Subject: William Frederick Hayden Park (2019 Green Mountain) Annexations

Petition for CASE AX-18-001

SUMMARY STATEMENT: The applicant, Kit Newland, Director of Community

Resources for the City of Lakewood is requesting the annexation of three areas of land

that are part of William Frederick Hayden Park that are currently in unincorporated

Jefferson County. The City desires to annex these land areas into the corporate limits of

the City of Lakewood. In addition, there is one parcel within one of the subject land

areas that is owned by the Green Mountain Water and Sanitation District and

surrounded by the City owned lands that are to be annexed. The Green Mountain Water

and Sanitation District has provided a letter supporting the annexation and inclusion of

their parcel into the City.

BACKGROUND INFORMATION: Consideration of whether to annex property requires many steps that are controlled by state statutes. This resolution is the first step required of City Council and initiates consideration of annexing the property. This step does not determine the final question of whether to annex the property. Passage of this resolution would:

- Formally initiate procedures necessary to consider annexation; and - Establish April 8, 2019 as the date for a public hearing before City Council and

formal consideration of the proposed annexations.

The proposed annexations are shown on the attached aerial photograph. The

annexation, if approved, will be known as the 2019 Green Mountain Annexations. Prior

to the annexation hearing before City Council, the Planning Commission will make a

recommendation regarding proposed annexation and initial zoning for the property. It is

planned that a public hearing and decision by City Council on the property’s zoning will

occur on the same night as the property is considered for annexation.

In compliance with the statute applicable to this resolution, the following finding is included

in the attached resolution;

- The Petition has been signed by persons comprising more than fifty percent of the landowners in the area and owning more than fifty percent of the area, excluding public streets and alleys.

BUDGETARY IMPACTS: N/A

STAFF RECOMMENDATIONS: Staff recommends acceptance of the annexation

petition so that these properties may be incorporated into the City limits and William

Frederick Hayden Park. The proposed annexations satisfy the State Statutes and

criteria for annexation.

ALTERNATIVES: The City Council may approve the resolution to adopt the annexation

petition or deny the resolution to adopt the annexation petition. More specifically, the

City Council may approve the resolution to adopt the annexation petition if it meets

State Statutes, which will bring the property into the City of Lakewood or deny the

resolution for the annexation petition if it is found that it does not meet the State

Statutes for requesting the annexation, which will leave the property in unincorporated

Jefferson County.

PUBLIC OUTREACH: As required by the Zoning Ordinance, a neighborhood meeting

was held in January of 2018 to discuss the initial zoning and annexation cases, prior to

the formal application submittal. At the neighborhood meeting, there were no concerns

expressed about the proposed annexations; however, there were concerns expressed

about the initial zoning of the property to R-1-6 to match the zoning for the portion of

William Frederick Hayden Park that is currently within the City of Lakewood. The

properties are currently part of William Frederick Hayden Park and are owned by the

City of Lakewood for parkland and open space purposes. If annexed and initially

zoned, the property would remain parkland and part of William Frederick Hayden Park.

NEXT STEPS: The Planning Commission hearing for the initial zoning and annexation

is scheduled for February 20, the 1st reading for City Council is scheduled for March 25th

and the public hearing for City Council is scheduled for April 8th.

2019- A RESOLUTION INITIATING ANNEXATION PROCEEDINGS FOR CERTAIN PROPERTY TO BE KNOWN AS THE KELLEY ANNEXATION NO. 2, THE WILLIAM FREDERICK HAYDEN PARK NORTHEAST ANNEXATION, AND THE WILLIAM FREDERICK HAYDEN PARK NORTHWEST ANNEXATION (DESCRIBED COLLECTIVELY AS THE 2019 GREEN MOUNTAIN ANNEXATIONS), LOCATED IN SECTIONS 7, 18, AND 19, TOWNSHIP 4 SOUTH, RANGE 69 WEST AND IN SECTION 14, TOWNSHIP 4 SOUTH, RANGE 70 WEST OF THE 6TH PRINCIPAL MERIDIAN, COUNTY OF JEFFERSON, STATE OF COLORADO.

