand we would be infringing ITW patents and hence would be sued by ITW Australia for patents infringements with serious consequences. Accordingly we ONLY therefore offer for sale our products including the Spartan Sideforms system, of which the subject aluminium extrusion is only a component of, in overseas markets. Dear Victor Further to this matter and our communications below I would like to put forward the following responses on Public Record to the points raised by Inex Australia, Capral Aluminium & G James Aluminium. First and foremost we would like to point out that under the Dumping Duty Act there are two exemption provisions namely:- • that like or directly competitive goods are not offered for sale in Australia to all purchasers

on equal terms under like conditions having regard to the custom and usage of trade (section 8(7)(a) and section 10(8)(a));

• that the goods, being articles of merchandise, are for use as samples for the sale of similar

goods (section 8(7)(e) and section 10(8)(d). And in this regard we believe that SRB Systems Satisfies BOTH criteria for such exemption. I will firstly address the second Point:- • that the goods, being articles of merchandise, are for use as samples for the sale of similar

goods (section 8(7)(e) and section 10(8)(d). SRB systems office and as such “operations” are located in Australia, namely Adelaide, and SRB system ONLY sells its product, including the Patented Spartan Sideform System of which the aluminium extrusion, the subject of this application for exemption, to overseas markets where we have patents and patents coverage etc. We do not and cannot sell the said aluminium extrusion in Australia, nor can anyone else for that matter manufacture and or even sell the said extrusion in Australia other than ITW Australia or their nominee as ITW Australia own the said patents. On the said website, as illustrated via the above link, it is blatantly obvious that our sales are international sales via “distributors” and where we do not have distributors we sell to the precasters directly until such time as we develop a distributor or agent in any specific market or region etc. On this SAME web page if you look under Australia it CLEARLY states that sales in Australia are through “Reid Construction Systems” that is a 100% owned Subsidiary of ITW Australia (the owners of the IP / Patents for this product):-

And as such WE DO NOT sell into Australia and WE CANNOT sell into Australia through patent protection on this product as all the Intellectual Property (Patents) for this product for Australia and New Zealand is owned by ITW Australia. As we have some overseas Distributors and are in there process of establishing further overseas distributors we need to have samples of our product range that includes samples of the completed Spartan Sideforms (part of which comprises the said aluminium extrusions) to send to our Distributors to use for demonstrating our novel products to their customers i.e. Precast yards in their territories. We also need to keep completed sample lengths of this product to send to precasters Overseas even in territories where we still currently do not have distributors so as these precasters can review our products from these sample lengths in their determinations of whether they wish to buy our precast formwork systems or not. Accordingly we need to bring into Australia sample lengths of the said aluminium extrusion in our complete range of sizes in lengths of between on average 300 mm and 600 mm long to which we add the Rubber End Caps and Rubber Base inserts and PVC Chamfer Capping Profiles - all the other patented items that complete the Spartan Sideform that we then send ‘as samples’ to Overseas Distributors and Precasters to evaluate our products. Below are actual images of the actual samples as completed that were part of the import for which we were charged the anti-dumping fees and for which we are is seeking exemption for:-

Attached is our Product Brochure title “SRB Spartan & Titan Brochure - English.a . 16.05.2013.pdf” which illustrates on page 8 that the actual Spartan Sideforms are sold in length of 5.8 m. Also attached is our Customer 2014 Price “SRB Systems - Precast Formwork Pricing - 2014.pdf” that ton page 3 again clearly illustrates that the Spartan Sideforms (of which the said aluminium extrusions are one component) are sold in lengths of 5.8 m long. Anyone with any basic knowledge or understanding of precast formwork or even the construction Industry generally will know that formwork or sideforms more particularly are always sold in lengths of around 6 m long and cannot used or are fit for purpose as lengths of 300 mm to 60 mm and that these lengths would ONLY be sample lengths and of no practical commercial use! These products are used as edgeforms to mould precast concrete walls that are generally 3 m wide and from 7 to 12 m high so you would not cast these from 600 mm long pieces! Based on all the foregoing I believe that we have more than adequately illustrated and proven that we cannot and do not sell or market in Australia and that we only market and sell offshore through the patents for this product in Australia and New Zealand being owned by a third party i.e. ITW Australia and as such we cannot sell these products in Australia for the life of those said patents.

We have previously provided Customs with copies of all these said Patents that all can go on Public Records as are documents already available in the public domain. Since we are only bringing into Australia Samples for sending out to Overseas Distributors and Customers for marketing purposes of our products we clearly fall into the category for exemption under the clause:-

that the goods, being articles of merchandise, are for use as samples for the sale of similar goods (section 8(7)(e) and section 10(8)(d).

We have NO alternative than to bring these samples into Australia for this is where our operations are located and run from! Accordingly the objections raised by the three aluminium companies are totally unwarranted and unjustified as these items obviously fall into the exception category as samples. The Statement by INEX that this product is produced by another producer and now is sought to be IMPORTED is totally false and misleading. The product in Australia I produced by Capral SOLELY for ITW Australia and Capral cannot produce this produce for us or anyone else for that matter other than ITW Australia whom own the IP. We are a totally independent company from ITW Australia and have NO intentions of importing this product into Australia or to sell the product in Australia as this would be an infringement of ITW Australia Patents so we have never sought to import this into Australia as we clearly stated in our application but only sought to bring into Australia samples of the product that we use to market our product overseas in our patented jurisdictions. Secondly I will address the second Point of exemption:- • that like or directly competitive goods are not offered for sale in Australia to all purchasers

on equal terms under like conditions having regard to the custom and usage of trade (section

