WEST PUBLISHING CO.

These volumes have been prepared to assist lawyers and theirstaffs in preparing legal documents for real estate transactions by theuse of example forms used in other transactions. In addition todocument forms, the book contains procedures which, through the useof checklists and worksheets, assist the lawyer and staff in the produc-tion of documents for clients.

These are the forms that are generally required in Florida for realestate transactions. No form should be used and no procedure shouldbe followed unless the lawyer understands it and decides that it appliesto his or her practice and to the facts in the particular case. Eachlawyer's practice differs in some respects, and all transactions differ, sothe lawyer should plan to make changes to these forms and proceduresaccordingly.

Every real estate transaction involves one or more federal, stateand local tax questions. There are always issues concerning income, gift, estate, property, excise, documentary, intangible, sales and othertaxes arising from real estate transactions. These tax matters areoutside the scope of this work. Each person using this book shouldconsider the tax consequences of each form in this book on his or herown or by obtaining tax advice from a tax attorney, tax accountant orother tax professional.

The author thanks his family and publisher for their understand-ing and assistance. The author thanks his associate Katy Prats for herhelp with the landlord and tenant forms.
