On September 20, 2012, Judge Marvin Garbis, of the Federal District Court of Maryland, ruled in the case of Robert F. Cherry, Jr., et al vs. Mayor and City Council of Baltimore City, et al. that the retiree bene-fit increase in Ordinance 10-306 is unconstitutional. Ordinance 10-306, which was passed in June 2010 replaced the variable retiree benefit increase with a fixed increase. The fixed increase is:

• No increase to retiree and beneficiaries younger than age 55;

• A 1% increase to eligible retirees and beneficiaries age 55 and older, but young-er than age 65; and

Peter Keith Elected Chairman of the F&P Board of Trustees

Peter E. Keith was elected Chairman of the Board of Trustees by the members of the Board on September 18, 2012, succeeding Theodore I. Weintraub whose term ended June 30, 2012. Mr. Keith, a partner at Gallagher, Evelius & Jones, LLP specializing in civil litigation, was first appointed to the Board of Trustees in March 2005 by then Mayor Martin O’Malley.

Captain Ray Hudson Elected Vice-Chair of the F&P Board of Trustees

Captain William “Ray” Hudson was elected Vice Chair of the Board of Trustees by the members of the Board on September 18, 2012. A 21 year veteran of the fire department Captain Hudson joined the Board in July 2010 as the Fire Depart-ment Active Member Representative Trustee after having been elected by active employees of the fire department who are members of the F&P.

Dr. Anthony W. Batts New Police Commissioner

On August 28, 2012, Mayor Stephanie Rawlings-Blake named Dr. Anthony W. Batts as the new police commissioner of the Baltimore Police Department. Commissioner Batts officially began his term on September 26, 2012, and he replaces former commissioner Frederick Bealefeld III, who retired in July. Commissioner Batts served as police chief in both Long Beach and Oakland California.

Payroll Direct Deposit The Fire and Police Employees’ Retirement System (F&P) strongly encourages all retired members and beneficiaries to receive their bi-weekly benefits by direct deposit. Direct deposit is the safest and fastest way to receive your bi-weekly F&P benefit. An F&P Payroll Direct Deposit Request form can be obtained by calling the F&P member services section at 410-497-7929, Option 1 during business hours from 8:30 a.m. to 4:30 p.m. The request form is also available 24 hours a day on the F&P website www.bcfpers.org. Click on the Retirees & Beneficiaries link then proceed to forms. All forms must contain your signature to be accepted by the F&P. Remember if you are requesting your benefit to be deposited into a checking account a blank voided check must be attached to the direct deposit form. Completed original forms must be submitted to the F&P by mail.

• A 2% increase to eligible retirees and beneficiaries age 65 and older, and also to members retired with a 100% line-of-duty disability, regardless of age, and to their beneficiaries.

• A retired member or beneficiary must have received F&P retirement benefits for 2 or more years as of the June 30 increase eligibility determination date in order to be eligible for any increase.

Judge Garbis said that, in order to be constitutional, the change in the retiree benefit increase had to satisfy an important public purpose and had to be “reasonable and necessary.” Judge Garbis found that the elimination of the variable benefit increase satisfied the important public pur-pose of restoring actuarial soundness and sustainability to the F&P. He also found, however, that the struc-ture of the fixed increase was not “reasonable and necessary” because it adversely affects some retirees (e.g., those younger than age 65) more than others. As of the date this article was written, the City of Baltimore has not yet decided whether it will appeal the decision.

Keeping Your Mailing Address Current

As a retiree or beneficiary of the Fire and Police Employees’ Retirement System (F&P) it is important to keep your address current. Throughout the year you receive retirement benefit checks or direct deposit advices, newsletters, 1099R forms, widowhood certifications, and many other important documents. Even the healthcare mail that is sent to you from the Employee Benefits Division is based upon the address you give to the F&P. Therefore it is imperative that you maintain a current mailing address with the F&P. If your address changes you need to complete an F&P Change of Address Form and submit it to F&P member services section. An F&P Change of Address Form can be obtained by calling the F&P member services section at 410-497-7929, Option 1 during business hours from 8:30 a.m. to 4:30 p.m. to request a change of address form.