8(7)(a) and section 10(8)(a)); There are claims made in the Objection by INEX Australia that are totally false in that there already are similar competing products already being produced in Australia. This statement is totally false as there are absolutely NO similar or such competing products being sold in Australia (other than the ones produced by the patent Holders ITW Australia) – there are other aluminium extrusion sold in Australia that are used for concrete formwork edgeforms however there are absolutely NO products like the Spartan available on the market and if there were they would be infringing the Intellectual property owned by ITW Australia and such sales would be stopped through the IP owners exercising their patent rights. The Spartan Sideform is the ONLY “composite” sideform available on the market where the aluminium extrusion itself CANNOT be used for concrete edgeforms /sideforms unless it is completed with the other patented components that make it the complete product i.e. Spartan Sideform. Hence literally, production of this aluminium section on its own is useless and non-saleable as non-usable item as needs all the other (also patented) components added to it to make it complete and a commercially usable item! We mentioned this previously – the Actual Spartan Sideforms is NOT a one material homogenous product and the aluminium extrusion is ONLY 1 component of that completed product (which you should have clearly noted from the brochures and information provided on our product for which

reason it is called a “COMPOSITE” sideform clearly indicating it is a sideform made from many materials and components i.e. a composite and not homogenous material product) and that the aluminium section needs a PVC profile fitted to the top of it and a Rubber Base Insert inserted into the base of it and then Rubber End Caps placed into the end so as to be a complete usable product and accordingly does not have any like or competing product as such – totally unique and novel product exclusively owned by us and exclusively produced by us and protected by patents here in Australia and internationally - the fact that it is a composite product is one of the patented novel features making it the only such formwork available in the market. So the aluminium extrusion itself cannot in any way be used as precast formwork (its designed and intended use) or any other application for that matter as is incomplete and needs the other materials and components fitted / added to it (that are ALSO patented – PVC capping is covered by the same sideform patent and Rubber End Caps are also an independent stand-alone patent – copy attached which then does not allow ANY other product to be produced with these features and additions etc. and as such no competing product to be manufactured and put on the market!) to be in any way functional and usable! In its raw extruded state the aluminium extrusion is unusable and only one part of a complete product. This is clearly evident in all our brochures, website and even patent document itself! We have previously provided the copies of the said patents that can be made public as are already in the public domain. As for the statement in regards to “like or directly competitive goods” there are NO like goods as we have already highlighted in that we have in fact invented, developed and patented this product and there are NO like goods being produced anywhere in the world as our Spartan Composite Sideforms are unique and novel so there are NO like good that can be purchased anywhere in the world including Australia – ITW Australia own the patents in Australia and we own the patents in other territories in the world including China so no one, even in China, can produce like goods without infringing our IP in China and no one can produce or even manufacture these products in Australia or even sell in Australia without infringing ITW Australia patents Here in Australia ITW are the only ones that can produce this section and sell this section – they are a patented exclusive design product and hence a proprietary product accordingly Capral, INEX or G James or any other manufacturer in Australia CANNOT produce these products at all without the specific approval of ITW Australia whom own the IP of the said section In Australia accordingly Capral or any other extruder in Australia cannot produce these items for anyone else or sell to anyone else other than ITW Australia or as distinctly authorised by ITW Australia. This includes NOT only the aluminium extrusion that forms a portion of the final product but any other member on that product including the PVC capping and rubber base Insert and Patented End Caps that all when combined form the usable finished product. Accordingly the statement made by INEX quote: “In conclusion, we (and other Australian Extruders) can extrude these extrusions if requested”. Is NOT correct for even though we request INEX Australia to Produce this product they CANNOT produce it for us as it is a patented produce with said patents owned by ITW Australia hence INEX could ONLY produce this product for ITW Australia. If we had ANY aluminium extruder produce this product for us this would be an infringement of the said Intellectual property owned by ITW Australia whom would stop such sale and have claims against us and the aluminium extruder for patent infringement. INEX Claims to have attached a confidential Invoice that illustrates that quote “like goods have been sold by them” once again we confidently confirm and state that this is FALSE as if “Like goods were produced by INEX and sold by INEX that INEX and the purchaser of those allegedly like goods would be infringing ITW Australia IP and knowing ITW Australia as we do that there would have already been legal proceedings against INEX and any other purchaser of the like goods for patent infringement.

