SUBJECT: DISPOSITION OF DRAFT REPORT ENTITLED, "A PRELIMINARYNUMERICAL STUDY OF THE HAZARD FROM LOCAL LANDSLIDETSUNAMI SCENARIOS AT THE DIABLO CANYON SITE INCENTRAL CALIFORNIA"

This memorandum is to inform you of the Office of Nuclear Reactor Regulation's (NRR's)disposition of the subject draft report, which was transmitted to NRR via a memorandum fromJohn Moninger, dated February 3, 2005. The draft report was prepared under subcontract tothe Center for Nuclear Waste Regulatory Analysis (CNWRA), in support of your staff'sevaluation of the Pacific Gas & Electric (PG&E) application for an Independent Spent FuelStorage Installation (ISFSI) at the Diablo Canyon site. The letter from the CNWRA's, principalinvestigator, John Stamatakos, to your staff Project Manager, James Randall Hall, datedMarch 17, 2004, noted that in Dr. Stamatakos' professional opinion the draft report used amethodology that is "beyond the state of the art." Subsequent correspondence from CNWRAmanagement has confirmed that the draft report has not been accepted by CNWRA and hasnot gone through the CNWRA quality assurance process. Thus, the draft report's technicalbasis is not supported by CNWRA.

Based on our discussions of the report and the need for a technical review, we jointly asked theU.S. Nuclear Regulatory Commission's (NRC's) Seismic Issues Technical Advisory Group(SITAG) to perform such a review. The SITAG assessment of the draft report was transmittedto Michele Evans and Gene Imbro in a memorandum from Andrew Murphy, datedNovember 17, 2005. The SITAG concluded that the draft report was based on low resolutiondata having considerable uncertainty and that it was not suitable for use in regulatoryapplications. The SITAG also provided (1) a recommendation that the draft report be providedto PG&E for their information as they finalized their own reassessment of the tsunami hazardfor the Diablo Canyon site, and (2) recommendations for additional NRC research to addressthe tsunami hazard.

We subsequently considered an approach to release the draft report to PG&E andto provide the staffs assessment of the report to place the report in context for the public.However, following the discussions with the Commission technical assistants onJanuary 18, 2006, the staff received direction from the Commission that the report was not tobe released, absent a thorough review by the staff and, resolution of the staff comments.

Unrelated to the staff's evaluation of this draft report, the President's Office of Science andTechnology Policy (OSTP) released a report entitled "Tsunami Risk Reduction for the UnitedStates: A Framework for Action." The multi-agency efforts described in the OSTP reportincludes one of the tsunami mechanisms proposed in the draft report provided by the CNWRAsubcontractor in the OSTP broad review of tsunami issues.

Given the speculative nature of the draft report, the SITAG assessment of that draft report, theCommission direction to not release the draft report absent further staff assessment, and theongoing technically robust and broad review by the OSTP, the NRR staff is terminating anyfurther consideration of the draft report. The staff will be investing our continuing efforts inparticipating in the OSTP effort, seeking to build on the comprehensive efforts being conductedby the National Oceanographic and Atmospheric Agency (NOAA), the U.S. Geological Survey(USGS), and the National Science Foundation. We believe that participating with theseorganizations will provide a more technically credible base to broaden our technicalunderstanding and inform our efforts to reassess tsunami design criteria in our StandardReview Plan (NUREG-0800) than could be obtained by further efforts to evaluate the tsunamiassessment methodology described in the draft report.

SUBJECT: SUMMARY OF INTERNAL MEETING WITH NRR AND RES TODISCUSS CONTRACTOR REPORT ON TSUNAMI HAZARDSANALYSIS

On April 28, 2005, an internal meeting was held between staff from the Office of NuclearMaterial Safety and Safeguards (NMSS), the Office of Nuclear Reactor Regulation (NRR), andthe Office of Research (RES), to discuss a contractor's report on tsunami hazards analysis thatwas prepared as part of the NRC's review of an application for an independent spent fuelstorage installation (ISFSI) at the Diablo Canyon site. On February 3, 2005, NMSS had sent amemorandum to NRR and RES transmitting the contractor's report for information. AlthoughNMSS did not rely on the information in the report in reaching a licensing decision on the DiabloCanyon ISFSI, NMSS recognized that the issues identified in the report could have broaderapplicability and should be provided to the other program offices for consideration.

The meeting participants agreed that the information in the contractor's report warrants furtherreview by NRC staff, in that the report raises questions regarding the use of new methods andassumptions in evaluating tsunami hazards. The participants also agreed that the SeismicIssues Technical Advisory Group (SITAG), led by RES with membership from NRR and NMSS,would take the lead in reviewing the subject report, and in making recommendations for anyfurther NRC action. The SITAG chairman stated that it would take the group from one to sixmonths to develop its recommendations, and emphasized that the group's existing work on.Early Site Permits would remain its first priority.