The form is also available 24 hours a day on the F&P website www.bcfpers.org. Click on the Retirees & Beneficiaries link then proceed to forms. All forms must contain your signature to be accepted by the F&P. Completed forms can be submitted through the U.S. postal mail and via fax. The F&P should be notified of your change of address at least 3 weeks prior to your move. This is to assure that your direct deposit advice or your retirement benefit check will be mailed at the ap-propriate time to your correct address. The F&P does not accept address change requests over the phone or via e-mail.

2013 Benefit Plan Changes for Non Medicare Retirees Submitted by: Employee Benefits Division of the Department of Human Resources

Like all other employers, the City of Baltimore continues to face rising costs of healthcare. Employee Benefits Division goal is to continue to provide affordable and competitive benefits for those who serve the City. Beginning in 2013, there will be important plan changes to benefits. Effective January 1, 2013, the City of Baltimore will offer retirees (2) plan design options for CareFirst PPN and (2) plan design options for Express Scripts for Non Medicare retirees. Both the medical plan and the prescription drug plan will offer a High Option plan design, which is our current plan design, and a new Standard Option plan design. The High Option medical plan will be linked to the High Option prescrip-tions drug plan and Standard Option medical plan will be linked to the Standard Option prescription drug plan as a combined payroll deduction. The High Option medical and prescription plans will cost more than the Standard Option medical & prescription drug plans. Note: Retirees who are currently enrolled in CareFirst Medicare Supplemental (formerly CareFirst BCBS Traditional Medicare Supplemental) or Kaiser Permanente and Express Scripts will be linked to the High Option Prescription Drug Plan for 2013 if no enrollment changes are made online during Open Enrollment. If you are Medicare eligible and/or have Medicare eligible dependents currently enrolled in the CareFirst BCBS Traditional Supplemental Plan, which will be renamed CareFirst Medicare Supplemental for 2013, and the Baltimore City Medicare Part D Prescription Drug Plan, this change will not affect your coverage. Outlined below is an illustration of the current (2012) enrollment for Medical & Rx and what Medical & Rx plans retirees will default to if no changes are made online during Open Enrollment or choose to elect for 2013.

Retirees who elect the New CareFirst PPN Standard Option medical plan for 2013 can only enroll in the Express Scripts Standard Option prescription drug plan for 2013 Rx coverage.

Effective January 1, 2013, retirees will contribute 20% (currently 10%) towards the prescription drug cost for both the High Option and Standard Option Prescription Drug (Rx) Plans. Under the Standard Option Medical Plan, there will be annual deductibles, coinsurance, an annual out-of-pocket maximum for an individual/family for in-network benefits and an out-of pocket maximum for an individual/ family for out-of-network benefits. The Standard Option Prescription Plan will have an annual deductible in addition to retail and mail order copayments. New F&P Legislation Makes Technical Changes to Article 22

On June 26, 2012, Mayor Stephanie Rawlings-Blake signed into law Ordinance 12-43. Ordinance 12-43 amends the Fire and Police Employees’ Retirement System (F&P) law, Article 22 of the Baltimore City Code, by incorporating several technical changes made by federal tax laws, including the legislation entitled “The Pension Protection Act of 2006.” The amendments are required to assure that the F&P remains in compliance with the Internal Revenue Code. The F&P Board of Trustees supported passage of the amendments. None of the changes affect the amount of the benefit provided by the F&P. The most important of the changes concern the “rollover” rules. Under the tax laws, an F&P member can transfer certain lump sum payments (e.g., DROP account balances or return of member contributions) to other retirement vehicles (e.g., an IRA) without paying current income tax on the payment. This transfer is called a “rollover.” The Pension Protection Act liberalizes the rollover rules in the following ways:

• Allowing rollovers to “Roth IRA’s.” A

member making a rollover to a Roth IRA pays income tax on the F&P payment in the year the payment is made but avoids taxes on the Roth IRA when it is eventually withdrawn.

• Allowing after-tax employee contributions

to be rolled over. A member receiving a payment that is attributable to after-tax member contributions (e.g., pre-1989 member contributions) can now roll over that payment to an IRA or another employer’s retirement plan.