There is, as confirmed by INEX literally thousands of different sections of aluminium and one could more than likely if they spent hours searching find section that might appear to be similar however this does not constitute a “Like” or “DIRECTLY Competing” products and as such these claims are grossly misleading. As stated this is a specific proprietary patented product and anyone whom is producing a “Like” product is in fact infringing Intellectual Property and cannot legally be doing so. We do not challenge claims made by INEX and the other aluminium suppliers in that they CAN produce this product and have the technologies and capabilities to produce these products. That however is irrelevant for they CANNOT produce these products as they claim for any other party other than the party or corporation etc. that OWN the intnlelctual property and as such they can ONLY produce this product in Australia and NEW Zealand for ITW Australia and NO ONE ELSE. Hence their claims that they could produce this product for us – or ANY other person on Entity in Australia is totally false (Yet alone that they can produce it and supply to all purchasers on equal terms!) as they cannot do so WITHOUT infringing the said Intellectual Property owned by ITW Australia and as such ITW Australia own a MONOPOLY in Australia on this product and as such this then prevents any of these aluminium extruders producing this product for ANY other purchasers yet alone on “equal terms”! The Regulations clearly states quote:- “that like or directly competitive goods are not offered for sale in Australia to all purchasers on equal terms and under like conditions having regard to the custom and usage of trade” unquote and in this regard I underlined the specific part of that statement where it states that the same or similar goods are NOT offered for sale in Australia to ALL purchasers under equal terms………………. Emphasis being ALL Purchasers and EQUAL terms. Hence INEX, CAPRAL and G James CANNOT make the tools for us for this suite of extrusions nor run any lengths of these extrusions for us as in making the said profiles they would infringe ITW Australia IP and in selling the extrusion to us both the extruder and SRB would be infringing on ITW Australia IP so the claim make by all these companies that they can produce this product for ALL other purchasers including us i.e. SRB Systems is totally false as they legally cannot produce this product for anyone else bar ITW Australia whom are the only entity in Australia and NEW Zealand that can produce or sell this product in Australia and New Zealand hence this product cannot be made available to all purchasers on EQUAL terms and can only be made available to ITW Australia! Even if we wanted to manufacture this product in Australia and sell overseas to our O/S markets we CANNOT legally do so through the IP in Australia being owned by ITW Australia and as such any of these aluminium companies making these sections and selling them to us constitutes a IP infringement! Response to Claims made by Capral Aluminium: Capral claims under B2. That “Capral is the existing Manufacturer of the exemption goods”. Capral is NOT the manufacturer but ITW Australia is the manufacturer of the said goods and Capral only provides the service of extruding one portion of the Patented Spartan Sideform that being the aluminium extrusion. Capral is not allowed to extrude these proprietary extrusions for anyone else bar ITW Australia whom own the said IP. C.2 The Brochure referred to by Capral – Attachment A – DOES NOT describe Capral as the manufacturer of the said Spartan Sideforms. They are NOT the manufacturer as the Spartan sideform is composite of many components of which the aluminium extrusion is ONLY a part of the product!.

There seems to be a lot of misrepresentation being made by the said aluminium extruders in their objections. The said brochure on the last page where is SOLELY refers to the actual aluminium extrusion and so states clearly under the first bullet point that the aluminium “section” is “EXTRUDED by Capral Aluminium NOT that Capral is the manufacturer of the said sideform. That brochure is dated 2004 when we i.e. SRB Systems Pty Ltd still owned the IP of the product in Australia and NEW Zealand and at that time Capral produced the extrusion SOLELY and exclusively for us i.e. SRB Systems Pty Ltd and were not allowed to produce the extrusion for anyone else as were not allowed to do the same ALL the other aluminium extruders in Australia! When SRB Systems were the “manufacturer” of the Spartan Composite Sideforms - this said brochure itself details that the Spartan Sideform is a composite product made of many different components. ALSO note on the bottom of every page is that at that time the patent was still PENDING at that time. In 2008 we i.e. SRB Systems SOLD the IP for Australia and NEW Zealand to our then distributors Reid Construction Systems parent company ITW Australia and Capral was hence duly notified at that time in writing that the ownership of the IP has transferred to ITW Australia and that the said tools and dies etc. were also now owned by ITW Australia. Accordingly from that notification onwards CAPRAL was FULLY aware that they could ONLY produce that aluminium extrusion ONLY for ITW Australia and NO ONE LESE and hence they cannot offer this product for sale to ANYONE else including SRB Systems and hence their assertion now that they can in fact offer this produce to others AND on equal terms contrary to the exemption clause is TOTALLY false and misleading. Capral claims that “most recently ‘that they sold the said extrusions to ITW Australia is also extremely MISLEADING in that this falsely implies that they have sold it to others as well which is grossly deceptive and misleading. Capral can ONLY ever show two clients for ALL sales of this extrusion and that would have been the SRB Group i.e. us up until June 2008 and then from June 2008 till now ONLY ITW Group i.e. the owners of the patents and during that period they have NEVER made this product available or sold this product to ANY other purchaser in Australia or overseas as they CANNOT through the IP protection on this product. And if they have sold this product to ANY other purchasers we would welcome details of any such sale! Accordingly their assertion that they have sold the product is the past 12 months is MISLEADING in the way they are presenting this through the wording of their claims. They have not only sold it in the past 12 month but since mid-2008 to ITW Australia and ONLY to ITW Australia and they CANNOT produce to or offer this product for sale to ANY other purchasers other than ITW Australia hence CANNOT offer this product to any other purchaser on equal terms‼‼! Since they cannot produce this product for ALL purchasers and offer on EQUAL terms then they are estopped from their objection to our claim as our claim clearly falls in line with the exemption clause”- • that like or directly competitive goods are not offered for sale in Australia to all purchasers

Capral statement that ITW only own the hole in the die is also misleading as ITW own the intellectual property rights to the shape and to the physical attributes of the product and technology and as such, and as Capral confirm, they cannot produce this product for any other purchaser other than ITW Australia. Accordingly NO other purchaser in Australia can get those product on similar or equal terms as that which ITW Australia get it for as they can then ONLY attain this product from ITW Australia that own the monopoly on this product (and not the extruders)! ITW Australia can switch extruders as Capral acknowledges but then Capra CANNOT offer production and sales of this extrusion to ANY other purchasers aside of ITW Australia yet at competitive terms for the sheer FACT that this is a IP protected product clearly illustrates a complete monopoly on the said technology and product and as such CANNOT in any way be classified as being available on “competitive terms” by the sheer fact it is a monopoly supply! The fact that ITW own the IP makes it their monopoly and as such the product is not available to any other purchasers and no terms can be described as being “competitive” as they have NO competition. It is FOR this reason that they have stayed with Capral (as we have whilst we owned the IP) for the period to date even when Capral raises its prices etc. for once there is a monopoly and NO ONE else can produce that said product there is NO competition so Both SRB System and even ITW Australia are not basing their decision on extrusion of this product on price through having this monopoly they can adjust their prices to compensate for their sales to their customers as their customers CANNOT source any alternate supplier for this product, aluminium extrusion, so the claim made by Capral that this product has been available in Australia on “Competitive” terms is nothing short of absurd and is nothing farther from the truth and we know this for a fact as we had much cheaper prices offered to us by J Games and other aluminium suppliers including Pan Asia etc. however did not bother changing extrusion supply from Capra not due to Capral Quality or any loyalty or superior production capabilities etc. but solely because we would not be bothered through the sheer monopoly that we owned on this product, even though we had cheaper pricing offered by other extruders – as have ITW also done to Date since they have purchased the IP in 2008 for they have had cheaper quotes for aluminium extrusion that were provided to hem from the other supplier when they purchased the IP but again due to the monopoly they did not bother changing suppliers as they could charge whatever prices they liked through having the said monopoly on the product! Accordingly the extrusion of these sections by Capra over the years was and is by NO MEANS on “competitive terms” but on a typical monopoly supply. D3. Capral makes the Statement that:-

