Preliminary – Definition Of Terms

Unless otherwise explained, the following terms and/or phrases

means as described;

“FKF” refers to Football Kenya Federation

“Board” refers to the Electoral Board;

“Appellate body” refers to the Electoral Appeal Body

“Secretariat” refers to the FKF Secretariat

“Secretary General” refers to the Secretary General/ CEO of FKF

“Statutes” refers to the Constitution of FKF

“Regulations” refers to the FKF Electoral Rules & Regulations

“Branch” refers to branches of FKF

“Sub-Branch” refers to the sub-branches of FKF

“President” refers to the president of FKF

“Deputy President” refers to the Deputy President of FKF

“NEC Member” refers to National Executive Committee Member

1. Regulations and Applicable Principles

Section One – General Principles

i. Elections for the office of FKF President, Deputy President and NEC

Members, Branch and Sub Branch Officials are governed by the provisions

of the Statutes, and these Electoral Regulations.

ii. Fundamental principles such as those of democracy, separation of powers,

transparency and openness, shall be respected.

iii. Candidatures and electoral campaigns shall be carried out by the

candidates in a fair and reputable manner and, more generally, in a spirit of

respect for fundamental ethical principles and Statutes

iv. Candidates shall conduct all campaigns with dignity and moderation and

with respect for any other candidate(s), for FKF itself and its members.

v. Persons presenting themselves for election as candidates shall refrain from

carrying out any electoral campaigning prior to the start of the electoral

period. Electoral campaigning shall be understood, for the purposes of these

regulations, as all activities undertaken by candidates or those working for

them with the aim of canvassing votes.

vi. Any violation of these regulations shall be dealt with by the Elections

Board and the Elections Appeals board.

2. Scope of Application of The Electoral Regulations

i. These regulations shall apply to all persons who present their

candidature for the elective FKF positions from Sub Branch, Branch

and the National Office.

If a person engages in campaign or similar activities that give the

appearance that he is a candidate, the Board or, if the Board has not

yet been constituted, the FKF Secretary General, shall give him a

deadline of ten days to formally state, in writing, his/her intention

of becoming a candidate for the elective position. If the individual

responds in the affirmative, the person concerned will be subject to

the present regulations from the time of the relevant declaration

onwards. Notwithstanding this, in order to be eligible for admission

as Candidates for any elective office in FKF, the individual

concerned must be proposed as a candidate in accordance with art.

13 of these regulations.

3. Time and Place of The Election

The FKF election shall take place at the FKF General Meeting called

by NEC for the purpose of election.

The FKF NEC shall decide on the place and time of the Elections

4. Implementation of The Call

I. Elections shall be called by the FKF NEC in accordance with the

relevant provisions of the Statutes.

Section Ttwo – Calling Elections

5 Content of The Call

The call for elections shall contain, at a minimum, the following

points:

Agenda of the General Meeting;

List of candidates who have complied with article 13 of the Regulations;

Names of the members of the Board;

The electoral period, which shall last for fourteen (14) days from the date of

issuing of the notice for the elective general meeting;

v. Electoral calendar, which shall respect the deadlines established in the FKF

Statutes and the present Electoral Regulations.

6. Announcing The Call

The call shall be sent to the FKF members. It shall also be published on

the FKF website, www.fkf.or.ke.

7. Establishment and composition

i. For an appropriate period of time in the context of the FKF elections, the

FKF Executive Committee shall set up the Board.

The Board shall be composed of a Chairman and at least 4 other members,

the Board shall agree on their schedule for meetings.

If a member of the Board is or becomes a candidate for any Elective FKF

position, he shall immediately become ineligible, or cease in his function

respectively, as a member of the Board.

If a member of the Board is prevented from performing his duties due to a

conflict of interest, or for any other duly justified reason, he shall be replaced

by the Chairman of Board.

Once appointed, the members may only delegate their duties to their

replacements if one of the reasons given in the paragraph above applies.

The headquarters of the Board shall be the same as the FKF headquarters/

Secretariat or any other physical address that shall be deemed appropriate.

The FKF Secretariat shall provide all necessary support to enable the

Board carry out all its requisite administrative tasks.

