DEAR MEMBERS :
The holiday season is an appropriate time to highlight thecontributions the FCBA Foundation makes to the Washingtoncommunity, and at the same time explain how the Foundation’sactivities benefit the Association and its members.
Last spring the Foundation awarded $104,000 in collegescholarships to nine students at four DC public high schools.This is up from $82,000 awarded to seven local students in2003. As is evident from the video produced each yearfeaturing the scholarship winners, this program has been the factor that has made itpossible for many of the recipients to attend college.
Much of the scholarship money was raised through the purchase of sponsored tablesat the Chairman’s Dinner. This year the total proceeds to the Foundation from thatevent were $39,500. The Foundation’s annual golf tournament, the Charity Auction,plus corporate and individual giving have increased the Foundation’s total budget to$230,000.
The Foundation provides stipends for law students who take summer internships atthe FCC or other government entities. This past summer five law students received atotal of $15,700 through this program. A total of $10,600 was awarded to four internsfor the summer of 2003. This program fosters interest in the communications lawfield, and helps broaden the reach of local internship opportunities to students fromlaw schools outside the DC area.
The Foundation also sponsors monthly participation by our members at both Martha’sTable and McKenna’s Wagon, volunteer organizations that serve Washington’shomeless population. And, the Foundation has sponsored a holiday gift drive underwhich over the past nine years FCBA members and friends have donated thousands ofdollars worth of gifts to 1,200 people in the Washington area.
This year’s Charity Auction, a joint venture with the Young Lawyers Committee, raised$70,000, all of which is going to the Charitable Coalition for Children with Cancer, aWashington,D.C.charity. And of course,much of the giving done for the Charity Auctionis done by individual FCBA members and their employers,who each year come up witha wide range of valuable prizes that produce higher and higher bidding totals.
These charitable programs help define the FCBA and add significantly to our culture.Sponsoring college scholarships for needy students manifests the care our membershave for the Washington community. And, the McKenna’s Wagon, Martha’s Table andholiday gift drive programs afford community service opportunities that go beyondgiving money. Our members’ support of all of these Foundation programs makes usmuch more than just another trade organization. You might say the Foundationprovides a different dimension, if not a changed identity for the FCBA, for ourcharitable side promotes a positive feeling about the association among our members.This, in turn, makes the association cohesive and attractive to volunteers. In this way,the Foundation not only provides meaningful service to the community, it also fostersthe very volunteerism on which the FCBA depends to mount an ever-increasingnumber of events, whether they be charitable, educational or social. We thank GregVogt, this year’s Foundation board chair, his fellow trustees and the Foundation’svolunteers, for helping to move all of us forward.

The transformation oftelecommunications from an analog,narrowband network optimized for voiceto a digital, broadband networkoptimized for data traffic has created amyriad of challenges for businesses,policymakers, and academics alike. Inenacting the Telecommunications Act of1996, Congress instituted a regulatorymodel based on the traditionaltechnology used to deliver voicetelephony-and largely did not grapplewith the implications of the Internet.Thisfailure, along with the challenges ofreforming the legacy model of spectrumpolicy and “re-missioning” the FederalCommunications Commission, have ledmany to suggest that it is time to re-writethe Telecom Act.
This conference will examine the issuesleft largely unaddressed by the TelecomAct: how to grapple with the advent ofbroadband and Voice over InternetProtocol (VoIP); how to reform spectrumpolicy; and how (and whether) the FCCcan re-adjust its institutional mission.With a thoughtful array of leaders fromacademic, industry, and governmentalcircles, we believe that this conference
will continue the Silicon Flatirons’tradition of encouraging “bolderthinking” in Boulder. Like itspredecessors, the proceedings from thisconference will be published in theJournal on Telecommunications and HighTechnology Law.

Volunteer for Breadfor the City onFebruary 12Mark your calendars now — nextmonth is the FCBA volunteer date atthe Bread for the City legal clinic,Saturday, February 12. It is a greatopportunity to spend a few hours andget so much more in return. Clients areappreciative and you can actually learnsome practical advice and talk to clientswho are every day people.
The FCBA’s Young Lawyers Committeeorganizes volunteers to spend threehours once a quarter helping lowerincome individuals through a clinicsponsored by the DC Bar. We co-volunteer with the DOJ AntitrustDivision. Attorneys receive a half-houroverview/orientation beginning at 9:30a.m. over bagels and juice. Volunteersare expected to assist clients only
during the time they are at the clinic.
No special legal knowledge is needed— attorneys generally need to keep aneye out for potential legal issues whileusing their common sense to solve amyriad of questions and make referralsto other organizations. Experiencedattorneys on-site will assist FCBAattorneys and other volunteers withany questions. Previous attendees havedescribed this as “the most satisfyingvolunteer experience I’ve had as anattorney.”
You must either be a member of theDC Bar, have an application pending tothe DC bar, or be an employee of thefederal government to provide advice.Those who are not DC bar members,paralegals and law students are needed,however, to provide intake and triage.Law students can have the opportunityto sit in on advice sessions. Dress iscasual,but respectful.Bring a pen.

