Having National Champions in these competitions is a testament to the hard work and dedication of the teams and the support of their utilities in training and practice. TWUA PRESIDENT: Departing Message Byron Hardin, CPM, Hardin & Associates Consulting, LLC

It is hard to believe that a year has passed and my term as President of TWUA has come to an end. As I reflect on the past year’s experiences and events, the one thing that stands out most is the professional and dedicated TWUA membership that I have had the privilege of meeting during my travels across the state. It was truly amazing and refresh-ing to meet so many professionals that demonstrate a “can do” attitude and are committed to protecting the public’s health and environment in their respective communities. This attitude was expressed by members all over the state and reaffirms my belief that TWUA is an organization made up of individuals that make a difference.

In regards to the direction of our organization, there are a lot of exciting activities taking place regarding improving our training and membership opportunities in the coming year. The current Manage-ment Committee, Executive Director and central office staff have been diligently working to ensure that TWUA is prepared to respond and meet the needs and issues facing our industry regarding regulatory changes, membership and training needs. Our organization will turn 93 years old this year and has undergone many changes and challenges throughout our history. Whatever the future holds for TWUA, I firmly believe that our members will continue to support the mission of TWUA, which is to “assist our members in providing improved services to mankind in their public health and environmental endeavors”.

I hope that everyone has enjoyed my articles this past year. My goal was to offer something new that focused on the members of our organization by highlighting their diversity, dedication and the many professional roles in our industry. It has been my honor and privilege to serve you this year as President, and I look forward to fulfilling my duties as Chairman of the Management Committee this coming year.

Closing on a reminder note, I hope everyone has made a strong effort to attend our 93rd Annual School (February 27- March 2, 2011) in the beautiful City of Corpus Christi, Texas. If you have not already registered please accept this as an open invitation to join us along with other members, exhibitors and mentors for this event.

Annual School is specifically designed to educate operators on all levels, Lab Technicians, Customer Service Reps, Pretreatment Professionals , Managers and Director.

In these economic times obtaining approval in the workplace for training and travel can sometimes create

obstacles, so if you missed the pre-registration for Annual School don’t panic, there is still time to register. TWUA is not in the habit of discouraging training participation. Even if you have to regis-ter on site, we welcome your participation and you are encour-aged to come join us and take part in this 93rd Annual School.

Hope to see you in Corpus. We are looking forward to another great event. The format of Annual School is the same as last year; with the Last Board Meeting, Opening Session and Reception all taking place Sunday evening beginning at 5:30 PM on the third floor of the Omni Bayfront Hotel.

All training classes are scheduled to begin at 8:00 AM on Monday morning and all classes will be at the Convention Center. TCEQ will be providing testing opportunities Wednesday afternoon beginning at 1:30 PM at the Convention Center. Shuttle buses will be provided from the Omni to the Convention Center – Monday through Wednesday at noon.

I would like to thank all those who responded to the Computer Training Survey. We are still in the decision making phase however, 90 % of the responses indicated TWUA should pursue this training concept.

We have a new survey available online please, take a few minutes and let us know your thoughts to help us improve the function of Central Office.

On a different note - we have been asked to stress and share with the operators that are planning to testing at any TCEQ sanc-tioned testing center – NO CELL PHONES are permitted in the testing area. This includes TWUA Annual School, TWUA Regional Schools, TCEQ Regional Testing locations, and Computer Based Testing locations.

You are NOT ALLOWED to use a cell phone as a calculator. Please leave your phones in your truck or secure them elsewhere; but

PLEASE DO NOT BRING CELL PHONES TO THE TESTING AREA. If someone is observed with a cell phone while tests are being ad-ministered – the exam will be collected. No recourse, No second chance, No excuses. With the camera and video functions stan-dard on phones today, TCEQ feels the opportunities for someone to use the cell phone for copying exam questions are too great.

Along these lines – exam fees must be paid at the time of testing or in advance but TCEQ will no longer allow operators to test and the state hold exam results until the fees are paid. TWUA has been informed that operators who forgot to get a check for exam fees or think they can use electronic payment on site will more than likely NOT be able to test. For more clarification on payment for testing please contact TCEQ at 512-239-6133.

One of the movies that I enjoy watching from time to time is" Saving Private Ryan" After watching this movie over the holidays, I started thinking about who might be the best known Texas veteran or most decorated Texan to serve in our military.

There are several to choose from but the person I am writing about was born in Kingston, Texas which is near Greenville or about 70 miles North East of the Dallas area. He was born June 1924 and fought in World War II. He became the most decorated United States soldier of the European Theatre.

This young man was one of 12 children and raised on a poor share croppers farm. In the fifth grade he had to drop out of school to help his family, after his father abandoned them. He worked for a dollar a day plowing and picking cotton when anyone would hire him.