8. Duties

1. In addition to its role of supervising the electoral process, the Board

duties shall also include, in particular:

a) Supervising the administrative process relating to the FKF elections and

monitoring compliance with these regulations as well as with any other

guidelines issued by FKF, as required in the performance of its duties

b) Ensuring the correct application of the FKF Statutes, regulations and

provisions, as well as the contents of these regulations, in matters relating

to the electoral process.

c) Issuing instructions for the application of the FKF Electoral Regulations

as necessary before and during the entire electoral process.

d) Admitting and declaring candidatures. In this regard, the Board shall

assess whether a candidate for any FKF Elective position meets the profile

specifications provided for by art. 13 of the present regulations and art. 25

(4) of the Statutes.

e) Any other tasks that may be required in the course of its duties or by the

FKF regulations.

2. The decisions of the Board may be appealed against directly with

the Appellate Body set for this purpose

9. Supervisory duties

In view of its close and direct knowledge of the electoral process, the

Board shall be obliged to notify the competent bodies of FKF in

writing and in a substantiated manner of any infringements of the

provisions of these regulations that may be committed during the

course of the electoral process as soon as it has direct knowledge of

such infringements or is made aware of them by any of the candidates,

or members of FKF.

Section Three – The Board

10. Convocation and quorum

i. The Board shall be convened by its chairman, and the presence of

the chairman and at least three other member shall constitute a

quorum. If the circumstances so require, deliberations and

decision-taking may be conducted via telephone conference, video

conference, email, or any other similar method.

ii. Board shall pass decisions by majority of its members. The

chairman shall have the deciding vote in case of a tie.

iii. Minutes of Board meetings shall be recorded by a member of the

Board designated to write minutes and record of decisions.

11. Calculation of deadlines

The deadlines and timeframes contained in the present regulations

shall be understood to refer to calendar days.

12. Election format and type of ballot

The FKF Elections shall be conducted by secret ballot in accordance

with the Statutes art 25 par. 1 and the Electoral Regulations.

13. Eligibility

i.Candidates for the office of President must meet the following

requirements:

a.)The candidate shall have played an active role in association

football (as a NEC member, committee member, referee and

assistant referee, coach, trainer and any other person responsible for

technical, medical or administrative matters in FKF, League or Club

or as a player) for the last two (2) years before being proposed as a

candidate

b.) The candidate shall have been proposed by members of FKF.

c.) The candidate shall present declarations of support from at least 5

members of FKF (cf. art 10 par 1 of the FKF Statutes) drawn from5 of

the 8 distinct FKF regions. Being proposed as a candidate by a

member shall be understood as a declaration of support. Each

member may only present a declaration of support for one person

for this position. If a member presents declarations of support for

more than one person, all its declarations shall become invalid.

ii. Members must notify the FKF general secretariat, in writing, of a

candidature for the office of FKF President within the deadline

stipulated in the Statutes and the present Electoral regulations

iii. Candidates for the position of Deputy President must meet the

following requirements:

a)The candidate shall have played an active role in association

football (as a NEC member, committee member, referee and

assistant referee, coach, trainer and any other person responsible for

technical, medical or administrative matters in FKF, League or Club

or as a player) for two (2) before being proposed as a candidate

b)The candidate shall have been proposed by Members of FKF

c)The candidate shall present declarations of support from at least (5)

members of FKF (cf. art 10 par 1 of the FKF Statutes) drawn from five

(5) of the eight (8) distinct FKF regions. Being proposed as a

candidate by a member shall be understood as a declaration of

support. Each member may only present a declaration of support

for one person for this position. If a member presents declarations of

support for more than one person, all its declarations shall become

invalid.

iv. Candidates for the position of NEC Member must meet the

following requirements:

a) The candidate shall have played an active role in association

football (as NEC Member, committee member, referee and assistant

referee, coach, trainer and any other person responsible for

technical, medical or administrative matters in FKF, League or Club

or as a player) for two (2) before being proposed as a candidate;

b) The candidate shall have been proposed by members of FKF;

c) The candidate shall present declarations of support from at least 5

members of FKF (cf. art10 1 of the FKF Statutes) (2) of whom shall

be domiciled in the respective elective region and (3) from other

distinct regions of FKF. Being proposed as a candidate by a member

shall be understood as a declaration of support. Each member may

only present a declaration of support for one person for each of this

position. If a member presents declarations of support for more than

one person, all its declarations shall become invalid.