Chairman’s DinnerDraws a CrowdThe International Ballroom of theWashington Hilton was jammed withover 1,550 FCBA members and guests onDecember 2nd for the 18th Annual FCCChairman’s Dinner honoring FCCChairman Michael K. Powell.
This year’s special guests included FCCCommissioners Kathleen Abernathy,Kevin Martin, and JonathanAdelstein, as well as Ambassador DavidGross and Assistant Secretary MichaelGallagher.
After being introduced by FCBAPresident, Harry Martin, the Chairmangave a lively speech about some of theindustry’s current events, as well as,recent FCC decisions. Following hisspeech, the Chairman prompted the now“traditional” video.This year’s theme wasa mock version of Bravo’s “Inside theActor’s Studio” show where ChairmanPowell was interviewed by James Lipton.
Special thanks to co-chairs MargaretTobey, Jennifer Warren, and ClarkWadlow, whose efforts helped make thedinner an overwhelming success.
The proceeds of the FCBA’s 15th AnnualCharity in the amount of over $70,000was announced by FCBA President,Harry Martin. This year’s auctionrecipient was The Charitable Coalitionfor Children with Cancer. Martin alsoannounced that the FCBA Foundationwould receive over $39,500 for theirscholarship and internship fund from theproceeds of the sponsor’s tables sold atthe dinner.

2004 CharityAuction a SuccessThe 2004 Charity Auction held onNovember 18, 2004, was the mostsuccessful to date, raising well over$70,000 for The Charitable Coalitionfor Children with Cancer.
The Charitable Coalition forChildren with Cancer is comprised offour non-profit organizations with theshared goal of meeting the needs ofchildren with cancer and their families inWashington, D.C. The four organizationsthat form this collation are: Teardrops toRainbows; the John QuadrinoFoundation; The Inova Fairfax Hospitalfor Children Pediatric Oncology Fund;and The Make-A-Wish Foundation. These
organizations provide financial andemotional support to children withcancer and their families through avariety of programs and services.
The winner of this year’s Grand RafflePrize, a Sony flat screen television, wasKevin Reed of Dow Lohnes &Albertson,PLLC.

Chairman Robert E.Lee Scholarship andInternship Fund forLaw StudentsIn 1993 the Foundation established aScholarship and Internship Fund inmemory of former FederalCommunications Commission (FCC)Chairman Robert E. Lee, who passedaway in April 1993 after serving on theFCC for almost thirty years. ChairmanLee served as a Commissioner of the FCCfor 28 years and was instrumental in theearly development of color television,among other contributions to federalcommunications policy.
For the twelfth consecutive year, theFederal Communications Bar AssociationFoundation will award stipends to lawstudents from its Chairman Robert E. LeeScholarship and Internship Fund. In2005, the Foundation will award at leastfour $3,000 stipends to law studentsemployed as unpaid summer interns inpositions with the FCC and othergovernment Agencies or entities withjurisdiction over the communicationsindustry (i.e., broadcasting, cabletelevision, telephony, satellites andinformation technology).
Applicants will be selected on the basisof: (1) having secured or having pending,an unpaid summer position (internship)in communications with governmentoffices, (2) a demonstrated interest in thecommunications field, (3) dependenceon financial assistance in order to acceptan unpaid internship in a governmentagency involved in communications, and(4) involvement in community activities.Applications for a Lee Fundscholarship will be posted on thefront page of the FCBA Website as ofJanuary 10, 2005 - www.fcba.org.

For several years now,the FCBA has been providing volunteersto Martha’s Table and McKenna’s Wagon.These organizations rely on the goodwork of our members each month, sograb a friend, colleague or familymember and join your fellow FCBAvolunteers!
FCBA volunteers will meet to assistMcKenna’s Wagon on Sunday,January 23. Volunteers will meet onSunday afternoon at Martha’s Table beforethey depart with the van of food toselected locations. On Sunday, January 30,members of theFCBA will help prepare meals for thehomeless at Martha’s Table in theDistrict of Columbia. Martha’s Table feedshundreds of hungry, homeless adults andchildren on the streets of Washingtondaily, through its mobile soup kitchen.Children and friends are also welcome.Wewill begin at 10:00 am and work until 1:00pm. Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW, inthe District, near the intersection of 14thand U Streets. On-street parking isavailable. Volunteers are asked to bringsandwich fixings (bread and sandwichmeat) with them, as the center often runsout of donated food. Future dates includeFebruary 27 and March 27, so mark yourcalendars now. Chip Pickering hails from Laurel,Mississippi. Currently serving his fourthterm representing Mississippi’s ThirdDistrict, he was first elected to Congressin 1996, at the young age of 33. Chipserves as Vice Chairman of the HouseEnergy & Commerce Committee andalso serves on the AgricultureCommittee. He is assistant majority whipin the House of Representatives.
Before coming to Congress, Chippioneered the first full-time presence bya Southern Baptist missionary behind theIron Curtain in Budapest, the capital ofthen communist Hungary. PresidentGeorge H. W. Bush appointed Pickeringto the United States Department ofAgriculture to bring economic anddemocratic reform to Eastern Europe andthe Soviet Union.
Later, as a member of Senate MajorityLeader Trent Lott’s staff, and as aprofessional staff member on the Senate
Commerce Committee, Chip helpedshape the landmark TelecommunicationsAct of 1996.
Chip holds a bachelors degree inbusiness administration from theUniversity of Mississippi and a mastersdegree in business administration fromBaylor University. He and his wife Leishahave five sons: Will, Ross, Jackson, Asher,and Harper.They reside on a small farmin rural Madison County.

Nominations Openfor 2005 ElectionsPursuant to Article V, Section 20 of theAssociation’s Bylaws, the FCBA’sNominations Committee is beginning theprocess of preparing the ballot for the2005 annual election. Positions to befilled are: President-Elect; Secretary;Assistant Secretary; Assistant Treasurer;Delegate to American Bar Association;Chapter Representative to the ExecutiveCommittee; three (3) members of theExecutive Committee; three (3) membersof the Nominations Committee; and five(4) FCBA Foundation Trustees.
