Session r: Hot Topics in Attorney-Client Privilege

In today’s businesses, corporate counsel play a variety of business and legal roles: corporate attorney, business advi-sor, corporate officer, contract negotiator, personnel director and personal adviser to executives and employees. But the attorney-client privilege applies only when corporate coun-sel’s communications provide legal advice. This session will provide insight for paralegals working in-house and with out-side counsel on how to recognize corporate counsel’s role at any given time in order to determine whether the communi-cations are privileged. It will also provide practical guidance on how to distinguish discoverable business communications from privileged legal communications. Finally, this session will address exceptions that may make otherwise privileged communications discoverable or admissible in litigation, with particular emphasis on the crime-fraud exception.

Session u: Trial Preparation and Presentation options – Digital Alternatives Perry Mason never Saw

It’s all about the power of the presentation! A hallmark of the stories is that Perry Mason (with the assistance of his devot-ed secretary Della Street and his faithful private investigator, Paul Drake), once embarked on a case, will juggle the evi-dence using unusual, even bizarre tactics, in order to mislead the police—but (except for the very earliest novels) always in an ethical fashion. A quote from The Case Of The Long-Legged Models (1958): ”It’s my contention, Della, that an attorney doesn’t have to sit back and wait until a witness gets on the stand and then test his recollection simply by asking

him questions. If facts can be shuffled in such a way that it will confuse a witness who isn’t absolutely certain of his story, and if the attorney doesn’t suppress, conceal, or distort any of the actual evidence, I claim the attorney is within his rights.”

Do not allow the opposing counsel to “juggle the evidence” or shuffle in facts to “confuse a witness.” Gain a greater rap-port with the bench and jury by succinctly presenting the theme of the case and simplify complicated concepts and ex-hibits by displaying key evidence using proven and emerging courtroom presentation technology. Courtroom presenta-tion technology is not a luxury anymore. It is believed jurors only retain 20% of what they hear, but 80% of what they see. These seasoned professionals will demonstrate and discuss the practical application of TrialDirector, CaseMap, TimeMap, Timeline Express, PowerPoint, video/transcript presentations and other emerging courtroom presentation technology. Regardless of the size of the case, the broad spectrum of presentation tools have significantly improved and can add efficiency and professionalism to your team as well as cost savings to your clients.