The applicant has not claimed that like goods are not available on competitive terms in Australia. The invoices at Confidential Attachment D also demonstrate that like goods generally are available to all purchasers on equal terms under like conditions.

The Reason we have NOT made that statement in our application was because the application was made in respect of Samples for we were always aware that ITW owned the IP for Australia and we could NOT legally have the product extruded here without infringing their IP. Even if we WANTED Capral, G James or INEX aluminium to make this product for us for International sales i.e. not even for sales in Australia we CANNOT do so for production of any of these extrusion by any of these aluminium extruders to us in Australia constitutes a patent infringement of ITW IP and as such we legally cannot even have these companies extrude for us if we wanted to! Accordingly we did not bring up that claim however since Capral have we have accordingly also addressed that Claim as well to clearly illustrate that these and even Like goods are NOT available in Australia on ‘COMPETITIVE’ terms! Capral attachment D is a sale of the said aluminium extrusion to ITW Australia (or their subsidiary company Reid Construction Systems) and the claim they made now under this clause D.3 that this

said invoice illustrates that the goods are available to all purchased on equal terms and under like conditions is totally FALSE and MISLEADING and quite deceptive. As we have clearly pointed out Capral CANNOT sell the product to ANY other purchasers at all aside for ITW Australia YET ALONE on competitive terms and under like conditions. Accordingly they cannot sell to ANY other purchaser, supplier or on seller including us as that would constitute a patent infringement and leave them and us open to law suit and damages by ITW Australia for patent infringement. Capral can ONLY illustrate that the said product is available to ALL other purchasers on EQUAL terms and under like conditions if they have shown invoices for sale of these same extrusion to any other purchasers aside of SRB System (previous IP owners) and ITW Australia current IP owners! Accordingly their statement made to Customs that they can sell this section to All other purchasers on equal terms is totally false as they cannot! We would be happy for them to show us sales to ANY other purchasers to illustrate otherwise. F.1 Once again is being grossly misleading. Capral acknowledges throughout their objection document that ITW Australia is the owner of the said IP for this product in Australia and as such we i.e. SRB have NO right to manufacture or sell this product in Australia at all and would not do so for reasons as already outlined namely that the product is patent protected with patent owned by ITW Australia. Capral is using an ASSUMPTION that it’s not based on any evidence or fact that through ITW not purchasing the said extrusion from them for a while that based on that, we, a totally independent company of ITW, should not be granted an exemption in case ITW chose to purchase the said sections from O/S. This is totally inappropriate and bordering on absurdity. As stated we have declared that we only bring in product to be used for our O/S market as samples and we have nothing to do with the ITW Australia operations here in Australia nor do we get involved in any sales into Australia of our products. As ITW own the said IP in Australia if they chose to have the extrusion made offshore and imported it into Australia that is a matter for them and Customs and the issues in regards to anti-dumping tariffs etc. to be addressed at that time by THEM and has nothing to do with us and our claim for exemption. Is it not dumping in the Australian market of standard readily produced articles and profiles that are made available to every purchaser on same terms etc. and are cheaply produced in China and elsewhere and dumped on the Australian market for which the anti-dumping laws were designed to protect Australian extruders and NOT for exclusive proprietary made patent protected prducts which are not available to ALL purchasers but ONLY the actual patent owners and which said laws the extruders here are now looking at improperly exploiting. Our products are proprietary products developed and patented so as no one can copy them or even produce similar products like them and as such they cannot be produced by third party Chinses (or other) extruders and dumped on our market as they are IP protected here in Australia and even overseas and as such as is obvious by the actual clauses in the Anti-Dumping laws that they are not simple extrusions that can be produced by anyone and dumped on our Australian market and sold to EVERYONE but are in fact proprietary patented products and NO extruder can produce for all purchasers on equal terms but can ONLY produce for the IP owner and no one else! In the case of these products they do not need anti-dumping provisions to protect the market as the patents on the products themselves do this by stopping ANYONE for O/S producing these or similar

product and dumping (selling) them on this market! And do a better job as anti-dumping provisions only impose a financial import whereas the actual patent prevent totally any sales! Accordingly it is totally now improper for Capral to try and prevent us from bringing in samples we use in promotion of our business overseas through the improper and overzealous protective behaviour andstifle our operations unnecessarily and which is totally unwarranted and unjustified on vague claims that somehow in future we can possibly sell full lengths to ITW for ITW to sell into Australia. It is highly improper to prevent us from getting the requested exemption on the basis that Carpal feel that it MIGHT at some stage in future POSSIBLY result in Sale of the extrusion in Australia without any evidence of that being even a remote possibly or activity but solely on their assumption that it might happen! That premise is absurd to say the least – yet also that fact that this is a patented product that falls outside of the scope of the anti-dumping provision for the many reasons and detailed and outlined. This case was initiated on 11 June 2015 by the Commissioner of the Anti-Dumping Commission. The details of the initiation and responses received from the various Australian producers’ in response to this case (case number EX0038) can be found on the Commission’s website following the link: http://www.adcommission.gov.au/cases/Pages/CurrentCases/EX-0038.aspx The Commission would like to seek the following clarification/ information from you regarding this exemption inquiry:

1) Page 2 of your application states that ‘SRB does not sell any of their products in Australia only overseas’. Please clarify if SRB intends to import Spartan Sideform Extrusions from China and resell (export) in overseas countries. The intention of the exemption in the Customs Tariff Act 1975 s8(7)(a) and s 10(8)(a) is that the like or directly competitive goods cannot be purchased from Australia.