v. Candidates for the office of Branch Chairman must meet the

following requirements:

a)The candidate shall have played an active role in association

football (as committee member, referee and assistant referee, coach,

trainer and any other person responsible for technical, medical or

administrative matters in FKF, League or Club or as a player) for

two (2) years before being proposed as a candidate;

b) The candidate shall have been proposed by three (3) of FKF within

branch he/she is seeking elective position;

c)The candidate shall present declarations of support from at least

three (3) members of Branch (cf. art10 1 of the Branch Statutes)

domiciled in the Branch. Being proposed as a candidate by a

member shall be understood as a declaration of support. Each

member may only present a declaration of support for one person

for this position. If a member presents declarations of support for

more than one person, all its declarations shall become invalid.

vi. Candidates for the office of Branch Secretary must meet the

following requirements:

a)The candidate shall have played an active role in association

football (as committee member, referee and assistant referee, coach,

trainer and any other person responsible for technical, medical or

administrative matters in FKF, League or Club or as a player) for

two (2) years before being proposed as a candidate

b) The candidate shall have been proposed by three (3) of FKF within

branch he/she is seeking elective position.

c)The candidate shall present declarations of support from at least

three (3) members of Branch (cf. art10 1 of the Branch Statutes)

domiciled in the Branch. Being proposed as a candidate by a

member shall be understood as a declaration of support. Each

member may only present a declaration of support for one person

for this position. If a member presents declarations of support for

more than one person, all its declarations shall become invalid.

vii. Candidates for any other elective office in the Branch must meet

the following requirements:

a) The candidate shall have played an active role in association

football (as committee member, referee and assistant referee, coach,

trainer and any other person responsible for technical, medical or

administrative matters in FKF, League or Club or as a player) for

two (2) before being proposed as a candidate

b) The candidate shall have been proposed by 1 member of FKF within

branch he/she is seeking elective position.

c)The candidate shall present declarations of support from at least 1

member of Branch (cf. art10 1 of the FKF Statutes). Being proposed

as a candidate by a member shall be understood as a declaration of

support. Each member may only present a declaration of support

for one person for each of this position. If a member presents

declarations of support for more than one person, all its declarations

shall become invalid.

d) Candidatures for the position of Branch Youth Representative shall

be restricted to individuals aged above 18 years and not older than

35 years.

e) Candidatures for the position of Branch Women Representative

shall be restricted to individuals of the female gender.

viii) Candidate for the office of the FKF Sub Branch Chairman must

meet the following requirements:

a)The candidate shall have played an active role in association

football (as committee member, referee and assistant referee, coach,

trainer and any other person responsible for technical, medical or

administrative matters in FKF, League or Club or as a player) for

two (2) before being proposed as a candidate

b) The candidate shall have been proposed by three (3) of FKF within

the Sub Branch he/she is seeking elective position.

c)The candidate shall present declarations of support from at least

three (3) of FKF Sub Branch. Being proposed as a candidate by a

member shall be understood as a declaration of support.

person for this position. If a member presents declarations of

support for more than one person, all its declarations shall become

ix). Candidates for the office of FKF SUB Branch Secretary must meet

the following requirements:

a) The candidate shall have played an active role in association

football (as committee member, referee and assistant referee, coach,

trainer and any other person responsible for technical, medical or

administrative matters in FKF, League or Club or as a player) for

two (2) before being proposed as a candidate

b) The candidate shall have been proposed by three (3) of FKF within

the Sub Branch he/she is seeking elective position.

c) The candidate shall present declarations of support from at least

three (3) of FKF Sub Branch. Being proposed as a candidate by a

member shall be understood as a declaration of support. Each

member may only present a declaration of support for one person

for this position. If a member presents declarations of support for

more than one person, all its declarations shall become invalid.

