• Underground works are related to risks that are difficult, if not impossible, to estimate

• In order to cover all risks reasonably, the price and therefore the cost of investment will inevitably rise.

• The allocation of risk to one party is uneconomic.

Why a specific Form of contract for Underground Works?

• Underground is different from other works in terms of risk management and allocation

Which aspects require particular attention?

1. Each risk shall be allocated to the party that is fittest to control it, in order to get best value for money.

2. Information to contractors on ground conditions (careful investigation, full disclosure).

3. Production cost depends on ground behaviour during excavation, not on physical characteristics of the ground.

4. Construction time may vary according to ground conditions. To be considered in the definition of time for completion.

5. Expensive equipment means high investment by the contractor and therefore high time related costs.
