Fences and Walls in Palm Coast

• At their Jan. 13th meeting, City Council requested Planning staff to review our fencing and wall standards.

• With a focus on whether 6-foot solid fences along saltwater canals should be stepped down as they approached the canals?

• Staff has reviewed the history of our standards and also researched the fence standards in ten other Florida coastal communities.

Palm Coast’s Fence and Wall History

A Palm Coast Community Service Corporation policy in January 1996 had the following guidelines:

1. Black chain link fences were the preferred fencing material along saltwater canal lots.

2. Maximum fence height was 6 feet.3. Fences and walls over 3 feet in height required review by the

Architectural Review Committee.4. Those in front yards over 3 feet high were only allowed as

variances.

Considerations

Possible changes for City Council to consider, include:

Page 13: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Allow White and Other Color Choices for Metal Fences?

Page 14: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

For Vinyl Fences Allow More Colors Besides White and Tan?

Page 15: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Permit Short, Open Fences in Front Yards?

Page 16: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Require Solid Fences to Reduce Height to 4 Feet Nearby Saltwater Canals?

Page 17: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Or Require Fences to be Open Nearby Saltwater Canals?

Page 18: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Stop Requiring Fences to be Set Back 3 Feet From Canals, Golf Courses and ROWs for

Required Planting Areas?

Page 19: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Discontinue Requiring Shrubs along Fences Facing Streets?

Page 20: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Allow Pre-Cast Concrete Fences?

Page 21: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Summary of Potential Changes

• Allow more colors for metal & vinyl fences• Allow short open fences in front yards• When nearby saltwater canals require fences to be

open or reduced in height to 4 feet• Stop requiring fences to be setback 3 feet from canals,

golf courses and ROWs and discontinue requiring planting areas

• Discontinue requiring shrubs along fences facing a street

• Allow pre-cast fences

Page 23: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Introduction to our Zoning Standards for Drinking Establishments

• A restaurant with a bar or lounge must have at least 51% of it sales from food services.

• In this scenario the bar is accessory to the restaurant or eating establishment.

• This presentation involves only businesses whose principal uses are drinking establishments.

Types of Drinking Establishments

• Palm Coast has two levels of drinking establishments that are split by their intensity.

• Bars, taverns and nightclubs (without discotheques and/or live entertainment) are the lower intensity ones.

• Bars, taverns and nightclubs (with discotheques and/or live entertainment) are the higher intensity ones.

Standards in Code of Ordinances on Alcoholic Beverages Including Bottle Clubs

• Section 7-1.(b) limits the hours they may be sold, delivered, served or consumed.

• These activities may not occur between 2 AM - 7 AM weekdays and 2 AM - 10AM Sundays.

• Bottle clubs are specifically included in the standards.

Page 28: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Brew Pubs and Micro-Breweries are an Evolving Trend

Page 29: Fences, Walls and Drinking Establishments City Council Workshop March 10, 2015

Potential Changes to our Standards for Drinking Establishments

• In our Code of Ordinances clarify that Saturday mornings are specifically included on the time restrictions.

• Modify our land use standards so bars, taverns and nightclubs are not allowed in the OFC and COM-1 Districts.

• Modify our thresholds from discotheques and live entertain-ment to outdoor entertainment. (Bars with outdoor entertainment typically have the most impact on any neighboring homes.)

• Update our terminology so bottle clubs, brew pubs, and micro-breweries are specifically included.
