Australian Industry Standards Limited (AIS)

AIS is a Skills Service Organisation (SSO) that undertakes professional activities for the following IRCs:

• Aviation • Corrections • Electrotechnology • ESI Generation • ESI Transmission, Distribution and Rail • Gas • Maritime • Public Safety • Rail • Transport and Logistics • Water.

AIS also provides technical, operational and secretariat services to enable IRCs to undertake industry engagement and to develop training packages and other products.

This submission puts forward a Case for Endorsement for the TLI Transport and Logistics Training Package Release 3.0. It includes the following units of competency that have been developed in direct response to a request by the National Heavy Vehicle Regulator (NHVR) to support the fatigue management accreditation process.

The Australian Industry and Skills Committee (AISC) requested the preparation and development of three new units of competency to be published in the TLI Transport and Logistics Training Package:

B. DESCRIPTION OF WORK AND REQUEST FOR APPROVAL

1. Description of work undertaken and why

On behalf of the Transport and Logistics IRC, AIS has prepared and developed three new units of competency for the TLI Transport and Logistics Training Package Release 3.0, based on the following existing three units of competency on fatigue management:

• TLIF2010 Apply fatigue management strategies • TLIF3063 Administer the implementation of fatigue management strategies • TLIF4064 Manage fatigue management policy and procedures.

The three new units of competency have been developed to support the NHVR fatigue management accreditation process. Currently, industry is allowed to operate under a National Heavy Vehicle Accreditation Scheme (NHVAS) that allows drivers to drive additional hours per day using the accreditation scheme. The current training package units of competency that are being used by the regulator to address fatigue management were not designed for NHVR accreditation. Safety and non-compliance with the current accreditation system are the key drivers for this work. The development of units of competency specifically aligned to the NHVR's fatigue management accreditation requirements will ensure that the regulator and industry have greater certainty that workers can demonstrate the knowledge and skills to operate safely and compliantly. It will also enable transport businesses to meet the training requirement for the NHVAS. The units currently being used for fatigue management accreditation do not fully address the skills and knowledge requirements for NHVR accreditation scheme. The NHVR fatigue management accreditation supports increased transport efficiency, while improving road safety. At the Technical Advisory Committee (TAC) meeting, it was agreed that the three new units of competency will be packaged in the following qualifications:

2. Decision being sought from the AISC

This submission puts forward a case for the endorsement of three new fatigue risk management units that have been developed in accordance with the Training Package Products Policy, the Standards for Training Packages 2012 and the Training Package Development and Endorsement Process Policy, and the inclusion of these three units in the general elective units for five qualifications.

Evidence of consultation with states and territories, and evidence that the views of all key stakeholders have been considered is also provided in this document.

This Case for Endorsement is approved by the Transport and Logistics IRC and is submitted to the AISC through the Department of Education and Training for AISC consideration.

C. EVIDENCE OF INDUSTRY SUPPORT

1. IRC written evidence of support

The Transport and Logistics IRC members endorsed the TAC recommendation to put forward the fatigue risk management units of competency and relevant revised qualifications to the AISC for endorsement. The IRC members support the draft units and the analysis of the anticipated impact of the change on the industry and on the vocational education and training (VET) sector. Written evidence of this support was obtained on 28 February 2017.

2. Evidence of consultation with all relevant stakeholders

During development of the three fatigue risk management units of competency, AIS used the following communications strategies to ensure relevant stakeholders were consulted:

• Face-to-face meetings, phone, video/teleconference meetings and emails to key industry stakeholders

• IRC member communications to their relevant industry networks using various methods • Emails to State and Territory Training Authorities (STAs) and VET regulators • Email alerts on project progress to stakeholders providing project information • Information about the project, progress updates and draft materials posted on the AIS website

throughout the life of the project • TAC meetings.

3. Evidence that states/territories have been actively engaged and provided advice

State and territory industry stakeholder views were sought and all feedback was presented to TAC members during the development of the three fatigue risk management units of competency. All state and territory feedback was considered during the consultation periods and the draft materials were prominent on the AIS website project page for sector-wide consultation.

State and territory industry stakeholders were advised that there were no components proposed for deletion from the National Register and advice was provided on the possible impact of implementing the proposed training package components.

4. Advice about alternative approaches explored

TAC members were aware of the minimum standard arrangements that IRCs are to adhere to. The members did discuss and consider future technology and technical equipment available to industry. No alternate view or alternative arrangements were proposed to the TAC members by industry stakeholders that would have better suited the needs of their industry or the project outcomes.

5. Report/s by exception

There is no report by exception for the TLI Transport and Logistics Training Package Release 3.0 being submitted to the AISC.

6. Evidence that key stakeholders (including training providers) are aware of the expected impact of the changes

Key stakeholder views were sought and all feedback received was presented to TAC members during the development of the three fatigue risk management units of competency. Stakeholder feedback was considered and discussed at TAC meetings and all decisions made at these meetings were documented.

As part of the AIS communication strategy, all key stakeholders were regularly informed of the anticipated impact of the changes during the consultation periods.