At this stage we are not proposing to bring any of the Sideform extrusion to store in Australia solely through commercial restraints i.e. the costs in Shipping them from China to Australia and then shipping to our customers O/S from Australia is far too costly making such an option totally unviable commercially especially due to the nature of the products i.e. long lengths of close to 6 m. So we only bring in Samples i.e. lengths of anywhere between 300 mm long to 1 m long that we assemble with the other components that affix to the sideforms to make them a complete product and usable for their intended use i.e. PVC capping profiles and Rubber Base inserts and Rubber End Cap as the sideform extrusion in its RAW extruded aluminium state is useless and cannot be in any way used! We then send these samples out to potential customers and Distributors to use for demonstration purposes to illustrate our products. Hence literally, production of this aluminium section on its own is useless and non-saleable as non-usable item as needs all the other (also patented) components added to it to make it complete and a commercially usable item! We mentioned this previously – the Actual Spartan Sideforms is NOT a one material homogenous product and the aluminium extrusion is ONLY 1 component of that completed

product (which you should have clearly noted from the brochures and information provided on our product for which reason it is called a “COMPOSITE” sideform clearly indicating it is a sideform made from many materials and components i.e. a composite and not homogenous material product) and that the aluminium section needs a PVC profile fitted to the top of it and a Rubber Base Insert inserted into the base of it and then Rubber End Caps placed into the end so as to be a complete usable product and accordingly does not have any like or competing product as such – totally unique and novel product exclusively owned by us and exclusively produced by us and protected by patents here in Australia and internationally - the fact that it is a composite product is one of the patented novel features making it the only such formwork available in the market. So the aluminium extrusion itself cannot in any way be used as precast formwork (its designed and intended use) or any other application for that matter as is incomplete and needs the other materials and components fitted / added to it (that are ALSO patented – PVC capping is covered by the same sideform patent and Rubber End Caps are also an independent stand-alone patent – copy attached which then does not allow ANY other product to be produced with these features and additions etc. and as such no competing product to be manufactured and put on the market!) to be in any way functional and usable! In its raw extruded state the aluminium extrusion is unusable and only one part of a complete product. This is clearly evident in all our brochures, website and even patent document itself! As for your statement in regards to “like or directly competitive goods” there are NO like goods as we have already highlighted that we have in fact invented, developed and patented this product and there are NO like goods being produced anywhere in the world as our Spartan Composite Sideforms are unique and novel so there are NO like good that can be purchased anywhere in the world including Australia – ITW Australia own the patents in Australia and we own the patents in other territories in the world including China so no one, even in China, can produce like goods without infringing our IP and no one can produce or even manufacture these products in Australia or even sell in Australia without infringing ITW Australia patents Here in Australia ITW are the only ones that can produce this section – they are a patented exclusive design product and hence a proprietary product accordingly Capral or any other manufacturer in Australia CANNOT produce these products at all without the specific approval of ITW Australia whom own the IP of the said section In Australia accordingly Capral or any other extruder in Australia cannot produce these items for anyone else or sell to anyone else other than ITW Australia or as distinctly authorised by ITW Australia. This includes NOT only the aluminium extrusion that forms a portion of the final product but any other member on that product including the PVC capping and rubber base Insert and Patented End Caps that all when combined form the usable finished product. ALSO: Your statement “10(8)(a) is that the like or directly competitive goods cannot be purchased from Australia” does not appear to be complete for on the government website for anti-dumping laws and regulations is clearly states quote:- “that like or directly competitive goods are not offered for sale in Australia to all purchasers on equal terms and under like conditions having regard to the custom and usage of trade” unquote and in this regard I underlined the specific part of that statement where it states that the same or similar goods are NOT offered for sale in Australia to ALL purchasers under equal terms………………. Emphasis being ALL Purchasers and EQUAL terms. This product is not only novel and exclusive in design and function but is fully patented i.e. every component on it that forms the composite product NOT just the aluminium extrusion and as mentioned throughout this response, the patents for this product are held solely and exclusively by ITW Australia Pty Ltd and as such they are the only entity in Australia that controls DIRECTLY all or any manufacture and sale of this product in Australia and as such the goods are obviously NOT offered for sale to ALL Purchasers on equal terms and never will be!