x).Candidates for any other elective office of FKF Sub-Branch must

meet the following requirements:

a)The candidate shall have played an active role in association

football (as committee member, referee and assistant referee, coach,

trainer and any other person responsible for technical, medical or

administrative matters in FKF, League or Club or as a player) for two

(2) before being proposed as a candidate;

b) The candidate shall have been proposed by 1 member of FKF within

the Sub Branch he/she is seeking elective position;

c)The candidate shall present declarations of support from at least 1

member of FKF Sub Branch. Being proposed as a candidate by a

member shall be understood as a declaration of support. Each

member may only present a declaration of support for one person

for each of this position. If a member presents declarations of

support for more than one person, all its declarations shall become

invalid.

d) Candidatures for the position of Branch Youth Representative shall

be restricted to individuals aged above eighteen 18 years and not

older than 35 years;

e) Candidatures for the position of Branch Women Representative

shall be restricted to individuals of the female gender.

xi) Eligible Clubs / at the National/ Branch and Sub Branch Elections

a) The 16 KPL clubs will vote at the National Elections, represented by

one delegate each (cf. art 21(1) (a) of the FKF Statutes);

b)18 Clubs drawn from the FKF PL, National Super League and

National Division one Clubs will vote at the National Elections (cf.

art 21 (1)(b) of the FKF Statutes);

c) Clubs in FKF PL/ NSL and National Division one other than the 18

clubs in (b) above will vote at their respective Branch Elections. Each

club will have one Vote;

d) Clubs participating in the Regional Leagues and County Leagues

will be eligible to vote at their Respective Branches;

e) Clubs participating in the District Leagues will vote at the Sub-

Branch Elections;

f) Only clubs that have participated in the FKF leagues for the last

three consecutive seasons i.e. 2014, 2013, 2012 will be eligible to

participate in National Branch and Sub Branch Elections;

g) Each of the clubs eligible to vote at the Sub Branch will be

represented by 3 delegates namely the Chairman, Secretary and

Treasurer.

h) Five (5) delegates, namely the Chairman, Secretary, Treasurer ,

Youth Representative, women Representative, from the Sub Branch

will be eligible to vote at their Respective Branch Elections.

I) The FKF Secretariat shall publish the preliminary list of eligible

clubs as prescribed by Article 12 (h) on its official website,

www.fkf.or.ke, on or before October 5th 2015. Upon such

publication, all disputes shall be notified by a written petition to the

Secretary General, who shall notify, without any delay, branch

affected and the NEC Member under whose jurisdiction branch is of

the dispute. The NEC Member shall then, within three (3) days,

convene a meeting to resolve the dispute and submit a new list to the

Secretariat, with a detailed memorandum signed by branch

Chairman and Secretary.

14. Submission of Candidatures

I. Candidatures for the Elective FKF office at the National, Branch and

Sub Branch shall be proposed by members of FKF fifteen (15) days

before the date of the general meeting in which the elections are

held. A written proposal submission signed by the interested party

and addressed to the Board, including the candidate's

identification details and declarations of support from members of

FKF as per art. 13 of the Electoral Regulation.

ii. Nomination forms for all candidatures shall be issued by the FKF

Secretariat upon submission of identification documents and

payment of the applicable nomination fees in the form prescribed

in Article 14 (3) of these regulations. The FKF general secretariat

shall keep a record of nomination forms collected and shall

forward them without any undue delay to the Board for

examination and for passing a decision on admission of the

candidate.

iii. For purposes of nomination, the following nomination fees shall

apply:

a. For position of President or Deputy President; Ksh50, 000

b. For position of NEC Member; Sh25, 000

c. For any position for Branch Official; Ksh10, 000

d. For any position for Sub-branch Official; Ksh5, 000

14. Submission of Candidatures

i. Candidatures must be submitted to the elections at least 15 days

before the prescribed elections date and must be accompanied by

the following documents:

a. A duly filled, signed and commissioned Nomination Form;

b. A letter of recommendation from a member of FKF as

prescribed in Article 10 (1) of the Statutes, showing proof of

participation in football activities for the period prescribed in

these regulations;

c. National Identification card and/or passport

d. Two passport-size photographs

15. Examination and Announcement Of Candidatures

i. The list of candidates shall be made public and published on the

FKF official website, www.fkf.or.ke, and the Board shall forward

the candidatures to the Independent Electoral and Boundaries

Commission (IEBC).