There is no training package component proposed for deletion from the National Register being submitted to the AISC.

D. INDUSTRY EXPECTATIONS ABOUT TRAINING DELIVERY

1. Advice about industry’s expectations of training delivery

Industry priorities and expectations

The proposed fatigue risk management units have been developed to address NHVR requirements for when an enterprise is applying for accreditation under the NHVAS, operating within the road transport sector.

The industry expectation is that people assessed as competent in these three units will be equipped with the appropriate skills and knowledge to operate effectively, efficiently and compliantly in a road transport enterprise that operates under the NHVAS.

Due to the geographical issues faced by industry there is also an expectation that these units of competency can be delivered online and via face to face. Training providers will focus on providing quality training and assessment that meets the assessment requirements identified in the units.

Via the consultation process, wider industry feedback has ensured delivery and assessment components have been thoroughly examined and amended to meet industry requirements.

It is also expected that training provided by registered training organisations (RTOs) will address the identified need and that individuals will attain skills that are relevant and transferable across industries and enterprises, by providing quality training and assessment that is consistent and meets the outcomes identified by the regulator.

Specific training delivery strategies requested by industry are listed in the Companion Volume Implementation Guide (CVIG).

The new units of competency are able to be delivered by all RTOs who have the qualification/s they are packaged in on their scope of registration or who have the new individual unit/s of competency added to their scope of registration.

However, if an RTO wishes to deliver the units of competency for NHVR accreditation purposes, the RTO must first be approved by the NHVR. The approval process for RTOs to deliver these units of competency for accreditation purposes will be administered by the NHVR.

RTOs who are not approved by the NHVR to deliver the units of competency on their behalf are still able to deliver the units for a qualification outcome or a Statement of Attainment outcome, just not for NHVR accreditation purposes.

Industry’s imperatives and timelines for implementation of the components

The timeline for implementation of the fatigue risk management units of competency will align with the NHVR’s finalisation of amendments to the current fatigue management accreditation process.

Reflection of contemporary work organisation and job profiles

With increasing costs within the road transport sector, the opportunity to operate higher productivity vehicles for longer periods assists industry to alleviate the rising costs of road transport distribution. Currently, the NHVAS is in place to assist in road safety, however there were identified gaps in the skills and knowledge of the current endorsed fatigue management units that did not meet the regulatory compliance and the safety requirements of drivers operating for the extended periods.

The development of the new fatigue risk management units ensures that road transport enterprise owners and schedulers are provided with the necessary skills and knowledge to operate compliantly within the NHVAS and to manage their duty of care.

Supporting movement of skills within and across organisations and sectors

The three new units of competency have been developed to support the NHVR fatigue management accreditation process, which allows enterprises to gain efficiencies; they have broad application across organisations and different workplace environments.

Consequently, other industry sectors may find the three units of competency applicable to their needs.

Credit arrangements existing between Training Package qualifications and higher education qualifications

There is currently no credit transfer arrangement between the proposed units of competency in the TLI Transport and Logistics Training Package and higher education qualifications.

2. Traineeships and apprenticeships

The proposed units of competency would be suitable for a traineeship or an apprenticeship – should these units /s be selected as an elective in a qualification that is used as a traineeship or apprenticeship.

A training provider’s training and assessment strategies and practices, including the amount of training provided, must be consistent with the requirements of training package/s and/or VET accredited courses and enable each learner to meet the requirements for each unit of competency in which they are enrolled.

E. IMPLEMENTATION OF THE NEW TRAINING PACKAGE

1. Advice about how Training Package components meet occupational and licensing requirements

The three new units of competency have been designed for specific job roles in the road transport sector to enable road transport enterprises to meet the NHVR accreditation requirements.

These units of competency were requested by the NHVR to provide the skills and knowledge to enable individuals and enterprises in the road transport sector to operate safely and compliantly within the NHVAS.

The relevant regulatory body, the NHVR, is supportive of the draft endorsed components due to their direct involvement in the development, consultation and validation processes.

The requirements of the accreditation scheme come from the Heavy Vehicle National Law (HVNL). The units of competency will be a mandatory requirement for enterprises and their staff if they are seeking accreditation under the NHVAS. To deliver and assess these units for ‘accreditation purposes’ RTOs will require to be approved by the NHVR.

2. Implementation issues of note and management strategy

Meeting the diversity of individual and enterprise needs

The three fatigue risk management units of competency outlined in this submission have been developed in consultation with organisations, regulators and individuals across a range of road transport industry sectors.

Stakeholders consulted were associated with a range of organisations, industry associations and the regulator, representing a wide variety of workplace and state and territory requirements and environments. This included the NHVR (the regulator) who provided specific advice and guidance around the HVNL in developing the final draft of the units of competency.

Supporting equitable access and progression of learners

The Equity Review undertaken for the three units of competency provides evidence that the draft endorsed components meet the requirements of flexibility and functionality. Access to training and mobility within and between industry sectors is supported by industry.

