Remark: In accordance with article 9 “Each State Party shall take all appropriate legal, administrative and other measures to implement this Convention, including the imposition of penal sanctions, to prevent and suppress any activity prohibited to a State Party under this Convention undertaken by persons or on territory under its jurisdiction or control.”

Legal, administrative and other measures taken to implement the CCM (including imposition of penal sanctions)

The draft of a national plan for destruction of the cluster munitions, that are under the control of the Ministry of Defense, has been elaborated.

No special national legislation on the implementation of the Convention on Cluster Munitions will be considered for adoption.

Status: pending (due to financial modalities consideration)

The current legislation stands sufficient to accommodate the provisions of CCM. CCM was ratified by the Bulgarian National Assembly with an act, adopted on February 10, 2011, in force as of October 1, 2011. According to Art. 5, paragraph 4 of the Bulgarian Constitution the international acts, that are ratified and enforced by the Republic of Bulgaria, are part of the domestic legislation. They have supremacy over the conflicting domestic acts. Since CCM became part of the Bulgarian domestic law, there is no legal necessity to adopt an additional specific legislation on this matter.