In the reciprocal - No One can produce our products in China or USA or Canada etc. either as we i.e. SRB Construction Technologies Pty Ltd – Own the patents in China and other territories elsewhere in the world as identified in item 2 below so literally NO ONE can make or sell these products in China as they would infringe our patents and any importation and sales into Australia would infringe ITW Australia patents‼‼ Due to ITW Australia patents the goods are especially and solely limited to them and as such NO ONE else in Australia can access these goods yet alone on any terms equal to that of ITW! Hence in summary it is NOT our intention to import the extruded 6 m lengths into Australia for sales O/S as that is not commercially viable for us so we produce and store the section in China for sales O/S. However if at any time in the future we were to decide to do so through that option becoming commercially viable then we should not in any way be burdened with the anti-dumping laws for a stated these sideforms section are NOT available to all purchasers on equal terms through the patents on these products limiting their manufacture and availability as detailed previously. We do however bring into Australia samples section that are between as stated 300 mm to 1000 mm long that we use to send to Distributors and customers as samples of our products. Aside of this we CANNOT sell the sideforms in Australia at all as we assigned our Australian Patent AU 2004902767 to ITW Australia in 2008 which is clearly also identified in the patents history for this patent - http://www.ipmonitor.com.au/patents/case/2005247959 So scroll down on this page and you will see it clearly states that the said patent was assigned to “SRB Manufacturing Pty Ltd” company wholly owned by ITW Australia Pty Ltd on 27th November 2008 and the application was Accepted / Granted on 21 April 2011 with the actual patent officially sealed on 18th August 2011 i.e. fully granted and sealed and sealed copy provided to the owners i.e. ITW Australia Pty Ltd. On 5th July 2012 SRB Manufacturing again assigned the same patent to its PARENT company ITW Construction Systems Australia Pty Ltd. So the Australian patent is owned by ITW Australia Pty Ltd and NOT us and hence we CANNOT legally sell any of the patented sideform technologies in Australia including the said Aluminium extrusion that ONLY forms a portion of the said sideforms and DO NOT for that reason sell them in Australia and will not sell in Australia‼ Accordingly we cannot buy or sell these products in Australia and if ITW was in agreement to sell them to us these would NOT be offer to all purchasers and on equal terms!

2) In your brochure there is a footnote that states that ‘Patent Pending 2004902767’ (refer to the link http://www.srb.net.au/images/pdf/SRB_SPARTAN_SIDEFORMTechnicalBrochure.pdf ). Does this refer to the patent you were referring in your application?. Is it still pending or has it been granted. Please provide documentary evidence.

You should NOT be going off the footnotes of brochures that were prepared years ago especially when the bottom of that same brochure states it was prepared in 2004‼‼. In our submission you were provided with specific patent numbers and could follow up by following these patent numbers. Hence the patents are NOT pending but actually granted in Australia and many other countries (patent number for each country attached):- - Australia - AU 2005247959 B2 - USA - 2008/0265127 / 11569560 - South Africa - 2006/09770

3) At attached A (page i) of your brochure (refer to above link), it states that SRB section is extruded by ‘Capral Aluminium (largest in Australia)’. In its submission, Capral also stated it can produce the goods. Please clarify if the like or directly competitive goods you are seeking exemption can be produced by Capral Limited? This has already been addressed in the previous points! Firstly Capral CANNOT produce this product for us or anyone else in Australia unless it is specially authorised to do so by ITW Australia whom OWN the IP in Australia hence they cannot offer this product to anyone yet alone all purchasers and at the same terms‼! Any sale of this product by Carpal to anyone in Australia outside of direct authority from ITW Australia constitutes a breach or infringement of the ITW Patents in Australia! Accordingly Carpals submission that it can also produce this product for us is FALSE as it can ONLY produce this product for the IP owner which is ITW Australia and NO ONE else for as stated if Capral produce this item and sell it to anyone else they are infringing the patent held in Australia by ITW Australia and that is a serious matter. Accordingly Carpal cannot make or produce this product us for us just as ITW Australia cannot manufacture this product or have it manufactured for them say in China, USA Canada etc. or any other jurisdiction where we have the patents! Hence Capral CANNOT produce this product for us in Australia as that would be in breach of and infringing the IP held by ITW Australia so in Essence Capral CANNOT make this product for ANYONE else other than the patent owner which is ITW Australia! The reason Capral is mentioned in the said brochure you refer to is because that brochure is a very old brochure that dates back to 2004 as stated at the base of every page of that brochure i.e. PRIOR to 2008 when we sold the patents for Australia for this product to ITW Australia! When we first developed our products – before we started selling them overseas Capral use to produce them ‘exclusively’ for us as we owned the patents in Australia and they could not produce them legally for or sell them legally to anyone else in Australia hence it is NOT a product that has any similar or competitive product that can be produced by ANY aluminium

producer in Australia as it is a priority patented product and can ONLY be produced for the patent owners by manufacturers approved by the patent owners. In 2008 we sold the patents for this product for Australia to ITW Australia and as such since 2008 we legally cannot get any manufacturer to produce and sell us these products in Australia and we legally cannot sell the products at all in the Australian marketplace either through the patents being owned now by ITW Australia and as such they are the only ones that can legally sell this product in Australia! Accordingly we can store such material in Australia for sales to other countries and jurisdictions in the world but we cannot manufacture it or sell it in Australia! Hence Capral Aluminium and EVERY other manufacturer of aluminium in Australia CANNOT make that product for us or anyone else for that matter or sell to anyone for that matter other than the actual Patent owners being ITW Australia!

4) In your email dated 20/ 5/ 15, you provided a copy of USA patent for the Spartan Sideforms and explained that it is the USA derivative of the Australian patent (they can refer to PCT/AU2005/000738) – these are the USA Patent, CT application and Australian Patent for the same patent. Can you please clarify?

