CHAPTER 7 COUNTY BOUNDARIES

Revision Note: 1. For uniformity, the head­ings of all sections are: "The boundary lines of ------------------------ county are as follows:" with the exception of Escambia and Monroe coun­ties in which cases the original headings are used changed to the present tense.

2. The word "on" has been substituted in all laws for "along" with reference to run­ning ''on" lines.

3. The word "commencing" has been changed to "beginning" in all counties.

4. Where descriptions of counties bounding

on a river read "down the river" or '"up the river", the words "thread of" have been in­serted to make it read "down the thread of the river" in order to put said river iii some county. Also, the word "middle" has been changed to "thread".

5. Where the words "up the river" or "down the river", etc., are used, the direction has been inserted,-i. e. northerly, southerly, etc.

6. All counties described in any part by "thence along the east boundary of -----------~-----­county", or ~ords to similar effect, have had

7. All counties bordering on the Gulf of Mexico, or the Atlantic Ocean, have had added to the description "along said gulf (or ocean)" the phrase "including the waters of said gulf (or ocean) within the jurisdiction of the State of Florida"; the purpose being to extend the boundaries to the boundary of the State of Florida, thereby having every part of the State of Florida in some county.

8. Additions have been made to all laws of the words "south" and "north" where omitted from the township numbers, an'd "east" and "west", where omitted from the range numbers.

9. Unneeded or surplus verbiage has been omitted.

10. Where two counties have common boun­dary, the descriptions of both of said counties have been made to read . alike, i. e. "to the southeast corner of section one" instead of one reading "to the southeast corner of section one" and the other reading "to the southwest corner of section two" . or ."to the northeast corner of section twelve" etc.

Revision Note : The cia use "thence down the eastern bank of said river, including the islands in said river, to the most eastern point of James island" has been changed to read "thence south and easterly following the east­ern bank of said river, including the islands in said river, to a point directly north of the easternmost point o£ · James island;" which clears up ambiguity and accomplishes the de­signed purpose. Also, the words "South and west along the leeward side· of · James, Dog, St. George ·and St. Vincent islands" have been omitted and substituted therefor are the words "thence· easterly to the boundary line of the State of Florida; thence south and westerly along said boundary· line, including the waters of the Gulf of Mexico within the jurisdiction of the State of Florida, to the Forbes line, produced southerly;". A federal case said "leeward", as used here, meant to the outside of the islands, or leeward of a ship. The words "thence following the Forbes line to the place of beginning" have been changed to read "thence following the Forbes line until it crosses the waters of the Apalachicola river; thence northerly along the thread of said river to the place of beginning." The riew wording clarifies the description and definitely includes the above mentioned islands within the boun­dary of Franklin county.

§2692 RGS provides that it shall be "grounds of challenge for cause" if a person called for jury duty "has served as a juror in the court in which he is called at any time within one year when no regular terms of court are held, or at any other time within one year where regular terms are held". This provision has not been expressly amended or changed since the adoption of the RGS.

At the time of its adoption §2772 RGS, which. related to the selection of the jury lists, made no mention of the above mentioned "grounds ·of challenge for cause"; however, ch. 12068, 1927, as expressed in its title, was an "act to amend §§ .... 2772 . ... of the revised general statutes of Florida, relating to the qualifica­tions of jurors." The 1927 act inserted in said §2772 by amendment the following pro­vision, to-wit: "The fact that any person so selected had been on a former jury list or had served as a juror in any court at any time shall not be ground for challenge of such per­son as a juror."

The amendment of 1927 seems to be in con­flict with §2692 RGS insofar as they both re­late to jury service of persons placed upon jury lists, in any year last past. This conflict seems only to relate to such jurors as are selected in the usual manner and not to special

. venires summoned from the body of the county or bystanders. However, it seems that §2692 conflicts in part with the later expression in ch. 12068, and as §9 of such chapter contains a general repeal of laws in conflict with it, it was superseded to such extent by the conflict.

Therefore, it seems that §2692 RGS should be revised so as to eliminate the said ground of challenge for cause, insofar as it relates to jurors selected from jury lists, but said ground should be retained a s to jurors selected from bystanders or otherwise and not from jury lists. The provision probably should be preserved as a protection against what may be described as habitual jurors around courts which have no jury lists.

§184, ch. 19554, 1939, provides for challenge of jurors in criminal cases and by implication amends or repeals §2692 RGS insofar as they are in conflict. §2692 RGS has been further revised by changing the word, "criminal" in ~he phrase, "criminal court of record" to 'civil"; thereby making the phrase read: "civil

court of record". The phras.e, "or motion of

the state or defendant in any criminal case" has been eliminated. The phrase, "criminal or civil" toward the end of the section, has been stricken and the word, "any" has been changed to the words, "the civil"; thereby making the same read: "when the nature of the civil case requires a knowledge, etc."