He became very proficient with a rifle and hunting game since this was all the meat his family would have. He would later say “if I missed what I was shooting at, my family did not eat”. His mother died when he was 15 and he and his oldest sister made the difficult decision of placing his youngest three siblings in an orphanage to ensure their care.

With the help of his sister, he lied about his age and enlisted in the military when he was 17. He tried to join the Marines, Paratroopers, and Navy but was turned down for “being too short and slight of build”. He was only 5’ 5” and weighed 110 pounds. The

Army finally gave him a shot and sent him to Basic Training. The army officers tried to make this young man a cook or some other support personnel but, he would have no part of it. After Basic Training he was sent to Advanced Infantry Training.

This young man was a tenacious fighter and on many occasions almost single handedly took on the enemy. In one fight, his best friend was killed by machine gun fire. This so enraged this young soldier that he advanced on the machine gun nest killing the two german soldiers and turning the machine gun on the enemy.

On another occasion he used a .50 caliber machine gun from a burning enemy tank to hold off a squad of German soldiers for more than an hour. The official citation says he and his unit were attracted by 6 tanks and waves of enemy infantry. He ordered his men to retreat and he remained and continued to give firing coordinates to the US artillery. The citation goes on to say that this young man jumped on a burning tank and used the .50 caliber machine gun to hold off the enemy for more than an hour. He is credited with destroying 6 tanks and killing and wounding more than 240 enemy soldiers as well, as capturing many more all while being shot in the leg.

He was wounded several times from rifle fire and shrapnel from mortar rounds but as soon as he was able, he would return to active duty. He achieved the rank of Major and for his bravery he was awarded the - Congressional Medal of Honor, Distinguished Service Cross, Two Silver Stars, The Legion of Merit, Two Bronze Stars, Three Purple Hearts, Oak Leaf Clusters, and a host of lesser known medals. Sometime when you have a little time, Google Audie Mur-phy Awards and Honors – it is quite impressive.

Audie Murphy would go on to become a national celebrity. He was on the cover of Life magazine in July 1945. He became a writer, a country and western song writer, and a movie star. His autobiography – “To Hell and Back”, became a national best seller and in 1955 a movie was made with Audie Murphy staring himself. This film was the biggest hit of the studio and held the record as

the company’s highest grossing film until 1975 when Jaws was released. Audie Murphy starred in 44 films, 33 of which were westerns.

Audie Murphy was killed in a private plane crash in 1971. He is buried in the Arlington National Cemetery. His grave site is the second most visited, after that of President John F. Kennedy. Audie Murphy before his death had requested that his head stone remain plain and inconspicuous, “like that of an ordinary soldier”.

So some will ask, what does this story have to do with Water or Wastewater? For me this is an amazing story about over-coming adversity and remaining focused on achieving goals. Instead of assuming his current situation would dictate his life Audie Murphy applied himself and changed his circumstances. Operators and those desiring to become operators have the same opportunity today. If you are not happy and content with your current situation; start applying yourself. Study and advance through the state licensing program. There is a tre-mendous need for operators but particularly those with a B or higher license. You may have to study harder and longer than someone else, but it all comes down to – how bad do you want to change things and how committed are you to your goals? S

Remember – We do not need all the operators in Texas to be a member of TWUA – JUST YOU ! ! !

PES NEWS: A Look at the Decade and the Future By Maurice Akech, City of Dallas Assistant Manager Pretreatment Operations Water Dept.

As we start 2011, the TWUA (Texas Water Utilities Association) Pre-treatment and Environment Section (PES) wishes all pretreatment professionals a Happy New Year and continued success in managing their pretreatment programs. Cities with established pretreatment programs have worked successfully for many years to implement new regulations and improve the quality of their wastewater discharges. During the last decade, pretreatment programs have evolved with new regulations coming into force, experienced personnel retiring and Publicly Owned Treatment Works (POTWs) grappling with the challenges in treating new emerging pollutants.

These are the complexities we face now and those we will have to address in the new decade. In 2010, many pretreatment programs had a busy year dealing with issues such as pretreatment audits, implementing the new streamlining rules, and updating Technically Based Local Limits (TBLLs). This year promises to be yet another busy year for POTWs with several pretreatment programs in various stages of implementing new streamlining rules, and in updating TBLLs, as well as facing audits.

Over the years, pretreatment programs have been losing experienced personnel who have either retired or left for other fields of work through promotion or change of jobs. These changes in personnel had a major impact on the programs where new personnel, without pretreatment experience, were being recruited and had to go through a steep learning curve to learn about pretreatment. In order to maintain qualified and experienced personnel, pretreatment programs had to offer continu-ous training, sharing of knowledge and mentoring. Training offered through TWUA has been invaluable in providing pretreatment educa-tion for pretreatment personnel at regional and state level. The TWUA training covers both basic and advanced pretreatment and has been beneficial to both new and experienced employees, enabling them to share experiences. PES will continue to encourage pretreatment pro-grams to send their employees to either the annual, regional or to the State workshops. The next TWUA Annual School will be held in Corpus

Christi from February 27 to March 2, 2011.