WHEREAS, a Petition for Annexation of certain parcels of land as described in Exhibit A attached hereto, has been filed with the City Clerk of the City of Lakewood, Colorado; and

WHEREAS, the City Council finds that the City of Lakewood comprises more than fifty percent of the landowners in the area and owns more than fifty percent of the area, excluding public streets and alleys; and

WHEREAS, the Petition has been referred to the City Council of the City of Lakewood, Colorado, for a determination of substantial compliance with the requirements of Section 31-12-107 (1) of the Colorado Revised Statutes; and

WHEREAS, the City Council has received testimony and evidence, and has taken official notice of all maps, records and information and other material on file with the City of Lakewood, Colorado, regarding said Petition,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKEWOOD, that:

SECTION 1. The City Council of the City of Lakewood has received a petition for annexation and is initiating annexation proceedings for the property, to be known as the 2019 Green Mountain Annexations, situated in the County of Jefferson, State of Colorado, which are legally described in Exhibit A, attached hereto, and incorporated herein by reference, are hereby determined to be in substantial compliance with Section 31-12-107(1) of the Colorado Revised Statutes. Specifically, the City Council finds that the City of Lakewood comprises more than fifty percent of the landowners in the area and owns more than fifty percent of the area, excluding public streets and alleys.

SECTION 2. The Notice attached hereto as Exhibit B is adopted as a part of this Resolution. Said Notice establishes the date, time and place when a hearing will be held regarding the consideration of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in Section 31-12-108(2), of the Colorado Revised Statutes.

SECTION 3. The date, time and place of the public hearing on the proposed annexation ordinance shall be Monday, April 8, 2019, at 7:00 p.m. in City Council Chambers, City of Lakewood, Colorado, 480 South Allison Parkway.

SECTION 5. An annexation impact report shall be filed with the Jefferson Board of County Commissioners because the property is larger than ten (10) acres in size as provided in Section 31-12-108.5. of the Colorado Revised Statutes.

PLEASE TAKE NOTICE that the City Council of the City of Lakewood adopted a Resolution initiating annexation proceedings for the 2019 Green Mountain Annexations, said Annexations being more particularly described in said Resolution, a copy of which precedes this Notice.

That, on April 8, 2019, at the hour of 7:00 p.m., or as soon thereafter as the matter may come for hearing in the Council Chambers in the City Hall, 480 South Allison Parkway, Lakewood, Colorado, the Lakewood City Council will hold a public hearing upon the annexation and initial zoning request for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation and for the purpose of determining the appropriate zoning for the property included in the annexation. This is a summary of the neighborhood meeting. It is not inclusive of all the details, but rather a summary of the main points discussed at the meeting. Staff opened the meeting with introductions, followed by an explanation of meeting protocol, the neighborhood-meeting format and the rezoning process. Staff discussed the location of the site and zoning. Ross Williams, Parks Planner with City’s Community Resources Department introduced himself and the purpose of the meeting to annex three areas of land contiguous to William Frederick Hayden Park that are currently within unincorporated Jefferson County into the City of Lakewood. Land annexed must also be initially zoned into a City zone district. The existing zoning of William Frederick Hayden Park is Small Lot Residential (R-1-6). Therefore, the proposed zoning for the three areas of land proposed to be annexed is R-1-6 for consistency. These properties are owned by the City of Lakewood for park and open space purposes and can only be used and developed for these purposes. The three parcels are approximately 270 acres in size and are currently part of the park. This neighborhood meeting is being held as a requirement of the rezoning/initial zoning process and not required as part of the annexation process. Ross provided a brief history of the William Frederick Hayden Park, which is approximately 2,300 acres in size. The park is a conglomeration of many donations and purchases of the public open space since 1972. Since incorporation, the citizens of Lakewood have always desired to preserve the land on Green Mountain for public open space. The first parcels were donated to the City in 1972. Over the intervening years the City has received donations and made purchases of open space. In 1984, the City assumed the ownership and management of the entire park. With the assumption of management, the City began annexing all the parcels into the City limits to clarify jurisdictional issues. The last land purchase was the Kelley property. The City closed on the property in 2017 after making the thirtieth and final payment. This land along with two other smaller land areas that the City owns make up this year’s annexation request. All of the City owned land in this year’s annexations are owned for park and open space purposes, no matter what zoning is placed on them. The park and open space uses are ensured by the protections of the City Charter regarding land acquired and used for park and open space purposes, which would require a positive vote of the citizens of Lakewood to remove parkland designation at an election. Ross also addressed a rumor that the City is going to build a parking lot on the Northeast land area to be annexed. The City has no plans to install a parking lot here. Further, it is not supported by the Green Mountain Master Plan. Ross reiterated the annexation and initial zoning process including that there will be two hearing, one before Planning Commission and one before City Council.

