the law says now: Discharge of indebtedness income from qualified principal residence debt, up to a $2 million limit ($1 million

for married individuals filing separately) is excluded from gross income. Under pre-Act law, this exclusion didn’t apply to any debt discharged after 2012.

New Law The 2012 Taxpayer Relief Act extends this exclusion for one year so that it applies to home mortgage debt discharged before 2014. (Code Sec. 108(a)(1)(E), as amended by Act Sec. 202)

Oh the joys of a maturing community. Just like our ever-aging bodies, our properties

require vigilant cleaning, spackling and trimming to keep from looking like the neighborhood version of that old guy with the scary ear hair.

One of my Anthem friends (yes, I actually have two or three of those) phoned the other day about a tree whose root had migrated across his lawn and under the wall shared with his neighbor… who may or may not still be his friend. The root was beginning to lift the wall footing, causing the wall to heave. What to do, what to do...

Barring the imminent invention of a time machine, my advice was woefully limited. Once the wall has begun to move, we are dealing with a minimization of damage, as opposed to an ounce of prevention. Hindsight would have told him (or the previous homeowner) to choose a tree with less invasive roots, and to plant it far away from anything he doesn’t want pushed around, (e.g., a patio, a sidewalk, a house).

The best advice I could give at this point was to cut the root to stop it from growing, leave it in place, keep an eye on any other buggers that might decide to creep that way, and consider going all George Washington on that tree. Removing the root completely will likely cause the wall to sag. Filling the cavity with dirt or concrete will likely cause movement when everything settles. Chances are, no matter what he does, in a few years he’ll be looking at rebuilding that section of wall.

Not the answer he wanted to hear, but, hey, I’m no miracle worker. If I were, I’d have just invented the time machine. io

There’s a growing problem in the greater Anthem area.

Roots from those 15-gallon trees planted a decade ago in relatively small yards, defined by block walls, have already begun to heave walls, push patios, crack concrete and invade sewer mains.

And, the destruction has just begun. Certified arborist Rick Cober said trees in the area are still young and could easily double or triple in size, and roots can extend from the

trunk two-and-a-half to four times beyond the drip line. Anthem Parkside residential guidelines require two trees planted in the typical backyard, planted 5 feet from structures and property lines. But, homeowners are beginning to discover 5 feet is not enough.

“There really is no [standard] safe distance from any masonry feature to plant a tree,” Cober said. “You can plant the tree as far away as possible, but what it comes down to is planting the right tree in the right place.”

invasive roots planted within 5 feet of a concrete walk or wall is required to have root barriers, according to the guidelines. A root barrier is a sheet of thick plastic about 18-inches tall, buried in a trench around the tree. But its efficacy is questionable, Cober said, as roots can go under or over the barrier. “It can work when trees are very young and small, but it won’t help in the long run.”

Tyler Ringe of Proskill Plumbing has repaired four sewer mains in the previous three months, one of which involved ripping up the entire driveway. “It’s

So what is a homeowner to do? Be proactive. Survey trees that are improperly planted and consider removing them before damage occurs. Homeowners and prospective buyers might consider an inspection of the sewer main, suggested Ringe, who inspects the sewer by snaking a camera to reveal possible root invasion. The cost for service is around $200,

Ringe said, but could potentially save a homeowner up to $10,000 or more in future repairs, especially if a driveway is involved. Another tip: Ringe suggested replacing concrete with pavers to avoid costly future repairs.

Work TogetherIf a neighbor’s tree is causing the

problem, bring it to their attention in a friendly conversation. Trees can be a point of contention between neighbors and can get either one in legal or financial trouble if not handled gracefully.

Arizona case law allows a homeowner to trim branches or roots of a neighbor’s encroaching tree. However, if your trimming damages the tree, you may be liable for the cost of replacing or healing the tree. If a tree is damaging a neighbor’s property, the

tree owner may be responsible for the damage.

“If your roots grow into someone else’s soil, you have trespassed. Arizona case law says if the tree isn’t poisonous and the roots don’t do any damage, you haven’t done anything wrong. But if the roots do damage, you’ve trespassed and caused damage for which the landowner is entitled to relief,” said Kimberly Garde of The Garde Law Firm. This includes damage to block walls, pools, patios and driveways.

Cober suggests calling a certified arborist to assess the issue before doing anything. An arborist, as opposed to a landscaper, can determine the potential structural damage or safety hazard a tree might cause. Landscapers usually work with flowers, shrubs, grass and the overall design and maintenance of a yard. Arborists are specially trained to work with trees. io

A newly dedicated Bill of Rights Memorial graces a sweeping walkway at Wesley Bolin Plaza, Arizona’s “National Mall.” And, with

Feb. 14 being Arizona’s 101st birthday as well as the official end to our state’s centennial celebration, a trip down to Wesley Bolin Plaza and the state capitol is an appropriate way to spend a cool February day.

It was Dec. 17 (National Bill of Rights Day), 2012 when Arizonans of all political persuasions came together for the unveiling of the first of 50 memorials that someday will grace the grounds of every state capitol of the union.

It was comedian Chris Bliss who, in 2005, came upon the idea from one of his comedy routines for a series of 50 Bill of Rights memorials. He used his comic ways to influence friends, foundations and

corporations and began to raise the necessary private funds for these uniquely American structures.

In 2006, Arizona legislators, in a rare show of cooperation, unanimously passed the necessary bills to make Wesley Bolin Plaza the home for Arizona’s memorial. Bliss now had the funding and the political go-ahead to move forward with what had become his own “Power of One” dream.

He found a stonecutter in Austin, Texas: Artist Joseph Kincannon was commissioned to make the Arizona monument. Kincannon chose 10 limestone monoliths of various shapes to reflect the unique beauty of the

Arizona desert.

The starkly beautiful 10 standing stones bearing the precious words of our Bill of Rights have now joined the other 29 memorials found at Wesley Bolin Plaza. The 30 memorials reflect the historic and/or most significant events of human sacrifice that has shaped the history of Arizona and the United States of America.

At its Jan. 28 meeting, Daisy mountain Fire Department Board agreed to auction ad space on six of its vehicles in an effort to generate revenue to offset a decrease in tax revenue.