CHARTER FOR THE NUCLEAR REGULATORY COMMISSION'SFREEDOM OF INFORMATION ACT RESPONSE TASK FORCE

Objective

In support of the effort to consolidate and process the Freedom of Information Act (FOIA)requests related to the Japan nuclear events beginning on March 11, 2011, NRC hasestablished an Intra-agency FOIA Response Task Force (TF). The TF consists of subjectmatter experts representative of each Program Office who are knowledgeable of the technicalinformation contained within these FOIA requests. The Office of General Counsel (OGC) willprovide legal advice and assistance.

Scope

The scope of the NRC FOIA Response TF and responsibilities include the following:

1. Expedite and coordinate the review of agency records related to the events in Japan.The review of agency records will occur in four phases:

a. Phase 1 - Selected key information from the first seven days of activating theHeadquarters Operations Center (HOC) will be collected and reviewed. Thisinformation includes:

i. NRC Situation Reports (SITREPs);ii. One-page briefing sheets;

iii. Executive team (ET) phone audio transcription;iv. ET, Reactor Safety Team (RST), Protective Measures Team (PMT), and

Liaison Team (LIA) chronology and logs with attachments;v. RST reactor status slides;vi. International information and radiological monitoring results

1. Ministry of Economy, Trade, and Industry (METI)2. Ministry of Education, Culture, Sports, Science, and Technology

(MEXT)3. International Atomic Energy Agency (IAEA)

vii. Meteorological information from the National Oceanic and AtmosphericAdministration (NOAA)

viii. Department of Energy (DOE) Situation Reportsix. WASHFAX emails (i.e., agendas and meeting summaries from the

Interagency Policy Committee (IPC), Deputies Committee (DC), and

Principals Meetings)

b. Phase 2 - Other information requested from the first seven days of the Japanevents will be collected and reviewed. This information includes:

i. HOC e-mail accounts (-66 in total)ii. FOIA resource e-mail account

iii. Main phone audio transcriptions from the RST, PMT, LIA (International

and Federal), HOOs

c. Phase 3 - Any outstanding information requested from the first seven days of theJapan events will be collected and reviewed. This information includes:

i. Individual e-mail accounts identified in FOIA requestsii. Remaining HOC phone/bridge audio transcription (-99 phones/bridges)

d. Phase 4 - Next seven days of information from phase 1, phase 2, and phase 3 ofthis charter.

2. Identify sensitive information within agency records that should be withheld under aFOIA exemption. A foreseeable harm statement should be developed, as appropriate.

3. Identify information which requires consultation with other Federal agencies, companies,and foreign governments.

4. Consult with OIS to ensure that FOIA requesters are engaged at the end of each phaseof the record collection and review process, to inform them of available information, andreconfirm whether this information meets their needs.

5. Propose and implement improvement recommendations (OIS or TF) to the work flowprocess that support the deliberate and diligent processing of Japan related FOIArequests.

Coordination and Communication

The NRC FOIA Task Force will:

1. Provide periodic status updates to NRC internal stakeholders, including NSIRmanagement, the NRC's FOIA/PA Officer and the OIS Integrated Project Team (IPT), ofthe TF progress made in satisfying FOIA/PA requests.

2. Ensure that communication channels (i.e., NRC daily announcements, yellowannouncements, FOIA Sharepoint site, NRC Public website) are effectively used toinform the agency and public of the progress made in satisfying Japan related FOIArequests.

3. Ensure that FOIA requesters are engaged at the end of each phase of the recordcollection and review process, to inform them of available information, and reconfirmwhether this information meets their needs.

4. Ensure that the information identified as withholdable under a FOIA exemption is

coordinated with the NRC's FOIA/PA Officer and OGC.

5. Provide support to OIS in implementation of its communication plan for the FOIAinitiative.

Expected Product and Schedule

The expected output product to be delivered from the TF to the FOIA/PA group is a bundledpackage of information separated into one of the following four categories: Release in Full,Release in Part, Withhold in Full, and Referral to other agency. The information identified asIreleasable in full or part' will be made publically available in ADAMS, and available on the NRCpublic website as a single, bundled package.

Short-term Schedule Milestones

Collect phase 1 documents, excluding ET audio transcription - Friday, June 24, 2011

Transcribe ET phone recording (1-1/2 months) - Monday, July 18, 2011

Complete review and segregation, or referral of, phase 1 documents - August 8, 2011