• Allowing non-spousal beneficiaries to

make rollovers. If you die, and a beneficiary other than your spouse is entitled to a death benefit, that beneficiary can now roll over the death benefit to avoid current income taxation.

This past July a water main broke forcing the F&P offices to close unexpectedly for two days. During this time many F&P members were concerned that this unforeseen closure would cause a delay in bene-fit checks to retirees and beneficiaries. In 2007, the retirement payroll was outsourced to a global payroll processor called Automatic Data Processing, Inc. which is commonly referred to as ADP. F&P benefit payments are processed in Alpharetta, Georgia which is a suburb of Atlanta. This is only one of many remote locations across the globe that ADP can use to process payroll. So even though the F&P offices were physically closed because of the water main break, payroll was still being processed by ADP and supervised by the F&P accounting manager. Rest assure in the future if the F&P offices has another unscheduled closing the payroll process will contin-ue and also the process of printing checks along with direct deposits will continue uninterrupted. However, keep in mind if you receive your benefit payment in the form of a physical check there are numerous ways your benefit may be delayed. Checks are also mailed from Alpharetta, Georgia and it may take up to seven working days to be delivered to you by the U.S. postal service after being mailed. Weath-er conditions including hurricanes, snowstorms, earthquake damage, or power outages cause postal mail delays. In addition the United States Postal Service is considering ending Saturday mail delivery. The F&P strongly encourages all retired members and beneficiaries to receive their bi-weekly benefits by direct deposit. Direct deposit is the safest and fastest way to receive your bi-weekly F&P benefit.

Your benefit payment will be electronically de-posited into your bank account on Friday morn-ing every two weeks and without the risk of it being delayed, lost, or stolen. An F&P Payroll Direct Deposit Request form can be requested by calling the F&P member services section at 410-497-7929, Option 1 during business hours 8:30 a.m. to 4:30 p.m.

The request form is also available 24 hours a day on the F&P website www.bcfpers.org. Click on

Retirees & Beneficiaries then proceed to the Forms link. If you are using direct deposit and you change financial institutions, you will need to complete a new Payroll Direct Deposit Request form with your new account information. Please be aware that even if you send the F&P your bank’s direct deposit form, it must be attached to an official F&P Payroll Direct Deposit Re-quest form to be valid. All forms must contain your

social security number and signature to be accepted by the F&P. Remember if you are requesting your benefit to be deposited into a checking account a blank voided check must be attached to the direct deposit form. Completed original forms must be submitted to the F&P by mail only. Once the form is received by the F&P, it may take up to two pay periods for the direct deposit to take effect

I have been retired for over twenty years. Can I receive a lump sum payment for the remainder of my pension? No, the F&P does not issue any lump sum payments for the full amount of a pension benefit. Automatic Data Processing (ADP) is not an agency with the City of Baltimore, but they have my personal information. Will they give out my per-sonal information to other companies or telemar-keters? No, ADP will not give out or sell your information to another source. ADP is a global payroll processing company with thousands of companies and agencies as their clients. They believe that privacy and security is important.

Why can’t the F&P tell me over the telephone who my beneficiary is? Answer: Beneficiary designation information is sensitive and confidential and never revealed over the telephone. Please make an appoint-ment with a Retirement Benefits Analyst to discuss your beneficiary designation or send a request in writing. When does the F&P pay retirement benefits? The F&P pays retirement benefits on a bi-weekly basis, which means every two weeks. A schedule of benefit payment dates can be found on the F&P website www.bcfpers.org/ . Click on Retirees and Beneficiaries then proceed to F&P Benefit Payments and click on Benefit Payment Dates.

Who should I contact if I have a question concern-ing my healthcare deduction on my check? Questions regarding healthcare deductions should be directed to the Employee Benefits Division of the Department of Human Resources at 410-396-5831. Questions regarding any other deductions should be

directed to Central Payroll Division of the Department of Finance at 410-396-3759 Who should I contact if I have lost my benefit check? If you have lost or misplaced your benefit check, please contact the F&P accounting section at 410-497-7929, Option 2 to report the lost or misplaced check. The accounting section will issue a stop payment request. A replacement check will be mailed out as soon as possible. This process could take up to three weeks. Please consider receiving your bi-weekly benefit by direct deposit.

