The Minutes of the 211th Meeting of the NRC held from February, 19th to 21st 2013

The 211th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from February, 19th to 21st, 2013 at NRC, NCTE, Jaipur.

The following were present:-

The Regional Director, NRC apprised the members of Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

AGENDA ITEM NO.- 211.1 CONFIRMATION OF MINUTES OF 210th MEETING The decision mentioned against Aganda item no. 210.18.2 S. No. 81 file No. NRC APP-2802 be read NRC decided that VT be constituted to verify the infrastructure & Instructional facilities created by the Institution for D.El.Ed. Course as per the provisions of NCTE Regulation, 2009 for further processing of the application.

The institution shall be required to provide all information as required in NCTE Regulation, 2009 to the Visiting Team at the time of Inspection along with building completion certificate issued by the Competent Authority in place of decision mentiond in the minuts of 210th meeting and the decision mentioned against Agenda item no. -210.31.8 S.No. 158 file no. NRCAPP-2386 be read as NRC decided that VT be constituted to verify the infrastructure & Instructional facilities created by the Institution for D.El.Ed. Course as per the provisions of NCTE Regulation, 2009 for further processing of the application.

The institution shall be required to provide all information as required in NCTE Regulation, 2009 to the Visiting Team at the time of Inspection along with building completion certificate issued by the Competent Authority. In place of decision meeting in the Minutes of 210th NRC Meeting

The Northern Regional Committee considered the case in view of the direction of the NCTE Hqr. following the directions of the Hon’ble Apex Court in the Civil Appeal No. 3505 of 2012 (arising out of S.L.P. (Civil) No. 233 of 2011 in light of provisions of the NCTE Act, Rules & Regulations.

The Committee after going through all relevant records, report of the NCTE Hq. under section 13 of the NCTE Act,1993, deficiencies pointed out by the NCTE Hq., reply submitted by the institution viz-a-viz provisions of the NCTE Act, Rules & Regulations deliberated and considered the case in detail.

The Committee noted that the NRC in its 207th meeting observed that the institution has not make up the deficiencies pointed out by the NCTE Hqrs and decided that the order of withdrawal of recognition stands for derecognized courses. Thereafter the institution filed a W.P. No. 121/2013 & CM NO. 241/2013 and the Hon’ble High Court directed the institution to file its reply within two weeks and the NRC shall take a decisions, by passing a reasoned order. Accordingly the NRC in its 210th meeting decided to direct the institution to file a reply within two weeks from 11.1.2013 (as has been directed by the Hon’ble High Court) so that the matter may be processed further for taking a final decisions.

In compliance of the direction of the Hon’ble High Court, the institution submitted its reply to the NRC vide letter dated 28.1.2013 received in the NRC on 30.1.2013 and the same was considered by the NRC and after examination of the same the NRC observed that the institution has cured the deficiencies satisfactorily, therefore, it has been decided that the recognition of the institution shall stands as per the order of the Hon’ble Supreme Court. Accordingly, appropriate order withdrawing order of de-recognition for de-recognised courses be issued.

The NRC in its 207th meeting noted that the institution did not reply to the deficiencies pointed out by the NCTE Hq. under Section 13 of the NCTE Act, 1993 as per the directions of the Hon’ble Supreme Court. Therefore, the NRC decided to issue a show cause notice to the institution. The same was issued to the institution on 15.1.2013.

The NRC finally considered the matter and noted that inspite of the NCTE Hq. letter dated 6.8.2012 and subsequent SCN issued by the NRC on 15.1.2013, the institution did not reply to the deficiencies pointed out by the NCTE Hq. under Section 13 of the NCTE Act, 1993 as per the direction of the Hon’ble Supreme Court.

The institution submitted its reply and the same was considered by the NRC and after examination of the same the NRC observed that the institution has cured the deficiencies satisfactorily, therefore, it has been decided that the recognition of the institution shall stands as per the order of the Hon’ble Supreme Court.