Topics of Discussion: Questions from residents began around 6:45 p.m. Q1: Is it a public process to open a new trailhead? What about the one located off of West Ohio Avenue. A1: The trailhead off of West Ohio Avenue is not an official trailhead and not promoted by the City. Comment: There is also a social trail off of Flora. Ross: Will send the rangers out to look at unofficial trails. If there are concerns, you may contact the Community Resources main line at 303-987-7800. Q2: Is there a public hearing, do we have a say? A2: Yes, the City Council will make the final determination. This is a City process with the intent to clean up the municipal boundaries and place entire park within City boundaries. Q3: What is the initial zoning? A3: It is proposed to be Small Lot Residential (R-1-6); however only park and open spaces uses are and will be allowed. Q4: Is the City purchasing the Kelley property? A4: No, we own the property and the final purchase payment was made in September of 2017. Comment: Can you explain why R-1-6 and what park and open space purposes means? Ross: Read the park charter language over the land that will only allow the land to be used for park and open space purposes regardless of the zoning classification. The zoning classification does not determine the use of the property since there is a charter over the property. Q5: Why not a straight park district? A5: The City does not have one for park only. Q6: Is parking a use in the R-1-6 zone district? A6: Yes, parking can be located on park property, however the northeastern land area would be a bad location for parking as it is a circuitous route to get to this area and

would route visitors through a single-family neighborhood. Parking is envisioned off of main roadways with direct access. Q7: Is there a road near the northeast property? A7: Green Mountain Water and Sanitation District has an access easement in this area. Comment: Please encourage Green Mountain Water and Sanitation District to engage with public in this area. There is a new wide trail that is currently revegetating and little notice of work. Q8: Will annexing the property allow more enforcement of the park? A8: Currently the City maintains the park and will continue to do so. Q9: Will the services change? A9: No, maintenance and services will still be provided by the City and West Metro Fire Protection District will still provide emergency fire services. Q10: Where is Foothills Park? A10: Ross showed a larger map of the northeast parcel and explained that it is made up of remnants of the old Alameda right-of-way that was originally platted as a straight street, which differs from today’s alignment. Q11: If park projects are proposed does the community get to participate? A11: Yes, there is a notice process to neighbors and neighboring municipalities. At this time no development is proposed. Q12: Concerns were raised about mountain bikers and trail users in the park after dark and park hours. Some people are sleeping at the trailheads. Who should we call? A12: After hours call the police non-emergency line. Q13: What is an example of a capital improvement? A13: Picnic shelter, trails, play equipment. Q14: How do you distinguish a City trail from a social trail? A14: There are only 4 City trailheads on Green Mountain. The rest are social trails. Q15: Why is there not a park zone district? A15: Zone districts require more than one use.

Q17: What is the current zoning on the northeast land area? A17: This is currently zoned PD in unincorporated Jefferson County. Q18: Are there plans for a trail connection to the parking for Red Rocks College? A18: None. Q19: If surveying was done in 2017, then why is there still a stake behind my house?