I am bemused by the lack of understanding of patents! There is NO one patent for the entire world‼‼! For the same invention or technology you LITERALLY need to lodge a patent in every PCT country you want to have a patent in which is done under the PCT phase! The very first patent lodged is generally the patent in your own country which gives world-wide coverage until the PCT phase is reach – PCT phase stands for Patent Cooperation Treaty at which time you then apply for your patents to be lodged in all the selected / nominated PCT countries where you are applying for the said technology to be patented! Hence the PCT patent is NOT the USA patent it is in fact the PCT application where we are applying for patents to a number of jurisdictions in the Patent Cooperation Treaty countries world-wide. USA Application US 2008/0265127 A1 is the Application for Patent for this specific technology in USA under the PCT application process and even in the USA application under line (30) clearly stated “Foreign Application PRIORITY Data” as – May 24, 2004 (AU) ………. 2004902767. This indicated that the USA patent application is a derivative of the actual original Australian Patent Application AU 2004902767 PCT / AU2005/000738 is the PCT application in Australia for this same Patent where in the same PCT patent Application is again under line (30) for “PRIORITY DATA” it clearly has - 2004902767 24 May 2004 (24.05.2004) AU. Which clearly Illustrates that the PCT application (for world-wide patent coverage is specific PCT Jurisdictions) is BASED on the actual Australian application AU 2004902767! This CLEARLY indicated that the PCT application and USA Applications are a derivative of or based on the Actual original Priority Data of the Australian patent AU 2004902767 hence is based on the original Australian Patent of this Technology. The SAME is actually specified and stated on the USA patent application as well hence this should have been CLEAR to you that these patents for USA and even the PCT patent application are all based on the ORIGINAL Australian Patent AU 2004902767

In ALL the patents there it is the USA patent or PCT patent or European Patent it always has “Foreign Application Priority Data” which refers the to the ORIGINAL patent lodged in an origin country of lodgement which clearly illustrates that the FIST patent ever lodged was in fact the Australian Patent i.e. AU 2004902767. You can see CLEARLY on the PCT application (again attached) that the PRIORITY DATE is the original Australian patent that was lodged on 24th May 2004 i.e. Australian patent application AU 2004902767 - http://www.ipmonitor.com.au/patents/case/2005247959 So if you simply searched the said Australian patent with IP Australia or on the website you would have found this webpage that gives you the entire history of the patent and when it was granted etc. etc. etc. - http://www.ipmonitor.com.au/patents/case/2005247959 Hence between my response in regards to IP in question 1 above and in the foregoing I trust this has now been clarified for you! NOTE: It is extremely IMPORTANT that you understand and can acknowledge the fact that this is a product that is one component of a finished product where the WHOLE concept of that product is patented which patents provides not only complete novelty but exclusive monopoly to the patent holder and as such NO ONE in any patented jurisdiction can produce this suite of products that form the patented “Spartan Composite Sideform” or sell ANY component that makes up that complete unit including the aluminium extrusion , PVC Capping, Rubber Base Insert or Rubber End Caps which not only included Capral but any other manufacturer in Australia. Accordingly there are NO similar or competing products available on the market in Australia nor will there be due to the Patents for the products being held here! Accordingly we cannot and will not be selling ANY of these components or the complete composite product known as the Spartan Sideforms in Australia through the patents being held and owned by others! We also cannot be purchasing these products in Australia readily as they are NOT readily available to all purchasers yet alone on same terms as the product is patented with patens owns by ITW hence only available to be produced for them at their terms and if Capral or anyone else was to produce them for us and sell them to us they and we would be sued for infringement of patents and also Capral cannot in any way make these sideforms available for us or any other purchasers at all yet at the same terms or even similar terms to that of ITW Australia! And in the same token NO ONE in Australia can be manufacturing that or similar competing products or sell similar or competing products through these same patents so it is NOT a readily available product that can be produced by any other manufacturers in Australia including Capral Aluminium and sold to all purchasers at the same terms!!

• the titan™ Magnet clamp housing is made from a glass reinforced plastic which prevents concrete from sticking to it, making it easy to clean.

there is no need or requirement to spray or apply release agents to either the titan Magnet clamp or the Spartan Sideform and the products perform better without application of release agents or mould oils.

• the magnet housing can be cleaned by using a dry/damp cloth or a fine plastic bristle brush.

• the underside of the magnet (the magnet pack) should be cleaned of any foreign matter. this will enable the magnet to sit flush on the precast bed and perform to specification.

• Do not clean the titan™ Magnet clamp using high pressure water cleaners, acids or aggressive detergents. the magnet clamps can be cleaned from the top only with low pressure water only over a grate or drain to prevent water pooling at base of magnet.

1. turn the magnet upside down and check that the bottom is clean and free from slurry, metal wire and other particles. It can be cleaned with a rag or by using a plastic scraper (the Spartan™ capping removal tool: crt).

2. while the magnet is in this position, check that there is no excessive wear on the rubber skirting. If required, the rubber skirting can be replaced.

3. Make sure that the handle bolts are securely fastened using a 4mm or 5/32” hex wrench. If they are loose, remove the bolts, apply loctite® (262) and replace. the loctite® will prevent the bolts from working loose again.

4. remove any excessive concrete build up from the magnet handles. avoid hitting handles with a hammer. If there is any visible damage, the handles should be replaced.

5. remove the adapter plate and clean both the front of the magnet housing, and the adapter plate. ensure that the bolts are only finger-tight when replaced. do not over-tighten the bolts.

when not in use, the titan™ Magnet and sideform, like any other capital equipment, should be cleaned and stored away under cover to prevent accidental damage. the magnets can be stored on any clean surface or SrB workstation rack / Stillage.

• the unique epoxy powder-coating makes cleaning the sideform easy and more efficient. the epoxy powder coating minimises concrete adhesion.

• once stripped, clean the sideform surfaces using a damp cloth, the Spartan™ capping removal tool (crt) or a fine plastic bristle brush. cleaning as soon as possible after stripping will make it easier and will prolong the life of the epoxy coating.