ii. Candidates shall be allowed to launch their campaign from the

nomination day to the day before the election. No candidate shall

conduct his/her campaigns or distribute campaign material

whose contents may reflect in any way ethnic, political, religious,

regional or race undertones. Any candidate found to have

engaged in such divisive, abusive and offensive campaigns shall

be disqualified from contesting and/or holding office by Board.

iii. On the respective date for sub-branch, branch or national

elections, no campaign meeting shall be allowed under any

circumstances and no events or supportive attire shall be allowed

therein within vicinity of polling stations and offenders will be

disqualified from the elections.

16 Holders of Official Positions

Candidates for the office of FKF President, Deputy President, NEC

member, Branch and Sub Branch officials who hold positions within

FKF, are permitted to remain in office during the election campaigns.

17. Voting Procedure

i. The FKF office bearers shall be elected by the general meeting for a

period of four years. Such elections shall be conducted by secret

ballot with ballot papers (cf. art. 25 par. 1 of the FKF Statutes). A

secret ballot shall always be conducted, regardless of how many

candidates there are. The secrecy of the ballot shall be guaranteed

by the provision of a procedure ensuring privacy for the voter.

ii. At the beginning of the first session, the Board shall appoint an

adequate number of scrutinizers.

iii. The Board, assisted by the scrutinizers, shall conduct the

distribution and counting of the ballot papers and be responsible

for ensuring that the process is properly documented.

iv. The number of ballot papers that have been distributed shall be

announced by the chair of the Board before the count.

v. The order in which the members present shall cast their votes shall

be the alphabetical order of members in English language.

vi. If the number of ballot papers returned is equal to or less than the

number of ballot papers distributed, the election shall be declared

valid. If the number returned exceeds that of the ballot papers

distributed, the vote shall be declared null and void and another

vote shall be taken.

vii. For the election of the FKF President, Deputy President (50 % + 1)

of the votes of the FKF members present and eligible to vote are

necessary in the first ballot. If none of the candidates obtained the

simple majority after the first ballot and there are more than three

candidates for one available position, the three candidates that

obtain the highest number of votes will remain for the following

ballot. Should there be three candidates remaining in a ballot, the

candidate that obtains the lowest number of votes will be eliminated

and a following ballot will take place with the two remaining

candidates.

viii. All other Candidature for the National, Branch and Sub Branch

Election, the winner will be determined by the candidate with the

highest votes.

ix. The ballot papers shall conform to the official model established by

the Board, and any vote cast using a different ballot paper shall be

invalid.

x. The ballot papers shall contain the name(s) of the candidate(s), and

the voters must mark one candidate only. Ballot papers on which

more than one candidate is marked or on which no candidates are

marked shall be invalid.

xi. The Secretary General shall put the ballot papers that have been

collected and counted into envelopes intended for this purpose and

seal them immediately. The general secretariat shall keep these

envelopes and destroy them 100 days after the end of the general

meeting.

i. The counting and declaring of the results shall take place at the

Voting center.

ii. The Officials -elect shall state whether or not they accepts their

election immediately after election is concluded. In the affirmative,

their mandate shall begin after the end of the General meeting that

has elected them.

18. Counting and declaring the results

i. All appeals against any decisions in respect of any dispute arising

from the electoral process may be filed with the Appellate Body

whose decision shall be final.

ii. For purposes of Appeal, the following fees shall apply:

a. In case of an appeal in respect of position of President or Deputy

President; a sum of Ksh250, 000

b. In case of an appeal in respect of NEC Member; a sum of Ksh150, 000

c. In case of an appeal in respect of a position of Branch Official; a sum

of Ksh100, 000

d. In case of an appeal in respect of a position of Sub-Branch Official; a

sum of Ksh50, 000

iii. Any appeal against the decision for lists or candidatures or

nominations shall be lodged, in writing, to the Appeals Board

within three (3) days from the date of publication of the final lists

and/or decision and the Appeals Board shall convene

immediately and gives its decision within three (3) days if in respect

of list or nominations and at least five (5) days before the prescribed

date of elections if in respect of candidatures.