In the event of my death, what should my spouse do? Answer: Your spouse or family should contact the F&P member services section as soon as possible to report your death. A retirement benefits analyst will advise your family on the next steps they need to

Only July 1, 2012, Lieutenant Victor C. Gearhart began his term as Police Department Active Member Trustee. Victor began his career with the police department in 1982. During this time he has served as a officer, sergeant and lieutenant in patrol units in the Northern, Northwest, Southeast, Southern, and

Western Districts. Victor has also served in CID (Narcotics & DDU) and in various administrative units including Court Liaison Project, Grants, Gunstat (MOCJ), MIS and Professional Standards Sections.

Robert A. Haukdal, a New Jersey native, joined the Baltimore Police Department in 1969 and retired as a lieutenant in 2005 after serving 36 years in the police department. Bob’s career assignments in-cluded the Central, Northern, and Southeastern Districts,

the Education and Training Division, the Internal Investigation Division, the Administrative Bureau, and the Criminal Investigation Division. Bob was acting director of the Fiscal Section upon his retire-ment. He has been a member of the FOP since the early 1970’s and still regularly attends meetings.

Victor C. Gearhart TRUSTEE UPDATES

Board of Trustees Meeting - The F&P Board of Trustees typically meets every third Tuesday of the month. Regular meetings of the Board of Trustees are open to the public.

Currently, Bob is a Colonel/Undersheriff for the Baltimore County Sheriff’s Office. Bob holds a Bachelor of Science degree in accounting from the Baltimore College of Com-merce which has since merged with the University of Baltimore. Bob has been married for 43 years and has two children and four grandchildren.

Born at Bon Secours Hospital, Victor grew up in Highlandtown as the son of a lifelong Bethlehem Steel worker and a High’s Convenience store clerk. Victor was promoted to his current rank of Lieu-tenant in 1998 and is currently the midnight shift commander at the Southern District. Victor served four years in the United States Ar-my and holds a Bachelor of Arts degree in His-tory from Loyola College. Victor has been married for 26 years and has two sons.

Gaye L. Burrell joined the F&P in March 2003. Gaye’s provides comprehensive office support to the F&P member services section. Gaye’s duties include respond-ing to active members and retiree telephone inquiries re-

garding benefits, scheduling appointments, and types various correspondences for Retirement Benefit Analyst. In addition Gaye processes retiree and beneficiary change of address request, prepares monthly spreadsheet of all outgoing member services correspondences, and updates F&P data-bases from which annual membership state-ments are prepared and mailed. Prior to working at the F&P, Gaye worked for Baltimore City Department of Transportation where she was responsible for resolving payroll problems. Gaye holds an Associate of Applied Science degree from the Community College of Baltimore County and is currently pursuing a Bachelor of Science degree in Human Resource Management.

Venerando “Benji” Ignacio be-gan working for the F&P in January 2006. Benji is responsi-ble for accuracy in accounting in accordance with the generally accepted accounting principles. Benji’s duties include encoding payroll in ADP, adding new

retirees and beneficiaries to the payroll, and the termi-nation of members. Benji also responds to retirees and beneficiaries inquiries regarding their federal and state tax withholdings. In addition Benji prepares retiree and beneficiary direct deposit forms ensuring that all checks are assigned their respective bank codes.

Benji also reconciles bank balances against general ledgers, prepares journal entries and monthly financial reports, and tracks expenses of the F&P’s budget. Benji works closely with the F&P member

services section and coordinates with the F&P’s legal counsel on the approval of financial power of attor-neys. In addition Benji assists in the preparation of account-ing records and actuarial data for the annual financial audit and provides assistance to auditors. Benji works with the Accounting Manager to compile financial data for the Comprehensive Annual Financial Report. Benji holds a Bachelor of Science in Business and Economics with a major in accounting from De La Salle University.
