This report is to request that Council nominate Cr Deirdre Comerford and Cr Karen May to attend the Year of Women in Local Government Conference 2010 to be held in Moranbah from 9-10 September 2010.

Costs of attendance are catered for in the current budget. This will involve car travel and one night's accommodation.
Conclusion
It is proposed that Cr Comerford and Cr May be nominated to attend the Year of Women in Local Government Conference 2010 to be held in Moranbah from 9-10 September 2010. There is an opportunity to send more delegates if Council desires.

11.1 MRC 2010-078 SUPPLY AND CONSTRUCT OR LEASE OPTIC FIBRE COMMUNICATIONS LINK - PAGET WORKS DEPOT

Purpose
To present to Council for approval of tenders submitted for the MRC 2010-078 Supply & Construct or Lease Optic Fibre Communications Link – Paget Works Depot.
Background/Discussion
As part of the development of the Paget Depot, a requirement exists for intranet and internet connections. Minimum connection performance requirements to enable video conferencing has been set at 10 GB/s. Tender documentation was prepared on the basis of a conforming dedicated optic fibre link from the Paget Depot site to the Gordon Street Administration building to provide the required services with options for both Council own & operate and or lease options in order to consider a range of financial alternatives. Provision was also made within the tender documentation to consider non-conforming options. Tenders were invited on the 19 June 2010, via Council’s website and advertised locally in the Daily Mercury, requesting submissions from Companies suitably experienced and resourced for the lease of or construction of optic fibre communications. Submissions were received from: I3 Asia Pacific Pty Ltd Malco Constructions Telstra Wavelength Pty Ltd Jai-Cor Communications Nexium Telecommunications An initial compliance check was conducted by the Evaluation Panel on the 2nd August 2010 to identify submissions that were non-conforming with the immediate requirements of the RFT. This included compliance with contractual requirements and provision of requested information. On the basis of the criteria assessment, Tender Information Requests (TIR) were sent out to I3 Asia Pacific Pty Ltd, Malco Constructions, Telstra, Wavelength Pty Ltd and Nexium Telecommunications. Details received enabled the panel to determine that the non-conforming and lease options submitted to Council, were insufficient to operate the Depot as required. Jai-Cor Communications and Nexium Telecommunications were deemed non-conforming due to there being no representation from either company at the mandatory site meeting. All other submissions were progressed through to the qualitative criteria assessment on the basis that all terms and conditions and mandatory requirements of the RFT had been met.

During the evaluation the tenderers were assessed against the nominated qualitative criteria. The weighting attributed to each qualitative criteria was: Relevant experience in performing works of similar nature 20% Key personnel skills and experience 20% Tenderers’ resources available to complete the works 20% Demonstrated understanding or methodology proposed 30% Local Content 10% The tendered Lump Sum Fixed Prices are listed below Wavelength Pty Ltd $ 599,000.00 I3 Asia Pacific $1,009,979.00 Telstra $1,195,000.00 Malco Constructions $1,742,100.00
The Summary of Costs and Tender Assessment is attached for reference. Group CCTV were engaged to undertake a technical review of the submitted tenders - their report is attached for reference. At the end of the assessment process, the assessment team ranked Wavelength Pty Ltd as the preferred tenderer. This option was assessed as being the most cost effective option whilst meeting the required performance criteria established for connectivity of minimum 10GB/s. In addition non-conforming options were considered and disregarded on the basis of: Wavelength – Option to install P50 conduit limits future options for multiple use of the
conduit at some future time. Considered restrictive to possible future uses. I3 Asia Pacific – Non conforming option for installation within gravity sewer mains not
considered due to objections from Mackay Water on access and ongoing maintenance issues for gravity sewers as well as currently unknown deterioration of optic cables installed in this environment. Similarly lease option disregarded on same basis.
Telstra – Conforming lease options disregarded. Performance of lease lines not meeting required connectivity standards (Max 2 GB/s)

Consultation and Communication

Resource Implications/Risk Management
Provisional funding of $1,000,000 has been provided within budget allocations for the Paget Depot Project to fund the provision of an optical fibre link. Acceptance of the tender offer of $599,000 is within the current allocation.
Conclusion
That awarding the contract to Wavelength Pty Ltd represents the most advantageous outcome to Mackay Regional Council based on the ability to perform the works requested and demonstrated value for money to Mackay Regional Council.
Officer Recommendation
THAT the fixed price tender submitted by Wavelength Pty Ltd of $599,000.00 (excluding GST) be accepted for the provision of MRC 2010-078 Supply & Construct or Lease Optic Fibre Communications Link – Paget Works Depot.