• do not clean the sideform using high pressure water cleaners, aggressive detergents or chemicals as these may prematurely wear the epoxy powder-coating, damage the top capping and rubber base – as well as potentially forcing sediment in between the rubber base and the sideform.

1. remove the rubber base from the sideform body and check that both the bottom recess and the base slots are clean.

2. turn the sideform upside down and check that the bottom is clean. If not, use the Spartan™ capping removal tool (crt) to scrape away any foreign materials from the base.

3. on the back of the Spartan™ Sideform, use the capping removal tool to clean the “Ball lock rail” and joiner plate slots.

4. If there are any sections of top capping showing excessive wear, they can be replaced by removing the capping from the side body and simply cutting out the segment and replacing it with a new section cut to the required size.

when not in use, Spartan™ Sideform should be stored in racks or SrB Sideform Stillages.

PERMAnEnT JOInIng OF SIDEFORM whilst Joiner plates are recommended for temporary or semi-permanent joining of sideform and internal corners, Spartan™ Sideform can be permanently joined using square stainless steel tubing.

• the size of tubing required varies depending on the height of the sideform you are using: 100 mm to 125 mm (4” to 5”) sideform use two 19.05 mm x 19.05 mm x 300 mm (3/4” x 3/4” x 12”) long sections. 150 mm to 200 mm (6” to 8”) sideform use two 25.4 mm x 25.4 mm x 300 mmm (1” x 1” x 12”) long sections.

• Insert the two lengths of tubing 150 mm (6”) into the end of the sideform.

• lay the sideform on its front face.

• using stainless steel screws, 8 g x 25 mm (8 g x 1”) fasten the tubing into position. to ensure a solid connection, 2 screws per side per tube are required.

• to aid in this process, Spartan™ Sideform features centreline marks on the rear face to help locate the point of the screw.

• push the other length of the sideform into position and repeat the fastening process.

• the sideform is now permanently joined together.

Attaching the Top CappingTo attach the top capping onto the sideform, hook the front of the capping into the top, front recess of the sideform.

Push the rear of the capping down so that it clips firmly into position. Once the capping is clipped onto one end, move along the full length of the sideform body.

Removing the Top CappingThe capping is easily removed by using the Capping Removal Tool (CRT). Likewise, the capping can be removed by placing the sideform upside down and, whilst holding it vertically, gently pushing down with your heel onto the overhanging section and tilting the sideform forward. The capping will unclick.

Installing the Rubber BaseTo install the rubber base, lay the sideform body flat onto its back and using your fingers, push the rear of the base into the bottom slot of the sideform.

Once the base is in position at one end, move along until you reach the end of the sideform.

Installing the End CapsSpartan™ End Caps are easily installed by aligning the end cap with the sideform and gently pressing it into position. The end caps are easily removed if required, but are recommended for seamless joining of sideform and bleed-free panels.

Handy Hint: When cutting Spartan™ Sideform to length, ensure cuts are made with a docking saw running an aluminium blade and always use a wax stick lubricant to prevent burs. Sideform which is free of aluminium burs results in a precise and easy fit of the end caps.

When the top capping, rubber base and end caps have been installed correctly, the sideform is ready for use.

Preparing the Magnet ClampEach Titan™ Magnet is supplied with 2 hex bolts that are used to secure the adapter plate to the magnet housing.

Partially install the bolts to the housing (approx 3 turns).

Slot the adapter plate over the head of the bolts. Pull the adapter plate up until the bottom of the slotted holes are hard up against the bolts.

Ensure bolts are only finger tight. DO nOT OVER TIgHTEn THE BOLTS.

Ensure that the back of the adapter plate is flush with the front of the magnet housing.

The Magnet is now ready for use.

Using the Magnet ClampPlace the Titan™ Magnet behind the sideform at the recommended spacing. Magnet spacing varies depending on the height of the sideform you are using. The recommended spacing of magnets listed below, are based on a steel bed with a plate thickness of approximately 10 mm to 1 2mm.

MAgnETS SHOULD BE SPACED AS FOLLOWS:

100 mm to 225 mm (4” to 9”) high sideformMagnets should be spaced 1.5 m to 1.8 m (5’ to 6’) apart

225 mm to 250 mm (9” to 10”) high sideform Magnets should be spaced 1.2 m to 1.5 m (4’ to 5’) apart

STAgE 1: ATTACHIng THE MAgnET TO THE SIDEFORMStarting from one end of the sideform, tilt the sideform forward (away from the magnet) and seat the male section of the ball lock (located on the front of the adapter plate) into the female recess ball lock rail located on the rear face of the sideform.At this stage, the magnet should be fully disengaged with the handle in the upright position. Refer to Image (A).

STAgE 2: PARTIAL EngAgEMEnT The Titan™ Magnet Clamp can be partially engaged to provide enough initial magnetism to remain in place. The magnet is partially engaged by pushing the handle half way down, or at an angle of approximately 45 degrees. Refer to Image (B). If fine adjustment of position is required, the magnet housing or the sideform can be gently tapped with a rubber mallet or by foot.It is important not to use hammers or similar devices, as both the sideform and magnet can be damaged. Once the first magnet has been positioned, continue along the full length of the sideform until all magnets are correctly located.

STAgE 3: FULL EngAgEMEnT Once the magnets and sideform are in the required position, fully engage each magnet by pushing the handle down towards the precast bed. The magnets are now locked into position. Refer to Image (C).

Panel Setup: It is important to ensure that the beds are clean and free of any foreign matter. place the sideform on the precast bed in the desired position. If required, the sideform can be cut-to-length by using a ‘drop Saw’ with a fine tooth wood or specific aluminium cutting saw blade. to ensure a smooth cut, it is important to use paraffin wax on the blade.