The new streamlining rules were a significant change in pretreatment regulations in the last decade. The rules enacted on Oct. 14, 2005, identi-fied the 13 rule changes that were more stringent than the provisions in 40 CFR Part 403, which required changes to the POTW pretreatment program. These rules necessitate pretreatment program modification and the implementation of the required changes. Texas is implement-ing pretreatment streamlining rules and/or updating the TBLL. Some pretreatment programs have implemented the streamlining rules and have updated their TBLL while others are in the process of implementing the streamlining rules and updating their TBLL to bring their programs in line with the new pretreatment regulations. Additional pretreatment regulations passed in the last decade include the following effluent guidelines;

(1) 40 CFR 432 - Effluent Limitations Guidelines and New Source Perfor-mance Standards for the Meat and Poultry Products Point Source Category passed on 09/08/2004 and became effective 10/02/2004.

(2) 40 CFR 437 - The Centralized Waste Treatment Point Source Category passed on 12/22/2000 and became effective 01/22/2001.

(5) 40 CFR 451 - Concentrated Aquatic Animal Production Point Source Category passed on 08/23/2004 and became effective 09/22/2004.

Other issues which have become known as new pollutants of concern dur-ing the last decade are the emerging contaminants. There has been a lot of concerns and research conducted in evaluating the effects of emerging contaminants on the environment. Their effects on the environment are still being studied and long-term impacts on the development and behavior of aquatic life forms is a major concern. Traces of emerging pollutants have been found in drinking water from both ground and surface waters. Examples of these types of chemicals include phthalates, polybrominated diphenyl ethers (PBDEs), perfluorinated compounds, pesticides, pharmaceuticals and personal care products such as toiletries, sunscreen agents, lotions, cosmetics and shampoo. As we begin 2011 and move into the new decade, we will be faced with challenges of dealing with these emerging pollutants and finding ways to treat and remove them from our drinking and wastewater to address the public concernsS

One of the issues that TWUA has been wrestling with for the past few years is related to tracking members by using social security numbers. The association, management and staff have shared your concerns as they relate to Identity Theft.

Up until recently the database that TWUA was using would not handle the addition of another data field such as for TCEQ Operator License numbers This database limitation is about to be resolved with a conversion to another database.

Within the next couple of months TWUA will be converting all social security numbers to TCEQ Operator License numbers. This will mean that operators will need to memorize another number or have access to this information when they register for TWUA Training; however, this should provide one more level of security.

Our goal is to report hours from all TWUA functions using this operator licensing information. The state will continue to accept social security information as a means of reporting and if you as an operator are not concerned about identity theft related issues and want to continue to provide your social security number - - TWUA will continue to use that information; however, we are discouraging this practice.

For new hires that do not hold a state operator license you will have to provide your social security number until such time as you are issued a TCEQ Operators License number.

From the TCEQ perspective if you have multiple operator licenses, it does not matter which license number you provide. All training re-ported under your specific license number will be credited. In other words, if you are a dual license holder and provide a water license number but attend a wastewater training event – the training credit will be credited appropriately using the one license number.

TWUA will in all likelihood, continue to maintain a data field with social security numbers so that we will have a second way to confirm someone’s identity but this information would only be used inside Central Office and not released to any Region or District.

Is this alphabet soup? Yes!! These are letters representing some of the governmental entities that regulate safety in the state of Texas.

HB 7 was passed during the regular session of the 79th Legislature. This sweeping legislature abolished the “Texas Workers Compensation Com-mission” (TWCC). It was designed to reduce duplication of function and achieve economies of scale. This legislation changed the name of the TWCC to “Texas Workforce Commission” (TWC). And put it under the Texas Department of Insurance (TDI). This same legislature also consolidated Information Technology Services when it passed HB 1516. You can access their website at www.TDI.state.tx.us. One of the department headings on their home page is “Workers Compensation”.

Where does the TDI get their funds? They calculate and set rates to be charged. The Texas Comptroller of Public Accounts (CPA) bills and collects the taxes. The TWC Charges different entities according to their accident rate. These funds are used for overhead expenses and safety consultations.

Another source is federal grants. One such grant comes from OSHA which supports the states OSHCON consultants. Is this because Texas conducts consultations, but must refer potential safety violations to OSHA for enforcement?