In each unit the assessment requirements state that ‘Assessment processes and techniques must be appropriate to the language, literacy and numeracy requirements of the work being performed and the needs of the candidate’.

Supporting learner transition between education sectors

There are no formal transition arrangements between the vocational education and training sector and the higher education sector for the units being submitted to the AISC.

3. Advice about implementation

Supporting implementation across a range of settings

The TLI Transport and Logistics Training Package Release 3.0 CVIG provides advice on implementation.

These units of competency can be delivered and assessed in the workplace or in a simulated environment. They support implementation across a range of settings by providing guidance on assessment that encourages assessment in a variety of contexts and applications. The units can be modified for distance-based learners and cultural appropriateness, and are suitable for the level of communication, language, literacy and numeracy capabilities of the work being performed.

Supporting sound assessment practice

Industry is committed to sound assessment practice that ensures assessment is fair and reliable and is evidenced by knowledge, skills and work performance that meet the agreed industry standard. This imperative is reinforced by the need to respond to technological change and to provide solutions to economy-wide issues.

As a minimum, assessors and assessment must satisfy applicable regulatory requirements, which include the Standards for Registered Training Organisations (current at the time of assessment).

Assessment processes and techniques must be appropriate to the language, literacy and numeracy requirements of the work being performed and the needs of the candidate.

The assessment requirements within the proposed units specify:

• Performance evidence • Knowledge evidence • Assessment conditions.

Evidence must demonstrate that the learner has successfully met the requirements of the elements and performance criteria in the units.

Where these units are being delivered for the learner to gain NHVR accreditation or a learner is required to have the specific unit of competency for the purpose of working at an enterprise operating under a NHVR accreditation scheme, the qualification or specific unit of competency will need to be delivered by an NHVR approved RTO.

Support the availability of necessary places so students can meet work placement requirements

Implementation of the fatigue risk management units of competency is critical to the NHVR changes to the national heavy vehicle accreditation scheme. Stakeholders support the implementation of the three fatigue risk management units of competency to improve productivity and to be compliant while operating under the NHVAS.

Public/private training and assessment services

There are currently a number of training providers with the capacity to deliver units of competency, skill sets and qualifications in this area.

Training providers wanting to deliver and/or assess against the proposed fatigue risk management units of competency will need to update their scope of registration if these qualification/s are not already on their scope of registration or to add these new individual unit/s to their scope of registration.

For delivery and assessment for national heavy vehicle accreditation purposes, the training provider must be approved by the NHVR.

The assessment requirements in the proposed units of competency have been written to assist training providers in assessing the units in a variety of environments and workplace contexts.

Enterprises

By incorporating the three units of competency in the TLI Transport and Logistics Training Package Release 3.0, enterprises will have access to personnel with high level, transferable skills across the industry.

Policy environment

Training and VET policies have been addressed during the development process through consultation with STAs.

STAs, registration and accrediting bodies and training providers will need to ensure that processes implemented are valid and in line with government policy.

Supporting implementation through compliance with National Register requirements

The draft endorsed components meet the requirements for the Standards for Training Packages and the National Register (i.e. training.gov.au) and therefore present no structural barriers at the systems implementation level.

Data on VET delivery and participation

As the proposed fatigue risk management units of competency are new units of competency, there is no current NCVER participant data available.

AIS and the Transport and Logistics IRC confirm that the CVIG is available and has been quality assured.

4. Statement of evidence against the Training Package Quality Principles

The Transport and Logistics IRC confirms that evidence against the following quality principles has been obtained as part of the development of the draft endorsed components listed in this Case for Endorsement:

1. Reflect identified workforce outcomes 2. Support national (and international) portability of skills and competencies, including reflecting

licensing and regulatory requirements 3. Reflect national agreement about the core transferable skills and core job-specific skills

required for job roles as identified by industry 4. Be flexible to meet the diversity of individual and employer needs, including the capacity to

adapt to changing job roles and workplaces 5. Facilitate recognition of an individual’s skills and knowledge, and support movement between

the school, vocational education and higher education sectors 6. Support interpretation by training providers and others through the use of simple, concise

language and clear articulation of assessment requirements.

G. IMPLEMENTATION OF THE COAG INDUSTRY SKILLS COUNCIL REFORMS TO TRAINING PACKAGES

1. How the decision being sought from the AISC would support the COAG Industry and Skills Council reforms to training packages

Completion of the training package development work and extensive industry consultation with relevant stakeholders confirms that the draft endorsed components:

• do not duplicate existing unit outcomes from within the VET system • meet the NHVR requirements for national heavy vehicle fatigue management accreditation

requirements • will improve the efficiency of the training system through the creation of units that can be

used by multiple industry sectors.

2. Evidence of completion of the training package development work assigned by the AISC in the Case for Change

The Transport and Logistics IRC has provided in writing that the development work required by Activity Order AISL/TPD/2015−16/001 has been completed. This document is in the form of an email from the Transport and Logistics IRC chair. The work has also been completed to the satisfaction of the NHVR as per the requirements in the Activity Order.

3. Evidence that training package component/s are prepared for publication