The Occupational Safety and Health Administration (OSHA) provides compliance assistance to help employers understand safety regula-tions and general safety issues, similar to the activities performed by the Division of Worker’s Compensation OSHCON consultants. However, OSHA does not provide consultative services on-site to employers in the same manner as the OSHCON program. The OSHCON program is partially funded by a grant from OSHA to perform these services and to supple-

ment the OSHA efforts related to workplace safety. If your municipal-ity joins the OSHCON program they will provide free expertise and training to help you meet OSHA requirements with no citations for the first year.

TDI coordinates with federal agencies to administer grants that fund special TDI activities. Recent federal grants include:

A.) U.S. Department of Labor (DOL of which OSHA is a part) – TDI annually receives three grants from this entity. The purpose of the grants are to 1) conduct surveys on occupational injuries and illnesses and gather information on fatal occupational injuries, 2) provide consultation services identifying and

controlling workplace safety & hazards and improving workplace safety and health programs, and 3) provide occupational injury and illness and employment data to OSHA.

B.) Department of Health and Human Services – From the spring of 2001 to Febru-ary 20007, TDI participated in a federally funded State Planning Grant (SPG) program designed to help participating states develop strategies to significantly reduce their num-

ber of uninsured citizens and develop options for expanding health insurance to uninsured Texans.

C.) Department of Homeland Security – From April 2004 to August 2005, TDI received a one-time grant to disseminate materials to the public regarding effective methods of fire safety and prevention.

D.) Changes in the federal budget could impact the ability of the agency to fulfill OSHA and BLS grant requirements, especially if appropriations are diminished. Changes in federal and state safety laws could impact how DWC interacts with employers and what information TDI provides to them.

What does all of this mean? TDI gets their money from State Workers Compensation Premiums and Federal Grants. The TDI has a free OSHCON program which helps municipalities follow OSHA regulations with no citations for the first year. The Non-compliance issues for others are referred to OSHA for enforcement as stated in the TDI Self-Evaluation report of August 2007. S

The U.S. Department of Health and Human Services (HHS) and the U.S. Environmental Protection Agency (EPA) today are announcing important steps to ensure that standards and guidelines on fluoride in drinking wa-ter continue to provide the maximum protection to the American people to support good dental health, especially in children. HHS is proposing that the recommended level of fluoride in drinking water can be set at the lowest end of the current optimal range to prevent tooth decay, and EPA is initiating review of the maximum amount of fluoride allowed in drinking water.

These actions will maximize the health benefits of water fluorida-tion, an important tool in the prevention of tooth decay while reducing the possibility of children receiving too much fluoride. The Centers for Disease Control and Prevention named the fluoridation of drinking water one of the ten great public health achievements of the 20th century. 

“One of water fluoridation’s biggest advantages is that it benefits all residents of a community—at home, work, school, or play,” said HHS Assistant Secretary for Health Howard K. Koh, MD, MPH. “Today’s announcement is part of our ongoing support of appropriate fluoridation for community water systems, and its effectiveness in preventing tooth decay throughout one’s lifetime.” 

“Today both HHS and EPA are making announcements on fluoride based on the most up to date scientific data,” said EPA Assistant Administrator for the Office of Water, Peter Silva. “EPA’s new analysis will help us make sure that people benefit from tooth decay prevention while at the same time avoiding the unwanted health effects from too much fluoride.” 

HHS and EPA reached an understanding of the latest science on fluoride and its effect on tooth decay prevention and the development of dental fluorosis that may occur with excess fluoride consumption during the tooth forming years, age 8 and younger. Dental fluorosis in the United

States appears mostly in the very mild or mild form – as barely visible lacy white markings or spots on the enamel. The severe form of dental fluorosis, with staining and pitting of the tooth surface, is rare in the United States.

There are several reasons for the changes seen over time, including that Americans have access to more sources of fluoride than they did when water fluoridation was first introduced in the United States

in the 1940s. Water is now one of several sources of fluoride. Other common sources include dental products such as toothpaste and mouth rinses, prescription fluoride supplements, and fluoride applied by dental professionals. Water fluo-ridation and fluoride toothpaste are largely responsible for the significant decline in tooth decay in the U.S. over the past several decades.

HHS’ proposed recommen-dation of 0.7 milligrams of fluoride per liter of water replaces the current recommended range of 0.7 to 1.2 milligrams. This updated recommendation is based on recent EPA and HHS scientific assessments to balance

the benefits of preventing tooth decay while limiting any unwanted health effects. These scientific assessments will also guide EPA in making a determination of whether to lower the maximum amount of fluoride allowed in drinking water, which is set to prevent adverse health effects.

The new EPA assessments of fluoride were undertaken in response to findings of the National Academies of Science (NAS).  At EPA’s request, in 2006 NAS reviewed new data on fluoride and issued a report rec-ommending that EPA update its health and exposure assessments to take into account bone and dental effects and to consider all sources of fluoride. In addition to EPA’s new assessments and the NAS report, HHS also considered current levels of tooth decay and dental fluorosis and fluid consumption across the United States.S
